A spare hardware wallet is not enough: the fund needs independent approval paths, documented key-management procedures, tested recovery actions, clear decision authority, provider-contingency plans, and restoration targets that preserve security while operations resume.
Availability is a governance problem, not just a hardware problem
A hardware wallet can be lost, damaged, locked, or physically inaccessible. A key holder can be sick, unreachable, on leave, terminated, or prohibited from acting by a legal event. An external custodian or technology provider can suffer an outage or become insolvent. In each case, the practical question is the same: can the institution authorize a legitimate transfer without weakening controls or creating an emergency single-person override?

NIST’s institutional key-management guidance treats policy, procedures, roles, protection, and recovery as a connected system. NIST SP 800-57 Part 1 Revision 5 was published in May 2020; NIST’s key-management project reported an initial public draft of Revision 6 for comment in late 2025 and early 2026, so confirm the publication status before describing Revision 5 as the current edition. SP 800-57 Part 2 Revision 1, published in May 2019 and listed as under review, focuses on institutional planning and documentation, including key-management policy and practice statements.

Start with an inventory of what must remain accessible
List assets, wallets and transaction types
Record every wallet, account, vault, chain, and asset covered by the continuity plan. Include operational hot wallets, treasury wallets, staking or validator accounts, collateral accounts, and long-term reserves where the institution has a duty to act. For each one, document the network, asset standards, withdrawal restrictions, daily limits, whitelisted destinations, fee requirements, and the business process that depends on it.
Separate routine actions from exceptional actions. A payroll or margin call may require a different approval path and restoration deadline than a long-term reserve transfer. The inventory should also identify read-only systems, signing systems, policy engines, and records needed to prove who approved a transaction.
Map every role and dependency
Create a role map rather than a list of names alone. Useful roles include transaction initiator, independent approver, key-share or device custodian, policy administrator, incident lead, legal or compliance reviewer, and communications owner. For each role, specify primary and alternate personnel, required identity checks, access method, location, working hours, and the authority that can appoint or revoke the role.
Document dependencies outside the fund: custodians, multisignature coordinators, multiparty-computation services, cloud identity systems, secure-signing facilities, telecommunications, banking rails, and chain-specific infrastructure. A process that needs an unavailable provider is not a real alternate route.
Remove single-person and single-device bottlenecks
Use independent approvals
Define how many approvals a transfer needs and how independent those approvals must be. Independence can involve separate people, devices, credentials, locations, administrators, and recovery materials. Two approvals that are controlled by one administrator or stored in one room do not provide the same resilience as genuinely separate controls.
A Federal Register item published October 6, 2026 discusses proposed safeguards for covered adviser self-custody, including joint authorization by two or more designated people. The proposal mentions multiparty-computation and multisignature wallets as possible approaches and discusses identity checks for authorizers. It is proposed rulemaking, not a final requirement for every fund, and it does not replace a jurisdiction-specific legal analysis.

Define absence without creating an emergency override
Your policy should state what happens when one approver is unavailable, how long the institution waits, who confirms the absence, and which alternate can participate. The alternate route should retain the required independent approvals. Avoid a procedure in which an incident lead can simply declare an approver absent and take that person’s authority.
Recommended Free Tools
For planned absences, rotate alternates and verify contact details before the leave begins. For unplanned absence, require a documented incident record, independent confirmation through preselected channels, and a review after the normal approver returns. Termination, incapacity, death, legal restraint, and suspected compromise should have distinct procedures because the security and evidentiary requirements differ.
Compare custody architectures by recoverability and security
No single architecture is a universal winner. Compare the design actually under consideration against the fund’s assets, legal structure, staff, and providers.
| Evaluation axis | Questions to answer |
|---|---|
| Authorization independence | How many approvals are required? Can one administrator, vendor, or location control enough components to move funds? |
| Unavailable signer or device | What exact route works if a signer, hardware device, key share, or secure facility cannot be reached? |
| Compromise and collusion | How many compromised participants could authorize a transfer? Can insiders collude without detection? |
| Provider outage | Which functions depend on an external service, and can the institution operate if that service is offline or insolvent? |
| Network and asset support | Does the design support every chain, token standard, staking operation, and policy restriction the fund uses? |
| Restoration time | How long does replacement, re-issuance, identity verification, or migration take in practice? |
| Legal and jurisdictional treatment | Who legally controls the assets, where are records and signing components located, and what happens in a provider insolvency? |
| Auditability | Can the institution reconstruct approvals, recovery actions, configuration changes, and communications? |
Multisignature arrangements
Multisignature arrangements require a defined number of signatures from a larger set of keys. Their continuity depends on the remaining signers, backup devices, address-recovery procedures, and network support. Test how a replacement signer is added and how a new policy address is communicated to exchanges, banks, counterparties, and internal systems. A recovery that silently changes the receiving address can create a separate operational and fraud risk.
Multiparty-computation arrangements
Multiparty computation divides signing capability among participants without necessarily creating a conventional on-chain multisignature address. Evaluate the process for refreshing shares, replacing a participant, recovering from a lost device, and operating when the coordinating service is unavailable. Confirm which actions require the provider and which can be performed independently, and preserve evidence of policy changes.
Qualified-custodian arrangements
An external custodian may provide staffed operations, segregation, approval workflows, and recovery facilities, but it also introduces counterparty, outsourcing, jurisdiction, and insolvency dependencies. The institution must know how to obtain records, move assets, or appoint a replacement if the custodian is suspended, unavailable, or insolvent. FINMA’s January 12, 2026 announcement highlights technology-related custody risks and the need for expertise and robust technical infrastructure; it also warns that custody abroad can create complex legal issues, particularly if a custodian becomes insolvent.

Write the recovery plan before an incident
Specify triggers and authority
Define the events that activate continuity procedures: a missing or damaged device, an unreachable key holder, suspected credential compromise, a signing-service outage, a network disruption, or a custodian failure. Name the incident lead and the person who can authorize a move from normal operations to recovery. Require a second review for any decision that changes a wallet policy, address, signer set, or provider.
Document the recovery sequence
- Open an incident record. Capture the time, affected wallet or service, suspected cause, assets at risk, pending obligations, and people notified.
- Freeze unsafe actions. Pause transfers or narrow policy limits when compromise is possible. Do not treat unavailability and compromise as the same event.
- Verify the event independently. Use prearranged channels and identity checks to confirm that a person, device, or provider is actually unavailable.
- Assemble the alternate authorization group. Confirm each participant’s authority, identity, and independence under the written policy.
- Restore the minimum required capability. Use the documented replacement, share-refresh, backup-device, or custodian-transfer procedure; do not improvise key material during a crisis.
- Validate policy and destination data. Check signer thresholds, allowlists, transaction limits, chain identifiers, fees, and receiving addresses through an independent channel.
- Approve and execute a controlled transaction. Start with the smallest transaction that proves the route, unless a time-critical obligation requires another sequence.
- Reconcile and preserve evidence. Record approvals, system logs, screenshots or signed records where appropriate, transaction identifiers, configuration changes, and communications.
- Return to normal operations. Revoke temporary access, replace compromised components, reconcile balances, and obtain a post-incident review.
Keep recovery materials usable but protected
Backups should be sufficient to restore the required function without becoming a second uncontrolled signing path. Separate backup locations and administrators where the threat model requires it. Document access prerequisites, environmental requirements, chain software versions, and the order in which components must be restored. A sealed device or encrypted backup that nobody has ever verified may fail when it is most needed.
Set recovery objectives that people can execute
Recovery time objective
Set a maximum acceptable time to resume each critical function, not one vague target for the whole fund. For example, the plan may assign different deadlines to a margin obligation, a redemption queue, a treasury transfer, and a reserve wallet. The target must account for identity verification, approvals, provider response, chain congestion, and legal review.
Recovery point objective
Specify how much transaction and configuration data the institution can afford to lose or reconstruct. Include policy versions, signer rosters, allowlists, pending approvals, balances, provider tickets, and audit records. Backups should be tested for both integrity and usability, not merely existence.
Communications objective
Prepare internal and external notices for employees, directors, counterparties, banks, exchanges, custodians, insurers, regulators, and affected clients where applicable. State who may communicate, which channel is authoritative, how identity is verified, and how suspected phishing or impersonation is handled. Keep a private incident channel separate from a public status message when disclosure could increase risk.
Account for outsourced functions and provider failure
Commission Delegated Regulation (EU) 2025/299 Article 4 requires covered crypto-asset service providers to establish business-continuity plans. Its adverse scenarios include unavailable staff and disruption of outsourced critical or important functions. The regulation requires plans to specify recovery measures and deadlines, recovery point objectives, maximum resumption times, backups of critical business data, and communications procedures. Its scope is limited to entities and jurisdictions covered by the regulation; it is not a universal duty imposed on every investment fund.

The regulation states: “The business continuity plans shall contain procedures to address any disruptions of outsourced critical or important functions, including where those critical or important functions become unavailable.” For a fund that relies on a provider, use the same practical questions even when the regulation does not directly apply: What is the provider’s outage notification path? Which functions can be performed independently? How are assets and records retrieved? What contractual rights, data formats, and transition assistance exist? How quickly can the institution appoint another provider?
Test provider exit, not only provider uptime
Request evidence of recovery procedures, incident contacts, identity controls, backup arrangements, and subcontractor dependencies. Confirm that the contract addresses access to records, wallet addresses, transaction history, configuration data, and legally required cooperation after termination or insolvency. A provider’s published availability percentage does not answer whether the fund can authorize a transfer during a specific outage.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Build a role-and-control matrix
| Control area | Primary owner | Alternate and evidence |
|---|---|---|
| Transaction initiation | Operations or treasury role named in policy | Designated alternate; request and purpose recorded |
| Independent approval | Separate authorized approver | Second approved person; identity and approval log retained |
| Key, share or device custody | Security or custody role | Separate custodian and tested recovery materials |
| Policy administration | Restricted administrator | Dual review for threshold, signer, allowlist, or address changes |
| Incident command | Named incident lead | Escalation deputy; timeline and decisions recorded |
| Legal and compliance review | Assigned control function | Alternate reviewer; jurisdiction and disclosure decision recorded |
| Communications | Authorized spokesperson | Verified backup channel and approved templates |
Review this matrix whenever personnel, providers, wallet policies, chains, or legal requirements change. Store the current version where the incident team can reach it without relying on the unavailable person or system it describes.
Exercise realistic failure scenarios
Hardware wallet unavailable
Simulate a device that is lost, damaged, locked after failed attempts, or held at an inaccessible location. Verify that the alternate route does not require the missing device and that replacement hardware is initialized, authenticated, and recorded under dual control. Confirm address and policy verification before any material transfer.
Key holder unavailable
Run a scenario in which one approver cannot be reached for several days. Test the absence-confirmation process, alternate identity checks, quorum, escalation, and communications. Ensure no participant can unilaterally lower the threshold.

Provider outage or insolvency
Assume the signing coordinator, custodian, identity service, or secure facility is unavailable. Test whether the institution can obtain records, approve transactions, access backup components, and move to an alternate provider. Include a legal review of asset title, segregation, governing law, and cross-border recovery.
Best Value
Compromise during an availability event
Combine an absent key holder with a phishing alert or suspected credential theft. The exercise should require the team to freeze unsafe paths, preserve evidence, rotate or revoke affected components, and communicate without revealing recovery secrets. Availability must never be restored by bypassing compromise controls.
There is no universal exercise frequency established by the cited material. Set a schedule proportionate to risk and repeat testing after major personnel, provider, wallet, chain, or policy changes. Record observed restoration time, failed assumptions, unauthorized dependencies, and corrective owners.
Common failure modes and fixes
- “We have a spare device.” A spare does not provide authorization, policy data, chain support, or a tested restoration path. Pair it with documented roles, backups, initialization controls, and an exercise.
- “The founder or head of trading can always approve.” This creates a single-person bottleneck and a tempting emergency override. Use independent designated approvers and a documented absence process.
- “The vendor handles recovery.” Outsourcing transfers operations, not accountability. Define provider dependencies, outage contacts, records access, transition rights, and exit procedures.
- “Backups exist, so recovery is assured.” Unverified backups may be incomplete, corrupted, incompatible, or inaccessible. Test restoration and reconcile recovered policy and balances.
- “An emergency address is enough.” An address change can introduce fraud, configuration, and counterparty risks. Require independent verification, dual approval, and a controlled test transaction.
- “A proposed rule already applies.” The October 6, 2026 U.S. item is proposed rulemaking. Determine which final laws, regulations, licenses, and contractual duties actually govern the institution.
- “One global plan fits every asset.” Chain operations, staking, token standards, settlement windows, and provider capabilities differ. Set wallet- and function-specific objectives.
A practical implementation sequence
- Define scope. List assets, wallets, chains, transactions, jurisdictions, legal entities, and providers.
- Map normal operations. Record each approval, signing, custody, policy, identity, and communication dependency.
- Identify bottlenecks. Mark any person, device, location, credential, provider, or system whose absence stops a critical function.
- Choose and document alternate controls. Set thresholds, independent participants, recovery materials, replacement procedures, and provider-exit steps.
- Set RTOs, RPOs, and escalation rules. Assign accountable owners and deadlines for every critical function.
- Secure and test backups. Verify integrity, access, compatibility, and evidence preservation under dual control.
- Run exercises. Include absence, device loss, provider outage, compromise, and cross-border legal complications.
- Correct and govern. Track findings to closure, approve changes, and review the plan after organizational or technology changes.
Regulatory and legal checks to make before relying on the plan
The Federal Reserve, FDIC, and OCC stated in a July 14, 2025 joint statement that existing risk-management principles apply to banks’ crypto-asset safekeeping activities; the statement created no new supervisory expectations. That means a bank relationship does not remove the need to understand existing governance, operational, third-party, information-security, and recordkeeping obligations.
For institutions operating in Switzerland or using overseas custody, review the legal consequences of location, insolvency, segregation, and access to records. FINMA’s January 12, 2026 announcement specifically highlights technology and infrastructure risks and the complexity that can arise when a foreign custodian fails. For EU-regulated service providers, map the applicable requirements of Delegated Regulation 2025/299 Article 4 to the entity’s actual outsourcing and continuity arrangements.
Have counsel determine whether the fund is an adviser, crypto-asset service provider, bank, broker, investment vehicle, or another regulated entity in each relevant jurisdiction. The architecture, approval threshold, disclosure duties, and recovery records should follow that analysis rather than a generic industry template.
What a successful recovery looks like
At the end of an exercise or real incident, the institution should be able to show which event triggered continuity mode, who confirmed it, which independent people authorized each action, what provider or device was unavailable, how policy integrity was checked, when the critical function resumed, and what evidence was retained. The fund should also know whether any temporary access remains active and whether a signer, share, address, or provider must be replaced.
Accessibility is therefore a measurable property of the whole control system: authorized people can act, critical records and recovery components are reachable, providers can be replaced or bypassed where necessary, and restoration meets the institution’s stated deadlines without sacrificing approval integrity.
