When a procurement dispute is filed or reasonably anticipated, issue a written preservation hold, capture the tender portal and every related record, and keep an untouched master with a documented hash and chain of custody. A screenshot is useful for showing what an operator saw, but it is not a complete record by itself. Preserve native files, metadata, linked documents, communications and the context needed to explain the capture.
The exact retention period and evidence requirements depend on the jurisdiction, contract, records schedule and tribunal. The UK example discussed below uses a three-year baseline for specified Procurement Act records; U.S. federal law cited below uses five years for specified above-threshold procurement computer files. A litigation hold or another legal duty can require longer retention.

Why a screenshot alone is a weak tender record
A screenshot freezes visible pixels at one moment. It may not include JavaScript-generated content, hidden fields, linked attachments, revision history, access conditions, metadata or the relationship between a notice and the procurement file. It also does not, by itself, establish who authored the statement, whether the page was complete, whether the content was true, or whether a tribunal will admit it.

- Portal exports of bids, questions, answers, evaluations and status history in their native format.
- Supplier and contracting-authority correspondence, including emails and attachments.
- Capture context: the full URL, portal name, procurement, notice and contract identifiers, page title, navigation path, publication or revision dates, and whether login was required.
GSA guidance says that when an appeal is filed, the contracting officer must ensure that evidence in their control related to the dispute is preserved, including relevant electronic data held by other organizational units. UK transparency guidance similarly warns that a published notice is not a complete record; the authority must keep its own records.
Issue a preservation hold immediately
When the duty starts
Do not wait for a formal claim if litigation or a procurement challenge is reasonably foreseeable. UK Practice Direction 31B requires legal representatives to notify clients of the need to preserve disclosable documents as soon as litigation is contemplated. A federal contract clause described in the source material likewise directs the holder of a preservation notice to stop alteration, overwriting, deletion or destruction and to preserve electronically stored information in native form so creation and modification metadata remain available.
What the written hold should say
- Identify the procurement, lots, suppliers, contract, notice numbers and dispute or appeal.
- State that records must not be deleted, overwritten, altered, reformatted or auto-purged.
- Name custodians and systems: procurement portals, shared drives, email, chat, document-management systems, local devices and backups.
- Include web records and dynamic pages, not only downloaded PDFs. GSA treats interactive website content as web records governed by records-management rules and retention schedules.
- Require custodians to report devices, accounts or systems that may contain relevant data and to preserve native exports.
- Set a process for suspending automatic deletion, mailbox retention limits, browser-cache cleanup and portal account deactivation.
Have counsel tailor the hold to the governing procurement statute, contract, records schedule and tribunal rules. A hold is an operational instruction, not a substitute for that legal analysis.
Capture the live tender notice and its context
Step 1: Record identifiers and access conditions
- Open the live notice through the public route or the authorized account used by the contracting team.
- Copy the complete URL exactly, including any path or query string. Record the portal name, procurement or contract identifier, notice number, lot, page title and visible publication or revision dates.
- Record the capture time in UTC, the operator, the account or public-access route, and the device or browser used. Note any login, subscription, geographic restriction or permission needed to view the page.
- Save a copy of the portal search results or navigation path that led to the notice. This helps show how the page relates to the procurement rather than presenting an isolated image.
Step 2: Save a readable representation
Print the notice to PDF or save a full-page image for human review. Include the browser address bar where practical, the page title and the visible date. If the page is long, capture the complete page rather than only the section supporting your argument. Keep the original output unchanged.
Step 3: Preserve native web data
Save the page’s native HTML and a standards-based web-archive package when the browser or capture tool supports one. Preserve downloaded stylesheets, scripts and assets when they are necessary to render the page. Do not assume that a PDF contains the source metadata or dynamic content.
Step 4: Follow every link
Open and preserve each linked tender specification, schedule, drawing, pricing form, clarification, addendum, question-and-answer page, award notice and termination notice. Record the source URL and the time for each item. If a link is broken, requires a role you do not have, or returns a blank or error page, record that fact and the steps taken rather than silently omitting it.
Step 5: Capture surrounding pages
Preserve the contracting authority’s procurement page, supplier or framework page, portal status history and any page showing the notice’s publication, amendment or withdrawal. Capture the visible relationship between the notice and the procurement record.

Preserve bids, evaluations and communications
A defensible package extends beyond the public notice. The UK transparency training list includes notices and associated procurement documents, tender submissions, assessment summaries, evaluation notes, governance records and supplier correspondence. FAR contract-file guidance includes award approvals and legal-review evidence, unsuccessful-offeror notices and debriefings, and bid, performance and payment bond documents.
Portal and procurement records
- All supplier submissions, versions and portal timestamps.
- Clarification questions, answers, addenda and acknowledgement logs.
- Evaluation sheets, scoring workbooks, moderation notes and assessment summaries.
- Approval memoranda, legal reviews, governance minutes and delegated-authority records.
- Standstill notices, debriefings, challenge letters, responses, award decisions and termination notices.
- Performance, payment and bid bonds where they form part of the contract file.
Messages and attachments
Export relevant email and messaging conversations in native form, retaining headers, sender and recipient data, timestamps and attachments. Preserve supplier questions and answers even if a later portal notice summarizes them. Keep mailbox or chat exports separate from working copies so conversion or review cannot alter the master.
Create a manifest, hash and chain of custody
Manifest fields
Create one manifest entry for every file, page capture and export. At minimum include:
- Filename and a stable item identifier.
- Source URL, portal, mailbox or system.
- UTC capture or export time.
- File size and cryptographic hash calculated over the complete file.
- Custodian, operator and method used to obtain it.
- Storage location and access restrictions.
- Relationships, such as “attachment to supplier email” or “linked from notice.”
Use a cryptographic hash to show that a later copy matches the preserved file. A hash is a numerical value calculated from the whole image or file; changing the content changes the value. Record the algorithm and tool version in the manifest, and recalculate only on a working copy when testing a transfer.

Protect the master
Store the definitive master as read-only or in a controlled repository that records access. The UK digital-investigation procedure calls for a documented, sealed Master Copy stored to prevent alteration or accidental erasure and available for examination by a court if required. Keep review, redaction and conversion copies in a separate location.
Log every handling event
Maintain a chain-of-custody log for each transfer, access, conversion, redaction and export. Record who acted, when, why, which tool and version was used, the source and destination, and the resulting hash where applicable. Never overwrite a master. If a redacted or converted exhibit is created, retain the unredacted original and document the reason and method.
Time evidence and electronic authenticity
An electronic timestamp and its certification may be admissible to show that data existed at the stamped time; electronic documents can include text, sound and visual or audiovisual recordings. A timestamp is not proof of authorship or completeness. It should be combined with portal records, the operator’s evidence and the preserved native file.

Hash values are ordinarily used to authenticate copied electronic data, but authentication is only one foundation issue. Rule 902 commentary makes clear that hearsay, relevance and attribution remain separate questions. Courts or tribunals may require a custodian, competent witness, certification, native-format production or a particular exhibit convention.
How to present a screenshot or web capture in a challenge
Explain the capture process
Prepare a short statement or affidavit identifying the operator, device or account, UTC time, URL, steps taken, files saved, hash process and storage controls. Explain whether the page was public or behind a login and identify anything that could not be captured.
Connect the image to the procurement record
Pair the screenshot with the native HTML or archive, linked documents, portal export and manifest entry. Show the notice identifier, lot and publication history so the decision-maker can tell which procurement the image represents.
Anticipate objections
- Completeness: provide the full-page capture, linked files and a record of missing or inaccessible material.
- Integrity: provide the original master, hash and chain-of-custody log.
- Attribution: identify the account, portal and custodian who can explain the system.
- Hearsay: ask counsel whether a business-record, public-record or other exception applies in the deciding forum.
- Privacy and redaction: retain an unredacted master, produce only the authorized version and document each redaction.
No universal statistic establishes the probability that a screenshot will be admitted. Admission is fact- and jurisdiction-specific.
Retention periods: use the stricter applicable rule

Apply the longest applicable obligation and ask counsel when a dispute, investigation, audit, public-records request or appeal changes the ordinary schedule. Do not destroy a record merely because the notice has disappeared from the portal.
Common failure modes and fixes
The portal returns a blank page or times out
Record the failed attempt, UTC time and URL. Try the authorized public or account route, preserve any error message, and obtain the document from the contracting authority or portal export. A failed capture is itself relevant context; do not replace it with an undated copy without noting the substitution.
A login or role prevents access
Use only an account you are authorized to use. Record the role, organization, login route and permissions. Ask the custodian or authority for a native export rather than sharing credentials or bypassing access controls.

The page changed after the dispute began
Preserve the current version, prior PDFs or emails, portal revision history and any cached or archived copy lawfully available. Label each version with its capture time and hash; never overwrite the earlier file.
Attachments are missing or links are dead
Save the page showing the dead link, record the URL and error, search the portal’s document area and request the native file from the custodian. Keep a written note of what was unavailable and when.

Keep the native export as the master. Produce PDF, image or redacted versions only as working copies, record the conversion tool and version, and hash each resulting file separately.
Large volumes make review impossible
For a small dispute, disciplined manual capture, hashing, manifests and a protected master may be sufficient for counsel’s review. For a matter spanning portals, mailboxes and attachments, e-discovery or legal-hold software can add indexing, deduplication and metadata search. Treat such software as an optional tool, verify it independently and do not assume that a vendor’s capture feature guarantees admissibility.

Manual capture gives an operator a chance to understand context and note exceptions, but it is slow and inconsistent across many URLs. Automated capture is useful for repeated snapshots, provided the process preserves the URL, UTC time, output, linked-document inventory and failure state. Whichever method you use, maintain the same manifest and chain-of-custody controls.
For dynamic notices, wait until the relevant selector appears or the page reaches network idle before saving. If a portal uses lazy-loaded documents, scroll or otherwise load the complete page, then verify that attachments and revision panels are present. Retain the tool settings and browser or API version so another person can reproduce the method.

A practical preservation package
Give counsel or the tribunal a package that can be understood without guessing:
- An index and manifest with hashes, source URLs, UTC times, custodians and storage locations.
- The untouched master archive and native portal exports.
- Readable PDFs or images for each notice and linked record.
- A capture log describing browser or API settings, waits, failures and inaccessible items.
- A chain-of-custody log covering every transfer, conversion, redaction and export.
- A custodian or operator statement explaining the system, account, process and storage controls.
- A separate redacted production set, with the unredacted originals retained securely.
This structure lets counsel address completeness, integrity, provenance, privacy and searchability without relying on a single screenshot.
Frequently Asked Questions
Should I capture from a personal account or a shared procurement account?
Use the authorized account that normally has access to the record, and document the account role and organization. Avoid personal accounts unless counsel and the system owner authorize them; account context can affect how the capture is interpreted.
What should I do if the portal blocks automated requests?
Do not bypass a security control. Record the block and obtain an authorized browser capture or native export from the portal operator or custodian. Preserve the error response and the request details in the log.
Can I redact supplier personal data before giving the file to counsel?
Keep an unredacted master first. Create a separate redacted copy, record the legal reason, tool and operator, and retain both the redaction log and the original hash.
Who should release a litigation hold?
The responsible legal team or records authority should release it in writing after the dispute, appeal and related obligations have ended. A normal retention date does not automatically cancel a hold.
