How to Monitor Pricing Compliance Across Retail Locations

Monitor pricing compliance as a recurring control: compare the price customers see with the current price record and the amount charged, record each mismatch, assign a correction, and recheck it. Use a consistent sample across stores and departments, with extra checks after price changes and promotions. In the United States, legal requirements vary by jurisdiction; NIST’s Examination Procedure for Price Verification (EPPV) is an inspection method, not a law or a universal safe-harbor threshold.

What a pricing compliance check should cover

A useful check follows a product’s price through the customer journey, from the shelf or advertisement to checkout. Confirm which price is expected for that store, sales channel, date, and customer eligibility, then compare it with every applicable customer-facing representation and the amount charged.

  • Shelf tags and signs: Check the displayed price against the current store price record.
  • Promotions and advertised offers: Verify the offer’s dates, qualifying items, required purchase quantity, and any other stated conditions. Test loyalty or member pricing when it applies.
  • Checkout: Scan or enter the sampled item and record the price returned by the point-of-sale system. A correct shelf tag alone does not establish that checkout is correct.
  • Unit prices: Check the calculation, unit and abbreviation, consistency across comparable products, required category coverage, and whether the label reflects current retail and unit prices.
  • Electronic shelf labels and online listings: Compare the content customers actually see with the relevant current price record and effective time. Include digital channels that fall within the retailer’s monitoring scope.

For unit-price audits, NIST Special Publication 1181 (2025) recommends applying clarity and accuracy principles to electronic shelf labels and extending unit-pricing recommendations to retail formats including e-commerce.

Build a repeatable monitoring workflow

1. Define the authoritative price and its owner

For each store and channel, identify the record that determines the expected price: for example, the point-of-sale price file, promotion record, loyalty offer, unit-price data, or digital price feed. Specify how effective dates and times are handled, who maintains each source, and which record controls if sources disagree. The exact data model is retailer-specific; the important operational point is that auditors need a current, identifiable expected price to compare with what customers see and pay.

2. Set a sampling plan by location, department, and risk

Checking every item on every visit may not be practical. Establish a recurring sample that spreads coverage across locations, departments, and products, and record what was selected and completed. Combine random selections with targeted checks after events that can introduce errors, such as a promotion starting or ending, a price-file upload, an assortment change, or a label reset.

NIST’s EPPV uses randomized and stratified sampling to evaluate pricing practices across a store. It can inform an inspection approach, but it does not establish a retailer’s required audit frequency or a universal percentage of errors that is legally acceptable.

3. Compare each representation with the expected price

At each sampled item, record the visible shelf or sign price and test the checkout result. Include promotional and loyalty conditions when relevant rather than treating every displayed number as an unconditional price. For unit prices, verify the underlying arithmetic as well as the displayed unit, abbreviation, category coverage, and consistency across like products. For electronic labels and online representations, include the actual displayed content and whether the price update took effect when expected.

4. Record exceptions and assign corrections

Use a shared exception log so that a finding can be understood and resolved by someone who did not perform the check. A practical record includes:

  • Store, department, date and time, item identifier, and the auditor or source of the finding.
  • Expected price, observed shelf or sign price, and checkout result if tested.
  • Promotion or loyalty conditions, including the applicable dates or eligibility.
  • Evidence such as a label image, receipt, or relevant system record.
  • Severity, assigned owner, corrective action, completion time, and recheck result.

Classify the cause where possible—for example, a shelf-label error, stale promotion, incorrect source data, checkout configuration issue, unit-price calculation problem, or unclear customer-facing communication. Correct the customer-facing information and relevant system data under the retailer’s process, then recheck the item. Investigate repeat exceptions by location, department, and change event. Internal measures such as initial error rate and time to correction can help manage the program, but they are not legal thresholds unless an applicable law makes them so.

5. Review performance locally and centrally

Store managers can own local corrections and rechecks; corporate teams can compare recurring causes and control performance across locations. NIST SP 1181 (2025) recommends unit-pricing audit programs at both corporate and store levels. Use trend reviews to direct follow-up sampling rather than relying only on a single store-wide result.

Map the rules for every jurisdiction

Retail pricing rules differ by state. NIST’s state-law overview says weights-and-measures agencies generally enforce state pricing laws, while its price-verification FAQ says the FTC has jurisdiction over most advertising and pricing practices and that every state has price-verification laws or regulations prohibiting inaccurate or deceptive pricing practices. A retailer operating in multiple states should identify the responsible authority and applicable rules for each location, then have appropriate legal or compliance staff resolve jurisdiction-specific questions.

NIST describes the EPPV as an inspection procedure, not a law. Its results must be evaluated against the federal or state laws and regulations that apply. An EPPV error rate is a guideline for evaluating pricing practices, not an allowance that makes a mismatch acceptable or excuses correction. Do not treat any single national audit threshold as proof of compliance everywhere.

NIST’s January 2024 survey notice quotes this model provision from the Uniform Weights and Measures Laws: “No person shall misrepresent the price of any commodity or service sold, offered, exposed, or advertised for sale by weight, measure, or count, nor represent the price in any manner calculated or tending to mislead or in any way deceive a person.” This is model language quoted by NIST, not a claim that every state uses that exact wording.

Jurisdiction matrix to maintain

Keep a location-level register rather than assuming one state’s requirements apply to all stores. Have qualified staff fill in and verify the actual rules and contacts for each jurisdiction.

Field What to record
Jurisdiction State or other applicable jurisdiction for each location and sales channel.
Responsible authority The weights-and-measures or other agency identified for jurisdiction-specific questions.
Applicable requirements Verified pricing, unit-pricing, advertising, inspection, and recordkeeping requirements, with effective dates and an internal source of confirmation.
Control owner The role responsible for maintaining the entry and communicating changes to stores.
Last review Date reviewed and the person or team that confirmed the entry.

Choose tools that support the control

A basic audit can be run with staff, a sampling list, access to the current price record, and checkout tests. Technology can reduce effort or make exceptions easier to manage, but it is only useful if it retrieves the correct price for the location, channel, promotion, and effective time being tested.

Approach Useful for Important limitation or validation
Manual audit with price file and checkout test Starting a controlled program or investigating a small targeted sample. Requires a disciplined sampling record and reliable access to current expected prices.
Handheld barcode scanner Looking up an item’s posted or advertised price against store computer data; the FTC’s scanner report describes it as a way to reduce labor compared with other manual checking methods. A scanner does not know the correct price on its own. The workflow must connect it to the retailer’s current price data. The FTC report is historical and does not establish current equipment costs or market rankings.
Phone-camera audit tied to a catalog Capturing shelf-label information and comparing it with a retailer catalog across locations. AisleOptix describes a smartphone workflow comparing shelf tags with Shopify prices and aggregating results across locations; this is a vendor description, not an independent product evaluation. Verify integrations and current terms directly.
Customer price-check kiosk Letting shoppers check a price themselves. A kiosk can support customer self-service but does not replace internal shelf-label and checkout audits. AML describes StoreScan software and kiosk-based price verification; verify current capabilities and terms with the vendor.
Dedicated audit software Centralizing samples, evidence, exception routing, corrections, and trend reporting. Validate that the software supports the retailer’s price sources, effective times, promotions, devices, connectivity, workflows, and reporting needs.

When evaluating any system, check its connection to the authoritative POS, ERP, e-commerce, or pricing data; how it handles promotions and effective times; how store and SKU coverage is assigned and measured; what evidence it retains; and whether it supports correction ownership, rechecks, and central reporting. Also confirm device compatibility, connectivity needs, deployment effort, training, and ongoing cost. Vendor descriptions establish what vendors say their products do, not independent proof that a tool will fit a particular retailer.

Capture online price evidence when it helps

For online representations, a dated record of what a customer-facing page displayed can supplement the price file and checkout test. A screenshot is evidence of page content at capture time; by itself it does not establish the applicable offer conditions, the price charged, or legal compliance. Keep the URL and capture time with the record, and use a separate test to verify checkout where needed.

For a U.S. field survey conducted in 2024, NIST and the National Conference on Weights and Measures report more than 7,400 inspections across 26 states and 20 local and county jurisdictions. That is a count of survey activity, not an error rate or a current estimate of retail compliance. NIST’s January 2024 notice described statistics to be collected, but no final national price-accuracy percentage or overcharge rate is established here.
