Short answer: use a lawfully acquired copy of the complete game, obtain a patch rather than an unauthorized game download, apply it to your own dump, and keep the modified file private. That approach reduces copyright and malware risk, but it is not an automatic legal safe harbor. U.S. law treats copyright, anti-circumvention, distribution, and computer security as separate questions.
This guide explains the current U.S. federal framework and a cautious technical workflow. Rules in other countries can differ, and the legality of a particular game, patch, emulator, or access method depends on facts that cannot be resolved by the label “ROM hack.”

What “ROM hack” means—and what it does not mean
A ROM hack is a community term for a modified video-game program. A project may change levels, dialogue, graphics, difficulty, translations, or other data in a game image. The term describes the modification, not where the original game came from, who owns the copyright, or whether distribution is authorized.

A patch can contain only the changes, or a download can contain a complete game image with changes already applied. Those formats create different copyright and security questions. A patch file is not automatically lawful, and a complete download is not automatically unlawful in every circumstance; the source, permission, purpose, and method all matter.

The four questions to answer before you play
Work through these questions separately. A “yes” to one does not answer the others.

How U.S. copyright and anti-circumvention rules fit together
U.S. copyright law protects video-game programs and other expressive elements. Separately, DMCA section 1201 addresses technological measures used to control access to copyrighted works, including games. The statute covers both circumventing certain access controls and trafficking in technologies primarily designed to do so. The fact that a device or program runs on hardware you own does not settle whether its use bypasses a protected access control.
Section 1201 also creates a rulemaking process for temporary, narrowly defined exemptions. The exemptions are not a general consumer license to download game files, copy any title, or defeat any protection whenever you own the original. They apply only to the activities and conditions written into the regulation.

“Video games in the form of computer programs embodied in physical or downloaded formats that have been lawfully acquired as complete games, when the copyright owner or its authorized representative has ceased to provide access to an external computer server necessary to facilitate an authentication process to enable gameplay, solely for the purpose of:”
The words “lawfully acquired,” “complete games,” “ceased to provide access,” “external computer server,” and “solely for the purpose” each limit the provision. Read the complete regulation and its definitions before assuming that a particular title or method qualifies.

What the current video-game exemptions actually cover
Games whose authentication server has shut down
One provision concerns a lawfully acquired complete game that requires an external server for authentication and whose copyright owner or authorized representative has stopped providing that access. The exemption permits specified copying or modification to restore access for personal local gameplay, subject to the regulation’s conditions. It is not a blanket permission to obtain any ROM from an archive, remove online features from a currently supported game, or share a modified copy.

Check the facts in order:
- Is your copy a complete game that was lawfully acquired?
- Was an external authentication server genuinely required for gameplay?
- Has the owner or authorized representative ceased providing that authentication service?
- Is your activity limited to the purpose and type of copying or modification described by the regulation?
- Are you keeping the result within the boundaries of the exemption rather than distributing it?
Preservation by eligible institutions
Another provision addresses preservation of certain lawfully acquired games that are no longer reasonably available commercially. The eligible users are libraries, archives, and museums meeting the regulatory definitions. Conditions include preservation-related purpose, restrictions on commercial use, and limits on access outside the institution’s premises. A home user cannot claim this institutional exemption merely by preserving a personal collection.
Institutional status is not a shortcut for public ROM hosting. An organization must satisfy the definitions and every applicable condition; the exemption does not authorize unrestricted internet distribution or commercial exploitation.
What the exemptions do not establish
- They do not create a general “I own the cartridge, so I can download any ROM” rule.
- They do not make every emulator, dumper, patcher, or circumvention device lawful in every use.
- They do not authorize uploading a game image, pre-patched ROM, or BIOS file for others.
- They do not determine whether a particular fan project has permission from the copyright owner.
- They do not answer questions under non-U.S. law.
A practical, lower-risk workflow for playing a hack
The following sequence separates legal choices from security precautions. None of the steps is a guarantee, and a careful workflow cannot cure an unauthorized source.
1. Identify the exact base game
Record the title, region, platform, revision, and media format. A patch made for one revision can fail on another or produce unpredictable behavior. Keep the original cartridge or authorized digital entitlement and any purchase records. If a project’s documentation specifies a particular revision, follow that requirement rather than trying random images.
2. Prefer a data patch over a complete game image
Look for a patch distributed through the project maintainers’ own channels. Common patch formats contain modification data that must be applied to a matching base file. A download advertised as a complete pre-patched game includes copyrighted game content and should be treated differently from a patch. No source reviewed here verifies that any particular site, patch, or tool is trustworthy or malware-free, so do not interpret a project’s popularity as a security certification.

3. Check the project’s documentation and file integrity
Read the release notes for the required game revision, patch format, supported systems, known bugs, and stated permissions. If maintainers publish a cryptographic checksum, compare it with the file you received using a trusted, current hashing utility. A matching digest only shows that your file matches the published digest; it does not prove that the publisher is authorized, that the file is safe, or that the resulting game is legal.
4. Keep your operating system and security tools current
Use current security updates and scan downloads before opening them. A patch should normally be data, not an installer that asks for administrator access. Treat unexpected executable files, password-protected archives, scripts, browser extensions, or requests to disable antivirus protection as warning signs. Do not disable protections merely to run an unknown file. If a project requires an executable patcher, obtain it from the maintainers’ documented channel, inspect what it is designed to do, and scan it before use; these precautions still do not establish that it is safe.
5. Dump your own game when technically and legally appropriate
Use hardware and software appropriate to your platform to create a personal copy from the game you lawfully acquired. Follow the equipment maker’s instructions and the game project’s required format. Do not assume that making a personal dump resolves anti-circumvention issues: if the process bypasses a technological measure, section 1201 and any applicable exemption must be considered separately.

6. Apply the patch offline to the matching dump
- Make a backup of the unmodified dump and store it separately.
- Open the patching utility and select the patch file, then the exact base-game file required by the project.
- Choose an output name that identifies the hack and revision; do not overwrite the original.
- Let the utility finish and check for an explicit success message or error report.
- Scan the output and retain the original patch and checksum information for troubleshooting.
If the tool reports a size, checksum, or format mismatch, stop. Do not force the operation with a different revision or an untrusted “fix” download. Obtain the correct base game from your own copy and recheck the project’s documented requirements.
7. Run the result in a controlled environment
Use an emulator or console setup that supports the platform and does not require you to install unrelated software. Keep the modified file on your own device and avoid automatic cloud-sharing folders. If you use removable media, protect it from write operations while transferring files and scan it on the receiving system.
8. Keep distribution private
Do not upload the base ROM, a pre-patched ROM, a BIOS file, or a bundle containing copyrighted game data. Do not seed it through a peer-to-peer client or send it to a group simply because recipients own the cartridge. If you want others to experience the project, share the maintainers’ patch information and require each person to obtain and dump their own lawful copy, subject to the project’s license and local law.

Safety red flags and what to do instead
“You must install this launcher”
Stop and verify whether the project actually requires a launcher. A data patch normally does not need system-wide installation. If the release documentation does not explain an executable, do not run it.
“Disable antivirus or SmartScreen”
Do not turn off protections to use an unknown download. Find an official release, ask the maintainers for an explanation through their documented channel, or abandon the file.
Password-protected archives and urgent mirrors
Unexplained passwords, shortened links, aggressive advertising, and “re-upload” claims make provenance difficult to establish. A password can also prevent security scanners from inspecting the contents. Prefer a direct, documented release and verify its digest when one is published.
Patch failure after downloading another ROM
Do not keep downloading random copies. Confirm the region and revision, compare the required checksum with your own dump, and ask the project maintainers which revision is supported. A mismatch is usually a compatibility problem, not evidence that you need a different website.
U.S. rules are not worldwide rules
The analysis above is based on U.S. federal sources: the DMCA, the U.S. Copyright Office’s rulemaking materials, and 37 CFR 201.40. Other countries may define private copying, circumvention, interoperability, preservation, and distribution differently. Some jurisdictions also impose rules on downloading or possession that do not mirror U.S. categories.
If you live outside the United States, check the law where you are located and where the relevant service operates. If a project has commercial plans, a disputed license, or a takedown threat, obtain advice from a qualified lawyer familiar with the applicable jurisdiction rather than relying on a general internet explanation.
Rulemaking can change the answer
The U.S. Copyright Office’s tenth triennial section 1201 proceeding is underway. Its materials describe possible renewal of current exemptions for October 2027 through October 2030, but that future period is not yet in force. A proposed renewal is not a present authorization. Recheck the current regulation when your activity depends on an exemption, especially after a rulemaking cycle or a change in a game’s server status.
