How to Manage U.S. Retirement Accounts and Benefits When Moving to India

Moving to India does not, by itself, determine how your U.S. retirement money will be taxed. The result depends on your U.S. tax status, Indian tax residence for each year, the type of account, whether you keep the money invested or take a payment, the relevant U.S.–India treaty provisions, and the documentation your U.S. payer has on file.

Before changing an address, requesting a rollover, or taking a distribution, make an inventory of every account and benefit. Then coordinate U.S. tax and withholding, Indian tax and Section 89A, treaty claims, and foreign-tax-credit records. The checklist below is designed to prevent an irreversible transaction based on an assumed treaty exemption.

Start with residency and citizenship, not the account balance

U.S. citizens and U.S. tax residents can remain subject to U.S. tax on worldwide income under domestic law even after relocating. A green-card holder, a person meeting a U.S. residence test, and a nonresident alien do not have the same filing and withholding rules. India separately determines tax residence for each Indian tax year, which generally runs from April 1 through March 31. Your move date can therefore produce a split year and different treatment for different payments.

A treaty residence result is not created simply by renting a home in India. Apply each country’s domestic residence rules first, then the residence and tie-breaker provisions of the U.S.–India income-tax treaty. The treaty’s saving-clause rules can preserve U.S. taxing rights over its citizens and other people covered by the clause. IRS Publication 901 (September 2024) and the IRS foreign-pension guidance both stress that the specific treaty article and the person’s status must be checked.

“If you determine you are a resident of only one of the countries to the treaty under that country’s domestic law, then you should refer to the benefits provided under the relevant treaty article dealing with pensions, annuities, government service, or social security payments.” — Internal Revenue Service, “The taxation of foreign pension and annuity distributions.”

Do not use a friend’s result as a template. Two people who moved on the same date can have different outcomes because one is a U.S. citizen, the other is a nonresident alien, or because one took a lump sum while the other received a periodic pension.

The four decision axes

Question Why it changes the analysis
Who are you for U.S. tax purposes? Citizens, green-card holders, other U.S. residents, and nonresident aliens have different filing, treaty, and withholding positions.
When are you an Indian tax resident? India taxes and reporting obligations depend on residence in each April–March year; the move can create a part-year transition.
What is the account and payment? A traditional IRA, Roth IRA, 401(k), periodic annuity, lump sum, Social Security payment, and public pension can fall under different domestic rules and treaty articles.
What action are you taking? Keeping an account, rolling it over, changing its address, or withdrawing money creates different U.S. payer, Indian timing, and documentation issues.

How should I handle my 401(k) when moving to India?

A move does not automatically require a 401(k) distribution. The practical choice is usually among leaving the balance in the employer plan, making a permitted rollover, or taking a distribution. Each choice must be reviewed in both countries before you act.

Leaving the balance in the employer plan

Ask the plan administrator in writing whether it will maintain an account for a participant with an Indian residential address, how it will authenticate you, and which payment methods are available. Confirm the administrator’s process for updating your address, tax status, beneficiaries, and bank instructions. Ask how it will issue year-end tax reporting and whether a foreign address changes its withholding workflow.

Keeping the account avoids an immediate distribution, but it does not answer future tax questions. A later periodic payment or lump sum still has to be classified under U.S. law, Indian law, and the treaty. Keep the plan’s summary, contribution history, employer statements, and any notices about a forced distribution or termination of the plan.

Considering a rollover

A direct rollover to another U.S. retirement arrangement can change the plan administrator and the account’s rules. Do not assume that a rollover is automatically tax-neutral in India, that every destination account accepts a non-U.S. address, or that the treaty treats the new account exactly like the old one. Have the receiving institution confirm eligibility, identity checks, address requirements, and available investments before you request the transfer.

Ask whether the transaction will be processed as a direct trustee-to-trustee transfer or as a payment to you. A check or wire made payable to you can create different withholding and reporting consequences from a direct transfer. Get the administrator’s written explanation of the transaction code, expected U.S. withholding, and forms it needs before submitting the request.

Taking a 401(k) distribution

Decide whether the payment is periodic or a lump sum, and identify the tax year in both countries. The U.S.–India treaty has separate concepts for pensions and annuities, government service, and social-security-type payments; the label “401(k)” alone does not establish the result. India may use a different tax year from the United States, so the year of U.S. withholding may not match the year in which India includes the income.

Before authorizing payment, ask the payer:

  • Which recipient status it has recorded for you and what address documentation supports it.
  • Which withholding rate it will apply if the payment is sent to India.
  • Whether it needs a particular U.S. tax-status or treaty form, and the validity period of that form.
  • What annual statement, payment detail, and withholding certificate it will issue.
  • Whether it can split a payment, change the frequency, or reverse an instruction before settlement.

Withholding is an amount collected in advance; it is not necessarily your final U.S. or Indian liability. A large distribution can also create a cash-flow problem if the U.S. payer withholds before you can claim treaty relief or a credit.

Suggested 401(k) sequence

  1. Obtain the plan document, current balance, vested amount, contribution and basis records, beneficiary designation, and distribution options.
  2. Tell the administrator the planned move date and Indian address, and ask how it determines foreign-person status.
  3. Obtain a written answer on leaving the account, rolling it over, or distributing it; do not rely on a telephone summary.
  4. Model U.S. withholding, Indian inclusion, treaty position, and cash needed for any tax before selecting a payment date.
  5. After payment, reconcile the amount received with the payer’s statement and preserve proof of tax withheld.

Will India tax my U.S. IRA?

There is no universal answer for a U.S. IRA. A traditional IRA and a Roth IRA have different U.S. tax histories, and a periodic pension-style payment can be analyzed differently from a lump-sum withdrawal. India’s treatment depends on your Indian residence, the character and timing of the payment, and any available treaty relief. The fact that an account is called an “IRA” does not itself establish an exemption or a deferral.

Traditional IRA

Keep records showing contributions, any nondeductible basis, conversions, distributions, and year-end values. When you withdraw, identify exactly what the payer reports and whether the payment is periodic or a lump sum. Ask a cross-border adviser to map that payment to the relevant pension or annuity treaty language and to Indian inclusion rules for the applicable April–March year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Roth IRA

A Roth label also does not guarantee that India will follow the U.S. tax treatment. Preserve the opening date, contribution records, conversion records, and distribution history. Before withdrawing, obtain an India-specific analysis of whether the account or payment qualifies for any timing rule or treaty treatment. Do not describe a Roth withdrawal as tax-free in India without that analysis.

Keeping the IRA versus withdrawing

Keeping the account can defer the payment event, but it may require the custodian to maintain foreign-address and tax-status documentation and may complicate beneficiary or banking arrangements. Withdrawing creates a definite payment year and a possible withholding event. Compare the two choices using your actual residence dates, expected Indian rate, U.S. status, and treaty position rather than a generic online tax calculator.

Why U.S. payer paperwork can determine withholding

IRS guidance on plan distributions to foreign persons says a payer may have to presume that a recipient is foreign when its records and address documentation do not establish U.S.-person status or treaty entitlement. If a foreign recipient has not supplied valid documentation supporting reduced withholding, the guidance describes potential withholding at 30 percent. The payer’s presumption can apply even when you believe you remain a U.S. person or qualify for treaty relief.

Contact every custodian before the first payment. Tell it whether you are a U.S. citizen, green-card holder, other U.S. tax resident, or nonresident alien; provide the requested address and status evidence; and ask what happens if your circumstances change. Do not submit a form copied from another taxpayer. The correct form and certification depend on your status, the payer, the payment, and the treaty claim.

Withholding troubleshooting

  • Unexpected 30 percent withholding: request the payer’s recorded status, the missing or expired document, and its correction procedure. Keep the original payment statement.
  • U.S. address still on file: update the address before requesting a payment; an old address can conflict with your foreign-person certification.
  • Treaty claim rejected: ask which treaty article and factual condition the payer could not verify. A rejected payer claim is not proof that the treaty cannot apply, but it means you need professional review and may have to seek relief through a return.
  • Payment already sent: do not destroy the withholding record. It may be needed for a U.S. return, an Indian foreign-tax-credit claim, or a refund request.

Can I receive U.S. Social Security in India?

Social Security follows a separate rule set from private IRAs and employer plans. Payment logistics and entitlement are questions for the Social Security Administration; the treaty material discussed here addresses a limited tax issue, not every claimant’s eligibility or the ability to receive payments in India.

IRS Publication 915 (2025) identifies a narrow India treaty exception for benefits paid to a person who is both a resident and a national of India, when the benefits are for services to the U.S. government or specified subdivisions or local authorities. That exception does not mean that every U.S. citizen living in India receives U.S.-tax-free Social Security. Determine your domestic U.S. tax position first, then test the exact treaty condition and your Indian treatment.

Before leaving, verify with the Social Security Administration your payment address, bank arrangements, identity checks, withholding election, and how to report a change in residence or citizenship. Keep benefit statements and evidence of any tax withheld separately from retirement-account records.

Could India’s Section 89A prevent a timing mismatch?

Section 89A is an Indian timing provision for certain foreign retirement accounts. The Income Tax Department’s salary guide says a qualifying resident can elect to include eligible account income in the year it is taxed on withdrawal in the notified country, rather than automatically following a different Indian timing rule. This is not a blanket rule for every U.S. IRA or 401(k).

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Conditions to check

  • The account and country must fall within the notified scheme.
  • You must meet the relevant Indian residence requirement for the year.
  • The account must have been opened while you were nonresident in India and resident in the other country.
  • The particular account must qualify; do not infer qualification merely because it is a U.S. retirement account.

Form 10-EE and the continuing election

The department says Form 10-EE is due by the due date for filing the Indian return for the relevant year. Its guide states that the election applies to later years and cannot be withdrawn. Treat that continuing and nonwithdrawable effect as a major decision, not a routine formality. Confirm eligibility, the filing deadline, and the account covered before submitting it.

Build a year-by-year schedule showing the U.S. withdrawal-tax year, the Indian April–March year, account income, distributions, withholding, and any Section 89A election. This schedule helps identify a mismatch before you file and prevents applying the election to an account that is outside the notified conditions.

How foreign-tax credit and treaty relief fit together

Foreign-tax credit and double-tax relief are possible coordination tools, not automatic outcomes. India’s Income Tax Department explains that relief depends on the person’s facts, the income, the tax paid, the year in which it was paid or accrued, and the applicable treaty and domestic rules. A U.S. amount withheld at source may not be creditable in India in the same year or in the same amount as the retirement income is included.

Keep the payer’s withholding statement, proof that the tax reached the U.S. authority, the payment date, exchange-rate method, Indian return schedules, and the treaty position used. Ask whether a credit is being claimed for the same income and year; claiming it twice or in the wrong year can create a notice and interest exposure.

A practical timeline for the move

Before departing the United States

  1. List every IRA, 401(k), pension, annuity, Social Security benefit, and other public benefit, including the custodian and beneficiary.
  2. Record contributions, basis, conversions, distributions, account values, and prior withholding.
  3. Ask each payer whether it accepts an Indian address and what tax-status and treaty documentation it requires.
  4. Obtain advice on residency for the departure year and the first Indian tax year, including the treaty saving clause.
  5. Model the consequences of retaining, rolling over, or withdrawing each account; do not bundle unlike accounts into one decision.
  6. Check whether Section 89A could apply and what Form 10-EE deadline would govern, but do not elect until the account is confirmed as eligible.

During the transition year

  1. Keep a calendar of the move date, days in each country, address changes, payment dates, and account transactions.
  2. Tell payers when your status or address changes and obtain confirmation that their records were updated.
  3. Separate U.S. calendar-year statements from India’s April–March records.
  4. Save the original currency amount, exchange rate, tax withheld, and net amount for every distribution.

Before any large distribution

  1. Identify the payment type and treaty article that may apply; do not rely on the account name alone.
  2. Obtain the payer’s withholding calculation and document requirements in writing.
  3. Estimate Indian tax, possible U.S. tax, cash needed for both, and the timing of any credit or refund.
  4. Have a qualified U.S.–India adviser review the transaction and any Section 89A election before the instruction becomes irreversible.

Records that make a future claim defensible

Maintain a permanent file containing account-opening documents, contribution and basis records, plan and custodian correspondence, address and status certifications, beneficiary forms, distribution confirmations, withholding statements, U.S. and Indian returns, treaty analyses, exchange-rate calculations, and foreign-tax-credit support. Keep evidence of the date each document was supplied and the payer’s response.

Use separate folders for private retirement accounts, employer plans, Social Security, and government-service pensions. That separation prevents a Social Security rule from being mistakenly applied to a 401(k), or a pension treaty provision from being used for a public benefit without checking its conditions.

When individualized advice is worth the cost

Get cross-border advice before a first large withdrawal, rollover to a new institution, Roth conversion, change from U.S. to Indian residence, treaty claim, or Section 89A election. The adviser should review both countries’ domestic rules, the exact treaty article and saving-clause effect, payer documentation, Indian timing, and foreign-tax-credit records. Ask for a written transaction memo that states the assumptions, payment year, residence status, withholding instruction, and documents to retain.

The safest operating rule is simple: classify the person, the country residence, the account, and the payment separately; verify the payer’s paperwork; then choose whether to retain, transfer, or distribute. That process is slower than assuming the move settled the tax question, but it avoids the most expensive errors.
