For an Indian contract-manufacturing export, the correct GST result depends on the legal supply chain—not on the label “contract manufacturer.” First identify the registered principal, the job worker, the owner of the goods, the party making the export supply, and the GSTIN in whose electronic credit ledger the input tax credit (ITC) sits. Then choose between the two zero-rated routes: export under a valid Letter of Undertaking (LUT) or bond without paying IGST and claim eligible unutilized ITC, or pay IGST on the export and seek a refund of that tax. Preserve job-work movement records, satisfy the one-year and three-year statutory return periods, file the electronic refund application with export evidence, and calculate the claim under the applicable Rule 89 formula. The exact claimant, amount and limitation date cannot be determined without the contracts, invoices, registrations, shipping documents, ledger and current notifications.

Why the contract-manufacturing structure matters

Section 16 of the Integrated Goods and Services Tax Act, 2017 treats the export of goods or services as a zero-rated supply. Zero-rating is not the same as an ordinary exemption: an eligible supplier can generally use ITC and claim a refund through one of the statutory routes, subject to the conditions in the IGST Act, the Central Goods and Services Tax (CGST) Act and the refund rules. Section 17(5) exclusions and other statutory restrictions still apply.

A contract-manufacturing arrangement can contain several distinct supplies. A principal may own imported or domestically purchased inputs, send them to a job worker for processing, receive finished goods, and export them. Alternatively, the job worker may be the supplier that exports, or the principal may arrange direct delivery to the job worker before export. The words “contract manufacturer” do not decide who made the zero-rated supply or who is entitled to the refund.

  • Which entity owns the inputs, work in progress and finished goods at each stage.
  • Which entity is the registered principal and which entity is providing job-work processing.
  • Whether goods move under job-work challans, ordinary tax invoices, delivery documents or a combination.
  • Who invoices the overseas customer or other export recipient.
  • Which GSTIN appears on the export invoice, shipping bill or bill of export.
  • Which GSTIN paid the input tax and holds the credit in its electronic credit ledger.
  • Whether the export is of goods, services, or a mixed arrangement with separate supplies.

These facts determine who made the zero-rated supply, whose turnover enters the refund calculation and whose ledger can be debited for a claim. Sections 16 and 19 provide the general framework, but they do not resolve every contractual or documentary variation.

How ITC works when the principal sends goods to a job worker

The principal can claim ITC on goods sent for job work

CGST Act section 19 allows the principal to claim ITC on inputs and capital goods sent to a job worker. The principal may claim the credit even when the goods are sent directly from the vendor to the job worker without first being brought to the principal’s own premises. The statutory wording expressly covers this direct-dispatch situation.

The credit belongs to the entity that satisfies the normal ITC conditions and owns the relevant procurement, not automatically to the processor that physically receives or transforms the goods. The job worker’s possession of the material is therefore not, by itself, evidence that the job worker may claim the principal’s ITC.

Track the statutory return periods

Section 19 sets a one-year period for inputs and a three-year period for capital goods sent to a job worker, measured from the date of their dispatch, subject to the statutory conditions. The relevant goods must be returned to the principal or supplied from the job worker’s premises within the applicable framework. Check the current provision for any permitted extension or specific exception before concluding that a period has expired.

If the statutory conditions are not met, the law can deem the principal to have supplied the inputs or capital goods to the job worker on the date they were originally dispatched. That deemed-supply consequence can create output-tax and documentation obligations. Do not wait until a refund audit to discover that an old challan has no return, supply or approved extension trail.

Controls that make the credit defensible

  • Maintain a goods-wise register showing the description, quantity, serial or batch number, value, dispatch date and receiving job worker.
  • Link every movement to the job-work challan and, where applicable, the vendor’s invoice and e-way documentation.
  • Record the date and quantity returned, consumed in processing, scrapped, or supplied onward from the job worker’s premises.
  • Reconcile opening balances, additions, returns and closing balances with the principal’s inventory and production records.
  • Keep proof of direct delivery where goods went from a vendor to the job worker.
  • Flag inputs approaching one year and capital goods approaching three years for management action.
  • Document any statutory extension or exception relied on under the law in force for the relevant period.

Choose the zero-rated refund route

Section 16 provides two broad routes for an eligible registered supplier. The choice affects cash flow, ledger usage, documentation and the restrictions that must be checked.

Decision point LUT or bond, without IGST IGST paid on export
Tax at export The zero-rated supply is made without payment of IGST under a valid LUT or bond and its conditions. IGST is paid on the zero-rated supply.
Refund sought Refund of eligible unutilized ITC attributable to the zero-rated supply. Refund of the IGST paid on the eligible export, subject to the current rules and restrictions.
Main reconciliation Zero-rated turnover, Net ITC, adjusted total turnover, eligible credits and the electronic credit ledger. Export invoice, tax payment, shipping or export records and the current eligibility conditions for the IGST-paid route.
Key verification LUT or bond validity, section 17(5) exclusions, section 54 restrictions and Rule 89 calculation. Current notifications and restrictions, tax actually paid, export evidence and any conflicting drawback or refund benefit.

This table describes the statutory characteristics, not a universal recommendation. Select the route only after confirming the exporter’s registration, the relevant tax period, current amendments and the benefits already claimed.

When the LUT route is usually considered

The LUT route avoids funding IGST at the time of export, which can be important when a principal regularly accumulates credit on materials, packaging, machinery or job-work inputs. The refund is limited to eligible unutilized ITC attributable to zero-rated turnover; it is not a refund of every balance in the ledger. Credit blocked by section 17(5), credit unrelated to the claim, and amounts failing the refund rules must be excluded.

When the IGST-paid route is considered

Paying IGST can produce a refund of the tax charged on the eligible export, but the exporter must first fund that payment and satisfy the applicable export and refund conditions. Confirm the current system and rule pathway for the relevant transaction. Do not rely on an old description of Rule 96(10) or a historical circular without checking later amendments and notifications. Circular No. 125/44/2019-GST is dated guidance and should be read as historical clarification rather than a substitute for the law currently in force.

Prepare the LUT or bond route correctly

1. Confirm the supplier and the LUT period

Verify that the entity making the zero-rated supply is the registered person using the LUT or bond. Retain the accepted LUT or bond details for the period in which the exports occur and confirm that any required undertaking, signature, furnishing or renewal has been completed under the current portal procedure. A job worker’s LUT does not automatically cover an export made and invoiced by the principal, and the principal’s LUT does not automatically cover a separate export made by the job worker.

2. Separate eligible and ineligible credits

Start with purchase and expense ledgers for the claim period. Identify ITC actually availed, then remove blocked credits under section 17(5), reversals, personal or non-business components, credits attributable exclusively to domestic or exempt supplies, and any amount otherwise disallowed by the refund rules. Reconcile the resulting Net ITC with the electronic credit ledger and returns.

3. Establish the relevant turnover

Compile export invoices, shipping bills or bills of export, export dates, quantities, values and the GSTIN used. Determine zero-rated turnover for the period under the definition applicable to the formula. Compile adjusted total turnover for the same period, applying the rule’s treatment of domestic supplies, exempt supplies, exports and other components. Do not substitute the value in a commercial contract for the turnover measure prescribed by Rule 89.

4. Apply the Rule 89 calculation

For a refund of unutilized ITC on zero-rated supplies without payment of tax, Rule 89 uses a formula based on zero-rated turnover, Net ITC and adjusted total turnover. In simplified form, the calculation is:

Refund = (Zero-rated turnover × Net ITC ÷ Adjusted total turnover) − tax payable on zero-rated supplies

Use the definitions and version of the rule applicable to the claim period. The formula is a ceiling based on attributable credit; it is not permission to claim the entire electronic ledger balance. Retain the working paper showing each numerator and denominator, the invoices included, exclusions, rounding and the resulting amount.

5. Account for the ledger debit

The refund rules provide for debit of the electronic credit ledger for the amount claimed. Confirm that the ledger has sufficient eligible balance and that the debit, return filings and accounting entries agree. If the claim is reduced or rejected, reconcile the sanctioned amount, rejected amount and re-credit treatment shown in the applicable order or portal record.

Evidence file for a contract-manufacturing export

A refund reviewer must be able to connect the purchase, job-work movement, export and credit claim. Build one indexed file for each claim period containing:

  • Principal and job worker GST registration details and the written manufacturing or job-work agreement.
  • Purchase invoices identifying the principal as recipient, including invoices for goods delivered directly to the job worker.
  • Job-work challans, e-way records where required, goods-receipt acknowledgements and processing instructions.
  • Return, consumption, scrap and onward-supply records, with reconciliation to quantities dispatched.
  • Export tax invoices, shipping bills or bills of export, export general manifest or export report evidence and transport records.
  • Foreign remittance or other evidence required for the particular export category, where applicable under the current rules.
  • Electronic credit-ledger extracts, GSTR filings, purchase registers, ITC reversals and the Net ITC computation.
  • LUT or bond acknowledgement and correspondence relating to amendments, extensions or deficiencies.
  • Drawback, incentive and other refund declarations so that mutually inconsistent benefits are not claimed.

For a goods-export refund, do not substitute evidence meant for service exports or supplies to a special economic zone. The supporting statement must match the category selected in the application.

File the electronic refund application

Before opening FORM GST RFD-01

  1. Confirm the claimant GSTIN, refund category, tax period and zero-rated route.
  2. Check that returns required for the period have been filed and that the credit ledger reflects the credits included in Net ITC.
  3. For exported goods, verify that the export manifest or export report has been delivered before filing. The refund rules require this condition before the application is submitted.
  4. Reconcile invoice numbers, shipping-bill numbers, dates, port details, taxable values and export values across the books, customs records and the portal.
  5. Check whether any drawback or other benefit election restricts the ITC refund or conflicts with the route selected.

Submit the application

  1. In the GST portal, open the refund service and select the category for refund of unutilized ITC on zero-rated supplies without payment of tax, or the applicable category for the route actually used.
  2. Enter the claim period, turnover figures, Net ITC and the amount calculated under the applicable Rule 89 formula.
  3. Upload the required statements and supporting records, including invoice and export-document details for goods.
  4. Review the declaration, verify that the claim is made by the correct registered supplier, and submit using the authorised signatory or electronic verification method available for the GSTIN.
  5. Save the acknowledgement, application reference, uploaded statement and ledger-debit record with the claim file.

The rules prescribe electronic FORM GST RFD-01 and supporting statement requirements. Portal labels and upload formats can change, so follow the current instructions displayed for the selected refund category rather than an old screenshot or checklist.

Respond to a deficiency or clarification

If the officer issues a deficiency memo or asks for clarification, answer each point with a document-level reconciliation. For a job-work issue, show the challan trail and return or supply date. For an ITC issue, show the invoice, tax payment, eligibility analysis and ledger entry. For an export issue, show the shipping bill, export report or manifest status and the corresponding invoice. Preserve the response and any revised filing reference; do not silently replace the original workings.

Deadlines and the relevant date

CGST Act section 54 sets a general two-year period for a refund application from the relevant date. The relevant date is not identical for every refund category. Export-goods claims, export-services claims, accumulated ITC claims and other categories can use different statutory starting points. Determine the date under the provision applicable to the exact claim; do not count two years from the invoice date by default.

Restrictions that commonly reduce or block a claim

Export duty

Section 54 excludes goods exported subject to export duty from the relevant unutilized-ITC refund route. Confirm the tariff treatment of the exported goods and the claim category before including their turnover.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Blocked or reversed ITC

Section 17(5) blocked credits cannot be used merely because the final product is exported. Reversed credit, ineligible invoices, credits attributable to exempt or non-business use and credits not actually availed must be removed from Net ITC.

Conflicting benefits

Section 54 and the refund rules contain restrictions where a claimant has taken drawback or another refund or tax benefit. Document the election made for each export shipment and check the current rule wording. A claim should not seek the same tax component twice through different mechanisms.

Incorrect claimant

A principal that owns materials but is not the exporter on the invoice and shipping documents may not be able to claim the export refund for that supply. Conversely, a job worker that merely processes the principal’s goods should not assume it can claim the principal’s unutilized ITC. Review the contract, invoice flow, customs documents and GSTIN before filing.

Stale guidance

Refund procedures and eligibility restrictions have changed through amendments and notifications. Historical circulars can explain the background but cannot establish the law on the filing date. Check the current Acts, rules, notifications and portal instructions for the relevant period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Worked framework for a typical arrangement

Assume a principal buys fabric and accessories, instructs a registered job worker to stitch finished garments, and exports the garments under the principal’s invoice and GSTIN using an LUT. The principal should:

  1. Retain ITC on eligible purchases in accordance with the normal credit conditions, including purchases delivered directly to the job worker.
  2. Record each dispatch under job-work documentation and track the one-year input period and any capital-goods period separately.
  3. Match returned or exported quantities to the challan register and investigate shortages, scrap or unreturned goods before a deemed-supply issue arises.
  4. Compile the principal’s export invoices and shipping records, confirm manifest or export-report delivery, and calculate zero-rated turnover and adjusted total turnover for the claim period.
  5. Exclude blocked, reversed or otherwise ineligible credit, apply the Rule 89 formula, debit the eligible amount from the principal’s electronic credit ledger and file RFD-01.

If instead the job worker buys its own materials, invoices the overseas customer and appears as exporter on the shipping bill, that is a different supply chain. The job worker’s ITC and refund analysis must be performed for its GSTIN; the principal cannot simply transfer its ledger balance to that claim.

Troubleshooting by symptom

“The portal shows no export data”

Check that the shipping bill or bill of export uses the correct GSTIN, the export report or manifest has been delivered, invoice numbers and dates match, and customs data has had time to transmit. Keep documentary proof and correct the underlying data through the prescribed channel before filing a claim that depends on the missing record.

“Our Net ITC is higher than the ledger balance”

Reconcile purchase registers, returns, reversals and prior refund debits. Net ITC for the formula is not automatically the same as every credit appearing in an accounting system. Remove blocked or reversed amounts and investigate timing differences between books and the electronic ledger.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Goods remained with the job worker too long”

Prepare a challan-wise ageing report. Identify whether the goods were returned, supplied from the job worker’s premises, consumed under an allowed process, or covered by a statutory extension or exception. Obtain current professional advice on the applicable provision before treating the movement as a deemed supply, and quantify any output-tax and interest exposure.

“The export was made under the wrong route”

Do not alter invoices or claim both routes for the same tax. Review whether the supply was made under a valid LUT or with IGST, whether tax was actually paid, and what correction or refund mechanism the current rules permit for that period. Preserve the original documents and seek a written determination for a material amount.

A practical pre-filing checklist

  • The exporting supplier and claimant GSTIN are identified and agree across invoice, shipping and portal records.
  • The principal–job-worker contract establishes ownership, processing responsibility and document custody.
  • Every input and capital-good dispatch has a challan, receipt and status record.
  • One-year input and three-year capital-goods clocks have been reviewed.
  • The LUT or bond was valid for the exports, or the IGST-paid route is supported by tax-payment records.
  • Eligible Net ITC excludes section 17(5) credit, reversals and credit unrelated to the zero-rated supply.
  • Zero-rated turnover and adjusted total turnover follow the definitions in force for the claim period.
  • Export manifests or reports were delivered before a goods-export RFD-01 application.
  • Shipping bills, bills of export, invoices and statements reconcile exactly.
  • Export duty, drawback and other refund restrictions have been checked.
  • The two-year section 54 period is calculated from the correct relevant date for each claim.
  • The claim amount, ledger debit and accounting entry agree and all acknowledgements are archived.

What must be verified before relying on the process

The CBIC-published text of the IGST Act, CGST Act, refund rules and sectoral FAQs provides the statutory framework for zero-rating, job-work ITC and RFD-01 claims. The Acts and rules consulted do not, by themselves, establish a fully consolidated amendment history through October 2026. Verify the current text, notifications and portal instructions at the time of filing, especially for IGST-paid export restrictions and Rule 96-related conditions. A final entitlement opinion requires the contracts, GST registrations, invoice flows, ownership and movement records, shipping documents, LUT status, tax periods, ledger entries and drawback or other benefit elections.
