How to Opt Out of Automatic License Plate Reader Data Sharing Where You Live

By Freedom251 Team · · 11 min read

There is no nationwide form that lets a resident opt out of automatic license plate reader (ALPR) collection or sharing. Your options depend on the state law, local agency policy, vendor contract and retention schedule governing the camera that recorded your vehicle. The most effective approach is to identify the agency operating the system, obtain its written rules, and make a targeted request to its records or privacy officer for information about collection, sharing, retention, correction and deletion.

What “opting out” can and cannot mean

ALPR cameras photograph passing vehicles, use optical recognition to extract a plate number, and attach information such as the time and location of the scan. Police departments, sheriffs, transportation agencies, toll operators, parking authorities and municipalities may operate cameras themselves or obtain data through a private vendor. A scan can therefore be governed by several different documents and laws at once.

In practice, “opt out” may refer to four different requests:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Prevent collection: ask that your vehicle or plate be excluded from the camera system. The authorities reviewed do not identify a consumer product or general legal mechanism that lawfully prevents a vehicle from being optically captured.
  • Stop sharing: ask the agency not to disclose scans to another agency, a vendor, federal authorities or an out-of-state agency except where law permits it.
  • Delete existing data: ask for a scan or associated record to be removed. Whether that is available depends on the jurisdiction and on exceptions for investigations, prosecutions or civil actions.
  • See or correct data: request information about records tied to your plate or ask that an inaccurate plate read, location or date be corrected.

A general privacy request does not automatically create a right to deletion. The controlling answer comes from the law and policy for the place where the scan occurred and from any contract under which the data is stored.

Step 1: Identify who operates the camera

Do not begin with the camera manufacturer or a generic privacy form. Start with the public body that owns, operates or queries the system. The operator may be different from the agency that employs the officer who later viewed a scan.

Where to look

  • Police, sheriff, highway, toll-road, parking and transportation-agency websites.
  • Pages titled “ALPR,” “automated license plate recognition,” “license plate reader,” “vehicle-location data” or “surveillance technology.”
  • City-council, county-board or transportation-authority meeting agendas and minutes approving a camera program.
  • Procurement notices, contracts, memoranda of understanding and budget documents naming a technology provider.
  • Public-records portals and records-officer directories for the agency that installed the camera.

Record the camera location, the date and approximate time of the scan, the plate jurisdiction, and every agency or vendor named in the documents. If you saw a camera but cannot identify the operator, ask the municipality, police department and transportation authority in writing which entity controls that location.

Why the operator matters

The operator determines who may query the database, which agencies may receive information, how long ordinary scans are kept and which officer handles an individual request. A private vendor may host or process records, but the public agency can still own the data and remain responsible for its policy and retention schedule.

Step 2: Read the policy, contract and retention schedule

Obtain the agency’s current ALPR usage and privacy policy, retention schedule, vendor contract, sharing agreements and any audit or reporting rules. Read the documents together; a policy may state a short ordinary retention period while a contract describes backup copies, vendor access or investigation holds.

Questions the documents should answer

  • What collection purpose is authorized, and are cameras limited to specific roads, facilities or investigations?
  • Who may search the system, what training is required, and are searches logged and audited?
  • How long are ordinary scans retained, and when does the deletion clock begin?
  • What exceptions permit a longer hold for an ongoing investigation, prosecution or civil action?
  • Which public agencies, private entities, federal entities or out-of-state agencies may receive data?
  • Can a vendor use the information for its own analytics, security, product improvement or resale?
  • Who owns the records, where are they stored, and what happens to copies, backups and audit trails?
  • Is there a procedure for access, correction, deletion, complaints or notice of a mistaken plate read?

Retention is not the same as access

An agency may delete the image and associated location data while retaining an audit log showing that an authorized user searched the system. Conversely, an image placed into an investigation file may be kept under a different schedule from routine scans. Ask separately about system data, copied case material, metadata and audit-trail data.

Step 3: Send a targeted written request

Send your request to the agency’s records officer, privacy officer or designated ALPR contact. Use a written channel that provides a delivery record. Describe the camera location and date as narrowly as you can, but do not include unnecessary personal information.

Questions to include

  1. Does the agency store any ALPR scan or derivative record associated with plate number [plate number], captured near [location] on or about [date and time]?
  2. What statute, regulation, policy or contract authorizes collection and the proposed use of that data?
  3. What is the ordinary retention period, and has any investigation, prosecution or civil-action exception been applied?
  4. Which categories of recipients have received, or may receive, the scan or a copy of it?
  5. Which vendor processes or stores the data, and does the vendor have independent access or use rights?
  6. Is there a process to obtain a copy, correct an inaccurate plate read, request deletion, or file a complaint?
  7. If deletion is denied, which specific law, policy or litigation/investigation hold requires continued retention, and what is the next review or destruction date?

Ask for the policy, retention schedule, contract, memoranda of understanding, sharing lists and relevant audit-log rules as public records even if the agency cannot disclose an active investigation. Request a written explanation for any redaction or denial.

Request template

Subject: ALPR data, policy and retention request

I am asking about an automatic license plate reader scan near [location] on or about [date/time] involving plate [plate number and state]. Please confirm whether the agency stores a scan or related record, identify the legal authority and retention period, list the categories of recipients, identify any vendor with access, and explain whether access, correction or deletion is available. Please provide the current ALPR policy, retention schedule, applicable contracts or sharing agreements, and the procedure for challenging an inaccurate record. If any portion is withheld, identify the legal basis and the date on which the record will be reviewed for release or destruction.

Do not assume that identifying yourself as the vehicle owner proves that every scan belongs to you. A plate can be misread, cloned or associated with a different vehicle. Ask for the agency’s identity-verification requirements and for a correction route that does not require disclosure of unrelated travel information.

Step 4: Use public-records and public-participation channels

When an individual deletion process does not exist, public-records law and local oversight are the practical ways to learn how a system operates. Request policies, contracts, retention schedules, sharing agreements, training materials, aggregate reports and audit procedures. Records laws often contain exemptions for active investigations, security-sensitive camera locations or personal information, so a partial response is not necessarily evidence that no records exist.

California’s public-policy requirements

California Department of Justice guidance says public agencies must conspicuously post ALPR usage and privacy policies and provide an opportunity for public comment before implementing a program. The same guidance states: A public agency “shall not sell, share, or transfer ALPR information, except to another public agency, and only as otherwise permitted by law.” That rule does not create a universal personal opt-out, but it gives residents a basis to examine the agency’s policy, sharing decisions and meeting record.

On October 3, 2025, California Attorney General Rob Bonta said state and local agencies are prohibited from sharing ALPR data with federal and out-of-state law enforcement when the use falls outside California oversight, and announced a lawsuit against El Cajon over alleged sharing. Bonta summarized the concern this way: When information about Californians leaves the state, we no longer have any say over how it is used or shared. A California resident should therefore ask specifically whether data has crossed state lines and which legal authority was invoked.

Jurisdiction Rule or practice reported by the cited authority What it means for a resident
Iowa The National Conference of State Legislatures’ state-statute survey, accessed in 2026, reports that an operator must permanently delete each captured plate image and accompanying data no later than 30 days after capture, unless law enforcement copied it for an ongoing criminal case. Ask whether your record was copied into an active case before the 30-day deadline and request the applicable destruction date.
Virginia Current Virginia Code §2.2-5517 requires an approved vendor to certify that it will not sell or share Commonwealth system data. System data must be purged after 21 days, except when retained for an ongoing investigation, prosecution or civil action; audit-trail data may be purged after two years. Sharing is limited to listed purposes and recipients. Separate ordinary system data from audit-trail data and ask which exception, if any, prevents the 21-day purge.
Utah In a May 14, 2025 privacy decision, the state privacy regulator reported that the two agencies reviewed used providers that automatically deleted ALPR data after nine months, limited sharing through memoranda of understanding and posted public policies. The regulator recommended formal retention schedules because the agencies owned the data. “Automatic deletion” may be a vendor setting rather than a complete agency retention schedule. Ask who owns the records and whether the nine-month period applies to copies and backups.
California California DOJ guidance requires conspicuously posted usage/privacy policies and says a public agency may not sell, share or transfer ALPR information except to another public agency and only as permitted by law. The Attorney General’s October 3, 2025 statement addressed sharing with federal and out-of-state law enforcement outside California oversight. Review the posted policy and meeting record, then ask whether any proposed or completed sharing involved an out-of-state or federal recipient.

The figures above are qualified to the cited jurisdiction and source. A number in one state does not establish a national standard, and a vendor’s automatic deletion setting does not override a longer legal hold.

Compare your jurisdiction on six questions

Use this checklist when reading a statute, agency policy or contract:

  1. Who may operate or query the system? Some laws limit operation to public agencies or approved vendors; others regulate individual searches and require training.
  2. What is the ordinary retention period? Find the exact number of days or months and when the period starts.
  3. What are the investigation exceptions? Determine whether an image can be copied into a case file and whether a prosecution, civil action or investigation suspends deletion.
  4. Who may receive the information? Look for limits on vendors, neighboring agencies, federal entities, out-of-state agencies and private parties.
  5. What transparency and audit duties apply? Check for posted policies, public meetings, annual reports, audit logs, training records and breach notices.
  6. Does an individual process exist? Look for access, correction, deletion, complaint, appeal and contact procedures; do not infer such a right from a general privacy statute.

When deletion, access or correction is denied

Ask for a precise reason

Request the exact exemption or policy section supporting the denial, whether the record is part of an active investigation, and whether a non-exempt portion can be released. Ask when the hold will be reviewed and when ordinary data will be destroyed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Challenge an inaccurate plate read

Provide evidence that the plate was misread, the vehicle was elsewhere, or the image depicts a different vehicle. Ask for the agency’s correction procedure and for an annotation to be added while the dispute is pending. A correction request is distinct from a demand to erase a valid scan.

Escalate to the appropriate local authority

If the first contact does not answer, send the request to the agency’s records supervisor, privacy officer, inspector general or internal affairs unit, depending on the issue. A state privacy regulator or attorney general may handle statutory violations, while a local civil-liberties legal clinic can help assess a denial, unlawful sharing allegation or public-records dispute. The available remedy depends on state law and the agency’s contract.

What residents can do before and after a scan

  • Keep a dated record of the camera location, the agency contacted, the request sent and every response.
  • Save the policy and contract versions in effect on the date of the scan; agencies can later replace web pages without preserving the earlier text.
  • Ask whether the agency has a public complaint, correction or appeal form instead of sending the same request to multiple departments.
  • Use public meetings and comment periods to request limits on retention, sharing, vendor access and audit practices.
  • Do not tamper with, obstruct or disguise a plate. Such conduct can create separate traffic or criminal liability and does not provide a lawful privacy opt-out.

Common situations

“I do not know which agency captured my car.”

Start with the road owner and the local police or sheriff, then check transportation, toll and parking authorities. Ask each agency to identify the operator for the specific location and date. Once identified, direct the substantive request to the data-owning agency.

“A private company’s name is on the camera.”

The company may provide hardware, hosting or analytics while a public agency owns the records. Request the public contract and ask whether the vendor can access, retain, copy or use data independently. The contract may reveal a different deletion process from the agency’s public-facing policy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The agency says it has no record.”

Ask whether the scan was never collected, was already deleted under the retention schedule, was transferred to a case file, or is held by another operator. Request the policy and retention schedule so you can distinguish a completed deletion from a search that used the wrong system or date range.

“I want all scans associated with my plate.”

That request may cover records from several agencies and jurisdictions, each with different rules. Divide it by operator and location, ask what identity verification is required, and expect investigation or public-record exemptions to limit disclosure. No reviewed authority establishes a general right to demand deletion of every scan associated with a plate.

A practical decision path

  1. Locate the operator: identify the public agency or transportation authority for the camera.
  2. Collect the governing documents: obtain the policy, retention schedule, contract and sharing agreements.
  3. Check the clock: determine the ordinary deletion deadline and any case-related exception.
  4. Send a focused request: ask about your scan, recipients, vendor access, correction and deletion procedures.
  5. Use oversight channels: submit public-records requests and participate in required public-comment processes.
  6. Escalate proportionately: seek a records supervisor, privacy regulator, attorney general or local legal clinic when the response conflicts with the governing rule.

The result may be an explanation rather than immediate deletion. Even so, identifying the operator and obtaining the retention and sharing rules tells you which legal deadline, exception or appeal route controls your data.
