Employers may be able to monitor some work activity, but there is no one rule that makes every method lawful everywhere. A fair approach starts with a specific business need, uses the least intrusive method that can address it, assesses privacy risks, and tells workers what is collected and why. The legal answer depends on the locations of the employer and workers, as well as the monitoring method.
Can an employer monitor you while you work from home?
Sometimes, but a business reason alone does not settle whether a particular form of monitoring is appropriate or lawful. Under the Information Commissioner’s Office (ICO) employment guidance for the UK, employers should identify a specific purpose, consider whether monitoring is necessary, and choose a method proportionate to that purpose. The ICO puts the principle plainly: “Just because a form of monitoring is available, does not mean it is the best way to achieve your aims.”

Remote monitoring deserves particular care because a home is also a private space. A webcam, microphone, screen capture or location tool may expose personal activity or information about family members and other people who are not employees. The more a method can reveal about life outside work, the stronger the reason to consider whether a narrower approach can meet the same need.

If those answers are unclear, ask for the employer’s current privacy information or monitoring policy and use the workplace process for raising a privacy concern.

Which monitoring method fits the business need?
Choose the method only after defining the problem. “Improve productivity” is too broad to justify collecting extensive personal data without explaining what issue is being addressed. A specific security, timekeeping, safety or regulatory concern gives the employer a basis for comparing narrower options. The following examples are not fixed privacy rankings: how intrusive each method is depends on its settings, scope, duration and the information it captures.
| Method | What to assess | Less intrusive starting point to consider |
|---|---|---|
| Webcam or screenshots | Whether the method captures a worker’s home, personal activity or information about others; how often it records; and whether content is stored or reviewed. | For a timekeeping concern, compare login or access records and ask workers to explain discrepancies before introducing visual checks. |
| Timekeeping or access records | Whether a limited record of start times, system access or attendance is enough for the stated purpose. | Use only the fields and time periods needed to answer the question. |
| Keystroke, internet or productivity logging | Whether the tool records detailed activity or content, how results are interpreted, and whether a less detailed measure would work. | Define a narrow measure tied to the problem rather than collecting broad activity histories by default. |
| Location tracking | Whether location is genuinely needed, when it is collected, and whether tracking continues outside the relevant work context. | Limit collection to the places, tasks or periods where location information is necessary. |
| Audio or video surveillance | Whether it could record private conversations, household activity or sensitive information, and whether its scope can be reduced. | Consider whether a non-audio or non-video method can meet the purpose. |
For each option, compare its fit with the stated purpose, the amount and sensitivity of information collected, duration and coverage, potential impact on people at home, and whether workers can understand or challenge the records. The ICO advises targeting monitoring to risk areas and limiting it to places or contexts where expectations of privacy are lower.
How should an employer design a fair monitoring policy?
- Define the problem and evidence. Write down the specific issue to solve and what shows it exists. Separate an evidenced need—such as inaccurate start-time records—from a general ambition to measure activity.
- Compare proportionate methods. Identify options that could address the issue, then select the least intrusive one that can achieve the aim. Record why broader or more invasive alternatives are unnecessary.
- Assess privacy risks before collection begins. Consider whether monitoring could capture personal correspondence, family activity, sensitive information, union communications or data about people who are not workers. Carry out a data protection impact assessment (DPIA) where appropriate, particularly for intrusive monitoring. If the DPIA finds a high residual risk that cannot be reduced, the ICO says the employer must consult it before proceeding.
- Identify the lawful basis and any additional data conditions. The European Data Protection Board’s GDPR overview describes six possible legal bases: consent, contract, legal obligation, vital interests, public interest and legitimate interests. The appropriate basis depends on the specific processing; it is not a menu from which to choose without justification. Special-category data is generally prohibited unless a specified condition applies. In the UK employment context, ICO guidance says worker consent is usually unsuitable because the power imbalance may mean workers do not have a genuine choice.
- Explain the practice before using it. Tell workers what is collected, why it is collected and how the monitoring works. Keep privacy information accurate and communicate changes so workers are not left to guess whether monitoring is taking place.
- Set access, retention and review rules. Decide who may access records, how they are protected, how long they are retained and when the monitoring will be reviewed. Keep the practice tied to its original purpose rather than allowing collected data to become a general-purpose record of workers’ private lives.
What should an employee monitoring policy explain?
A useful policy should let a worker understand the practice without having to infer it from software behavior. It should explain the purpose and lawful basis for the processing, the information collected, the method and circumstances of collection, who can access the information, how long it is retained, and how workers can ask questions or challenge inaccurate records. It should also describe meaningful changes to the practice and explain whether a supplier handles the data.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Who is responsible when a monitoring tool comes from a vendor?
Buying software does not transfer an employer’s accountability for the monitoring it chooses. In the ICO’s account, an employer is often the data controller and the supplier the processor, though a provider that uses information for its own purposes may be a controller for that processing. Employers should obtain enough information about the service to assess it, determine the parties’ roles, and put required terms in a written contract or service agreement.
Before adopting a tool, check what data it collects, whether the provider uses it for its own purposes, what security and access controls apply, and whether retention can be managed consistently with the policy. A vendor’s description of a feature does not establish that the employer’s particular use of it is necessary or proportionate.

Which laws apply to remote employee monitoring?
There is no worldwide checklist in the UK and EU guidance discussed here. The ICO material concerns UK data protection and employment monitoring; the EDPB page is a general GDPR overview. Employers with workers in multiple places should check requirements for every relevant worker location and get local advice about specific methods. UK ICO employment-monitoring guidance is marked as under review following changes made by the Data (Use and Access) Act, so readers should check the current guidance before relying on a particular interpretation.
A U.S. Department of Labor release dated July 22, 2026, addresses a narrower Fair Labor Standards Act timekeeping question: whether specified remote-work activities—receiving pages, calling clients and coworkers to schedule appointments, and traveling to a first client appointment—count as worktime employers must record and pay. That release does not establish general rules about webcam, keystroke, email or location monitoring.
