How to Hire Software Engineers in Latin America: A Country-by-Country Compliance Checklist

You can hire a software engineer who works in Latin America, but there is no region-wide contractor rule that makes the arrangement legally risk-free. The worker’s actual country and work location, the way the job is performed, and that country’s labor and tax laws matter. A contractor label—or an employer-of-record (EOR)—does not settle classification or eliminate every obligation. Have counsel in the worker’s country review the arrangement before onboarding.

How do I hire developers in Latin America without legal risk?

You cannot guarantee a risk-free hire. You can reduce avoidable exposure by deciding where the person will work, assessing the real relationship under the applicable law, and confirming local requirements before work begins. “Latin America” is a useful regional description, not one employment-law jurisdiction.

A U.S. company can engage a LATAM engineer as an independent contractor only if the actual arrangement qualifies under the laws that apply. A contract heading alone does not establish that status. The worker’s location may bring local rules into play even when the hiring company has no local office.

The examples below cover Argentina, Colombia and Mexico, plus the U.S. federal classification analysis. They are not a country-by-country survey or an opinion on any particular hire. Local labor and tax counsel should confirm the current rules and facts for the specific country and arrangement.

Why the worker’s location and actual work arrangement matter

Classification follows the relationship, not just its label

Before choosing a contract, examine how the work will actually operate: who directs it, whether it is ongoing, how the person is paid, and how much independence the person has. The legal test and consequences vary by country. If the arrangement functions like dependent employment, calling the worker a contractor may not resolve the issue.

Remote work can add duties to ordinary employment requirements

A country’s remote-work or telework rules may require written terms, equipment or expense coverage, data protections, social-security registration, or respect for working-time and disconnection rules. Which provisions apply depends on the country and the work pattern.

Cross-border rules are specific, not interchangeable

A worker living in one country and a company based in another does not automatically make the employer’s home-country law decisive. Some statutes address foreign employers or particular transnational arrangements directly. Their scope can turn on where work is performed and where the contract was concluded.

What the laws say in Argentina, Colombia and Mexico

Argentina: dependent service, a conditional presumption exception, and work-location law

Argentina’s Law 20,744 frames an employment contract around a person providing services for another under that party’s dependence in return for remuneration. Article 23 provides a presumption when services are performed under dependency. Its text amended in 2026 provides that the presumption does not apply to specified contracts for works or professional or occupational services when conditions involving receipts, invoices, or qualifying payment methods are met. That is a conditional legal provision, not an automatic contractor safe harbor; assess both the requirements and the real working relationship with Argentine counsel.

The current text reflects amendments effective March 6, 2026. Older summaries may not account for that change. Argentina’s updated telework law also directs that, for transnational telework, the law of the place where the worker performs the tasks applies. It addresses privacy in monitoring and protection of work information.

Colombia: foreign companies contracting workers in the country are expressly covered

Law 2121 of 2021 establishes a remote-work arrangement and expressly applies to foreign companies that contract workers located in Colombia. It treats remote work as a mode of an employment contract, preserves maximum working-time limits and non-waivable minimum rights, and permits agreed schedules within those limits. A foreign company should not assume that having no Colombian entity removes this law from consideration.

Separately, the 2025 additions to consolidated Law 1221 of 2008 address transnational teleworkers whose employment contract was concluded in Colombia. Those provisions specify Colombian law for that relationship and require occupational-risk coverage for certain work performed abroad. This is a defined case; it should not be generalized to every cross-border worker or contract.

Mexico: a threshold determines whether the telework chapter applies

Mexico’s Federal Labor Law defines covered telework as subordinate, paid work away from the employer’s premises using information technologies, where work from the employee’s home or chosen location exceeds 40% of working time. Occasional or sporadic work is excluded from that chapter. The threshold is part of the statutory definition, not a general rule for every remote worker in Latin America.

For covered telework, written conditions are required. Employer duties include providing and maintaining necessary equipment, covering relevant telework costs, protecting data, registering workers for mandatory social security, and respecting the right to disconnect. Confirm the currently applicable consolidated law and implementing standards for the proposed arrangement.

How a U.S. company should use U.S. classification guidance

The U.S. Department of Labor’s Fair Labor Standards Act (FLSA) guidance describes a six-factor analysis of employee versus independent-contractor status:

  • The worker’s opportunity for profit or loss.
  • The worker’s investment.
  • The permanence of the relationship.
  • The nature and degree of control.
  • Whether the work is integral to the potential employer’s business.
  • The worker’s skill and initiative.

The Department states that its 2024 rule became effective on March 11, 2024. This is an input to the U.S.-law portion of the analysis; it does not replace the worker-location country’s laws. Check current agency policy and litigation status before treating the rule as controlling, and get advice on the local-law analysis separately.

Choose a hiring route only after checking local fit

Direct employment through a local entity, an EOR arrangement, and genuine independent services are different routes to investigate—not a ranking from safest to riskiest. What each route can handle depends on the country, provider or entity, and facts. An EOR or payroll provider is a service category, not a guarantee against liability.

Route Classification fit Responsibilities and administration to verify Key limitation
Direct employment through a local entity Assess whether the role is employment under the worker’s country law. Confirm local contracting, payroll, tax withholding, social security, benefits, hours, leave, termination, and telework equipment or expense duties. Entity setup, tax, registration, and operating obligations depend on the country and company facts.
Employer of record Check how the arrangement is structured and whether it fits local employment law; the service label does not decide worker status. Confirm in writing which party handles the employment contract, payroll, withholding, social security, benefits, equipment and expenses, data, and termination administration. Do not assume an EOR transfers or eliminates every legal obligation. Local counsel should assess the arrangement.
Independent services Use only where the actual relationship qualifies under the relevant local law; do not rely on the contract title. Confirm invoicing and payment requirements, tax treatment, social-security responsibilities, IP and confidentiality terms, data handling, and any applicable remote-work rules. Misclassification exposure depends on the real work relationship and applicable law.

For any route, review intellectual-property assignment, confidentiality, privacy and monitoring practices, and data handling with local counsel. Assess corporate tax, permanent-establishment, foreign-exchange, and entity-registration implications separately; the labor rules described here do not determine those questions.

Pre-onboarding compliance checklist

  1. Confirm the work location. Record the worker’s actual country and work location, and require notice before a move or other location change. A change can affect which rules need review.
  2. Decide the intended relationship from the facts. Document how the work will be directed, paid, scheduled, and integrated into the business. Have local counsel assess whether those practices support employment or genuine independent services.
  3. Check country-specific obligations. Confirm written-contract terms, registration, payroll, withholding, social security, hours, leave, benefits, termination, and remote-work expense and equipment requirements.
  4. Review information and work-product terms. Check privacy and monitoring, data security, confidentiality, and IP assignment for the country and the systems the engineer will use.
  5. Analyze company-level exposure separately. Ask tax and corporate counsel about permanent establishment, foreign-exchange restrictions, and entity-registration obligations; a worker-status analysis does not resolve these.
  6. Compare hiring routes with counsel. Evaluate direct local employment, an EOR, and genuine independent services against local classification rules, who is responsible for each duty, payroll and social-security handling, remote-work costs, IP and data protections, setup and administration, and termination obligations.

What this guide can—and cannot—establish

The cited legal examples establish that local rules can materially shape classification, remote-work duties, and cross-border treatment. They do not establish one compliant hiring structure for every Latin American country, determine the status of an individual engineer, or settle company tax exposure. Before onboarding, obtain current advice from labor and tax professionals in the worker’s country and, where relevant, the hiring company’s jurisdiction.
