Do not ignore an Indian GST notice just because the amount is small. Save the complete notice, identify its form, section, tax period, service date and reply deadline, then reconcile the department’s calculation with your returns and records. You may need to dispute it, pay it, or respond before a hearing. The correct route depends on what was served; no single deadline or payment rule applies to every GST notice.

First, work out what you actually received

“GST notice” can describe several different documents. A preliminary intimation, a show-cause notice, a summary uploaded in FORM GST DRC-01, and an adjudication order do not put you at the same procedural stage. Read the entire document and every attachment before deciding whether to pay.

What to identify Why it matters
Form number and portal reference Forms point to different response and payment routes. A DRC-01 summary, for example, is not an order.
Issuing authority and statutory section The section determines the legal allegation, available response and possible consequences. Older section 73 or 74 assumptions may not fit a later tax period.
Tax period Amendments and commencement dates can change which demand framework applies. Recent GST Council material refers to section 74A, but the enacted law and effective date for your period must be checked.
Date and method of service Reply and appeal periods are generally calculated from communication or service, not from the day you happen to open the document.
Tax, interest and penalty separately A headline amount may combine three legally different components. A small tax figure does not automatically remove interest or a penalty.
Reply deadline and hearing instruction Missing a deadline or a scheduled personal hearing can leave the officer deciding on the available record.

Download the notice and attachments from the GST portal, keep the original email or other service evidence, and make a note of every date. If the document is incomplete, ask through the prescribed channel for the missing annexure rather than assuming the amount or deadline.

Why a small amount still requires a response

GST law does not create a general “small-demand” exemption. The notice remains effective until it is withdrawn, corrected, paid through the applicable process, or replaced by a lawful order. Ignoring it can lead to an order, additional interest, recovery action or loss of the chance to explain an error.

The amount printed in the notice may also be only the tax component. Check whether the calculation adds interest for the relevant period, a percentage-based penalty, a fixed penalty, or a separate late fee. Ask the officer or your adviser to identify the legal basis for each line before paying.

What section 126 does—and does not—protect

Section 126 of the Central Goods and Services Tax Act, 2017 deals with penalties for minor breaches and certain documentation mistakes. The CBIC text states: “No officer under this Act shall impose any penalty for minor breaches of tax regulations or procedural requirements and in particular, any omission or mistake in documentation which is easily rectifiable and made without fraudulent intent or gross negligence.”

The ₹5,000 threshold is narrow

The Act’s explanation treats a breach as minor when the amount of tax involved is less than ₹5,000. “Less than” does not mean ₹5,000 or less: an amount exactly equal to ₹5,000 is outside that wording. The figure is a statutory threshold in the section 126 explanation, not a statistic about how often notices are issued.

Conditions still apply

Section 126 also requires the error to be easily rectifiable and made without fraudulent intent or gross negligence. The section directs that a penalty be based on the facts and circumstances and be commensurate with the breach. Before a penalty is imposed, the taxpayer must receive an opportunity to be heard, and an order imposing a penalty must state the nature of the breach and the applicable law or procedure.

Important exclusions

The section excludes cases in which the penalty is a fixed sum or is expressed as a fixed percentage. It is therefore unsafe to tell an officer that every demand below ₹5,000 must disappear. Section 126 does not operate as a blanket waiver of the underlying tax or interest, and it does not decide disputes involving fraud, suppression, gross negligence or a fixed-penalty provision.

A practical response sequence

  1. Record service and due dates. Write down the date and method of service, the reply date, any hearing date, the portal reference, the issuing authority, form number, tax period and cited section. Save a PDF of the notice and attachments.
  2. Reconcile the department’s figures. Compare the alleged discrepancy with filed returns, invoices, credit notes, e-invoice or e-way records where relevant, ledgers, bank entries, payment challans and earlier correspondence. Recalculate tax, interest and penalty as separate lines.
  3. Classify the factual position. Decide whether the department is wrong, partly right, or right on the stated facts. A disagreement may concern the transaction itself, a return-period mismatch, input-tax-credit eligibility, arithmetic, payment already made, or the legal provision selected.
  4. Check whether a minor, rectifiable error is genuinely involved. If you rely on section 126, explain the visible documentation mistake, why it is easily corrected, the absence of fraud or gross negligence, and the evidence supporting those points. Do not present the threshold as an automatic cancellation of tax.
  5. Choose the procedural route. Dispute incorrect figures or legal grounds; accept and pay only after confirming the amount and consequences; or accept some items and contest the rest. If the notice asks for a written reply or hearing, payment alone may not close the proceeding.
  6. Use the form named by the applicable rule and notice. Under Rule 142 of the CGST Rules, where a notice summary is uploaded in FORM GST DRC-01, the reply is furnished in FORM GST DRC-06. FORM GST DRC-03 is used to communicate payment in the circumstances specified by the rule. Keep the complete filed form and portal acknowledgement.
  7. Attend or request the hearing properly. If the notice offers a personal hearing, use the stated method and date. If you need a rescheduling or clarification, make that request before the deadline and preserve proof of submission.
  8. Monitor the portal after filing. A submission is not complete merely because you drafted it. Confirm that the portal shows successful filing, download the acknowledgement, and check for a subsequent order or communication.

Rule texts and portal workflows can be amended. Follow the directions in the current notice and verify the current rule version rather than copying an old online procedure.

How to decide between disputing, paying and getting advice

Option Use it when What to do Main risk to control
Dispute The records, calculation or statutory basis is wrong. Answer each allegation in numbered paragraphs, attach the matching evidence and request that the proposed demand or penalty be dropped or corrected. A vague denial may be treated as no effective explanation.
Accept and pay The liability is verified and the notice’s payment route is available. Confirm tax, interest, penalty and payment head; communicate payment in the applicable form and retain the challan and acknowledgement. Payment may not by itself answer a required notice or preserve a challenge to an incorrect component.
Partly accept Some invoices or periods are correct but others are not. Separate accepted and disputed items, pay or communicate only what the applicable process permits, and provide a reconciliation. Lumping everything together can make a defensible partial position unclear.
Seek professional review The notice alleges fraud or suppression, concerns disputed input tax credit, covers a recurring or material issue, is near deadline, or follows an adverse order. Give a GST practitioner or tax lawyer the notice, records, service evidence and prior filings immediately. Waiting until after the deadline may leave little procedural relief.

Professional help is a category-level choice, not a guarantee of a particular outcome. Check the adviser’s jurisdiction, current GST experience, scope of work and fees before engaging anyone.

What a strong written reply contains

Use the notice’s sequence so the officer can match every answer to an allegation. A concise reply can still be detailed where the records require it.

  • Identification: GSTIN, legal name, notice reference, form, tax period, issuing authority and date of service.
  • Position: State whether you deny, accept or partly accept each proposed item.
  • Fact-by-fact response: For each discrepancy, give the invoice or return reference, the correct figure and the reason for the difference.
  • Legal basis: Cite the provision that supports your position. If relying on section 126, address the “less than ₹5,000” wording, rectifiability, absence of fraudulent intent or gross negligence, proportionality and the hearing requirement; explain any fixed-penalty exclusion rather than ignoring it.
  • Reconciliation: Show tax, interest and penalty separately and identify any amount already paid.
  • Evidence index: Number invoices, ledgers, returns, challans, correspondence and calculation sheets so each attachment is easy to locate.
  • Request: Ask for correction, dropping of the proposal, appropriate penalty treatment, or a hearing, as the facts support.

Do not attach unrelated volumes of records without an index. Make sure scans are readable, figures agree across documents, and confidential information not needed for the issue is protected where possible.

Records to collect before you answer

  • The complete notice, annexures and service message.
  • Returns for the exact tax period and relevant reconciliation reports.
  • Tax invoices, credit and debit notes, purchase and sales registers.
  • Input-tax-credit support, including supplier and payment records where relevant.
  • Electronic liability ledger, cash ledger, challans and any DRC-03 payment communication.
  • Bank statements or other proof of payment when payment is disputed.
  • Earlier replies, emails, inspection records and orders concerning the same issue.
  • A calculation sheet showing the department’s number, your number and the difference for each item.

DRC forms and orders: do not mix their roles

Rule 142 in the CGST Rules describes a summary of specified notices in FORM GST DRC-01, voluntary payment communicated in FORM GST DRC-03, and replies in FORM GST DRC-06 where the rule applies. It also describes FORM GST DRC-07 as the uploaded summary of an order specifying amounts payable.

These labels are not interchangeable. A DRC-01 summary signals a notice-stage response; DRC-06 is the prescribed reply in the situation covered by Rule 142; DRC-03 communicates payment in the rule’s specified circumstances; and DRC-07 records an order summary. Read the underlying document and directions rather than selecting a form because its number looks familiar.

If the document is already an order

An adjudication order is different from an initial notice. The GST Portal’s appeal FAQ gives a general period of three months from communication of an adjudicating authority’s decision or order for an aggrieved person to appeal. That statement is not a universal calculation for every case: verify the order, service date, applicable extensions or special rules, and current portal requirements.

Do not use a notice-reply deadline as though it were an appeal deadline, or assume that filing a reply to an earlier notice automatically appeals a later order. Preserve the order, communication proof, payment records and any request for a certified or corrected copy that the applicable process requires.

Common mistakes with small GST demands

Assuming “under ₹5,000” means no action

The section 126 threshold concerns a conditional definition of a minor breach and penalty treatment. It does not erase every tax, interest or procedure, and it does not cover every type of fixed penalty.

Looking only at the headline amount

Separate tax, interest, penalty and any other line item. A small tax principal can accompany a different amount calculated under another provision.

Using an old section 73 or 74 template

Demand provisions and effective dates change. Recent GST Council material refers to section 74A, so match the notice’s tax period and enacted law instead of copying a generic deadline from an older article.

Paying without preserving the explanation

If records show that the figure is wrong, submit the appropriate response and evidence. A payment entry may not communicate why the notice is incorrect or satisfy a required hearing opportunity.

Missing portal proof

Keep the acknowledgement number, filed PDF, challan, date and screenshots or downloaded confirmation. If the portal fails, record the error and use the official support or alternative route stated in the notice before the deadline.

Ignoring a fraud or suppression allegation

Such language materially changes the risk and is a reason to obtain individual advice promptly. Do not rely on the minor-breach argument without addressing the allegation and the evidence.

When to involve a GST practitioner or tax lawyer

Consider individual advice when the amount is disputed, the same issue may recur across periods, input-tax credit is involved, the notice alleges fraud or suppression, the officer has proposed a fixed penalty, an order has already been passed, or the deadline is close. Give the adviser the original notice and service evidence, not only a summary of what you remember.

An adviser can help distinguish a clerical error from a taxable discrepancy, test the calculation, identify the correct form and preserve appeal rights. Suitability depends on the adviser’s current knowledge of the relevant state, tax period and GST provisions.

A simple deadline checklist

  1. Today: download the notice, attachments and service proof.
  2. Today: highlight form, section, tax period, reply date, hearing date and each amount.
  3. Before the deadline: reconcile the figures against returns, invoices, ledgers and challans.
  4. Before filing: decide which items are disputed, accepted or partly accepted and prepare an indexed evidence set.
  5. On filing day: use the applicable portal form, submit the reply or payment communication, and download the acknowledgement.
  6. After filing: monitor for a hearing notice, clarification request or order and save every subsequent communication.
  7. If an order arrives: calculate the potential appeal period from its communication date and obtain advice immediately if you disagree.

What cannot be determined from the title alone

No one can state your exact reply deadline, payment amount, applicable section, interest calculation, penalty exposure or appeal date without seeing the notice, tax period, state, service date and current law. Treat general guidance as a way to organize your response, not as a determination that the demand is valid or invalid.
