How to make a game’s privacy notice clear and compliant

A game privacy notice is clear and compliant only when it describes the data your game and every integrated service actually handle, explains why and with whom it is used, and gives players or parents workable controls. Build it from a verified data map, check the laws in each target market, then present the result in prominent, age-appropriate layers that match the game’s screens and settings.

Start with the game’s real data, not a template

Write the notice after documenting the product’s actual data flows. A generic policy can omit an analytics identifier, voice recording, advertising SDK or crash-reporting event that is collected outside your own code. The Federal Trade Commission (FTC) says children’s privacy obligations can cover information collected by third parties and passive tracking, not only fields in your registration form. Its 2025 discussion of third-party software also urges app teams to understand how each software development kit (SDK) operates and to compare the vendor’s policy with the app’s own disclosures: FTC compliance plan and FTC SDK guidance.

As an Amazon Associate I earn from qualifying purchases.

Assign an owner for the inventory, involve engineering, product, trust and safety, advertising and support teams, and preserve the configuration reviewed for each release. The notice should be generated from this controlled record rather than from assumptions about what a typical game does.

Use a data-inventory worksheet

Field to record Questions to answer Evidence to keep
Data category What is collected, inferred or generated? Include account details, device and network identifiers, gameplay events, chat, voice, images, location, purchases and support messages. Schema, event list, permission declarations and sample payloads.
Collection point Which screen, background process, SDK or server operation obtains it? Is collection active, automatic or passive? Source-code references, SDK configuration, network traces and platform settings.
Purpose What specific function needs the data: authentication, matchmaking, safety, analytics, advertising, personalization, fraud prevention or support? Product requirement, feature owner and processing rationale.
Recipient Which company, processor, platform, moderator or other player receives it? Does a vendor use it for its own purposes? Contracts, vendor documentation, data-processing terms and transfer details.
Retention and deletion How long is each copy kept in the game database, logs, backups and vendor systems? What event starts deletion, and how is completion confirmed? Retention schedule, deletion job, backup policy and test result.
Control Can a player or parent view, correct, download, delete, restrict or refuse a use? Where is the control exposed? Settings path, request form, identity checks and support procedure.

Include every integrated service

Make an inventory of advertising, attribution, analytics, crash reporting, fraud detection, customer support, social login, cloud-save, chat moderation, payment and hosting components. Record the exact products and enabled modules, because a vendor’s capability is not proof that your game has disabled it. Check initialization code, consent or age gates, event allowlists, dashboard switches and server-side forwarding. Repeat the check for each platform build: a mobile release, PC launcher and console version may have different SDKs and permissions.

Map data that never appears in the user interface. Device identifiers, IP addresses, approximate location, diagnostic logs, advertising signals and gameplay telemetry can be collected automatically. A voice feature may create temporary audio buffers and moderation transcripts even when the game does not save recordings. State those flows according to the configuration that actually runs.

Decide which rules apply before choosing wording

There is no single notice that makes every game compliant. Scope depends on the game’s audience, age signals, markets, features, data categories, recipients and legal roles. Document the conclusion for each market and update it when distribution, targeting or functionality changes. The FTC’s COPPA materials are US guidance; the Information Commissioner’s Office (ICO) Children’s Code is UK guidance. Neither source establishes the complete obligations for an unspecified game in every country.

Check COPPA scope in the United States

The Children’s Online Privacy Protection Act (COPPA) can apply when an online service is directed to children under 13 and collects personal information, when it allows others to collect that information, or when a general-audience service has actual knowledge that it is collecting it from children under 13. The FTC expressly includes network-connected games and internet-enabled gaming platforms among online services that may be covered. See the FTC COPPA FAQ and six-step compliance plan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a directed-to-children analysis, the FTC considers multiple factors rather than one age label. Examine the game’s subject matter, visual and audio content, child-oriented activities, advertising and marketing, and evidence about the actual audience. A game marketed as suitable for everyone does not automatically avoid COPPA if its content and audience indicate child direction. Conversely, a game with some child players is not automatically directed to children; the documented facts and actual knowledge matter.

Ask whether an SDK, ad network, analytics service or other operator collects identifiers or other personal information through the game. If so, include that collection in the COPPA analysis and verify that the vendor’s settings and practices support your obligations. The FTC’s rule was amended on April 22, 2025, so confirm the current rule text, implementation materials and effective dates before launch or a major redesign.

Assess UK children’s-code expectations

The ICO Children’s Code applies to online services likely to be accessed by children, including games. Its standards influence the design of defaults, collection, sharing, retention, geolocation and transparency. The ICO describes high privacy settings by default, collecting and retaining only the minimum data, generally not sharing children’s data, and keeping geolocation off by default. Read the ICO Children’s Code.

“Likely to be accessed” is a design and audience assessment, not simply a declared minimum age. Consider distribution channels, promotional material, game style, community features, age assurance and observed use. Where the code applies, document how each standard is implemented in the product and reflected in the notice and just-in-time messages.

Compare scope decisions explicitly

Decision axis Questions for the team Notice consequence
Jurisdiction and market Where are the game, publisher and relevant users located? Which stores or servers are used? Identify applicable regional rights, contacts, age rules and transfer explanations.
Audience and age Is the game directed to children, likely to be accessed by them, or known to have child users? Use the relevant child-facing layer, parental process and default settings.
Feature and data Does the game use chat, voice, location, advertising, profiling, purchases or social sign-in? Explain the category, purpose, recipient, retention and control at the feature and policy levels.
Sharing and operators Who receives data, and who decides the purpose? Name operators or recipient categories accurately and describe their role.
Retention and deletion What is kept, for how long, and what survives account closure? Give periods or criteria and explain deletion limits such as legal records or security logs.
Notice and controls Where will people read the notice and exercise rights? Provide prominent links, age-suited explanations and a working request route.

Build a notice that readers can use

Turn the inventory into a layered document. Put the decisions a player needs at the top, then provide detail for people who need it. Use short sentences, descriptive headings, concrete examples and the same names for settings and features that appear in the game. Avoid saying “we may collect data” when the map shows that a feature always sends a particular category.

Use a practical section order

  1. Who operates the game. Give the legal entity, contact route and the products or versions covered. If several operators maintain the service, explain their roles instead of presenting an anonymous “we.”
  2. What information is handled. Group data into understandable categories and give an example for each, such as an account email, player ID, device identifier, voice clip or purchase record.
  3. Why each category is used. Tie every purpose to a feature or service. Separate core operation, safety, analytics, advertising, personalization and legal or security needs.
  4. Who receives it. Identify named operators where required and otherwise describe recipient categories precisely. Explain whether a service provider acts on your instructions or uses information for its own purposes.
  5. How long it is kept. State a period when one is fixed or the criteria used when retention varies. Address backups, moderation records, fraud logs and account closure.
  6. Choices and rights. Describe settings, opt-outs, access, correction, deletion, restriction and complaint routes that are actually available to the relevant user or parent.
  7. Children and parents. Explain age screening, parental notice or consent where applicable, and the process for reviewing or deleting a child’s information.
  8. Changes and contact. Give an effective date, explain how material changes will be announced, and provide a monitored contact method.

Meet COPPA notice requirements when the rule applies

The FTC says a COPPA notice must describe the children’s information practices, list the operators collecting or maintaining children’s information, and tell parents how to review or delete the child’s information and refuse further collection or use, including the procedures. A combined privacy notice can work, but its children’s section must be clearly identified and linked in the places where children’s information is collected. The FTC’s FAQ sets out these notice expectations: FTC COPPA FAQ.

Make the link prominent on the home or landing screen and wherever the game collects children’s information. A link hidden in a general settings menu is not an adequate substitute for a visible route at the relevant collection point. Ensure the parent process can identify the correct account, return the required information securely, complete deletion or refusal requests, and record the result.

Write for scanning, not legal endurance

Put a one-screen summary before detailed tables or legal terms. Define technical terms such as “device identifier” and “personal information” in the context of the game. Replace “for business purposes” with the actual activity, such as “to detect bots in ranked matches.” Use bullets for categories and purposes, and link from each feature’s explanation to the longer section. Keep translated versions synchronized with the current data map; a stale translation is still a misleading notice.

Add an age-appropriate layer for children

Children and parents may need different levels of detail. Provide a concise main notice in language suited to the expected age range, then offer parent-facing information with the complete categories, operators, retention and rights process. The ICO’s mobile-gaming DPIA example illustrates parent-facing information alongside child-facing text and video, with short explanations shown when a data use is activated: ICO mobile gaming DPIA guidance.

The ICO states in its Standard 4 explanation: “The privacy information you provide to users, and other published terms, policies and community standards, must be concise, prominent, and in clear language suited to the age of the child. Provide additional specific ‘bite-sized’ explanations about how you use personal data at the point that use is activated.” Apply that principle to the interface rather than treating the policy page as the only explanation.

Show a contextual message when a feature starts

  • Location: Say whether the feature uses precise or approximate location, why it needs it, who receives it and how to turn it off. Do not silently enable geolocation; the ICO describes it as off by default for children’s services.
  • Voice and text chat: Explain whether messages are visible to other players, scanned by moderation tools, recorded, transcribed or retained, and how to report abuse or request removal where available.
  • Advertising: Identify advertising or measurement partners, the signals used for personalization, and the setting that declines personalized advertising. Do not describe an ad as contextual if identifiers are still sent for measurement.
  • Analytics: Tell the player what events are measured and whether the feature is necessary for gameplay. Offer the documented control, or state clearly when a service is required to operate.
  • Photos, camera or microphone: Explain the permission, whether content leaves the device, who can see it and when it is deleted. Request access only at the moment the feature needs it.

Use the game’s actual labels, icons and control paths in these prompts. A child-facing message that says “change this in privacy settings” is incomplete if the setting is difficult to find or absent from a particular platform.

Give players and parents controls that work

A rights sentence is not meaningful unless the underlying workflow succeeds. Put a privacy entry in the game’s settings and provide a support route for people who cannot sign in. The ICO mobile-gaming example includes an in-app contact path for rights requests and access to the notice in settings. Link to the same current notice from the store listing, account portal, launcher and support pages where users encounter data collection.

Design the parental process

  1. Explain which requests a parent can make, including review, deletion and refusal of further collection or use.
  2. Describe the verification method in plain language and collect only what is needed to authenticate the requester.
  3. Show what will be returned, which information may be withheld for another person’s privacy or security, and how long the request takes under the applicable rule.
  4. Route the request to the teams that control game databases, backups, moderation tools and SDK vendors.
  5. Send a completion or limitation notice and keep an internal record without retaining unnecessary identity documents.

Test the route with a fresh account and a child-account scenario. Confirm that deletion reaches replicas and vendor systems according to the documented schedule, and that refusing optional collection does not silently remove a promised core function.

Set protective defaults

  • Start child accounts with the highest practical privacy setting and require an affirmative action for optional sharing.
  • Keep geolocation, personalized advertising and unnecessary profiling disabled by default where the applicable standard expects it.
  • Limit chat discoverability, friend requests and voice exposure until the player or parent chooses broader visibility.
  • Collect the minimum data needed for the selected mode; do not make an optional feature a condition of ordinary play.
  • Make controls reversible and explain their effect immediately after a change.

Verify that the notice matches runtime behavior

Schedule a privacy accuracy review for every release that changes an SDK, event, permission, server, advertising partner, account flow or retention rule. Compare the published text with the production build, not just a design mock-up.

Run a release-level verification

  1. Review vendor documentation and configuration. Check enabled modules, default collection, regional switches, data-use purposes, subprocessors and deletion APIs. Ask vendors to explain changes that are not obvious in release notes.
  2. Exercise each collection path. Use network inspection and server logs to confirm what is sent at sign-up, first launch, gameplay, chat, purchase, advertising consent, crash and account closure.
  3. Check age branches. Test child, teen, adult and unknown-age states, including a player who declines optional processing. Confirm that the correct notice, defaults and prompts appear.
  4. Test controls end to end. Change settings, submit access or deletion requests, and verify the result in primary storage, backups, moderation systems and vendor dashboards.
  5. Reconcile text and evidence. For every notice sentence, identify the implementation or contract that supports it. Remove claims that cannot be demonstrated.
  6. Approve and version. Record the build number, effective date, reviewers, affected markets and data-map revision. Publish change explanations that users can understand.

Keep a discrepancy log. Examples include an analytics event sent before the consent screen, a vendor retaining an identifier after account deletion, a setting that changes the interface but not the server flag, or a translated notice that omits a recipient. Fix the implementation or amend the notice; do not leave the mismatch for the next release.

Common failure modes and practical fixes

Failure Why it fails Fix
Copying a broad template It lists familiar categories but misses game-specific SDKs, passive collection or feature-triggered data. Rebuild the notice from the current inventory and production traces.
Calling a service “anonymous” A persistent device, advertising or account identifier can still single out a player. Describe the identifier and its purpose accurately; use “aggregated” only when the process supports that claim.
Hiding the policy link Players and parents cannot see the information at the point of collection. Place a clearly labeled, prominent link on the landing screen, collection screens, settings and support route.
Listing a vendor without its data flow A company name does not tell readers what it receives, why or for how long. State the category, purpose, role, retention and relevant control for each operator.
Using one adult paragraph for children Dense legal language does not meet age-appropriate transparency expectations. Add a concise child-facing layer and bite-sized explanations when features activate.
Promising deletion without testing it Backups, logs or vendor systems may keep copies after the account appears closed. Document the deletion workflow, exceptions and completion evidence.
Making optional data mandatory Players may be forced to share location, profiling or voice data unrelated to the requested mode. Separate required processing from optional features and provide a usable alternative.
Leaving SDK defaults unchanged A library may collect data before your own settings or notice appears. Configure the SDK before initialization, test first launch and obtain vendor assurances.
Ignoring platform differences Mobile permissions, console accounts and PC launchers can produce different flows. Maintain platform-specific maps, screens and retention checks under one policy framework.
Failing to update after a feature change The notice becomes inaccurate even if its original wording was clear. Make privacy review a release gate for new data, recipients, purposes or markets.

A launch checklist for product teams

  • All first-party and third-party collection points are listed for every supported build.
  • Each data category has a documented purpose, recipient, retention rule and control.
  • Audience, age and market assessments identify whether COPPA, the UK Children’s Code or other local rules may apply.
  • The COPPA section, when relevant, names operators and explains parental review, deletion and refusal procedures.
  • The policy link is prominent on the home or landing screen and at collection points.
  • Child-facing text is concise, age-suited and accompanied by contextual explanations for activated features.
  • Protective defaults, including the applicable geolocation and sharing settings, are enabled and tested.
  • In-game settings and support routes lead to the current notice and accept the rights requests described in it.
  • Deletion, access and preference changes have been tested across primary storage, backups and vendors.
  • The release record identifies the policy version, effective date, build, markets and approvers.

Keep the notice current after launch

Assign continuing ownership rather than treating publication as the end of the project. Monitor SDK updates, advertising and analytics configuration, new community tools, age signals, store requirements and changes in the markets you serve. Re-run the data map when a feature is removed as well as when one is added, because old accounts, logs and vendor copies may still require a retention or deletion decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

At least once during each planned review cycle, compare the notice with a live account’s data export, settings, support scripts and deletion result. Check that a parent or player can reach the same controls from every supported platform and that a material change triggers the communication promised in the policy. If a legal question depends on facts not documented by the product team, obtain jurisdiction-specific legal advice rather than expanding the notice with unsupported assurances.

What “clear and compliant” looks like in practice

A strong notice lets a player answer five questions without reverse-engineering the policy: What information does this game use? Why does it need it? Who receives it? How long is it kept? What can I or my parent change? The answers are credible only when the game’s interface, SDK configuration, retention jobs and support workflow produce the same result.

Use the FTC materials for the current US COPPA analysis and the ICO Children’s Code and mobile-gaming guidance for UK age-appropriate design. Then apply the documented facts of your own game, version and markets. The result is not a universal template; it is a living description of implemented practice that players can actually understand and use.
