Keep games off whenever the vehicle is moving. Play only after the vehicle is legally and securely parked, and use a vehicle system that automatically disables gameplay when it leaves Park. A passenger holding the controller does not remove the risk: a driver-visible game can draw the driver’s eyes and attention. A warning or passenger-confirmation screen is weaker than an affirmative motion-based lockout.

This guidance is based on U.S. federal safety material and a Tesla Model 3 owner manual. NHTSA recommendations are voluntary, and screen, device and gaming laws differ by state and country. Check the law and the owner manual for the specific vehicle you are using.

The safest rule: no gaming while the vehicle is moving

Do not start, continue or operate a game while driving. Pull over where stopping is lawful, place the transmission in Park, secure the vehicle and then begin play. This applies whether the driver is using the game, a passenger is using it, or the game is running on a center display that the driver can see.

Parking is more than a convenience. It separates an entertainment task from the driving task, so the driver is not expected to monitor traffic while looking at a game, reaching for controls or thinking through a challenge. Keep the vehicle fully stopped before connecting a controller, opening an arcade menu or launching a video game.

  • Compatible with Windows and Android.
  • 1000Hz Polling Rate (for 2.4G and wired connection)
  • Hall Effect joysticks and Hall triggers. Wear-resistant metal joystick rings.
  • Extra R4/L4 bumpers. Custom button mapping without using software. Turbo function.
  • Refined bumpers and D-pad. Light but tactile.

When a trip resumes, close the game before selecting Drive or otherwise moving the vehicle. If the vehicle’s software does not close or lock the game automatically, treat that as a safety limitation rather than a reason to continue playing.

Why in-car games can distract a driver

NHTSA divides driver distraction into three overlapping types:

  • Visual distraction: the driver’s eyes leave the road to watch a game, read instructions or follow animated graphics.
  • Manual distraction: one or both hands leave the steering wheel to operate a touchscreen, controller or connected device.
  • Cognitive distraction: the driver’s attention is absorbed by game rules, scores, conversation or decisions instead of traffic.

Gaming can create all three at once. A driver may look toward a screen, reach for a control and mentally track a game even if someone else is holding the controller. NHTSA defines distracted driving as “any activity that diverts attention from driving, including talking or texting on your phone, eating and drinking, talking to people in your vehicle, fiddling with the stereo, entertainment or navigation system—anything that takes your attention away from the task of safe driving.”

The scale of distraction matters. NHTSA’s Countermeasures That Work overview, citing the National Center for Statistics and Analysis in 2023, reported 3,522 fatalities, or 8% of all traffic fatalities, during 2021 in the distracted-driving category. That is a national estimate for 2021, not a current-year count and not a gaming-specific total.

Can a passenger play games while the car is moving?

A passenger’s control of the game does not make moving play automatically safe. NHTSA has warned that graphical content unrelated to driving can create visual and cognitive distraction even when a passenger operates the system. If the display is in the driver’s sightline, the prudent choice is to keep the game off until the vehicle stops.

Use the driver’s sightline as the deciding test

  • If the driver can see the screen without deliberately turning away from the road, do not run the game while moving.
  • If the game produces bright animation, rapid movement or sound that repeatedly attracts the driver’s attention, wait until parking.
  • If the passenger must ask the driver to adjust settings, troubleshoot a connection or read text, stop the vehicle first.

Do not assume that a rear-seat display is harmless. The evidence cited here does not establish a universal safety rating for every screen location or vehicle interior. Apply the same conservative rule when the driver can be drawn into the content.

Why a warning screen is not enough

Some systems show a message asking the user to confirm that they are a passenger. NHTSA’s Passenger Play investigation highlighted the importance of affirmative technology-based controls rather than administrative controls such as disclaimers. A prompt depends on a person making the correct choice every time; a motion-based lockout prevents the game from being used by the driver while the vehicle is moving.

For safety, prefer a system that checks vehicle state and disables gameplay when the vehicle leaves Park or begins moving. A passenger confirmation can be an additional reminder, but it should not be the only barrier. Do not defeat, bypass or reconfigure a lockout to make a driver-visible game available on the road.

What the Passenger Play investigation found

NHTSA’s Office of Defects Investigation examined Tesla Passenger Play in certain model-year 2017–2022 Model 3, Model S, Model X and Model Y vehicles. Tesla introduced the feature in December 2020, and selected games could be played while the vehicle was moving. After NHTSA requested action, Tesla disabled the capability in December 2022.

In the investigation dataset, approximately one third of trips with Passenger Play active showed in-motion use with no passenger-seat occupant identified by the occupant classification system. Model 3 and Model Y vehicles represented 86% of the subject vehicles, and those models present driving information on the same center screen used by Passenger Play. These figures describe the investigated fleet and period; they are not a prevalence rate for all in-car gaming or all vehicles.

NHTSA’s report records Tesla’s arguments and the agency’s concerns separately. Its practical lesson is that a driver-facing game can create risk even when the intended user is a passenger, and a technical lockout is more dependable than a user prompt. NHTSA also stated that its guidelines are not binding and that closing the preliminary evaluation was not a finding that no safety-related defect existed.

What federal guidance says about screens and games

NHTSA’s final first-phase visual-manual guidelines address original-equipment devices and secondary tasks. They are voluntary recommendations, not a nationwide statute. The guidance says tasks believed inherently to interfere with safe vehicle control should be inaccessible to drivers while driving. For other tasks, it describes eye-glance testing and recommends lockout when a task fails the acceptance criteria.

A 2019 U.S. Department of Transportation announcement summarized recommendations to limit an individual eyes-off-road glance to two seconds and total task-related eyes-off-road time to 12 seconds. It also described disabling video-based entertainment unless the vehicle is stopped and in Park. These are thresholds in federal guidance, not proof that every state has enacted the same limits.

The National Transportation Safety Board’s distracted-driving page, updated March 4, 2026, states, “Hands-free is not risk free.” Its explanation is relevant to gaming: removing the need to hold a device does not eliminate cognitive distraction. A driver can be mentally absorbed by a conversation or game while keeping both hands near the wheel.

How to play safely when parked

Use this sequence every time rather than relying on memory or a warning prompt.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Choose a lawful stopping place. Use a driveway, designated parking space, rest area or other location where stopping is permitted. Do not stop in a travel lane, shoulder or restricted area simply to open a game.
  2. Bring the vehicle to a complete stop. Set the transmission or drive selector to Park, apply the parking brake when appropriate and confirm that the vehicle cannot roll.
  3. Secure the surroundings. Keep doors closed near traffic, watch for pedestrians and cyclists, and do not block emergency access or another vehicle.
  4. Confirm the driver is no longer responsible for immediate vehicle movement. If another person will drive, finish the session and close the game before handing over the controls.
  5. Use only supported controls. Connect a controller or use the built-in controls specified in the owner manual. Do not route cables across pedals, steering controls or airbag deployment areas.
  6. Start the game after parking, not before. Avoid launching menus while coasting into a space or waiting at a traffic light; a temporary stop is still part of a trip.
  7. End play before moving. Save or quit, disconnect accessories if needed and verify that the display has returned to a driving-appropriate screen before selecting Drive or moving off.

Vehicle-specific example: Tesla Model 3 entertainment features

The reviewed Model 3 owner manual says Theater and Toybox are for use while parked and warns: “Use these features only when Model 3 is parked. Always pay attention to road and traffic conditions when driving. Using these features while driving is illegal and very dangerous.” This is manual language for that vehicle; it should not be presented as a universal legal determination for every jurisdiction or model.

The same manual notes that entertainment options vary by region, date of manufacture and vehicle configuration. Arcade may require the steering-wheel buttons or a Bluetooth or USB controller. A controller therefore does not guarantee compatibility, and it does not improve safety while driving. Check the manual for the exact vehicle before buying or connecting one.

Controller checklist for parked use

  • Confirm that the game supports the controller type and connection method.
  • Use the vehicle’s documented Bluetooth or USB procedure.
  • Keep the controller and cable away from the driver’s footwell and steering-wheel controls.
  • Remove or stow the controller before the vehicle moves if it could become a loose object.
  • Do not install software or hardware intended to defeat the vehicle’s motion lockout.

How to compare an in-car gaming system’s safety

When evaluating a built-in system, aftermarket display or passenger entertainment setup, compare the controls that affect distraction rather than judging the game library alone.

Safety question What to look for Why it matters
Does gameplay lock when moving? Automatic lockout when the vehicle leaves Park or begins motion Affirmative technology control is stronger than a passenger disclaimer.
Can the driver see the display? Screen position, viewing angle and brightness from the driving position Driver-visible graphics can create visual and cognitive distraction.
What does the manual say? Explicit parked-only instructions and warnings The manual provides vehicle-specific operating limits.
How is it controlled? Built-in controls, steering-wheel buttons, Bluetooth or USB controller Compatibility and cable placement vary by vehicle.
What affects availability? Region, manufacture date, configuration, Wi-Fi or paid connectivity A feature shown in another vehicle may not exist or work in yours.

If a system has no dependable motion lockout and the screen is visible to the driver, treat it as unsuitable for use during a trip. Use it only while parked or choose a different passenger-entertainment arrangement that keeps the driver from being drawn into the content.

Guidance for vehicle designers, fleet operators and installers

Build the lockout around vehicle state

Make gameplay unavailable to the driver whenever the vehicle is moving. The lock should be automatic, difficult to circumvent accidentally and restored after every ignition or drive cycle. A prompt asking someone to identify as a passenger can supplement the design but should not replace motion detection.

Keep driver information separate from entertainment

The Passenger Play investigation noted that Model 3 and Model Y vehicles used the same center screen for driving information and gameplay. Combining those functions increases the importance of a clear, immediate transition back to driving information when the vehicle moves.

Document compatibility and regional limits

State which models, software versions, manufacture dates, controller types, connectivity services and markets support the feature. Do not imply that a game or controller works across an entire product line when the manual says availability varies.

Do not create bypasses

Aftermarket modifications that make a driver-visible video display usable while moving undermine the type of lockout supported by NHTSA guidance. They can also conflict with vehicle requirements or local law. Installers should decline changes whose purpose is to defeat a safety interlock.

Common situations and the safe response

“The car is stopped at a red light.”

Do not play. A traffic signal is a temporary stop, not a parked vehicle, and the driver must be ready to move as traffic changes.

“The passenger promises not to show me the screen.”

Do not rely on a promise. Keep the game off if the driver can see the display or be drawn into its sound and conversation. Resume after parking.

“The game is only a quick round.”

Short duration does not remove the visual, manual or cognitive demands. Start only after parking and finish before moving.

“The vehicle still allows the game while moving.”

Treat that capability as a warning, not permission. Stop in a lawful location, review the manual for a software update or configuration change, and avoid using the feature until a dependable lockout is available.

“The controller will not connect.”

Stop troubleshooting if the vehicle is moving. Once parked, verify the supported Bluetooth or USB method, check the manual for model and region limitations, and remove the accessory if its cable could interfere with driving controls.

“I modified the display to unlock video.”

Undo the modification or leave the feature disabled. A bypass can expose the driver to moving graphics and may conflict with safety requirements or local rules.

Legal and geographic limits

The federal material discussed here is U.S.-centered. NHTSA’s design guidance is voluntary, and the cited sources do not establish the current law in every state, city or country. Rules may address driver-visible screens, handheld devices, vehicle equipment or aftermarket modifications in different ways.

Before publishing, installing or using an in-car gaming setup in a named jurisdiction, check that jurisdiction’s current rules and the vehicle’s own manual. Do not treat the Model 3 warning as a universal statement that every form of in-car gaming is illegal everywhere.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical pre-drive checklist

  • Is the vehicle parked in a lawful, secure location?
  • Is the game disabled automatically when the vehicle leaves Park?
  • Can the driver see the display from the normal driving position?
  • Are the controller and cables clear of the wheel, pedals and airbags?
  • Does the manual permit the feature and identify the required controller or connectivity?
  • Have you checked the rules that apply where the vehicle is being used?
  • Will the game be closed before the vehicle moves?

If any answer is uncertain, wait until the vehicle is parked and leave the game off during the trip. That choice follows the strongest common safeguard in the available guidance: remove the game from the driving task instead of asking the driver to divide attention.
