Build your Halloween gaming stream playlist around the event’s pace, clear every track for the platforms and formats you plan to use, then test how music, game audio, voices, and any saved VOD will sound together. A playlist in a consumer music app is not a streaming license: Twitch says a music subscription or purchased CD or record typically does not grant permission to share the music on Twitch.
Start with the watch party’s sound arc
Plan music around what viewers will be doing, not just around a list of Halloween songs. A watch party may move between introductions, menus, active gameplay, breaks, guest conversation, and a closing. Give those moments distinct musical roles so you can lower or stop music when the game or conversation needs attention.

- Arrival: Set an eerie tone while people join and you explain the plan.
- Lobby or intermission: Use a livelier mood during menus, breaks, or transitions.
- Gameplay: Favor material that leaves space for game sounds, commentary, and guest voices. Instrumental or low-lyric tracks may help, but no genre is inherently cleared for streaming.
- Wind-down: Keep a short closing segment ready so the event can end cleanly.
Keep these as separate, ordered blocks rather than one long, uninterrupted mix. That makes it easier to skip a segment when a match runs long, a guest starts talking, or an unexpected moment changes the mood.

For each segment, ask whether the music supports the game and whether viewers can still hear the host, guests, and important gameplay cues. Make music independently controllable where possible: you should be able to start, stop, or lower it without changing microphone or game audio. Short blocks and deliberate transitions usually give you more control than a single continuous sequence.

Do not build the playlist around commercial songs until you have verified the rights for the exact use. A track can fit the mood perfectly and still be unsuitable for a live broadcast, a saved VOD, or clips.
Clear every track for every destination
For each song or recording, note who controls it, what permission you rely on, and whether that permission covers each intended platform and format: live streaming, VODs, and clips. Check the terms that apply to the recording and composition, not just the service where you found the track.

Twitch’s guidance is direct: “Most importantly, don’t play recorded music in your stream unless you own all rights in the music, or you have the permission of the necessary rights holder(s).” Twitch’s music guidance also recommends checking a game’s EULA when its music will be audible. A subscription to a music service or a purchased CD, record, or other physical medium typically does not give you the right to share that music on Twitch, according to Twitch’s music policy.
For game audio, distinguish the game’s original score from licensed third-party music embedded in the game, such as an in-game radio station. Do not assume that permission for one covers the other, or that a game’s general streaming allowance covers every track. Check the specific game and publisher terms, and use a stream-safe setting or separate music control only if the game provides one and its instructions support your use.

Twitch’s 2020 guidance named music-library services as examples of possible alternatives. Treat any library as a lead to investigate, not blanket clearance: verify the current terms for the specific track, platform, live use, VODs, clips, and any commercial use that applies to your channel.
Use a track-by-track clearance checklist
- Identify the recording and composition, and the rights holder or source.
- Record the specific permission or license you are relying on.
- Confirm it covers your live stream and every destination you plan to use.
- Check separately whether VODs and clips are covered.
- For in-game music, check the game’s terms and whether a track is original score or third-party licensed music.
Set up music so you can control it

OBS’s Twitch VOD Track Guide explains how a Twitch VOD track can send a different audio mix to the VOD than to the live stream, including omitting a music source from the VOD mix. This is audio routing, not music permission: leaving a track out of a VOD does not establish that you may broadcast it live.

Use the OBS mixer meters as practical monitoring cues, then record a test and listen back before the event. OBS’s Audio Mixer Guide covers mixer controls and recommends checking a recording. There is no single volume setting that works for every game, microphone, room, and track; the test recording is where you can catch music masking speech or gameplay before viewers do.

- Play through each playlist block. Confirm that the order, transitions, and controls work, and that you can stop or lower the music promptly.
- Record a representative test. Include commentary, game audio, alerts if you use them, and music. Listen back on ordinary headphones or speakers, not only through the live mixer.
- Check the live mix. Make sure speech and important game sounds remain understandable when music is playing.
- Check VOD routing separately. If you use OBS’s Twitch VOD track, confirm the intended source assignments in the recording. Do not infer that the live feed has the same mix as the archive.
- Keep a fallback ready. Prepare a no-music scene or a second set of tracks whose permissions you have checked. If a track’s status is unclear, leave it out.
What Twitch and YouTube may do with music
Twitch
Twitch says its audio-recognition system scans VODs and clips. If it detects copyrighted audio, part of a VOD may be muted and associated clips may be deleted; Twitch says advance audio warnings are not themselves copyright strikes. See Twitch’s page on copyrighted-audio warnings. These detection and archive outcomes are not a way to confirm that a track is permitted, and the absence of a warning should not be treated as clearance.
YouTube
YouTube’s Content ID reference guidance says original video-game soundtrack references are valid only when owned by the game’s publisher, and distinguishes them from licensed popular music. That is a rule about eligibility to provide Content ID references, not a blanket creator-use license for a stream, VOD, or upload. Check the rights and current platform rules for the specific music and use.
