The practical answer: build a role-and-data-flow compliance map, then apply the payment-brand and acquirer rules for PCI DSS alongside the legal requirements of each country. PCI DSS is a global technical and operational baseline, not a universal legal safe harbor. A merchant, processor, bank, payment gateway, account-information provider, authorised payment-system operator and data controller can have different obligations, even when they handle the same transaction.

Start by identifying every role your organisation performs, where payment and personal data travels, which vendors can access it, and which entity controls your acquiring or payment programme. Confirm the required PCI DSS scope and validation method with the relevant acquirer, payment brands and a qualified assessor. Then map the US obligations that apply to your business and states, the UK Payment Services Regulations and UK GDPR layers where relevant, and India’s Reserve Bank of India (RBI) directions for covered payment-system providers, non-bank payment-system operators and domestic digital-payment authentication.

Why one compliance certificate cannot cover three countries

Payment compliance is a stack of obligations rather than one licence. The same organisation might be a merchant for its own sales, a data controller for customer information, a processor for a marketplace, and a technology provider connected to a payment service. Each role changes the rules, contracts and evidence you need.

PCI DSS provides a common card-data baseline. The PCI Security Standards Council describes it as “a baseline of technical and operational requirements designed to protect payment account data.” Its audience includes entities that store, process or transmit cardholder data (CHD) or sensitive authentication data (SAD), and entities able to affect the security of the cardholder-data environment (CDE). Payment brands, acquirers and other organisations that administer compliance programmes determine whether an entity must comply with PCI DSS and how it must validate compliance.

#1 Best Overall
Yubico - Security Key C NFC - Basic Compatibility - Multi-Factor authentication (MFA) Security Key and passkey, Connect via USB-C or NFC, FIDO Certified
  • POWERFUL SECURITY KEY: The Security Key C NFC is the essential physical passkey for protecting your digital life from phishing attacks. It ensures only you can access your accounts.
  • WORKS WITH 1000+ ACCOUNTS: Compatible with Google, Microsoft, and Apple. A single Security Key C NFC secures 100 of your favorite accounts, including email, password managers, and more.
  • FAST & CONVENIENT LOGIN: Plug in your Security Key C NFC via USB-C and tap it, or tap it against your phone (NFC) to authenticate. No batteries, no internet connection, and no extra fees required.
  • TRUSTED PASSKEY TECHNOLOGY: Uses the latest passkey standards (FIDO2/WebAuthn & FIDO U2F) but does not support One-Time Passwords. For complex needs, check out the YubiKey 5 Series.
  • BUILT TO LAST: Made from tough, waterproof, and crush-resistant materials. Manufactured in Sweden and programmed in the USA with the highest security standards.

That programme decision is different from national law. PCI validation does not automatically satisfy privacy, operational-resilience, outsourcing, breach-notification or financial-services rules. Conversely, a company can have legal obligations even when its payment architecture minimises its direct card-data exposure. Treat PCI DSS as a baseline and a contractual requirement where applicable, then add country, sector and role-specific controls.

Step 1: classify every role your organisation performs

Write down all roles, not just the label used by your sales team. A single legal entity may occupy several categories in one payment flow.

Role Typical responsibility Questions that change scope
Merchant Accepts payment for its own goods or services. Does it host payment pages, receive card numbers, operate recurring billing or use a point-of-sale system?
Payment service provider or processor Processes transactions or provides payment functionality to other businesses. Which payment data, authentication data and cryptographic keys are handled, and for which customers?
Acquirer or issuer Acquires merchant transactions or issues payment instruments. Which payment-brand programme and regulatory permissions govern the activity?
Payment gateway Routes or supports authorisation messages between merchants and payment participants. Does the gateway store account data, provide hosted fields, or connect to other service providers?
Account-information service provider (AISP) Provides account-information access, generally with user permission. In the UK, is the service seeking FCA authorisation or registration under the Payment Services Regulations 2017?
Payment-initiation service provider (PISP) Initiates payments from a user’s account. Does the UK service fall within the FCA authorisation or registration guidance for payment-initiation services?
Authorised non-bank payment-system operator (PSO) Operates a payment system under RBI authorisation in India. Is the operator classified as large, medium or small under the 2024 cyber-resilience directions?
Data controller or processor Determines purposes and means of processing personal data, or processes it for another organisation. Which entity decides the purpose, and what written terms govern security, subprocessors and incidents?

Document the legal entities, branches and contractors involved. Do not assume that a technology vendor is regulated in the same way as the payment institution that hires it. For an applicability opinion, regulators, acquirers, payment brands, counsel and qualified assessors need the actual transaction design and organisational roles.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 2: draw the payment and data flows

Create a flow for each channel and transaction type. A single diagram for “online payments” usually hides the systems that determine compliance.

  • Channels: web checkout, mobile application, point of sale, telephone or mail order, recurring billing, refunds, wallets and domestic or cross-border transactions.
  • Data elements: cardholder data, sensitive authentication data, payment tokens, bank-account information, authentication credentials, identity data and other personal data.
  • Systems: browser or app, checkout page, application servers, payment gateway, processor, acquirer, fraud tools, customer-support tools, analytics, logs, backups and disaster-recovery environments.
  • Locations: country of collection, processing regions, storage regions, support access locations and the location of subprocessors.
  • Connections: APIs, webhooks, batch files, point-of-sale networks, remote administration, software updates and vendor links.

Mark where data is collected, transformed, encrypted, tokenised, displayed, logged and deleted. Record whether a provider receives the primary account number, only a token, or a one-time payment result. Keep separate flows for India-issued domestic digital payments and cross-border card-not-present transactions because India’s authentication directions include transaction-specific provisions.

PCI DSS: set scope and validation with the payment programme

What PCI DSS covers

PCI DSS applies to the cardholder-data environment and to people, processes and technologies that store, process or transmit CHD or SAD, or could affect its security. The current PCI Security Standards Council materials identify PCI DSS v4.0.1 among the current documents; check the Council’s standards library and the payment programme’s instructions before adopting a version-specific checklist.

Scope is determined by actual technical connections and security impact, not by the marketing description of a service. A hosted checkout can reduce the systems that handle card numbers, but the merchant may still have security responsibilities for the page, scripts, redirection, administrative access, incident response and the service provider’s evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do I still need PCI DSS if I use a payment processor?

Usually, outsourcing payment processing does not make the merchant automatically exempt. The processor may carry its own PCI responsibilities, while the merchant remains responsible for the parts of its environment and for confirming that the service provider’s compliance status and responsibilities are documented. The exact validation route depends on the payment channel, acquirer, brands and contractual programme.

Ask the acquirer or payment brands which Self-Assessment Questionnaire (SAQ), Report on Compliance (ROC), Attestation of Compliance, external scanning and assessor requirements apply. Do not select an SAQ solely because a vendor recommends it. A qualified security assessor (QSA) can assess PCI DSS compliance; an approved scanning vendor (ASV) can perform external vulnerability scans required by the applicable PCI DSS programme.

PCI scope decisions to record

Decision Evidence to retain
Where account data enters the environment Annotated architecture and data-flow diagrams, including hosted pages and point-of-sale devices.

What a provider handles Current provider attestation, service description, responsibility matrix and contract.
How compliance is validated Acquirer or brand instructions, selected SAQ or ROC, ASV reports, QSA reports and signed attestations.

Maintain the exact PCI DSS version and supporting documents used. A change to checkout technology, recurring billing, a new acquirer or a new integration can change scope and validation even when the customer experience appears unchanged.

United States: build a business- and state-specific legal map

The available authoritative material supports PCI DSS as the cross-border card-data baseline and confirms that validation obligations are administered through payment brands, acquirers or other compliance-programme managers. It does not provide a complete inventory of US federal and state requirements. Therefore, do not describe PCI DSS as a universal US statute, and do not claim that PCI DSS resolves every US privacy, breach, financial-sector or state-law duty.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A defensible US workflow

  1. Define the footprint: list the states where the organisation is established, has employees, targets customers, operates facilities or processes data.
  2. Identify regulated status: note whether the organisation is a merchant, financial institution, money-service business, technology provider, healthcare-related business or another regulated entity.
  3. Map information: distinguish card data, bank information, authentication data, identifiers and other personal data, including data held by vendors.
  4. Confirm PCI programme terms: obtain the acquirer and payment-brand validation requirements and document the approved scope.
  5. Obtain legal analysis: have counsel or a qualified compliance specialist map the federal and state privacy, security, breach, financial and sector requirements that apply to the actual business.
  6. Align contracts and response: assign incident-notification duties, evidence access, retention, deletion and cooperation obligations to each provider.

A US conclusion must be qualified by the organisation’s locations, customers, products, regulated status, payment channels and data processed. Without those facts, a statement that a specific US law applies—or does not apply—is unreliable.

United Kingdom: separate FCA payment-service duties from UK GDPR security

When the FCA security guidance applies

The Financial Conduct Authority page on security requirements is directed to providers of account-information services and payment-initiation services seeking authorisation or registration under the Payment Services Regulations 2017. It was first published on 2 February 2017 and was last updated on 10 February 2023. It is not a general merchant checklist.

For an applicant, the FCA says: “As part of the authorisation and registration process, you will need to demonstrate that you have implemented effective security systems and controls, access to sensitive payment data, incident management and business continuity.” The guidance calls for security policies and risk assessment; processes for security incidents and complaints; continuity arrangements; classification, access control and monitoring for sensitive data; and consideration of outsourcing arrangements.

After authorisation, a covered payment service provider must identify, classify and manage risks, detect, manage and resolve major incidents, and notify the FCA of major incidents. Build an evidence set that shows ownership, testing, decisions and remediation rather than a policy document with no operating records.

UK GDPR is a distinct security layer

Where payment processing involves personal data, the UK GDPR requires appropriate technical and organisational measures based on risk. The Information Commissioner’s Office (ICO) expressly warns that PCI DSS compliance does not necessarily equal compliance with the UK GDPR security principle. The ICO states: “Although compliance with the PCI-DSS is not necessarily equivalent to compliance with the UK GDPR’s security principle, if you process card data and suffer a personal data breach, the ICO will consider the extent to which you have put in place measures that PCI-DSS requires particularly if the breach related to a lack of a particular control or process mandated by the standard.”

Apply the UK GDPR layer by identifying the controller and processor for each activity, putting appropriate security and incident terms in written processor contracts, limiting access, minimising data, controlling retention and documenting breach escalation. Evaluate international transfers and the locations from which support staff or subprocessors can access personal data. The ICO notes that some guidance is under review following the Data (Use and Access) Act 2025, so verify the current official wording and any updated statutory interpretation when implementing controls.

UK outsourcing evidence

  • Named owner for each outsourced payment or security function.
  • Due-diligence records, current assurance reports and subprocessor lists.
  • Contractual security requirements, audit rights, incident deadlines and continuity obligations.
  • Access approvals, monitoring, removal of access and evidence of periodic review.
  • Test results for major-incident response and business continuity.

India: apply three RBI layers according to role

Payment-system data storage

RBI’s notification dated 6 April 2018, “Storage of Payment System Data,” directs covered system providers to store payment-system data in India. Its central sentence is: “All system providers shall ensure that the entire data relating to payment systems operated by them are stored in a system only in India.” The notification describes the data as full end-to-end transaction details or information collected, carried or processed as part of a message or payment instruction.

For the foreign leg of a transaction, the data may also be stored in the foreign country if required. The notification’s six-month implementation period, 15 October 2018 reporting date and subsequent audit timetable are historical dates, not new deadlines. Determine whether the organisation is a covered system provider, what data is in scope and whether later RBI directions or amendments change the analysis. Do not extend the direction automatically to every merchant, software vendor or cloud service.

Cyber resilience for authorised non-bank PSOs

The RBI Master Directions on Cyber Resilience and Digital Payment Security Controls for non-bank Payment System Operators, published 30 July 2024, apply to authorised non-bank PSOs. Their phased implementation dates are:

PSO classification Stated implementation date
Large 1 April 2025
Medium 1 April 2026
Small 1 April 2028

The directions call for a Board-approved organisational policy and controls addressing cyber and technology risk. They also address links to unregulated entities such as gateways, third-party service providers and vendors. Adherence by those linked entities is subject to mutual agreement; a vendor should not be treated as directly regulated in the same way as the PSO merely because it supplies technology.

Confirm the current RBI-hosted text, definitions and classification before creating a control-by-control programme. For a covered PSO, evidence should connect Board approval, risk assessment, third-party oversight, access management, detection, response, recovery and testing to the applicable direction.

Authentication for domestic digital payments

The RBI Authentication Mechanisms for Digital Payment Transactions Directions, dated 25 September 2025, apply to payment-system providers and participants, including banks and non-banks, for domestic digital-payment transactions unless a specified exemption applies. They require at least two distinct authentication factors unless an exception applies and state 1 April 2026 as the compliance date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not implement “two-factor authentication everywhere” as an exceptionless rule. Check the directions’ annexures and transaction-specific provisions, including instructions for certain cross-border card-not-present transactions using India-issued cards. Issuers have responsibilities for the robustness and integrity of authentication and for data-protection adherence under the Digital Personal Data Protection Act, 2023.

Record the transaction type, payer and payee location, authentication factors, exemption relied on, risk decision and monitoring result. Re-check the RBI instrument and any amendments before changing production authentication, because the directions surfaced through legal-document hosting and their official text and exemptions should be confirmed from RBI.

A seven-step operating workflow across all three markets

1. Create the role register

List legal entities, payment roles, regulated permissions, countries served, acquirers, payment brands and data-controller or processor status. Identify combinations, such as a merchant that also operates a marketplace or a PSO that uses a third-party gateway.

2. Maintain authoritative flow diagrams

For every channel, record collection, processing, storage, access, transfer, deletion, authentication and vendor connections. Include backup, logging, support and disaster-recovery paths.

  • BUILT TO LAST: Made from tough, waterproof, and crush-resistant materials. Manufactured in Sweden and programmed in the USA with the highest security standards.

3. Set PCI scope and validation

Use the current PCI DSS and supporting documents. Obtain written confirmation of the applicable SAQ, ROC, attestation, ASV scanning and QSA expectations from the acquirer or payment brands. Keep provider responsibility matrices and evidence that outsourced services remain monitored.

4. Add jurisdictional overlays

For the US, obtain a business- and state-specific legal map. For the UK, map FCA and Payment Services Regulations duties when the organisation is an AISP or PISP, then separately assess UK GDPR security, processor terms and transfers. For India, assess RBI storage, PSO cyber-resilience and authentication directions according to the entity’s role and transaction types.

5. Contract and govern vendors

Contracts should define data roles, permitted locations, security controls, incident notification, evidence and audit access, subprocessors, continuity, deletion, return of data and flow-down obligations. Covered Indian PSOs should address linked gateways and vendors expressly; UK organisations should align outsourcing and processor terms with their FCA and UK GDPR responsibilities.

6. Keep evidence current

Retain inventories, diagrams, risk assessments, Board or management approvals, access records, vulnerability scans, penetration and recovery tests, incident records, attestations, processor contracts and dated regulatory versions. Evidence should show that controls operated during the period being assessed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Reassess after change

Trigger a review when adding a payment channel, country, acquirer, provider, product, data type, cloud region or acquisition, or when a standard, exemption or regulatory direction changes. Dates and implementation statuses are not permanent assumptions.

How to compare payment architectures and providers

There is no universally best processor or architecture. Compare options against the same evidence-based axes:

Axis What to compare Why it matters
Card-data exposure Primary account number handling, tokenisation, hosted fields, logs and support access. Determines PCI scope, control burden and breach impact.
Geography Collection, processing, storage, backup and support locations. Can affect India storage analysis, UK transfers and US state obligations.
Regulatory role Merchant, processor, gateway, bank, PSO, AISP or PISP status and permissions. Determines which regulator and programme requirements apply.
Authentication Factors, step-up logic, exemptions, recovery and monitoring. Must match India’s applicable domestic-payment rules and the transaction risk.
Third-party access Subprocessors, administrative paths, support locations and contractual flow-down. Shows whether outsourced risk is controlled rather than merely transferred.
Incident and continuity evidence Notification commitments, response tests, recovery objectives and assurance reports. Supports FCA, UK GDPR, PCI DSS and operational-resilience decisions.
Validation evidence Current PCI attestation, scope statement, scan results, audit reports and remediation records. Lets the customer verify claims instead of relying on a logo or sales statement.

Evidence package and governance checklist

  • Role register covering every legal entity and payment function.
  • Current data-flow and network diagrams for each channel.
  • PCI DSS scope statement, validation instructions and signed assessment documents.
  • Asset inventory, data inventory, retention schedule and access-control reviews.
  • Risk assessments covering payment systems, personal data, vendors and geographic transfers.
  • Board or senior-management approvals required by the applicable policy or RBI direction.
  • Vendor due diligence, contracts, subprocessor register and current assurance evidence.
  • Vulnerability scans, penetration tests, secure-development records and remediation tracking.
  • Authentication design, factor inventory, exemption decisions and monitoring results for India-relevant transactions.
  • Incident playbooks, contact lists, notification decisions, lessons learned and continuity tests.
  • Dated copies or references to the PCI DSS version, FCA guidance, ICO guidance and RBI instruments used.

Common failure modes and how to correct them

“Our processor is compliant, so we have no PCI work.”

Why it fails: provider compliance does not define the merchant’s entire environment or validation route.

Correction: obtain the acquirer or brand requirements, map the merchant’s systems and document the provider’s responsibilities and current evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“PCI DSS proves UK GDPR compliance.”

Why it fails: the ICO treats PCI DSS and the UK GDPR security principle as related but not equivalent.

Correction: perform a separate personal-data risk assessment, set controller and processor duties, minimise data, control access and maintain breach escalation and transfer records.

“The India storage deadline was in 2018, so the rule is obsolete.”

Why it fails: the implementation and reporting dates are historical, but the underlying direction and later regulatory developments still require an applicability check.

Correction: determine whether the organisation is a covered system provider, identify full end-to-end payment data and verify current RBI updates and amendments.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Every Indian digital payment must use the same two factors.”

Why it fails: the 2025 RBI directions contain specified exemptions and transaction-specific provisions.

Correction: classify the transaction, check the annexures, document the applicable exemption or factors, and confirm the 1 April 2026 compliance status.

“A vendor connected to a PSO is regulated exactly like the PSO.”

Why it fails: the 2024 RBI directions address links to unregulated entities and make adherence subject to mutual agreement.

Correction: define contractual controls, evidence, access, incident and continuity obligations for each linked entity, while separately confirming the PSO’s own regulatory duties.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A generic US checklist covers all states.”

Why it fails: applicability depends on the organisation’s footprint, sector, customers and data, and the available material does not establish a complete US legal inventory.

Correction: obtain a tailored federal and state analysis from counsel or a qualified compliance specialist, then align it with PCI and contractual requirements.

What a defensible compliance conclusion looks like

A useful conclusion names the organisation’s roles, channels, data, locations, providers and regulators. It states the PCI DSS scope and validation route confirmed by the payment programme; identifies separate US legal analysis; distinguishes FCA payment-service obligations from UK GDPR security; and records which RBI storage, PSO-resilience and authentication provisions apply in India. It also lists evidence owners, review dates, open risks and the event that will trigger reassessment.

That approach answers the operational question—how to meet requirements—without claiming that one certificate, processor or architecture makes a multinational payment operation compliant everywhere.
