An H-1B “transfer” is usually a new employer’s Form I-129 petition requesting to employ a worker who is already in H-1B classification. The new employer—not the worker—files the petition. In some cases, AC21 portability lets the worker begin the new job after the qualifying petition is filed and before USCIS approves it, but only when specific status, timing, and work-history conditions are met.
Prepare by having the new employer’s immigration team verify the worker’s authorized-stay dates, admission and prior petition history, and any unauthorized employment; select the correct Form I-129 filing basis; coordinate the filing and start date; and preserve the receipt notice for case tracking. A job offer by itself does not authorize work for the new employer.

What an H-1B “transfer” actually is
“H-1B transfer” is common workplace shorthand, not the name of a separate USCIS form. The official process is a Form I-129 petition filed by the prospective employer for the proposed employment. Form I-129 identifies a “change of employer” basis for a beneficiary who is already in the requested classification.

The new employer must file its own petition describing the new employment. The filing basis must match the real arrangement, because a change of employer, concurrent employment, and an amended petition are different requests.

USCIS’s portability rule may allow an eligible worker to start for the new employer when the new employer files a qualifying, nonfrivolous petition. “Nonfrivolous” means the application has an arguable basis in law and fact and was not filed for an improper purpose. Portability is conditional; it is not a blanket benefit for everyone who has ever held H-1B status.
Start with a case assessment before setting a start date
Verify the worker’s current status and authorized stay
The immigration team should identify the worker’s current H-1B status and the date through which the worker is authorized to stay. The filing must occur before the end of the applicable authorized-stay period for portability to be considered. Do not rely only on an offer letter, an old approval, or an assumed expiration date.
Review admission and petition history
Portability eligibility described by USCIS depends in part on lawful admission and the worker’s status history. Counsel should compare the worker’s admission record with prior H-1B petitions and identify any changes that could affect the requested classification or period of stay.

Check for unauthorized employment
USCIS’s employer guidance lists the absence of unauthorized employment since admission and before the new petition is filed as a portability condition. The review should cover every job, side engagement, gap, and change in duties that could matter. If the work history is uncertain, resolve it with authorized immigration counsel before promising a start date.
Confirm the actual employment arrangement
Ask whether the worker will replace the current job, keep it while adding another job, or remain with the same employer under materially changed terms. Those answers determine which Form I-129 basis the employer and counsel should request.
Choose the correct Form I-129 filing basis
The following situations are related but not interchangeable:
| Situation | What it generally means | Preparation question |
|---|---|---|
| Change of employer | A new employer seeks to employ a beneficiary already in the requested H-1B classification. | Is the worker moving to this employer, and does the worker meet the portability conditions if an early start is planned? |
| Concurrent employment | An additional employer seeks H-1B employment while the existing H-1B employment continues. | Will the original job continue at the same time? If so, this is not automatically a transfer. |
| Amended petition | An existing employer reports a material change in employment terms or eligibility. | Has the current job changed in a way that requires an amended filing? Whether a change is material requires case-specific review. |
| New employment | The petition requests employment that does not fit the worker’s existing classification or another available basis. | Does the worker’s current classification and history support the requested employment, or is a different filing approach needed? |
Use the current Form I-129 and its instructions, together with counsel’s analysis, to select the basis. Choosing “transfer” informally while filing under the wrong category can create avoidable problems with the requested employment or the worker’s ability to start.

Understand when portability can permit a start before approval
For qualifying workers, AC21 portability can permit work for the new H-1B employer as soon as that employer files a nonfrivolous petition, without waiting for USCIS approval. USCIS describes the rule as “working for a new H-1B employer as soon as that new employer files a ‘nonfrivolous’ … H-1B petition on the nonimmigrant’s behalf.” That sentence must be read with the eligibility conditions around it.

The USCIS employer guidance identifies these conditions:
- The worker was lawfully admitted to the United States.
- The new employer files the petition before the end of the worker’s authorized-stay period.
- The worker has not engaged in unauthorized employment since admission and before the petition is filed.
These are threshold conditions described by USCIS, not a guarantee that every H-1B worker can use portability. The employer and counsel must verify the individual facts, the filing basis, and the petition’s validity before the worker begins.
Use a filing-event sequence, not an offer-letter sequence
- Complete the case review. Confirm status, authorized-stay dates, lawful admission, prior petitions, and work history.
- Prepare the correct Form I-129 request. The petition should describe the actual employer and proposed employment, using the basis that matches the arrangement.
- File the petition. Portability, if available, turns on the new employer filing a qualifying, nonfrivolous petition—not merely on signing an employment agreement or giving notice to the old employer.
- Confirm the filing event. Keep the filing confirmation and, once issued, the receipt notice. The immigration team should tell the worker in writing whether counsel has determined that portability applies and what start date is authorized.
- Begin only under the confirmed rule. If the worker does not meet portability conditions, wait for the authorization appropriate to the case rather than assuming the new job can start immediately.
Prepare information without treating a generic checklist as definitive
USCIS materials establish the core status and filing concepts, but they do not provide one universal supporting-document checklist that fits every H-1B employer change. Required evidence can depend on the worker’s history, the requested employment, the employer, and the filing posture. The employer’s immigration team should use the current USCIS form instructions and any applicable Department of Labor requirements rather than copying an online list.
Information the worker should organize
- Current H-1B status and the date authorized stay ends.
- Admission history relevant to the current status.
- Prior H-1B petition history and any changes in employers or employment.
- A complete account of employment since admission, including periods that could raise an unauthorized-employment question.
- Planned travel, other current or prospective employers, and any overlapping start dates.
Information the new employer should provide to counsel
- The legal employer identity and the actual job arrangement.
- The proposed work, location, schedule, and start date as they are expected to exist, not as a placeholder.
- Whether the worker will replace an existing job or work concurrently for another employer.
- Any material change to an existing role that could make an amended petition relevant instead of a change-of-employer filing.
Do not guess at the LCA or evidence sequence
The exact Department of Labor Labor Condition Application sequence and a complete, current evidence list are not established by the available USCIS material. The employer should follow current Department of Labor and USCIS instructions and counsel’s case-specific process. Treating an old checklist as universal can leave out evidence or create inconsistencies in the petition.
Coordinate the filing and the practical start date
The new employer, worker, payroll team, and immigration counsel should use one written timeline. It should identify the authorized-stay deadline, the target filing date, the earliest proposed start date under portability if applicable, and the person responsible for confirming each event.
| Event | What to confirm | Why it matters |
|---|---|---|
| Case intake | Status, authorized-stay date, admission, prior petitions, and employment history have been reviewed. | These facts affect whether portability can be used and which filing basis fits. |
| Petition preparation | The employer and counsel agree on the Form I-129 basis and the proposed employment details. | Change of employer, concurrent employment, and amendment requests are distinct. |
| Filing | The petition has actually been filed and is intended to be nonfrivolous. | A job offer or internal approval is not the portability filing event. |
| Start authorization | Counsel or the immigration team confirms the worker’s individual portability eligibility and start date. | Starting too early can create unauthorized employment exposure. |
| Receipt tracking | The receipt notice and receipt number are saved and circulated to the appropriate team members. | The receipt number is needed for USCIS case tracking and future follow-up. |
Keep payroll and the hiring manager aligned with the immigration team. A worker should not be told to begin “once the package is mailed” unless counsel has confirmed that the qualifying filing has occurred and the worker meets the portability conditions.
Save the receipt notice and track the case
What the receipt notice does
USCIS says the receipt notice describes case processing and provides the receipt number. Preserve the notice in the employee’s immigration file and give the worker a secure copy. Keep the filing confirmation and delivery records with it so the organization can show when the petition was submitted.
Recognize the receipt number
USCIS Case Status Online accepts a 13-character receipt number consisting of three letters and 10 numbers. Enter the number exactly as shown on the notice. The receipt number is an administrative identifier; it is not an approval and does not, by itself, establish portability eligibility.

Allow for mailing time without treating it as a guaranteed processing deadline

If the notice has not arrived, the employer should use current USCIS service information and counsel’s instructions to determine the appropriate follow-up.

Practical checklists for the worker and employer
Worker checklist
- Give the new employer’s immigration team accurate status and authorized-stay information.
- Disclose prior H-1B petitions, admissions, employers, overlapping jobs, and any periods of work that may not have been authorized.
- State whether the current job will end or continue.
- Report planned travel and any other pending immigration matter before selecting a start date.
- Do not start the new job until the employer confirms the filing event and portability determination, or the required approval or authorization is in place.
- Save the receipt notice and 13-character receipt number.
Employer and HR checklist
- Assign an immigration contact and authorized counsel before promising a start date.
- Collect the worker’s status, authorized-stay, admission, petition, and employment-history information.
- Describe the actual job and identify whether the case is a change of employer, concurrent employment, amendment, or another filing type.
- Use the current Form I-129 instructions and current Department of Labor requirements.
- Document the filing date and retain the filing confirmation.
- Obtain a written portability and start-date determination for this worker.
- Give payroll and the hiring manager only the start-date instruction that immigration counsel has confirmed.
- Store the receipt notice and monitor the case using the receipt number.
How the rules apply in common scenarios
The worker is leaving the current employer
The new employer generally files a change-of-employer Form I-129 petition. If the worker was lawfully admitted, the petition is filed before the authorized stay ends, and there has been no unauthorized employment since admission and before filing, counsel may determine that portability permits the new job to begin after filing.
The worker wants two H-1B jobs at once
This is generally a concurrent-employment question, not automatically a transfer. Tell both employers’ immigration teams that the original employment will continue so the filing basis and work authorization analysis reflect the overlap.
The worker stays with the same company but the job changes
An amended petition may be relevant when the existing employer reports a material change in employment terms or eligibility. Whether a particular change is material cannot be decided from the label alone; counsel must review the facts.
The authorized-stay date is close or the work history is unclear
Escalate immediately. The timing and employment-history conditions are central to portability, and an informal assumption can lead to an unauthorized-work problem. The employer should not set a start date until the case has been reviewed.
When individualized immigration advice is necessary
USCIS says people who are unsure which forms to submit may need immigration legal advice from an authorized service provider. Obtain that advice before filing or starting work when there is uncertainty about status dates, lawful admission, prior petitions, multiple employers, travel, unauthorized employment, a material job change, or the appropriate Form I-129 basis.
General guidance cannot determine whether a particular worker qualifies for portability or whether a specific employment change requires an amendment. The employer’s counsel should apply the current agency instructions to the complete facts and retain the reasoning with the case file.
What this preparation process can and cannot establish
This process explains the general USCIS framework for an H-1B change of employer, the conditional portability rule, the main Form I-129 distinctions, and receipt tracking. It does not establish a universal supporting-document list, a complete current Labor Condition Application procedure, filing fees, adjudication times, approval odds, or a worker-specific legal conclusion. Those details require current agency instructions and individualized review.
