Crashes, No Sound, or Screen Glitches?

For sensitive work, use an enterprise service only after verifying retention, training use, third-party access, deletion, identity controls, security monitoring and data location. Remove unnecessary details or replace them with consistent placeholders, and never assume that an “enterprise” label, an opt-out switch or anonymization guarantees confidentiality.
The practical steps below apply broadly. The Singapore Ministry of Law’s Guide for Using Generative AI in the Legal Sector, published March 6, 2026, is written for legal practices and in-house legal teams, so legal examples should be adapted to your jurisdiction, client contracts and professional duties.

Why generative AI changes the confidentiality risk
A generative-AI prompt is data sent to a service for processing. Depending on the product and configuration, the prompt, uploaded files, generated answer and system logs may be retained, reviewed, used to improve a model, transferred across borders or exposed to an account with excessive privileges. A response can also reveal information through inference even when the original text was not copied verbatim.

You must know what is collected, why it is processed, where it is stored, who can access it, how long it remains, and how it is deleted. The Federal Trade Commission (FTC) says providers must honor privacy and confidentiality promises, including commitments about model training. Its business guidance also recommends collecting only data needed for a purpose, protecting it and disposing of it securely.

- POWERFUL SECURITY KEY: The Security Key C NFC is the essential physical passkey for protecting your digital life from phishing attacks. It ensures only you can access your accounts.
- WORKS WITH 1000+ ACCOUNTS: Compatible with Google, Microsoft, and Apple. A single Security Key C NFC secures 100 of your favorite accounts, including email, password managers, and more.
- FAST & CONVENIENT LOGIN: Plug in your Security Key C NFC via USB-C and tap it, or tap it against your phone (NFC) to authenticate. No batteries, no internet connection, and no extra fees required.

- BUILT TO LAST: Made from tough, waterproof, and crush-resistant materials. Manufactured in Sweden and programmed in the USA with the highest security standards.
Risk is contextual. The Information Commissioner’s Office (ICO) says security measures should match the risks of the particular processing and that organizations should use the minimum personal data needed. NIST’s SP 800-122 guidance similarly treats protection of personally identifiable information (PII) as a context-based decision rather than a single technology choice.
1. Classify the information and the task before opening an AI tool
Start with the material you intend to submit, not with the product’s feature list. Assign the strictest applicable classification to the content and identify the purpose of the requested output.
Classify the content
- Personal data: names, identification numbers, contact details, account information, unique dates or combinations of facts that identify a person.
- Special-category or highly sensitive data: health, biometric, financial, employment, family or location information, where applicable law gives it additional protection.
- Confidential business information: trade secrets, pricing, source code, strategy, credentials, security architecture, unreleased transactions or supplier terms.
- Privileged or professionally restricted material: legal advice, litigation strategy, regulated records or information covered by a professional secrecy duty.
- Contract-restricted information: data that a client agreement, nondisclosure agreement or cross-border-transfer clause limits you from sending to a third party.
Test whether the task needs the data
Write the desired output in one sentence, then list the smallest facts required to produce it. A request to identify unclear wording may need only a paragraph; it rarely needs an entire client file. A request to calculate a total may need amounts but not names, addresses or account numbers. If the answer can be produced from a fictional scenario, use one.

NIST’s PII guidance (SP 800-122, published April 6, 2010 and updated February 19, 2017) remains useful for this first step even though it predates generative AI. Its central idea is to tailor safeguards to the potential harm from inappropriate access, use or disclosure.
2. Approve both the service and the use case
Do not let employees choose an AI service ad hoc for confidential work. Create an approval record for each tool and category of use. A service that is acceptable for public marketing copy may be prohibited for client records.
| Option | When it may fit | Questions that must be answered first |
|---|---|---|
| Public or free-to-use tool | Public information, low-risk brainstorming or a hypothetical task with no confidential details. | Can retention and model-training use be disabled? Are prompts, files and outputs logged or reviewed? Can settings be reset by an update? Is temporary retention possible even after an opt-out? |
| Enterprise service | Confidential client or business work when the contract and controls meet your requirements. | What do the binding terms say about training, secondary use, third-party sharing, deletion, breach notice, confidentiality, subprocessors, access and data location? Are SSO, MFA, audit logs, API protections and administrative restrictions available? |
| Internally developed or isolated system | Organizations with the expertise and budget to control deployment, data flows and operations. | How was the model developed? Are input data used for training? Where are storage and processing located? Who patches, monitors and investigates the system? What happens when an engagement ends? |
For confidential client or business data, the Singapore Ministry of Law guide advises preferring an enterprise-level generative-AI tool that provides the requisite assurances for confidentiality and security. “Enterprise” is a starting category, not proof. Read the actual service agreement, data-processing agreement and product documentation that govern your account.

What to record in an approval
- Approved tool, edition, account owner and permitted users.
- Permitted data classifications and prohibited examples.
- Approved tasks, such as summarizing a de-identified excerpt, and forbidden tasks, such as uploading a complete client file.
- Required settings, identity controls, review steps and retention period.
- Vendor owner, review date, change-notification process and incident contact.
3. Minimize and transform every prompt
Data minimization means retaining and sending only what is necessary for the stated purpose. Redaction alone is not enough if the remaining context identifies the client.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteRemove unnecessary identifiers
- Delete names, account and policy numbers, addresses, phone numbers and email addresses.
- Generalize unique dates, locations, job titles, transaction values and rare events when precision is not required.
- Remove attachments, metadata, tracked changes, comments and hidden spreadsheet tabs.
- Strip credentials, API keys, tokens, private keys and internal network details completely; do not ask a model to handle secrets.
Use consistent placeholders
Replace identifiers with stable labels such as [Client A], [Supplier B], [Amount X] and [Date 1]. Keep the mapping in a separate, access-controlled system rather than in the AI conversation. Consistency lets the model follow relationships without receiving the real identity.
Prefer a hypothetical or isolated excerpt
Ask for a method using a fictional scenario where possible. If real text is necessary, submit the smallest clause, paragraph or data slice that answers the question instead of the entire document. After replacement, ask whether the combination of facts could still identify a person or organization. The Singapore guide warns that context can make apparently anonymized content identifiable.
Inspect the output too
Generated text may reproduce a name, infer a diagnosis, invent a detail or combine clues into a sensitive conclusion. Review the answer before saving or sending it, and remove confidential content from the output if the recipient does not need it. Do not paste the output into another unapproved service.
4. Read the provider’s binding data terms
Terms of service and a privacy notice are not interchangeable with a marketing statement. Obtain the contract, data-processing terms, security addendum and subprocessor list that apply to your account and region.
Retention, deletion and secondary use
- Determine whether prompts, uploaded files, outputs, feedback and system-generated telemetry are retained, and for how long.
- Check whether any of those categories are used to train, fine-tune, evaluate or otherwise improve a model.
- Confirm whether deletion is available on request, automatically after a period, or at the end of an engagement, and whether backups follow a different schedule.
- Find out whether human reviewers, support personnel or subprocessors can access content.
Confidentiality and legal commitments
Look for an express confidentiality obligation, permitted-use limitation, data-processing agreement and breach-notification process. Verify that the terms do not allow broad use of client content for advertising, profiling or unrelated product development. The FTC’s January 2024 guidance, AI Companies: Uphold Your Privacy and Confidentiality Commitments, emphasizes that providers must keep promises they make about privacy and model training.

Location and transfers
Identify the countries where content is processed, stored, supported or backed up. Compare those locations with client instructions, sector rules and cross-border-transfer requirements. A service may offer regional storage while support access or telemetry remains elsewhere; ask specifically about each data flow.
5. Verify technical and operational controls
Request security documentation and test the controls in your own tenant. A certificate or feature is evidence to evaluate, not a guarantee that confidential data is safe.
| Control area | What to verify | Why it matters |
|---|---|---|
| Identity and access | SSO, MFA, role-based permissions, least privilege, separation of administrators, joiner/mover/leaver process and emergency access logging. | Limits who can submit, retrieve or administer client content. |
| Encryption and isolation | Encryption in transit and at rest, tenant isolation, key-management responsibilities and API authentication. | Reduces exposure during transmission, storage and automated integration. |
| Logging and audit | Records of sign-ins, prompts, file access, exports, configuration changes and administrator actions; retention and export options. | Supports investigations, client audits and detection of misuse. |
| Monitoring and response | Abuse monitoring, alerting, incident-response procedures, notification timelines, evidence preservation and recovery testing. | Determines how quickly you can contain and report a suspected breach. |
| Deletion and lifecycle | Tenant-level deletion, engagement-end deletion, backup handling, legal holds and confirmation of completion. | Prevents old matters from remaining available indefinitely. |
| Independent assurance | Current SOC 2 Type II or ISO/IEC 27001 reports, scope, exceptions and the period covered. | Provides independent evidence to examine, while not replacing your own risk assessment. |
Also review model-isolation controls, API rate and origin restrictions, data-loss-prevention integration, vulnerability management and subcontractor oversight. Ask the provider to explain how training data sources and methods are governed. Keep the answers with your vendor-risk record so a later product change does not erase the rationale for approval.
Recommended Free Tools
6. Configure free tools cautiously
If a free service is used for a low-risk task, disable data retention and model-training use wherever the product permits. The Singapore guide specifically advises verifying those settings regularly because updates may reset them. Even with settings enabled, temporary retention may occur, so do not enter confidential or commercially sensitive information into a free tool.
If a necessary task cannot be completed without real context, use generic placeholders, a hypothetical scenario or an isolated clause. Treat the result as potentially identifiable and apply the same review and deletion rules as the source material. A setting that says “not used for training” does not answer questions about support access, logging, legal disclosure, storage location or deletion.

A short, enforceable policy is more useful than a general warning to “be careful.” It should name approved tools, data classes, use cases and prohibited actions.

Minimum policy contents
- Definitions of public, internal, confidential, personal, privileged and restricted data.
- Approved services, account types, required configurations and prohibited consumer accounts.
- Prompt-minimization rules, placeholder conventions and a ban on credentials and secrets.
- Human review requirements for factual accuracy, privacy, privilege, copyright and client-facing output.
- Vendor-assessment ownership, contract review, change monitoring and periodic access review.
- Retention, export and deletion procedures for conversations, files and generated outputs.
- A clear route for reporting accidental disclosure, suspicious output, misuse or a provider incident.
Train staff with realistic examples: a public press release may be acceptable, while a client complaint containing a rare medical fact is not. Include contractors and temporary staff, and refresh training when tools, terms or professional rules change. The Singapore guide’s sample governance approach includes staff training, quarterly issue review and immediate reporting of misuse, errors or breaches.

Approval is not permanent. Recheck configurations after product updates, changes to terms, new integrations, model changes, acquisitions or a move to a different region. Review user and administrator access at regular intervals, remove dormant accounts and confirm that logs still capture the events you need.
Keep an inventory of tools and use cases, a record of vendor answers, data-flow diagrams and deletion confirmations. Reassess whether a task still needs identifiable data. A workflow that began with de-identified excerpts can gradually expand into full-file uploads unless someone measures and corrects it.
9. Prepare for an incident before one occurs
Define what counts as an incident: an accidental prompt containing client data, an unexpected model response revealing information, a lost device with an active session, suspicious administrator activity or a provider notification. The response plan should identify the person who can disable accounts and integrations, preserve logs, contact the provider, notify the client and assess legal or regulatory reporting duties.
- Contain: stop further submissions, revoke tokens, disable the affected account or integration and preserve the conversation and audit evidence.
- Assess: identify the data, people, jurisdictions, recipients, retention status and whether the provider or a human reviewer accessed it.
- Notify: follow the contract, client instructions, professional obligations and applicable breach laws; do not wait for certainty if a required notice deadline is running.
- Remediate: delete content where permitted, rotate exposed credentials, correct access rights and address the provider or configuration fault.
- Learn: document the cause, update the approved-use list and retrain affected users.
Do not promise that deletion erases every copy. Ask the provider what remains in backups, logs, abuse-monitoring systems and legal holds, and obtain the applicable confirmation.
10. Adapt safeguards to your jurisdiction and profession
Legal, health, financial, public-sector and other regulated work may impose duties that a general AI policy does not address. The Singapore Ministry of Law guide is practical for Singapore legal practices and in-house teams, but it is not universal legal advice. The FTC material is U.S. regulator guidance. The ICO’s AI security and data-minimization guidance concerns UK data-protection law and is currently under review following the Data (Use and Access) Act. NIST SP 800-122 is foundational PII guidance rather than generative-AI-specific law.
Use these sources to structure questions, then confirm the rules that govern your organization, the client agreement and the location of processing. If a client prohibits third-party AI processing, that instruction controls even when a service advertises strong security.
A practical go/no-go checklist
- Have you classified the data and confirmed that the task needs each submitted detail?
- Is the exact service, account type and use case approved?
- Do binding terms address retention, training, secondary use, third-party access, deletion, confidentiality and breach notice?
- Do processing and storage locations satisfy the client and applicable law?
- Are SSO, MFA, least privilege, encryption, logging, monitoring and API protections configured and tested?
- Have you removed identifiers, secrets and unnecessary context, and checked for re-identification risk?
- Is a qualified person reviewing the output before it is saved or sent?
- Are staff trained, access reviewed and settings rechecked after updates?
- Can you contain, investigate, notify and remediate an incident using the available logs and provider contacts?
If any answer is no or unknown, do not submit confidential client data. Use a hypothetical or de-identified excerpt while the missing control is resolved, or choose a workflow that keeps the material outside the generative-AI service.
