Having two jobs is not automatically allowed or forbidden: the answer depends on the terms governing each role, the risks of a conflict, and the working-time rules where you live. Before starting or continuing a second job, review both employers’ agreements and policies, follow any disclosure or approval process, keep work and confidential information separate, and check local rules on hours and rest. The legal details below are specific to UK guidance unless stated otherwise.
Start with the documents that govern each job
Collect each offer letter, contract, written statement of particulars, and any handbook or policy that applies to you. A job contract may be written or unwritten, and accepting an offer can create a contract. UK government guidance says both parties must follow the contract until it ends or its terms change, usually by agreement. GOV.UK explains employment contracts and conditions.

Search the documents for “outside employment,” “secondary employment,” “exclusive service,” “consent,” “disclosure,” “conflict,” “competitor,” “confidential information,” “inventions,” and “availability.” Check whether a handbook or separate policy is incorporated into the agreement, and note which document sets the process if requirements differ.

Check whether you must disclose the second job or get permission
Disclosure and permission are different obligations. One agreement may require you to tell the employer about outside work; another may require approval before you begin. Follow the actual wording and process rather than assuming that telling a manager is enough—or that silence means approval.

If the requirement is unclear, ask HR, your manager, or the designated ethics contact in writing before starting. Explain the second role sufficiently for the employer to assess scheduling and conflicts, but do not share the other employer’s confidential information. Keep the written decision with your employment documents.
Approval requirements can depend on the employer and role. For example, the U.S. Food and Drug Administration says certain FDA employees need prior approval for specified outside activities to prevent conflicts with their government duties. That agency-specific rule does not establish a requirement for all U.S. public employees or private-sector workers. See the FDA’s outside-activity guidance.

Assess conflicts of interest and protect confidential information
Consider whether the employers compete, share clients, regulate or supply one another, or have interests that could make either employer question your divided loyalties. Also ask whether either job gives you access to nonpublic pricing, customer, product, security, or strategy information that would matter to the other.
Keep each job’s work separate:
- Use separate work accounts, devices, storage, calendars, and workspaces where practical.
- Do not use one employer’s paid time, systems, equipment, or confidential information for the other job.
- Do not transfer files or reuse nonpublic information between employers.
A UK government report discussing exclusivity clauses identifies access to confidential commercial information and work for a competitor as examples that may be relevant to conflicts. It also notes that confidentiality clauses can protect confidential information. These examples are not a universal test of whether a particular restriction is enforceable; that depends on the facts and applicable law. Read the UK government report.

Check the combined hours and rest rules that apply where you work
For workers covered by UK working-time rules, hours in multiple jobs should normally average no more than 48 a week, usually over a 17-week reference period. Some work can count even if it is unpaid when requested by the employer; treatment of travel, breaks, and on-call time varies. Certain jobs have different reference periods, and an opt-out or reducing hours may be relevant if the average exceeds the limit. Check the rules for your role and circumstances in the GOV.UK guidance on calculating working hours.
Do not assume that the rules in one country apply elsewhere. Your jurisdiction, worker status, occupation, employer sector, and any special rules attached to your role can all matter. Check the local working-time and rest requirements for both jobs.

Check whether UK exclusivity protections apply
UK guidance identifies protections against exclusivity clauses for workers on zero-hours contracts and workers whose earnings are at or below the lower earnings limit. GOV.UK also says that zero-hours measures in the Employment Rights Act 2025 are not in force until the Act is fully implemented. The scope and timing can change, so consult the current GOV.UK zero-hours contracts guidance rather than assuming that a general restriction is valid or invalid.

Recheck when either role changes
Repeat the review if your duties, clients, hours, reporting line, or employer policies change. New responsibilities can create an overlap that did not exist when you first accepted the second job, and a schedule change can affect working-time compliance.
If a clause is disputed or unclear, or you are concerned about dismissal, statutory rights, or a protected disclosure, get advice from a qualified employment adviser in the relevant jurisdiction. The UK and U.S. examples above do not settle an individual case or establish rules for other countries.
