Start with the consequences of the decision—not the vendor’s description of its product. A matching or ranking system can raise significant legal and worker-impact concerns when its output influences recruitment, promotion, task allocation, evaluation, or another work decision, even if a person formally makes the final choice.
The rules depend on jurisdiction, purpose, the data involved, and the system’s practical influence. The framework below draws on European Union and United Kingdom regulatory materials and the voluntary NIST AI Risk Management Framework; it is not a substitute for checking the law that applies where the system is used.

Begin with the decision the system can influence
“Skills data” can mean a credential, a self-reported capability, a manager’s assessment, a score inferred from work history, or a model-generated estimate of potential. Those records are not interchangeable. A skills profile may appear to be a development aid but become an input to promotion, hiring, performance evaluation, or work allocation. Map the full decision path, including later systems that reuse the profile or score.

Classification depends on the system’s actual intended purpose and use. A human reviewer does not by itself settle the question if a ranking or score is a primary input to the decision.
#1 Best Overall
Record whether the system is used for exploration, recommendations, ranking, or an automated outcome; who sees the output; what other evidence they consider; and what practical effect a low score, missing skill, or incorrect match can have. Also record who is responsible at each stage: development, procurement, configuration, deployment, and ongoing monitoring.
Build a field-level record of skills data
For every field used by the system, document its source and meaning rather than treating a skill label as self-explanatory. The European Commission’s AI Act materials identify data origin and collection, the original purpose of collecting personal data, data preparation and labeling, assumptions about what measures represent, suitability, and potential bias as relevant elements of data governance for high-risk AI.
- Source: distinguish self-report, CV, credential, training record, work history, project record, manager assessment, test result, or model inference.
- Meaning: state what the field is intended to represent. For example, project participation may indicate exposure to a task, but not necessarily independent proficiency.
- Provenance and timing: record when the information was collected, why it was collected, how it was transformed or labeled, and how often it is refreshed.
- Uncertainty: preserve confidence or other uncertainty information where available, and document known limits. Do not present an inferred estimate as a verified fact.
- Access and recourse: identify who can see or change the field and how the affected person can request a correction or review.
- Retention: set a retention period and deletion process that fit the purpose and applicable law.
Make assumptions explicit. A credential may not show current competence; a missing training record may reflect lack of access to training rather than lack of ability. If those distinctions are hidden, downstream users may treat gaps in evidence as evidence of gaps in skill.
Test whether the data and outputs fit the purpose
Assess data quality in the context where the system will actually be used. The European Commission’s AI Act recital says datasets should be relevant, sufficiently representative, and, to the best extent possible, free of errors and complete in view of the intended purpose. That is not a universal numeric threshold or a guarantee that one performance score makes a system fair.
Rank #2
- Check whether skill records are accurate, current, complete, and described consistently across teams, occupations, and worker groups.
- Look for uneven opportunities to generate evidence. Some employees may have had less access to visible projects, training, credentials, or managers who record capabilities.
- Check whether proxy fields—such as work history or access to particular assignments—reproduce disparities relevant to protected groups or other affected populations.
- Evaluate both the inputs and the outputs that influence later decisions. A system can reinforce a feedback loop if earlier rankings shape access to assignments and those assignments then become evidence for future rankings.
- Choose evaluation measures suited to the use, population, jurisdiction, and consequences. State what each measure does and does not establish; no single aggregate accuracy or parity result proves the system is safe.
NIST’s publication on identifying and managing bias in AI emphasizes that bias can arise throughout technology processes and cause harm even without intent. Include affected workers and people with relevant expertise in identifying what errors and harms matter, rather than relying only on model-level metrics.
Assess necessity, privacy, and worker impact before launch
Write down why the organization needs the system, what decision it supports, and whether a less intrusive or non-AI process could achieve the same aim. Identify what could happen if a skill is inferred incorrectly, a profile is stale, or a worker’s experience is missing from the data. Consider privacy, equality, transparency, and consultation obligations under the relevant local law, and determine whether a formal impact assessment is required.
The UK Information Commissioner’s Office (ICO) says employers remain responsible for deciding why and how worker monitoring takes place; buying software does not establish that its use is compliant. Its worker-monitoring guidance recommends considering effects on workers through a data protection impact assessment (DPIA). The ICO says this guidance is under review following the Data (Use and Access) Act, so UK organizations should check its current status before relying on detailed implementation instructions.

Under the European Commission’s GDPR explainer, protections concern solely automated decisions with legal or similarly significant effects, subject to legal conditions and exceptions. Whether a particular skills system falls within those rules depends on the processing and the decision it produces or supports.

Set supplier, contract, and data-transfer controls
Map the organizations and services involved: employer, HR platform, assessment provider, model vendor, and any downstream service that receives or reuses the output. Decide and document each party’s role and responsibilities. The ICO says a third-party provider may be a processor when it acts only on the employer’s written instructions, but the employer still needs appropriate oversight and contractual arrangements.
Before procurement or renewal, establish in writing:
- the permitted purpose and whether supplier reuse of employee data, profiles, or outputs is allowed;
- which subprocessors are involved and what security, retention, and deletion controls apply;
- where data is stored or accessed, and what transfer safeguards are required;
- what documentation the supplier provides about data provenance, model limitations, evaluation, and changes;
- audit and incident-notification rights, and how the employer can investigate a disputed or harmful result; and
- what happens to records and access when the contract ends or the system is retired.
NIST’s voluntary AI Risk Management Framework treats third-party software and data as supply-chain risks. Supplier assurance should therefore be part of the organization’s governance, not a substitute for understanding the system’s use and effects.

Tell workers what is happening and keep a route to challenge it
Give affected employees or candidates information they can use: what data is considered, whether skills are inferred or assessed, what decisions the output may influence, who reviews it, how to correct inaccurate records, and how to request a review or challenge a decision. Tailor the notice and process to applicable law and the system’s actual use; a generic statement that “AI is used” does not explain how a skills profile affects a person.
Rank #4
The European Commission describes GDPR safeguards for qualifying solely automated decisions, including information, human intervention, an opportunity to express a view, and the ability to contest the decision, subject to the applicable legal conditions and exceptions. Make the correction and review route operational: identify a contact, explain what information the person can provide, and ensure corrections can reach the relevant profile and downstream decision process.
Make human oversight substantive
A reviewer is meaningful only if they can evaluate the recommendation and act on that evaluation. UK ICO guidance says a decision-maker should actively scrutinize automated recommendations, have the competence and authority to reject them, and consider other available inputs. It cautions against routine rubber-stamping.
Give reviewers access to relevant context, clear information about uncertainty and known limits, enough time to assess the recommendation, and authority to override it. Train them on the system’s purpose and failure modes. Provide a way to record why they accepted, changed, or rejected a recommendation, then review those records for signs that human review is merely formal or that particular groups are affected differently.

Governance continues after deployment. Set an owner and review cadence, and monitor for stale profiles, changes in job requirements, data drift, feedback loops, complaints, overrides, differential errors, and adverse outcomes. Reassess when the purpose, population, data source, model, configuration, or supplier changes materially.
Best Value
Maintain processes to correct underlying records and affected outputs, escalate incidents, and stop use when risks cannot be managed. Include safe decommissioning: determine how access will end, how data will be retained or deleted under applicable requirements, and whether dependent workflows need to be changed. NIST’s framework supports lifecycle-wide responsibility, periodic review, training, monitoring, incident practices, and safe phase-out.
Keep legal duties specific to each jurisdiction
The European Commission’s current policy page states that AI Act rules for high-risk systems in employment and other named areas apply from 2 December 2027. This is not a single application date for every AI Act obligation: the Commission’s July 2026 transparency guidelines state that Article 50 transparency obligations apply from 2 August 2026. Confirm the system’s classification and check for subsequent amendments before relying on these dates.
For UK deployments, the ICO’s worker-monitoring guidance addresses the UK GDPR and Data Protection Act 2018, but the ICO says the guidance is under review following the Data (Use and Access) Act. For the United States and other jurisdictions, requirements on employment discrimination, privacy, consultation, collective bargaining, and automated decisions need separate local review; EU or UK conclusions should not be treated as universal rules.

Use a practical governance review before approval
- Describe the use: name the system, affected people, decisions informed, users, data flows, and the output’s actual influence.
- Account for each field: record source, collection purpose, meaning, preparation, age, uncertainty, access, retention, and correction process.
- Test for fit and harm: assess quality, coverage, representation, proxy risks, errors, and feedback loops in the intended context.
- Justify the processing: document necessity, alternatives, privacy and equality effects, notices, consultation, and any required impact assessment.
- Control suppliers: set roles, instructions, reuse limits, security, transfers, audit access, incident handling, retention, and exit terms.
- Provide recourse and oversight: explain the use, enable corrections and challenges, and ensure reviewers have the knowledge and authority to act.
- Review throughout use: assign owners, monitor outcomes, revisit material changes, correct harms, and retire the system safely.
This sequence is a governance aid, not a regulator-issued checklist. Map binding legal obligations separately for every jurisdiction and intended use.
