It covers certain videos built around Capcom game footage—such as commentary, walkthroughs, tutorials, reviews and streams—and expressly says it is not a license to create derivative works. To use Resident Evil characters in a live-action or animated film, ask the relevant rights holder for explicit written permission before you produce or release anything.
A disclaimer, a free release, a crowdfunding campaign, or a submission through Capcom’s portal does not replace a signed license. The official sources reviewed do not publish a dedicated fan-film application, standard fee, approval rate or response time.

What Capcom’s public policy actually allows
The Capcom USA Video Policy, last updated March 15, 2021, is guidance for publishing certain videos that use Capcom-owned game footage. Its examples are commentary-centered formats: gameplay videos, walkthroughs, tutorials, reviews and livestreams. A scripted story in which performers portray Resident Evil characters is a different use of the intellectual property.
The policy contains an important limitation: “It is not intended to be, nor should be considered as, express permission nor an official license or authorization for you to create mods or derivative works of Capcom titles or content.” A fan film using recognizable characters, names, settings, designs, dialogue or story elements is normally the kind of derivative use that requires separate authorization.

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
The policy also says fan content must not be presented as official Capcom material and places limits on commercializing Capcom content. Its references to platform advertising and partner-program monetization apply to qualifying video content under that policy; they do not turn the policy into a film license.
Capcom USA’s Terms of Use reserve rights in covered content to Capcom, its licensing partners or suppliers and prohibit derivative works or exploitation without express permission, subject to the stated Video Policy exception. That exception should not be read more broadly than the policy’s own gameplay-video scope.
Why a noncommercial fan film still needs permission
“Noncommercial” describes how you plan to distribute or fund a project; it does not automatically remove copyright, trademark or other rights. A free upload can still reproduce protected characters and branding. Advertising, sponsorship, crowdfunding rewards, donations, paid festival access, merchandise, licensing tie-ins or platform revenue add commercial questions, but removing those features does not itself create authorization.

Do not begin filming on the assumption that a disclaimer, silence, or a social-media reply is approval.
Is there a public Resident Evil fan-film application?
The official materials reviewed do not identify a dedicated Resident Evil fan-film application, published approval workflow, standard fee, approval probability or response-time promise. Capcom’s Partner Portal submission terms specifically warn that submitting material does not grant the submitter the right to use Capcom or its licensors’ trademarks, copyrights, patents or other intellectual property. The terms also describe a submission as nonbinding and say it does not create an agreement or entitle the submitter to compensation without a written agreement signed by an authorized representative.
Use the portal only if Capcom directs you to do so for your inquiry and only after reading its current terms. A portal upload is not permission to develop, film, market or release the project.

Inventory every Resident Evil element
- List each character you want to use, including alternate names, identities, costumes and visual designs.
- Identify settings, organizations, creatures, logos, title treatments, fictional products, dialogue, plot elements and other recognizable franchise material.
- List any game footage, screenshots, artwork, sound effects, music, scripts or still images you plan to incorporate rather than recreate.
- Describe whether the production is live-action, animated, machinima, virtual production or another format.
Describe the film itself
- Give the working title, approximate running time, logline, synopsis and script or treatment status.
- State whether the film is complete, in development, casting, shooting or already edited.
- Identify the production company or individual applicant and the responsible contact person.
- Explain the intended audience, rating target, language versions and any material that could affect brand suitability.
Set out the release and business plan
- Name every intended territory and language.
- List proposed outlets: a personal site, video platform, festival circuit, broadcaster, streaming service, theatrical venue or educational screening.
- State whether viewers will watch free of charge or pay, and identify advertising, sponsorship, subscriptions, donations, crowdfunding, merchandise or other revenue.
- Provide a target release date, planned promotional channels and whether the release is temporary or intended to remain available indefinitely.
Separate confirmed facts from ideas
Mark which elements are fixed and which can change if Capcom requires edits. A one-page rights matrix can show the character or asset, its proposed use, the scene, the owner you believe controls it, and the permission still needed. This makes it easier to narrow the request if a particular character, logo or soundtrack cannot be cleared.
Step-by-step: how to make a written licensing inquiry
- Identify the rights holder to contact. Start with an official Capcom business or inquiry channel and explain that you are seeking permission for a scripted film using Resident Evil elements. Ask whether Capcom controls the particular rights involved and whether a licensee or another rights holder must also approve them.
- Send a specific, complete brief. Attach or link only materials you are comfortable sharing under the recipient’s submission terms. Include the rights inventory, synopsis, format, duration, territories, languages, platforms, schedule and business plan. Say plainly that you are requesting a license, not relying on the public Video Policy.
- Ask what materials and process apply. Request instructions for any treatment, script, budget, concept art, production-company information, insurance documentation or other review materials. Ask whether unsolicited creative submissions are accepted and through which channel.
- Ask about all rights categories. Request confirmation of rights for character names and likenesses, settings, logos, trademarks, artwork, dialogue, music, footage, promotional images and any other elements you listed. Ask whether the grant would cover adaptations, trailers, posters, social clips, subtitles, dubbing and festival entries.
- Ask how approvals would work. Find out who would review the script, casting, costumes, rough cut, final cut and advertising, and whether changes must be made within a stated period. A request for approval is not an approval itself.
- Wait for an authorized written response. Do not interpret an automated acknowledgment, an employee’s informal comment or a lack of objection as approval. Production, public casting announcements and marketing should wait until the rights position is documented.
- Review the proposed agreement with an attorney. A lawyer familiar with entertainment and intellectual-property licensing can check whether the grant actually covers your script, performances, music, distribution and publicity plans in each territory.
A useful inquiry format
Put the request in a short email or letter with a descriptive subject line, then attach the rights brief. Identify yourself, the production entity, the exact Resident Evil elements, the format and running time, the intended territories and outlets, the commercial plan, and the date by which you hope to release. Ask Capcom to confirm the correct contact if another company or licensor controls any requested element. End by asking for the applicable submission process and written license terms, rather than asking for an informal blessing.
Terms a real license should address
Capcom has not published standard fan-film terms, so the following is a negotiation checklist rather than a promise that any particular term is available.
| Term | Question to resolve in writing |
|---|---|
| Licensed elements | Which characters, names, designs, settings, logos, dialogue, footage, artwork and other materials may appear? |
| Medium and format | Does the grant cover live-action, animation, machinima, trailers, behind-the-scenes material and short promotional clips? |
| Territory | In which countries or regions may the film be shown, and are online rights worldwide or geo-restricted? |
| Term | How long may you produce, promote, distribute and keep the film available? |
| Platforms and venues | Are festivals, social platforms, personal websites, paid services, broadcasters and theatrical screenings included? |
| Commercial use | Are advertising, sponsorship, crowdfunding, donations, subscriptions, merchandise or platform revenue allowed? |
| Approvals and edits | Who approves the script, casting, costumes, cut, artwork, marketing and translations, and how are review deadlines handled? |
| Credit and branding | What copyright, trademark, “unofficial” or attribution language must appear, and where? |
| Exclusivity | Is the permission exclusive, nonexclusive, limited to one production or subject to other licensees? |
| Fees and expenses | Are there license fees, royalties, minimum guarantees, legal-review charges, insurance requirements or revenue reporting duties? |
| Termination and takedown | What happens if the agreement ends, a platform removes the film, or an approval condition is breached? |
Compare any proposal across the same axes: each element, medium, territory, duration, platform, commercial use, approval conditions, exclusivity and cost. A grant that covers a free festival screening may not cover a monetized online release, a sequel, a trailer or merchandise. Ask for those uses expressly instead of assuming they are included.
Do not assume that permission to use a character also covers the character’s game music, original artwork, screenshots, voice performance, motion-capture recording or another contributor’s work. Each item should be identified in the grant or cleared separately.
Music, footage and other third-party rights
Capcom’s Video Policy cautions that some music included in games may be licensed from third parties. Ownership can therefore vary from one track or asset to another. Even if Capcom approves a character-based film, that approval may not authorize a soundtrack, game recording, promotional image or other incorporated material controlled by someone else.
Create a separate clearance list for every non-original asset. Record the owner, permission status, permitted media, territory, term, credit requirement and whether the permission covers edits, trailers and online distribution. Commissioning a new score or recreating a visual style does not automatically solve character, trademark or story-element issues.

How regional guidance fits in
A Capcom Japan support FAQ updated December 1, 2025 distinguishes individuals posting videos under its guidelines from corporations and contracted creators, for whom permission is required. That FAQ addresses gameplay-video distribution. It should not be treated as a separate rule authorizing a scripted Resident Evil film.
Capcom Taiwan lists Resident Evil among licensed intellectual properties and identifies categories such as campaigns, attractions, toys, figures and apparel. This shows that Capcom operates licensing programs, but it does not establish that fan-film rights are offered, that a Taiwan page controls rights in another country, or that the listed categories include film permissions. Ask the rights holder serving your intended territory which entity controls the requested rights.
Distribution and monetization pitfalls
- Platform monetization: A video platform’s advertising program is not a substitute for an intellectual-property license.
- Crowdfunding: Raising money before rights are secured can create obligations to supporters for a project you may not legally release.
- Festivals: Festival acceptance does not prove that you have rights, and a festival may require you to indemnify it.
- Promotional materials: Posters, thumbnails, trailers, social posts and press kits can use the same protected names and designs as the film itself.
- Merchandise: T-shirts, props, figures and downloads can require separate trademark, copyright and merchandising permissions.
- International release: Copyright exceptions, publicity rights, moral rights, trademark rules and enforcement procedures differ by jurisdiction.
- Early publicity: Announcing actors, dates or a crowdfunding page can make the project look officially connected to Capcom before any relationship exists.
- Version creep: Adding a new character, song, clip, language or platform after signing can take the project outside the written grant.
Keep a rights file containing inquiries, responses, signed agreements, asset licenses, approvals, credits and delivery versions. Give distributors, platforms and festivals only the rights documentation you are authorized to share.
What to do if Capcom declines or does not respond
Do not treat an unanswered inquiry as consent. Set an internal deadline for the project and, if no authorized written response arrives, pause the Resident Evil version rather than filming first and asking later. If permission is declined or unavailable, redesign the concept around original characters, setting, terminology, creatures, artwork, music and story elements. Avoid names, logos and combinations of details that intentionally evoke the franchise.

Frequently asked questions
Can I make a Resident Evil fan movie if I do not charge viewers?
Free distribution does not itself authorize use of the characters or franchise branding. Request written permission for the specific film and release plan.
Does Capcom’s Video Policy cover a scripted short film?
No. Its examples concern commentary-centered videos using game footage, and the policy expressly disclaims authorization for derivative works.
Recommended Free Tools
Is a “not affiliated with Capcom” disclaimer enough?
No. It may clarify that the project is unofficial, but it is not a license and does not grant rights to characters, logos, music or artwork.
Does uploading a pitch to the Partner Portal give me rights?
No. The portal terms say a submission grants no intellectual-property rights, is nonbinding and does not create an agreement without a signed writing from an authorized representative.
Can I assume Capcom will approve a fan film?
No approval rate, standard process or response promise is published in the official materials. Treat approval as uncertain until you receive signed terms.
Who owns the music in a Resident Evil game?
Ownership can vary because some game music may be licensed from third parties. Ask which party controls every track or recording you want to use and clear it separately if necessary.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Does permission for one country cover a worldwide online release?
Not automatically. Territory and online availability should be stated in writing, along with language versions and platform limits.
Best Value
Can a festival screen the film while permission is pending?
Do not assume so. Festival acceptance is not a rights grant, and submitting an unlicensed film can create contractual and takedown problems.
What if Capcom never answers?
Silence is not consent. Pause the project or redesign it with original elements unless an authorized rights holder provides written permission.
The bottom line on making a Resident Evil fan film
Capcom’s public Video Policy is gameplay-video guidance, not permission to create a scripted derivative film. The safest route is a detailed written licensing inquiry, followed by a signed agreement that names the exact characters and materials, media, territories, term, platforms, commercial uses and approval conditions. Until that agreement exists, treat the project as unlicensed and do not rely on a disclaimer, a noncommercial label, a portal submission or silence.
