The safe standard is simple: treat every AI-written MedTech message as an unapproved draft until a qualified person verifies its claims, audience, data use, channel rules and deployment settings. Generative AI can produce polished sequences quickly, but it does not know whether a performance number is current, whether a device has 510(k) clearance or premarket approval, whether a recipient has opted out, or whether an implied clinical promise exceeds the evidence. The company and marketer remain responsible for the message that reaches a prospect.
This guide provides a repeatable control process for commercial, marketing, regulatory, legal, medical and privacy teams. It covers United States and European Union considerations, while identifying issues that require country-specific review. It is educational information, not legal advice for a particular campaign.

Why AI-generated MedTech outreach becomes inaccurate or noncompliant
AI usually fails in sales outreach through plausible wording rather than obvious nonsense. A model may combine an old product brief with a newer one, turn a qualified result into an absolute promise, confuse a device’s regulatory pathway, or infer a clinical benefit from a technical feature. It can also generate a compliant-sounding email that is deployed with an unlawful subject line, missing postal address, invalid unsubscribe process or improperly sourced contact list.

“May help clinicians identify patterns in this evaluated setting” can become “identifies disease earlier.” “In a retrospective study” can disappear entirely. A percentage may be copied without its population, comparator, confidence interval, sample size or date. Those changes alter the net impression, even when every individual word appears reasonable.

It confuses the product, indication or regulatory status
A company may have several versions, configurations or markets. AI can apply language approved for one device to another, describe a research-use feature as commercially available, or call every regulatory pathway “FDA approved.” The FDA regulates medical devices, including AI-enabled devices, based on intended use and technological characteristics; it does not regulate “AI” as an undifferentiated product category. The relevant pathway may be 510(k) clearance, De Novo classification or premarket approval, and the permitted claims depend on the particular device and authorization.
It ignores the channel and recipient
Commercial email, telephone calls, text messages, social messages and one-to-one correspondence can have different rules. Business-to-business email is still covered by the U.S. CAN-SPAM Act. In the EU, direct marketing using personal data engages GDPR and ePrivacy requirements, and a person’s objection to direct marketing must be respected. A model cannot determine those facts from a name and email address.
It creates a false sense of approval
A prompt, a disclaimer or an “AI reviewed” label does not substantiate a clinical or safety claim. Human sign-off is useful only when the reviewer checks the evidence, scope, audience and deployment configuration. It is a control, not a substitute for the underlying basis required for objective claims.

FTC: express and implied claims need an adequate basis
The Federal Trade Commission’s Health Products Compliance Guidance says marketing must be truthful and not misleading, and that objective claims need adequate substantiation before dissemination. The FTC evaluates the advertisement’s overall impression, including wording, names, visuals and context. A claim does not escape responsibility because it is implied rather than stated directly.
The agency’s formulation is especially important for AI copy: “Under FTC law, a marketer is equally responsible for the accuracy of claims suggested or reasonably implied in advertising.” A headline, product name, image or sequence of emails can imply diagnosis, prevention, safety or superiority even when the body uses cautious language. Review the complete message and the likely interpretation by the intended recipient.
FDA: match claims to the specific device and authorization
FDA’s Artificial Intelligence-Enabled Medical Devices materials explain that oversight is risk based and considers intended use and technological characteristics. Premarket pathways include 510(k) clearance, De Novo classification and premarket approval. Certain modifications that could significantly affect safety or effectiveness may require FDA review.

Therefore, write the exact status supported by current regulatory and labeling records. “FDA cleared” is not interchangeable with “FDA approved,” “FDA authorized,” “FDA reviewed” or “clinically validated.” If a device is cleared through 510(k), say so only when that is the status for the product and claim at issue. If the evidence supports a limited indication, do not broaden it to a disease category, patient population or workflow that was not authorized.
FDA reported that more than 1,600 AI-enabled medical devices had been authorized for marketing in the United States as of September 2026. That figure describes the size of the device landscape; it says nothing about the accuracy of AI-written outreach or the compliance of a particular campaign.
Agency roles are related but not interchangeable
In joint matters described by the U.S. Government Accountability Office, FDA officials focused on whether a device followed the appropriate regulatory process while the FTC examined advertising for truth or falsity. A regulatory status does not automatically substantiate every marketing claim, and truthful advertising cannot make an unauthorized intended use permissible.
A controlled workflow for AI-assisted outreach
The following process turns a language model into a drafting aid inside an accountable approval system. It is a recommended operational control derived from the duties above, not a verbatim regulator checklist.
- Define the campaign before generating copy. Record the product version, intended use, audience role, geography, channel, campaign purpose, send date and owner. State whether the message is prospecting, customer education, renewal, event follow-up or another purpose.
- Lock the source set. Give the model only current, approved materials: labeling, instructions for use, cleared or approved indications, evidence summaries, validated performance statements, approved comparisons, pricing rules and required disclosures. Mark each file with an effective date and version. Exclude superseded brochures and unverified sales notes.
- Constrain the prompt. Require the model to use only supplied facts, preserve qualifiers, avoid unsupported clinical or regulatory claims, and flag missing evidence instead of guessing. Include the exact audience and jurisdiction. Instruct it not to invent study names, numbers, customer results, approvals or quotations.
- Generate with traceability. Save the model name or version, prompt, source-set identifier, output version and generation date. Require a claim ledger in which every objective statement points to a source and its scope.
- Run a whole-message review. A qualified reviewer should read the subject line, preview text, body, links, images, signature and call to action as a recipient would. Check the net impression, not just sentence-level factuality. Look for implied outcomes, urgency, superiority, safety, diagnosis or expanded intended use.
- Escalate high-risk language. Send clinical outcomes, safety, comparative performance, intended-use, regulatory-status and evidence-strength claims to the appropriate regulatory, medical, legal or clinical reviewer. Define who can approve, reject or narrow each category.
- Validate the sending system. Confirm sender identity, routing fields, subject line, required advertising identification, physical postal address, unsubscribe mechanism, suppression list, audience filters and links in the actual email platform. The model cannot establish that the deployment configuration is lawful.
- Approve a frozen version. Record the final copy, reviewer names and qualifications, approval date, applicable jurisdiction and channel. Any later model rewrite, personalization rule or source change starts a new review unless your controlled procedure expressly covers it.
- Monitor and remediate. Track bounces, complaints, objections, opt-outs, incorrect claims and questions from recipients. Stop or suppress affected sends, correct the source material, assess whether prior messages need clarification, and document the decision.
Claim controls: what to verify before sending
| Claim or element | Verification question | Typical escalation |
|---|---|---|
| Clinical outcome | What study, population, endpoint and limitation support the exact wording? | Medical, clinical and regulatory review |
| Safety | Is the statement supported for this device, use, population and time period, or does it imply absence of risk? | Medical, regulatory and legal review |
| Performance number | Is the number current, reproducible and accompanied by its test conditions, comparator and qualification? | Clinical or quality review |
| Comparison | Is the comparator named, fair, current and measured on the same basis? | Legal and regulatory review |
| Intended use | Does the statement match the authorized indication, users, workflow and patient population? | Regulatory review |
| Regulatory status | Is the precise product, market and pathway identified, with no substitution of “approved” for “cleared” or another status? | Regulatory and legal review |
| Evidence strength | Does the copy distinguish laboratory, retrospective, observational, prospective or real-world evidence? | Clinical and medical review |
| Testimonials or customer results | Are the source, permission, context and typicality substantiated? | Legal and compliance review |
| Price, availability or timing | Is the offer current for the recipient’s market and stated without hidden conditions? | Commercial and legal review |
| Personalization | Is the field accurate, necessary and permitted for this recipient and purpose? | Privacy and campaign-operations review |
U.S. commercial email: CAN-SPAM controls
The FTC’s CAN-SPAM guide covers commercial email, including business-to-business messages. For an AI-generated sequence, verify all of the following outside the language model:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →- Header information, sender identity and routing details are accurate and not deceptive.
- The subject line reflects the message and does not create a misleading impression.
- The email clearly identifies itself as an advertisement where required.
- A valid physical postal address appears in the message.
- An easy-to-use opt-out mechanism is present and works on the deployed version.
- Opt-out requests flow to a suppression system and are not reintroduced by a later model-generated list.
- Requests are honored within 10 business days, as stated in the FTC guide.
- Any outside email marketer is contractually controlled; using a service provider does not remove the marketer’s responsibility.
Keep CAN-SPAM analysis separate from telephone and text campaigns. The cited email guidance does not provide a complete analysis of the Telephone Consumer Protection Act, state telemarketing laws or text-message consent scenarios. Obtain current, channel-specific review before using AI-generated copy in those channels.

EU direct marketing, personal data and AI transparency
Contact-list provenance and objections
The European Commission advises organizations considering a third-party contact list to confirm that the source can demonstrate lawful collection under GDPR and that the data may be used for advertising. Email marketing must also comply with applicable ePrivacy rules. Member-state implementation and campaign facts can change the answer, so do not assume one consent model works throughout the EU.
Once a person objects to direct marketing, the data must not continue to be used for that purpose. Suppression must work across synchronized CRM, marketing-automation and enrichment systems. A model-generated “new” list must be checked against the authoritative objection and suppression records before activation.
Article 50 and AI-origin labeling
The European Commission states that Article 50 AI Act transparency obligations apply from 2 August 2026. Its description covers marking or detecting certain AI-generated content, including particular deepfakes and some AI-generated public-interest text. It does not establish that every ordinary one-to-one sales email must carry an AI-origin label.
Recommended Free Tools
Do not make a blanket “EU law requires an AI disclaimer in every sales email” claim. Check current AI Act guidance, the content type, the audience and the actual deployment. A company may still choose a transparency policy for trust or procurement reasons, but that policy should not be presented as a universal legal requirement based on Article 50 alone.
Prompt and system design that reduce risk
Use a claim-first prompt
Ask the model to produce a table containing each proposed objective claim, its source document and version, exact supporting wording, scope, qualification and a “missing evidence” flag. Generate prose only after the claim table is reviewed. This makes unsupported enthusiasm visible before it is hidden in polished paragraphs.
Make uncertainty explicit
Require phrases such as “the cited evaluation reported” when that is the evidence level, and instruct the model to return “not established in the approved materials” rather than fill a gap. Prohibit invented study identifiers, customer names, regulatory numbers, percentages, dates and safety outcomes.

Separate drafting from authorization
Keep source repositories, approval records, suppression lists and send permissions outside the model. Role-based access should prevent a draft from becoming a campaign merely because a user clicked generate. Integrate a human approval gate and a final preflight check in the marketing platform.
Control personalization
Define permitted fields, such as role, institution or publicly confirmed area of interest, and prohibit the model from inferring a person’s disease, diagnosis, treatment need or clinical performance. Validate every merge field and provide a fallback when data is missing or stale.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Examples of claim repair
Clinical performance
Risky draft: “Our AI detects cancer earlier and prevents missed diagnoses.” This combines an unqualified outcome with a prevention promise.
Controlled alternative: “In the retrospective evaluation described in the approved evidence summary, the software identified the specified imaging finding in the studied population. The evaluation does not establish earlier diagnosis or prevention of missed diagnoses.” The exact study limits must remain attached to the sentence in the final approved copy.
Regulatory status
Risky draft: “Our FDA-approved AI platform is ready for every hospital.” It may misstate the pathway and expands the intended users and settings.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Controlled alternative: Name the particular device, its precise 510(k), De Novo or premarket-approval status if supported, and the authorized indication and user setting. If those details are not in the approved source set, stop and obtain them rather than generalize.
Best Value
Comparative performance
Risky draft: “The most accurate solution on the market.” This is an objective superiority claim with no defined market, comparator, method or date.
Controlled alternative: State only a measured comparison that identifies the test conditions, comparator, population, endpoint and limitations, and retain the substantiation with the approved version.
Records, change management and incident response
Retain enough information to show how a message was controlled. A practical record should include:
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute- Source documents, versions and effective dates.
- The claim ledger and substantiation for every objective assertion.
- The model-assisted draft, prompt or generation record, and output version.
- Final approved copy, reviewer identity, qualifications and approval date.
- Product, intended use, audience, jurisdiction, channel and campaign purpose.
- Personal-data source, permitted-use assessment, consent or other lawful-basis decision where applicable, and suppression status.
- Deployment configuration, send date, links and personalization rules.
- Opt-outs, objections, complaints, corrections and remediation decisions.
This exact checklist is an operational recommendation, not a list prescribed word-for-word by the cited agencies. Its purpose is traceability: a revised model output must not be mistaken for language that was previously reviewed.
If an error is found, pause the affected sequence, preserve the sent version and recipient scope, identify whether the issue concerns claims, data, channel configuration or all three, and route the assessment to the responsible regulatory, legal, privacy and commercial owners. Correct the source set and suppression controls before restarting. Consider whether recipients need a correction and whether the incident triggers contractual, regulatory or internal reporting duties.
Pre-send checklist for an AI-assisted MedTech sequence
- The product name, version, market and intended use match current approved materials.
- Every number, date, comparison, clinical statement, safety statement and performance claim has a source and qualification.
- Implied claims from the subject line, visuals, naming and call to action have been reviewed.
- Regulatory language uses the exact supported pathway and does not substitute “FDA approved” for another status.
- The audience, geography and channel are recorded and approved.
- U.S. commercial email controls are present where applicable: accurate headers, truthful subject, advertising identification, postal address, opt-out and suppression.
- EU contact data has a documented lawful-use assessment, ePrivacy analysis and objection handling where applicable.
- No model-generated inference reveals a person’s health status or clinical need.
- Links, merge fields, signatures and disclosures work in the actual deployed message.
- A qualified owner has approved the frozen version, and the approval record is retained.
What “good” looks like
A compliant process does not ban generative AI. It limits what the model may see and say, makes every objective claim traceable, assigns human accountability, and keeps campaign operations outside the model’s authority. The strongest teams measure the process rather than the model’s fluency: unsupported-claim findings per review, time to correct source material, opt-out suppression failures, complaint rates, version-control exceptions and the percentage of high-risk claims receiving the required escalation.
The governing principle is the same in every market: AI may accelerate drafting, but it does not transfer responsibility. Before dissemination, the organization must be able to explain why each claim is accurate for this device, this evidence, this audience, this channel and this jurisdiction—and demonstrate that the deployed system honored the recipient’s rights.
