For U.S. federal personal property, the normal sequence is internal reuse, federal screening through the General Services Administration (GSA), donation of eligible surplus, public sale, and only then authorized abandonment, destruction, or recycling. A member of the public cannot claim an item merely because it appears unused.
This guide focuses on the federal process. State, county, municipal, school-district, and other public property follows the owning jurisdiction’s laws and property-control procedures; there is no single state-and-local process that applies everywhere.

What “excess” and “surplus” mean
Federal disposal terms describe stages in a controlled process, not the age or appearance of an item.
Excess property
An agency has excess personal property when one of its activities no longer needs it, but another federal agency may still need it. The owning agency reports the property for federal screening. It remains government property during this stage and must be safeguarded.

Surplus property
Property becomes surplus only after GSA determines that no federal requirement exists. It can then move to donation programs or sale. Calling an old, parked, or unused-looking item “surplus” before this determination can lead to an unauthorized transfer or removal.
GSA summarizes the federal obligation this way: “Federal executive agencies are legally required to report excess personal property to GSA for screening and disposal.”
Identify the owner and the property category first
Do not start with a sale listing or a disposal method. Start with title, custody, and classification.
Confirm the owning government
Look for the agency asset tag, property number, vehicle or vessel documentation, building records, signs, and the location’s responsible office. Ask the agency’s authorized property or contracting contact to confirm ownership. Property held by a federal contractor, cooperative, or project grantee can still be federal property when the government holds title.
If the item belongs to a state, county, city, school district, transit authority, or another public body, contact that owner. Follow its inventory, surplus declaration, public-notice, bidding, donation, and recycling rules. Federal GSA steps should not be applied to a nonfederal item without jurisdiction-specific confirmation.
Classify personal property
Federal personal property is physical property other than land and interests in real estate. It can include furniture, office equipment, vehicles, aircraft, vessels, animals, scientific instruments, and heavy machinery. The category is broad, but special rules can apply to aircraft, vessels, firearms, animals, electronics, hazardous materials, and controlled equipment.
Federal records are not included in the federal surplus-personal-property donation category. Land and buildings are handled through the separate real-property process, and certain naval vessels have additional exclusions or procedures.
Classify real property
Land, buildings, and interests in real estate are real property. They do not go through the ordinary personal-property donation path. GSA may use public-benefit conveyances, transfers for public purposes, negotiated sales in specific circumstances, or public auctions, depending on the property and governing authority.
Federal personal property: the disposal sequence
The order matters. Agencies should document each decision so that a later sale, donation, or destruction is traceable to an authorized determination.

1. Offer the item for reuse inside the agency
When one activity no longer needs property, the agency should first offer it to other activities within that agency. Federal rules also direct agencies, to the maximum extent practicable, to meet needs with existing assets or excess property from another federal agency before buying new items.
Internal reuse usually preserves the most value because it avoids a new purchase while minimizing transportation, advertising, and disposal work. The property record should show the receiving activity, transfer authorization, location, and condition.

2. Report excess property to GSA
Federal executive agencies generally report excess personal property through GSA’s Personal Property Management System (PPMS). SF 120 is the report-of-excess personal-property form and data reference. GSA’s current instructions control the required fields and submission method.
Assign a property custodian before the report is submitted. The custodian protects the asset, verifies its description and condition, arranges showings, answers questions, and coordinates release if another agency selects it. The asset should not be moved, dismantled, or released to an interested party without the owning agency’s authorization.
A report should identify the property well enough for another agency to find and evaluate it: manufacturer and model, serial or asset number when applicable, quantity, dimensions, location, condition, accessories, known defects, and any restrictions. Clear photographs and accurate descriptions improve screening and reduce failed requests.
3. Screen for federal requirements and transfers
GSA makes reported excess property available for federal use. Other agencies review the description, inspect or request information, and submit a selection under the applicable procedure. A direct transfer of personal property worth $10,000 or less is identified by GSA’s SF 122 form; verify the current instructions and threshold before filing because procedural details can change.
Do these 3 things before closing this tab:

Record the receiving organization, transfer date, location, and any conditions in the property system.
4. Declare and donate eligible surplus
If no federal requirement exists, GSA determines that the property is surplus. Eligible state and local agencies and certain public organizations or nonprofits may seek it through their State Agency for Surplus Property. The state agency—not an interested applicant—determines eligibility, coordinates the request, and issues the applicable transfer documentation.
Recipients may have to pay handling, transportation, and administrative charges. Before accepting an item, confirm who will pay those costs, where the item is located, how it will be loaded, and whether the recipient can meet the use restrictions.

GSA says donated property recipients must begin using the property within one year of acquisition and use it for at least one year after that. State agencies can impose additional terms. Aircraft, vessels, and certain foreign gifts have extra restrictions; violating the conditions can result in return of the property or reimbursement of fair market value.

5. Sell property not selected for donation
Surplus personal property that is not selected for donation can be sold to the public through competitive methods such as sealed bids, spot bids, or auctions. GSA Auctions is the federal electronic-bidding channel for many personal-property lots.
Each lot’s notice controls. Read the condition description, inspection opportunity, sale terms, payment deadline, pickup window, access rules, loading requirements, and removal deadline before bidding. The purchaser is responsible for payment and for access, loading, transportation, and removal as specified in that sale. A low bid can become expensive if the item is remote, heavy, incomplete, or difficult to transport.
6. Use authorized abandonment, destruction, or recycling only at the end
If utilization, donation, and sale do not dispose of the property, final-disposition control returns to the owning agency. GSA identifies abandonment or destruction procedures and recycling as possible routes. These are not shortcuts for an item that merely looks worthless.
Federal rules describe written determinations for property with no commercial value or for which continued care and handling is expected to cost more than sale proceeds. The determination should explain the condition, expected costs, failed or impractical alternatives, and approving authority.

Agency checklist before reporting or releasing an item
- Verify title and records. Match the physical item to the property record, asset number, serial number, acquisition information, and current location.
- Describe condition honestly. Note operating status, missing parts, damage, maintenance needs, safety concerns, and whether testing was performed.
- Separate components. Identify accessories, spare parts, manuals, software media, keys, chargers, attachments, and items that are not included.
- Check restrictions. Review export-control, hazardous-material, privacy, data-security, weapon, title, environmental, and other statutory requirements relevant to the asset.
- Capture photographs. Photograph the whole item, identification plates, defects, included accessories, and any packaging or loading constraints. GSA’s resource catalog provides reporting checklists and photo guidance.
- Estimate practical costs. Consider storage, handling, inspection, transportation, decontamination, loading, and administrative work—not only a possible sale price.
- Assign a custodian. Give one person responsibility for safeguarding, showings, questions, release, and updates to the property record.
- Document each decision. Keep internal reuse offers, GSA reports, selections, donation approvals, sale records, and final-disposition determinations together.
How a member of the public can buy federal surplus property
Public access normally occurs after federal screening and any donation opportunity. The practical path is:
- Find a legitimate listing. Use GSA Auctions or another sale channel identified in the agency’s official notice. Do not rely on an informal offer from someone who found an item at a government facility.
- Read the entire lot description. Confirm the agency, location, quantity, condition, included items, inspection arrangements, bidding rules, payment method, and removal deadline.
- Plan removal before bidding. Measure the item, check vehicle and equipment needs, determine whether loading assistance is available, and account for travel, labor, permits, and disposal of unwanted components.
- Bid under the stated terms. An auction’s conditions govern the transaction. A winning bid does not waive payment, pickup, safety, or removal requirements.
- Complete payment and pickup on time. Meet the sale’s deadlines and bring the identification, vehicle, personnel, and equipment required by the notice. Failure to remove an item can create additional charges or loss of the purchase under the sale terms.
- Keep the transaction record. Retain the winning notice, receipt, release paperwork, and any title or ownership documents supplied by the selling agency.
Never take property from a government site because it appears discarded. Only the owning agency or its authorized sale contractor can transfer possession.
How eligible organizations obtain donated property
A public agency, qualifying nonprofit, or other eligible organization should contact its State Agency for Surplus Property rather than approach an agency storeroom directly. The state agency reviews eligibility, identifies available federal surplus, coordinates requests, and explains fees and restrictions.

Questions to answer before accepting a donation
- Does the organization meet the state agency’s eligibility category?
- What public purpose will the property serve?
- Can the organization begin using it within one year and keep using it for the required period?
- Who pays handling, transportation, storage, installation, repair, insurance, and disposal costs?
- Are there extra terms for aircraft, vessels, foreign gifts, weapons, animals, data-bearing devices, or hazardous equipment?
- Can the organization document use and return the property or reimburse value if the restrictions are violated?
State agencies can add terms beyond the federal baseline. Obtain the written conditions before arranging transport or spending money to modify the item.
State and local government property
Federal sources do not establish a universal process for state and local assets. A city may use sealed bids; a county may use an auction contractor; a school district may have board-approval and public-notice requirements; a state agency may operate its own surplus warehouse. The rules can also differ by asset class, such as vehicles, land, computers, firearms, or laboratory equipment.
To identify a nonfederal item, contact the owning body’s property manager, procurement office, finance office, clerk, or records office. Ask for the governing surplus policy, the declaration that the item is no longer needed, the approved sale or donation channel, inspection rules, and the deadline for bids or pickup. Treat an answer from a site employee or a neighboring agency as incomplete unless that person has disposal authority.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Real property: land and buildings
Federal land and buildings follow a separate GSA process. Possible routes include transfers to government agencies for public purposes, public-benefit conveyances for eligible uses and entities under specific statutes, negotiated sales in defined situations, and public auctions.
Individuals can browse federal real-property sales through realestatesales.gov. A property’s notice determines the available use, eligibility, title information, environmental disclosures, minimum conditions, and sale method. Do not assume that a personal-property donation rule, such as the one-year use requirement, applies to real estate.
State and local land and building dispositions require separate jurisdiction-specific research. Zoning, environmental review, public hearings, appraisal, and title procedures can be decisive, but none should be inferred from the federal personal-property process.
Special-property and compliance checks
General guidance is not enough for every asset. Before transfer or disposal, route the item to the appropriate property officer and specialist when it involves:
- Aircraft or vessels: additional eligibility, title, safety, and use restrictions may apply.
- Firearms or weapons: security, registration, transfer, and destruction rules can control the disposition.
- Animals: welfare, transport, receiving-facility, and specialized federal or state requirements may apply.
- Electronics and data-bearing equipment: follow agency-approved privacy and data-security procedures before reuse, donation, sale, or recycling.
- Hazardous or contaminated equipment: identify substances and decontamination, packaging, transport, and waste requirements before moving it.
- Export-controlled or restricted items: verify whether the recipient, destination, technical data, or end use is permitted.
- Vehicles and titled equipment: confirm title, lien, identification, condition, and the paperwork supplied by the selling or transferring agency.
These checks are asset-specific. The general federal surplus pages do not replace the applicable specialist rule or the owning agency’s written approval.

Common mistakes and how to correct them
Calling an unused item surplus
Problem: “Surplus” is used as a synonym for old or unwanted. Correction: verify the internal-use decision, GSA screening result, and formal disposition status.
Assuming possession equals ownership
Problem: A contractor, grantee, tenant, or facility operator is treated as the owner. Correction: check title and the property record; the government can retain title while another party holds the item.
Skipping the custodian and asset record
Problem: The item is moved, cannibalized, or shown without accountability. Correction: assign a custodian, update PPMS or the agency record, and authorize every release.
Offering a federal item directly to a favorite recipient
Problem: An agency bypasses federal screening or the State Agency for Surplus Property. Correction: use the prescribed channel and let the responsible program determine eligibility.
Ignoring removal economics
Problem: A buyer wins a low-priced lot but cannot load or transport it before the deadline. Correction: inspect when allowed, plan labor and equipment, and calculate all removal costs before bidding.
Destroying equipment without environmental or data controls
Problem: Electronics, batteries, chemicals, or stored information are discarded as ordinary waste. Correction: follow approved sanitization, hazardous-material, recycling, and record-retention procedures.
Recommended Free Tools
Applying federal rules to local property
Problem: A reader assumes GSA forms or donation rules govern a city or school district. Correction: identify the owner and obtain that jurisdiction’s written policy and authorized contact.
