Keep borrower information out of any AI system that has not been approved for that exact use. A defensible mortgage-AI program maps every data flow, limits each tool to the minimum necessary fields, enforces identity and access controls, protects information in transit and at rest, binds providers by contract, preserves accurate adverse-action explanations, validates models, and deletes records on a defined schedule. The legal duties depend on your institution’s regulator, state, product, data, and use case, so this guide is an operational framework—not legal advice for every lender.
Start with a lifecycle control, not a model choice
Borrower data can be exposed at many points: application intake, document extraction, a prompt sent to an AI service, temporary files, model logs, human review, a credit decision, a vendor’s support system, backups, and eventual disposal. Treat those points as one controlled lifecycle. A model that is secure in production can still create unacceptable risk if an employee copies a pay stub into a personal account or if prompts remain in a vendor’s training dataset.

Before approving an AI use case, document the business purpose, the decision or workflow it supports, the data required, the people and systems that can access it, the providers and subprocessors involved, the retention period, and the evidence you will keep for examination. The Federal Trade Commission (FTC) Safeguards Rule guidance calls for an inventory of information and systems, a written risk assessment, evaluation of applications that store, access, or transmit customer information, periodic access-control review, and oversight of service providers. Those obligations apply to institutions within the FTC’s jurisdiction; banks, credit unions, and other firms may have a different primary regulator.

- What enters the system: identity data, income, assets, debts, credit information, property details, tax records, account numbers, voice or image files, and free-text notes.
- Whether each field is identifiable, financial, credit-related, property-related, or otherwise sensitive.
- Which employees, applications, model endpoints, storage locations, logs, backups, and subprocessors can see the data.
- Whether prompts, uploaded documents, intermediate files, outputs, and telemetry are retained or used to improve a provider’s service.
- Where the information is stored or processed, including region and legal entity where that matters to your obligations.
- When every copy is deleted, including cached files and vendor backups, subject to legal holds and records requirements.
Use the least data that can accomplish the task
Define the minimum fields before building a prompt or integration. A document-classification task may need a page image and document type, but not a complete Social Security number. A quality-assurance test may need synthetic or carefully de-identified records rather than live files. Removing a name alone does not make a mortgage document anonymous: addresses, dates, loan amounts, employer details, account numbers, and unusual property facts can permit re-identification. Document the remaining re-identification risk and the controls around it.
Separate environments and purposes
Keep production borrower data separate from experimentation, employee demonstrations, and personal accounts. Create purpose-specific data classes and handling rules—for example, “approved for internal summarization,” “prohibited from external processing,” and “restricted to credit-decision systems.” Block uploads of restricted classes with data-loss-prevention rules where feasible, and make the approved purpose visible in the tool’s interface or workflow.
Can I put borrower information into ChatGPT or another public AI tool?
Do not enter borrower information into a public or personal AI account unless your institution has explicitly approved that service, configuration, purpose, and data class. The practical default is to use no borrower-identifying information in an unapproved consumer tool. A provider’s general statement that it “protects privacy” is not an approval, and a browser-based connection may still create prompts, logs, backups, or support copies outside your control.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
An approved enterprise arrangement still requires a documented assessment. Confirm the account is controlled by the institution, that single sign-on and multifactor authentication are enforced, that administrators can restrict sharing and exports, and that retention and training/reuse settings match the use case. Test what happens when a user deletes a conversation, when an administrator disables an account, and when the provider changes its model or subprocessors. If the task can be completed with synthetic, tokenized, or redacted data, use that option instead.
Approve tools and restrict access
Maintain an approved-tool register
List each AI application, model endpoint, integration, and permitted purpose. The register should identify the owner, data classes allowed, environment, provider and subprocessors, retention setting, model-training or reuse setting, logging behavior, review date, and escalation contact. A tool approved for marketing copy is not automatically approved for underwriting support.

Apply least privilege
- Use role-based access so processors, underwriters, quality reviewers, developers, and administrators see only what their duties require.
- Require strong authentication and multifactor authentication for people accessing customer information. The FTC Safeguards Rule includes a multifactor requirement for covered institutions, subject to the rule’s stated exception.
- Keep prompts, outputs, connectors, and administrative functions under separate permissions where possible.
- Review access periodically and revoke it when an employee, contractor, or provider no longer needs it.
- Log who accessed a borrower file, what was submitted, which model version responded, and whether an output was exported into a loan record.
Do not let a shared service account hide individual activity. If an integration requires a service identity, bind it to a narrowly scoped role, rotate its credentials, and preserve user-level attribution in the surrounding application.
Protect data in transit and at rest
Use appropriate encryption for stored and transmitted customer information, protect key material separately, restrict administrative access to keys, and test that controls actually apply to uploaded files, logs, caches, backups, and exports. The FTC guidance describes encryption in transit and at rest; an alternative control is appropriate only where encryption is not feasible and the qualified individual approves it.

Choose between a lender-managed model and a third-party service
Neither architecture is automatically safer. Compare the complete control set, not just model accuracy or a security badge.
| Control question | Lender-managed model | Third-party AI service |
|---|---|---|
| Data residency and access | Can be designed around the lender’s network, identity system, and chosen region; the lender bears configuration and operations responsibility. | Depends on provider regions, support access, subprocessors, and cross-border processing terms; obtain the actual data-flow description. |
| Retention and deletion | The lender can set storage and deletion logic but must implement it across logs, backups, and derived data. | Require documented retention, deletion evidence, backup treatment, and controls for prompts and outputs. |
| Training or reuse | Usually controlled by the lender’s design, subject to internal governance. | Contract and configure whether borrower content is used for training, service improvement, or human review. |
| Identity and access | Can integrate directly with enterprise roles, multifactor authentication, and security monitoring. | Verify single sign-on, role administration, API-key controls, tenant isolation, and administrator access. |
| Explainability | The lender controls feature records, versioning, and explanation logic but must validate them. | Obtain documentation and usable reason support; a black-box interface does not remove the lender’s notice duties. |
| Validation and change management | Requires in-house testing, release controls, and skilled staff. | Require validation evidence, change notices, version pinning or migration controls, and a right to reassess material changes. |
| Audit logs | Can be integrated with existing security information and event-management systems. | Confirm log fields, access, export capability, retention, time synchronization, and provider support during an examination. |
| Incident response | The lender owns containment, investigation, communications, and recovery. | Contract for rapid notice, cooperation, evidence preservation, forensic support, and clear responsibility for customer and regulator communications. |
| Subprocessors and remedies | Fewer external parties may simplify oversight, but infrastructure providers still need review. | Obtain a current subprocessor list, change-notice process, audit rights, and meaningful contractual remedies. |
For a covered automated valuation model (AVM), add estimate confidence, data-integrity and manipulation controls, conflict controls, random sample testing, review procedures, and nondiscrimination testing to the comparison.

Perform vendor due diligence before sending a file
Ask the provider to describe the service in operational terms, not marketing language. Your assessment should cover:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- Exactly what data the service receives, generates, stores, derives, and exposes to support staff.
- Whether prompts, documents, outputs, and metadata are retained, for how long, and in which locations.
- Whether borrower content is used to train or improve a shared model, and whether that behavior can be disabled contractually and technically.
- Identity controls, tenant separation, encryption, key management, vulnerability management, penetration testing, logging, and monitoring.
- All subprocessors, their locations, their functions, and how the provider gives notice of changes.
- Incident-detection and notification procedures, evidence preservation, cooperation with investigations, and support for legally required notices.
- Deletion at termination, treatment of backups and derived data, and the evidence you will receive.
- Model versioning, release testing, performance monitoring, known limitations, and the provider’s change-notification process.
- Availability of audit reports or other validation evidence and whether the lender may conduct a proportionate review.
Use a written risk assessment to explain why the provider is suitable for the stated purpose. Reassess it periodically and whenever the provider changes its model, processing location, subprocessors, retention terms, or security architecture. FTC guidance calls for suitable provider selection, contractual security expectations, monitoring, and periodic reassessment; a vendor’s representations do not transfer the lender’s accountability.
Set enforceable contract boundaries
The agreement should state the permitted purposes and data classes, prohibit unrelated reuse, define retention and deletion, address training or model improvement, identify subprocessors, require security controls, and set incident-notice and cooperation duties. Include a process for material changes, assistance with access or deletion requests, support for legal holds, and access to records needed for regulatory examinations and model-risk reviews. Coordinate the contract with privacy notices and disclosures required for the specific information and workflow.
Do not accept a clause that allows the provider to change processing purposes silently or to retain data indefinitely for “service improvement.” If the provider cannot explain where prompts and outputs go, the use case is not ready for borrower data.
Keep credit decisions explainable
AI does not remove obligations under the Equal Credit Opportunity Act (ECOA) and Regulation B. CFPB Circular 2022-03 states that creditors must provide accurate and specific principal reasons for adverse action, regardless of the technology used. As the circular puts it: “A creditor cannot justify noncompliance with ECOA and Regulation B’s requirements based on the mere fact that the technology it employs to evaluate applications is too complicated or opaque to understand.”

Capture the decision record
- Inputs actually used, including the source and timestamp for material values.
- Model, prompt, rules, and configuration versions.
- Any human override, review, or escalation and the person responsible.
- The factors that actually drove the outcome and the method used to translate them into notice reasons.
- Validation results showing that the explanation method is faithful to the decision, not merely a plausible nearest-match reason.
If the system cannot produce accurate, specific principal reasons, do not use it for a credit decision until the limitation is resolved. Where a credit score triggers disclosure duties, review the Fair Credit Reporting Act requirements as well. A generic statement such as “the algorithm found insufficient information” is not a substitute for the actual principal reasons required by applicable law.

Before deployment
Assess data quality, representativeness, security, performance, error patterns, explainability, and fair-lending risk. Define acceptance thresholds, prohibited uses, human-review points, rollback criteria, and an accountable owner. Test adversarial inputs and malformed documents, not only clean historical samples.
After deployment
Monitor drift, missingness, override rates, disparate outcomes, error concentrations, latency, and anomalous prompts or outputs. Escalate material changes in performance or data. Revalidate after a model update, a prompt or feature change, a new data source, a major portfolio shift, or a provider migration. Preserve the evidence used to approve each version.
Specific controls for covered AVMs
The AVM rule applies to covered automated valuation models used in certain mortgage credit decisions or securitization determinations; it is not a general rule for every AI system. The CFPB compliance guide states that compliance began October 1, 2025. Covered models require quality-control policies and systems designed to support confidence in estimates, protect against data manipulation, avoid conflicts of interest, conduct random sample testing and reviews, and comply with nondiscrimination laws.
A lender may work with an AVM provider, but it cannot simply rely on the provider’s statement that testing was adequate. Evaluate whether validation is sufficient for your institution’s size, complexity, risk profile, and use. Keep the testing scope, results, exceptions, remediation, and approval decision in your model-governance record.

Use NIST as a framework, not a legal shortcut
NIST AI Risk Management Framework (AI RMF) 1.0 is voluntary. NIST’s current framework page says the framework is being revised and identifies its Generative AI Profile, released July 26, 2024. Use those materials to organize governance, measurement, and trustworthiness work if useful, but do not describe NIST AI RMF as a mortgage-specific mandate, certification, or replacement for binding law.
Define retention, deletion, and incident response
Make retention specific to each data object
Set separate schedules for source documents, prompts, model inputs, outputs, audit logs, security telemetry, and backups. Reconcile the schedules with legal holds, recordkeeping requirements, servicing or investor obligations, and legitimate business needs. When retention ends, securely dispose of the information and document completion. Include temporary workspaces and exported spreadsheets; they are common places for “deleted” borrower data to survive.
Prepare a written response plan
Assign decision authority and define containment, evidence preservation, investigation, customer and regulator communications, remediation, and post-incident review. Rehearse scenarios such as a prompt sent to the wrong tenant, a compromised API key, a provider’s subprocessor breach, and a model output that exposes one borrower’s data to another user.

| GLBA and Regulation P | Privacy notices and limits can apply to disclosure, redisclosure, and reuse of nonpublic personal information shared with nonaffiliated third parties. | Coverage and exceptions depend on lender type, arrangement, information, and state law. CFPB materials list nonbank mortgage lenders, mortgage brokers, and loan servicers among possible covered institutions. |
| FTC Safeguards Rule | For institutions within FTC jurisdiction, requires a written information-security program with risk assessment, access controls, encryption or approved alternatives, multifactor authentication, disposal, monitoring, training, provider oversight, and incident response. | It does not govern every bank, credit union, or mortgage firm; another regulator may have enforcement authority under GLBA section 505. |
| ECOA and Regulation B | Require accurate and specific principal reasons for adverse action, even when a complex model or vendor is involved. | Review current statutory and regulatory text and later interpretations for the particular product and decision. |
| FCRA | Credit-score-based adverse actions can trigger additional disclosures. | Coordinate the notice analysis with the data source and decision workflow. |
| AVM final rule | Requires specified quality-control features for covered AVMs used in covered mortgage credit and securitization decisions; compliance began October 1, 2025 according to the CFPB guide. | It is not a universal privacy or AI-governance rule. |
| NIST AI RMF | Offers a voluntary structure for identifying, measuring, and managing AI risks. | It is not law or a certification, and NIST says version 1.0 is being revised. |
Have privacy, information-security, compliance, model-risk, records, and business owners review the same use-case record. State privacy, breach-notification, biometric, records, and fair-lending requirements may add controls beyond the federal baseline.
A practical implementation sequence
- Inventory. List every proposed AI use, data element, recipient, storage location, output, and deletion point.
- Classify and minimize. Mark restricted fields, remove unnecessary values, and substitute synthetic or de-identified data for development where feasible.
- Approve. Add only tools with an identified owner, purpose, access model, retention setting, provider assessment, and risk acceptance.
- Control access. Integrate enterprise identity, multifactor authentication, least privilege, logging, export restrictions, and periodic access reviews.
- Contract. Set purpose, reuse, training, retention, deletion, subprocessors, security, incident, audit, and change-notice terms before production data is shared.
- Validate. Test security, quality, performance, fairness, drift, and explanation accuracy; document approval and rollback criteria.
- Operate. Monitor access, outputs, model performance, provider changes, incidents, and deletion jobs; escalate exceptions promptly.
- Reassess. Review the use case on a schedule and after material changes in data, model, provider, law, product, or portfolio.
Common failure modes and corrective actions
- “The vendor is compliant, so our review is finished.” Corrective action: assess the service against your own data, risk profile, notice duties, and regulator; retain the evidence.
- “We removed names, so the file is anonymous.” Corrective action: evaluate indirect identifiers and use synthetic or more thoroughly de-identified data.
- “The model is accurate, so explanations are automatic.” Corrective action: test whether the stated reasons are the actual principal drivers and preserve the decision record.
- “The AI tool is only used for drafting.” Corrective action: classify the information in prompts and outputs; drafting can still expose nonpublic personal information or create an uncontrolled record.
- “Deletion means the chat disappeared from the screen.” Corrective action: verify retention in logs, exports, backups, support systems, and derived datasets.
- “NIST AI RMF makes us compliant.” Corrective action: use it as a voluntary organizing framework while separately meeting applicable laws, regulations, contracts, and supervisory expectations.
- “The AVM rule covers every AI feature.” Corrective action: determine whether the system is a covered AVM used for a covered mortgage credit or securitization purpose before applying or rejecting that rule.
What good evidence looks like
An examiner, auditor, or incident investigator should be able to follow one borrower’s information through the system without relying on a vendor’s assurances. Keep the approved use-case record, data-flow diagram, classification and minimization decision, risk assessment, access review, provider due diligence, contract, model and prompt versions, validation results, monitoring alerts, human-review record, adverse-action reason mapping, retention schedule, deletion evidence, and incident exercises together. Link each control to an owner and review date. Evidence that cannot be produced is difficult to defend, even when a control exists in practice.
Final decision test
Before an AI workflow handles borrower data or influences a mortgage decision, ask: Is the purpose approved? Is every field necessary? Can we identify every recipient and copy? Are access, encryption, logging, retention, and deletion enforced? Has the provider accepted written boundaries? Can we explain a decision with accurate principal reasons? Have we validated security, performance, fairness, and change controls? Do we know which regulator and reporting rules apply? If any answer is no, keep the workflow in a synthetic-data sandbox or stop it until the gap has an accountable owner and documented resolution.
