Put the access method, handoff and return arrangements, permitted users, and what happens if something goes wrong in writing. Rules vary by location and by whether the space is tied to a home tenancy or rented separately.
Confirm you can rent the space and provide access
Before advertising or booking, check the property documents and applicable building rules. A lease, title conditions, property manager, or building association may restrict renting the space or issuing keys, fobs, permits, or access codes. Do not assume that owning or using a space automatically gives you permission to rent it out.

Also establish whether the parking space is part of a home tenancy or a separate rental. The distinction can affect which agreement and rules apply. In France, official guidance says a parking space attached to a home should be listed as an annex to the home lease and follow that lease’s rules; a separate parking rental can have negotiated terms. That is a France-specific explanation, not a rule to apply elsewhere. See France’s Service-Public guidance on renting a parking space.
Put the rental and access terms in writing
For a separate parking rental, France’s Service-Public guidance recommends a written contract specifying matters such as rent and payment date, rent review, duration, and termination. Local law may prescribe or restrict terms, so treat this as an example rather than a universal contract template.

For day-to-day access, record the details that prevent avoidable disputes:
- The exact space and the dates or hours it may be used.
- Which person or vehicle is authorized to use it, and any vehicle or user limits.
- How the renter enters: physical key, fob, permit, digital permit, or code. - When and how equipment will be handed over and returned, including the deadline and how a missing item must be reported.
- Who to contact if entry fails, the space is blocked, or a parking charge arrives.
- How a claimed loss or damage will be documented, and how an access outage will be handled.
Agree how reasonable replacement costs will be evidenced before the rental starts. GOV.UK says a landlord relying on England’s tenancy-fee rules must show that a replacement cost is reasonable; whether that guidance applies to a particular parking rental depends on the arrangement. Choose an access method that is permitted and manageable
There is no single best handoff method for every building. Compare the practical trade-offs before choosing:

Whichever method you use, consider reliability outside staffed hours, the risk of a copied or exposed key or code, and the effort and cost of replacing equipment. A platform’s access and deposit rules are its own terms, not universal requirements.

Document the handoff and return
- Record what was issued. Note whether the renter received a key, fob, permit, or code and when. For physical equipment, identify it clearly enough to distinguish it from other keys or fobs.
- Explain how to use it. Cover gates, bollards, opening hours, and any access restrictions. Where practical, confirm the renter can enter before the handoff is complete.
- Keep a dated record. Save the handoff confirmation and any receipt, replacement quote, or other evidence relevant to a later loss or damage claim.
- Confirm the return deadline. Agree where equipment goes and how the renter should report an item that is lost or not working.
If the booking uses a platform, its deadlines may differ from your agreement. For example, YourParkingSpace says a deposit-backed end-of-rental claim must be made within 48 hours after the final rental day. It also distinguishes eligible monthly bookings with a deposit from hourly or daily bookings without one, and says a loss or damage claim relies on a replacement receipt. Check the platform’s current terms for the booking in question; these are not general rules for parking rentals.
Respond to failed entry, blocked spaces, or damage
If the renter cannot get in
The renter should contact the named owner or manager promptly and keep the message, booking confirmation, and evidence of the failed device or blockage. Do not force a locked bollard or other access mechanism. YourParkingSpace advises users to contact the owner and then platform support; if damage occurs, it recommends keeping photos and a repair quotation. Follow the relevant platform’s current process if the booking was made through one.

If equipment is lost or damaged
Compare the report with the handoff record, then ask for an itemized receipt or other written evidence for any replacement cost being claimed. If you are claiming a cost, keep the replacement receipt and follow any applicable agreement or platform deadline. A platform deposit or claim process may depend on booking type and length, so do not treat it as automatic coverage.
Handle a parking charge separately from rent
A private parking charge is an enforcement matter, not rent or a parking tariff. The agreement should say who responds to a notice and who supplies evidence such as the booking confirmation, authorized vehicle details, or access record.

Keep the notice, booking record, vehicle details, and evidence that use of the space was authorized. Follow the appeal route and deadlines printed on the notice. The UK government’s parking consultation describes private parking charges and explains that statutory keeper or hirer liability may apply in certain circumstances in England and Wales; the rules are jurisdiction-specific. The consultation also reports that over 90% of parking charges were issued by ANPR, citing the British Parking Association Census 2024. Check local rules before relying on a template or platform process
The examples above do not establish a universal rule for deposits, permission, insurance, termination, damage liability, or dispute forums. France’s lease guidance applies to France; the cited UK consultation covers England, Scotland, and Wales for its consultation scope, while its keeper or hirer liability discussion specifically concerns England and Wales. GOV.UK’s replacement-cost guidance relates to tenancies in England. Identify the location and the relationship between the space and any home tenancy before relying on legal guidance.
