If a Slack conversation may matter in a dispute, act quickly with your lawyer and the workspace owner or administrator. Map the people, channels, direct messages, dates and files that may be relevant; check the workspace retention and export settings; then place an appropriately scoped Slack legal hold when the Enterprise feature is available, or use an authorized export and discovery process. A hold preserves data inside Slack, but it does not by itself give you the messages or file contents. Export access, private-channel coverage, deleted content and connected-workspace data all depend on the plan, settings and collection route.
This is practical information, not legal advice. Counsel must determine what the law requires, whose data is in scope, how long it must be retained and what format is appropriate for review or production.

Preservation is different from export
Preservation prevents potentially relevant Slack data from disappearing or changing under ordinary retention rules. Collection or export creates a copy that counsel, an eDiscovery team or an authorized investigator can review. Treat them as separate workstreams:

- Collection: an authorized export, Discovery API workflow or other approved process retrieves the preserved data for examination, processing or production.
Slack’s legal-hold documentation says held content can be accessed through JSON export or the Discovery API, so placing a hold is not the same as downloading its contents. A basic workspace export may also omit private channels, direct messages or file content, depending on the plan and approval. Confirm scope before relying on an export.

What to do in the first 24 hours
Bring counsel and the workspace administrator together
Notify the organization’s lawyer and the Slack workspace owner or administrator as soon as litigation is reasonably anticipated or a dispute is active. The administrator controls plan information, retention settings and export permissions; counsel determines the legal scope. If you are an individual participant rather than the workspace owner, do not assume you can preserve another person’s messages yourself. Ask the owner to coordinate with counsel.
Define the preservation scope
Prepare a short scope memo for counsel and the administrator. Identify:
- Custodians: employees, contractors, former personnel and outside participants whose Slack activity may be relevant.
- Conversations: channel names, private channels, direct messages, group direct messages and any connected workspaces.
- Time range: the earliest potentially relevant date through the end of the dispute period, with reasons for any narrower range.
- Content types: messages, uploaded files, links to external files, edits, deletions and related metadata.
- Known account or channel changes: renamed channels, deactivated users, deleted channels and migrations between workspaces.
Have counsel decide whether the scope should be narrower or broader. Avoid searching through unrelated employee or personal information merely because an administrator can access it.

Do not delete channels, change retention rules, purge accounts, move files or ask participants to “clean up” conversations after a dispute is foreseeable. Such actions can destroy relevant information or expose unrelated data. Preserve the existing configuration while the administrator documents what it is and counsel decides what must change.

Check retention and export eligibility before collecting
Slack’s plan and settings determine what an owner or administrator can export. Confirm the current plan, the organization’s retention configuration, the treatment of edited and deleted messages, and whether an application or Slack approval is required.
| Workspace capability | What Slack’s published guidance says | Practical implication |
|---|---|---|
| All plans | Owners and administrators can export public-channel data. | A public-channel export is not evidence that private channels, direct messages or all files are included. |
| Business+ | Workspace owners can apply for exports covering public and private channels. | Approval and the organization’s permissions affect whether the broader export is available. |
| Enterprise | Organization owners can apply for broader self-service exports; eligible customers may use Discovery APIs. | Confirm eligibility, approval and the specific data types returned before planning collection. |
| Enterprise legal holds | The Legal Holds feature is administered by users with the Legal Holds Admin role. | A qualifying Enterprise workspace can preserve selected custodians and conversations, subject to documented exclusions. |
These access descriptions come from Slack’s Data Management guidance. Availability can vary with plan, law, approval status and organizational permissions, so the owner should verify the live settings rather than rely on an old screenshot or a former administrator’s account.
Review retention and deletion settings
Slack documents different defaults for free and paid plans and allows workspace owners to configure how long messages and files are retained, including whether edits and deletions are preserved. A message deleted under a customer setting that does not retain deleted data may be removed immediately. Record the actual configuration and the date it was checked; do not substitute Slack’s default behavior for the workspace’s current policy. See Slack’s Privacy FAQs for the provider’s description of retention controls.

Retention is not a substitute for a litigation hold. A long routine retention period may still end before the dispute is resolved, while a short period can remove data before counsel identifies it. If relevant data may already have expired, tell counsel exactly what the administrator found and when.

Place a Slack legal hold when the Enterprise feature fits
Slack describes Legal Holds as an Enterprise feature. A user assigned the Legal Holds Admin role can create a hold by selecting conversations, an optional date range and custodians. Slack states that messages and files sent by all members in a selected conversation are saved regardless of retention settings or whether members edit or delete content. The published documentation lists a limit of 1,000 custodians per legal hold: Create and manage legal holds.
Suggested setup sequence
- Verify authority. Ask the organization owner to confirm the Enterprise plan and assign or identify a Legal Holds Admin. Record who authorized the action and the date.
- List custodians. Use counsel’s scope memo to identify current and former members. Check spelling, account identifiers and workspace membership so the hold does not silently omit a custodian.
- Select conversations. Add the channels and direct-message or group-message conversations that counsel identified. Include connected-workspace conversations only if the feature and legal scope actually cover them; Slack documents an important exclusion below.
- Set the date range. Use the narrowest defensible range that captures the dispute, and document the reason for the start and end dates. If the end date is open, follow counsel’s instructions for an ongoing hold.
- Review the confirmation. Check every custodian, conversation and date before saving. Keep a contemporaneous record of the hold’s identifier, selected scope and administrator.
- Plan access separately. Tell the collection team that the hold preserves data but does not display it. Arrange the authorized JSON export or Discovery API process after the hold is confirmed.
What the hold preserves
Within the selected scope, Slack says messages and files sent by all members in a conversation are saved despite retention settings and later edits or deletions. That wording is broader than “messages sent by the listed custodians”: a selected conversation can preserve content sent by other members as well. Counsel should therefore review whether the conversation selection is proportionate to the dispute.
What the hold does not preserve
| Documented boundary | Why it matters |
|---|---|
| Slack Connect conversations are excluded. | Messages exchanged with an external organization through Slack Connect require a separate preservation and collection plan with the relevant workspace or custodian. |
| Slack Sales Home notifications are excluded. | Do not assume those notifications are captured by a conversation hold. |
| Emoji reactions are excluded. | A hold covering messages does not establish that reaction data will be available. |
| Snippet version history is excluded. | Earlier versions of snippets are not covered merely because the current snippet is in a held conversation. |
| If a covered channel is deleted, its message and file data will not be saved by the hold. | Deletion of the channel itself can defeat the hold; instruct administrators not to delete covered channels. |
These limits mean a legal hold is not an all-purpose Slack archive. Note every exclusion that could affect the dispute and ask counsel whether another source, custodian or workspace must be preserved.
Collect held data through an authorized route
Use JSON export when it matches the scope
Slack identifies JSON export as an access route for held data. Before exporting, confirm which conversations, custodians, dates, files and metadata the export contains, how links to files are resolved, and whether the output is a one-time snapshot or can be repeated. Preserve the original export artifacts without editing them, and have the eDiscovery lead decide how copies are processed for review.

Use the Discovery API for an Enterprise workflow
Eligible Enterprise customers may use Slack’s Discovery APIs to access held data. Slack’s developer documentation explains that third-party applications can connect to those APIs to export, retain or archive messages and files: Using the Legal Holds API. Eligibility, permissions, authentication, rate limits and returned data types must be verified in the organization’s current documentation. Do not promise that an application captures reactions, Slack Connect content, snippet history or every file version when Slack’s hold documentation excludes those items.
Separate preservation from production format
The published Slack materials establish JSON and Discovery API access, but they do not prescribe a universal chain-of-custody method or production format. Counsel or the organization’s eDiscovery lead should select the review and production format, decide how timestamps and time zones are represented, validate that attachments open, and determine whether additional processing is needed. Keep an untouched source export alongside any normalized review copy.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Keep a defensible preservation record
A concise internal log helps counsel explain what was done and what was outside the chosen scope. As process guidance, record:
- Who identified the dispute, authorized the hold or export and performed each administrative action.
- The workspace plan, administrator roles and retention, edit and deletion settings observed at each check.
- Custodians, conversations, date ranges and connected workspaces included or excluded, with the reason for material exclusions.
- Hold identifiers, creation and modification times, export requests, approval messages and collection dates.
- Export files, API job records, checksums or equivalent integrity information used by the eDiscovery team, and every transfer or storage location.
- Known gaps, including deleted channels, expired data, Slack Connect conversations, reactions, snippet history or inaccessible private messages.
- Access controls: who can view the preserved data, how credentials are protected and when access is revoked.
This log is not a Slack-mandated evidentiary recipe. It is a practical way to let counsel and the organization’s technical team reconstruct decisions without exposing unrelated employee data.

How Federal Rule 37(e) frames lost electronically stored information
For U.S. federal civil litigation, Rule 37(e) addresses electronically stored information that should have been preserved, was lost because reasonable steps were not taken, and cannot be restored or replaced through additional discovery. The official December 1, 2024 text begins:
“If electronically stored information that should have been preserved in the anticipation or conduct of litigation is lost because a party failed to take reasonable steps to preserve it, and it cannot be restored or replaced through additional discovery, the court:”
Read the complete rule in the Federal Rules of Civil Procedure, December 1, 2024. The rule distinguishes measures available when loss prejudices another party from more serious measures that require an intent to deprive that party of the information’s use in litigation. A lost Slack message does not automatically produce sanctions; the court considers preservation duties, reasonable steps, prejudice, replaceability and intent.

Why sending a subpoena to Slack may not obtain message contents
Slack’s Data Request Overview says third parties seeking workspace data should contact the workspace owner. It also explains that the Stored Communications Act restricts a provider such as Slack from disclosing communication contents to third parties based solely on a civil subpoena or civil court order. Do not assume that serving Slack directly will produce the messages. Follow counsel’s process, identify the workspace owner and consider the applicable jurisdiction and legal authority.
This provider limitation is separate from an organization’s own preservation duty. The workspace owner may be able to preserve and export data under the plan’s controls even when a direct request to the provider would not yield content.
Common failure modes and corrective steps
| Failure | Corrective action |
|---|---|
| Relying on a public-channel export for a dispute that involves private channels or direct messages. | Ask the owner to verify plan eligibility and apply for the broader export or use an approved Enterprise discovery route. |
| Assuming a legal hold automatically supplies readable messages. | Arrange a separate JSON export or Discovery API collection and preserve the original artifacts. |
| Deleting or renaming a covered channel during cleanup. | Stop administrative cleanup, notify counsel and document the channel’s status; Slack says deleted covered channels are not saved by the hold. |
| Ignoring retention settings because the workspace “has a hold.” | Confirm the hold’s custodians, conversations and date range, then check documented exclusions such as Slack Connect, reactions and snippet history. |
| Collecting everything without a scope decision. | Have counsel define custodians, conversations and dates, and restrict access to unrelated personal or employee information. |
| Using an unverified third-party archive and assuming complete coverage. | Check the application’s current technical documentation, API permissions and returned data types; have the eDiscovery lead validate a test collection. |
| Waiting until a lawsuit is filed. | Preservation duties can arise when litigation is reasonably anticipated. Contact counsel promptly rather than waiting for service of a complaint. |
A practical decision framework
Use the following sequence to choose a route:
- Is litigation reasonably anticipated or active? If yes, involve counsel and the workspace owner immediately.
- Is the workspace Enterprise and is a Legal Holds Admin available? If yes, consider a scoped legal hold, while accounting for its exclusions and the 1,000-custodian limit.
- Is the data public-channel only? Owners and administrators can export public-channel data on all plans, but verify whether files and the required date range are present.
- Are private channels, direct messages or broad organizational sources relevant? Ask about Business+ application eligibility or Enterprise self-service and Discovery API options.
- Is the data in Slack Connect, reactions, snippet history or a deleted channel? Treat those as separate gaps and ask counsel what alternate source or custodian can supply them.
- Does the dispute require repeatable collection or ongoing preservation? Evaluate a managed, Slack-compatible eDiscovery or archiving workflow, but verify its coverage, permissions, security and legal suitability rather than assuming any product is complete.
The safest workflow is coordinated and documented: preserve first, collect through an authorized route, validate what the export actually contains, and let counsel decide the legal scope and production obligations.
