First define the project and inventory the character’s name, design, logo, footage, dialogue, music and other materials. Then identify each rights holder, use its official licensing or legal channel, describe the commercial use in detail, negotiate the license limits and obtain a signed grant before publishing, selling or promoting anything.
A gameplay-upload policy, fan-content guideline or platform monetization setting is not automatically permission to put a character in your own game, advertisement, film, product or other commercial work.

What permission actually covers
“A video game character” is rarely one legal asset controlled by one party in every context. The character’s name, visual design, logo, voice, written dialogue, animations, screenshots, gameplay footage and music can have different owners, licensors or contractual restrictions. A publisher may own some elements, license others, and distribute content created by outside studios, composers, performers or brand partners.
Permission therefore depends on the exact property and the exact use. A right to upload gameplay may cover a video channel but not a standalone game. A merchandise license may cover manufactured goods but not an advertisement featuring the same artwork. A platform catalog license may authorize creation inside that platform while excluding off-platform distribution.

World Intellectual Property Organization (WIPO) materials explain that video-game rights can be limited by scope, time and geographic area, and that games involve many contributors whose rights must be considered. Treat the character as a rights-clearance project rather than as a single image you can simply buy or copy.
Why a fan or gameplay policy is not enough
Publishers write content policies for particular activities. Those policies can be useful evidence of what is allowed, but they are not universal commercial licenses.
- Bandai Namco’s video policy applies to intellectual property it holds or controls and warns that third-party characters, music and other material may require separate permission.
- SEGA’s streaming guidelines say that if a gameplay video includes intellectual property owned by third parties, including characters or music, users must obtain permission from all appropriate rights holders. The SEGA Support page records an update on March 19, 2026, and says the guidelines were last updated March 12, 2026.
- Bungie states: “In the event that creators seek to profit from the use of Bungie assets, they must seek permission from Bungie and obtain a license to do so.” Its policy also directs prospective official merchandise licensees to an inquiry route.
- Electronic Arts’ content policy says not to use its game content for commercial purposes and provides a special-use inquiry route. It also notes that some uses might be permissible under fair-use or similar laws, but the policy does not decide whether a particular commercial use qualifies.
- YouTube explains that monetization of game or software content depends on commercial-use rights granted by the publisher’s licenses. Turning on monetization does not create those rights.
These examples cannot be generalized to every publisher, game or country. Read the policy for the particular property and ask for a separate license when your project falls outside its stated scope.
Step 1: Describe the proposed project precisely
Before contacting anyone, write a one-page use brief. Vague requests such as “I want to use the character in my business” force a rights team to ask basic questions and make it difficult to quote terms.
Record the project and audience
- Project type: standalone game, game modification, advertisement, film, animation, book, event, merchandise, educational product or another format.
- How the character appears: playable character, non-playable character, logo, cameo, image, voice, costume, dialogue, footage or reference.
- Who will see or buy it: age range, countries, language versions and whether the audience is the general public or a closed group.
- Business model: paid sale, subscription, advertising, sponsorship, in-app purchase, crowdfunding, free distribution with commercial promotion or another model.
- Distribution: stores, websites, social networks, cinemas, broadcasts, physical retail, live events and internal use.
- Launch and availability: planned release date, campaign dates, length of availability and whether the project can be updated or re-released.
State promotional use separately
Explain whether the character will appear in trailers, store listings, press kits, paid advertisements, influencer briefs, social posts, packaging or event signage. A license that permits the character inside a product may require a separate approval for advertising or may prohibit implying endorsement.
Describe modifications and interaction
Say whether you want to redraw, recolor, resize, animate, translate, give the character new dialogue, place it in a new setting, combine it with another property or let users alter it. Ask specifically about user-generated content if customers can remix or share the character.

Step 2: Inventory every asset
Create an asset register before you seek approval. Save the source of each item and mark whether it is original, licensed, user-created or supplied by a third party.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →- Character identity: name, aliases, catchphrases and distinctive symbols.
- Visual material: official model sheets, in-game models, screenshots, concept art, costumes, logos and promotional illustrations.
- Audio: voice performance, dialogue text, sound effects, music and lyrics.
- Game material: footage, interface elements, maps, weapons, creatures and story text shown with the character.
- Contributors: outside studios, composers, performers, artists, licensors or collaborators identified in credits or notices.
- Your own additions: new artwork, scripts, adaptations, translations and software that may need approval as modifications or derivative material.
Do not assume that identifying the game publisher settles all of these questions. SEGA and Bandai Namco expressly warn about third-party material in gameplay videos, and WIPO’s discussion of game contributors explains why ownership can be divided.
Step 3: Identify the proper rights holders
Start with the game’s current publisher or developer and its official intellectual-property, legal, licensing, brand-usage or business-development page. Use the company’s official contact route, not an unverified social-media account or a fan-maintained address. Ask to be directed to an authorized licensing representative if the first company does not control every asset.
Check the game’s credits, copyright notices, trademark notices and current publisher information. A company may have acquired a studio, transferred a catalog or retained only particular rights. For music, voice performances, artwork or branded collaborations, request confirmation of the relevant owner or sublicensing authority.
Some publishers do not accept unsolicited proposals, and some offer only narrow programs. Nintendo’s “Intellectual Property Policy,” for example, is an infringement-reporting policy; it is not a general commercial licensing route. Do not treat a reporting form as a license application.
Step 4: Choose the route that matches the use
Licensing inquiries, platform catalogs and content policies serve different purposes. Compare them before you submit anything.

| Route | What the published material shows | Questions to verify |
|---|---|---|
| Rights-holder licensing inquiry | Bungie directs prospective official merchandise licensees to an inquiry route. Electronic Arts identifies a special-use inquiry route for uses outside its content policy. | Whether your project type is eligible, whether unsolicited proposals are accepted, what materials are required, the territory and term, the rights included, compensation and review stages. |
| Platform license catalog | Roblox lets creators inspect an offered intellectual-property license, review its terms and standards, submit a request and pitch, and follow any revenue-share requirements. | Whether the specific character is listed, what creation types are allowed, whether monetization is permitted, what content standards apply, the revenue share and whether use is limited to the platform. |
| Publisher content or streaming policy | SEGA and Bandai Namco publish rules for specified gameplay-video uses and warn that third-party rights may need separate clearance. | Whether your activity is actually gameplay video, whether commercial use is restricted, whether third-party content appears, which territories apply and whether a separate authorization is required. |
These routes are not interchangeable. A streaming allowance or game-platform license may not authorize a film, advertisement, consumer product, standalone game or other commercial work.
Step 5: Submit a focused permission request
Send a concise pitch through the official route. Attach only material that helps the rights team evaluate the request, such as a short synopsis, storyboard, mock-up, prototype images, audience description and distribution plan. Label confidential information and ask how the recipient wants it submitted.
Include these facts
- The exact game and character, including the version or era if several designs exist.
- Your company or legal name, project team, business contact and any agency or production partner.
- The project format, story or function of the character, and the intended audience.
- Every asset requested: name, likeness, artwork, logo, voice, dialogue, footage, music or other material.
- Media and platforms, including physical and digital formats, app stores, websites, broadcasts, events and social channels.
- Countries and languages, launch date, campaign length and whether the release is permanent or time-limited.
- Pricing, advertising, sponsorship, subscriptions, in-app purchases, crowdfunding and other monetization.
- Planned edits, translations, combinations with other properties and user-generated features.
- Promotion, press, trailers, paid media and any request to use the rights holder’s name or marks.
- What you need next: eligibility confirmation, an application form, a licensing contact, required samples and the expected review stages.
Example request structure
Subject: Commercial license request for [game] character in [project]
In the body, identify the project and proposed use in the first paragraph, list the requested assets and distribution in the second, explain the audience and commercial model in the third, and ask who controls any third-party elements in the final paragraph. Do not state that approval has been granted; describe the request as subject to a written agreement.

Step 6: Negotiate the license boundaries
A useful license states exactly what you may do and what remains prohibited. Roblox describes licenses that can include content standards and revenue-share requirements. WIPO notes that rights can be restricted by scope, time or geography. Ask for each restriction in plain language before you approve a draft.
- Licensed assets: identify each character version, logo, artwork, voice, footage, music and text.
- Media and platforms: list the product, advertising channels, stores, services, events and physical formats.
- Territory and language: specify countries, regions and translations instead of assuming worldwide rights.
- Term: state the start date, end date, renewal process and treatment of copies already sold or downloaded.
- Commercial model: define price, advertising, sponsorship, subscriptions, in-app purchases, crowdfunding and revenue reporting.
- Fees and revenue share: confirm fixed fees, advances, royalties, minimum guarantees, payment dates, currency, taxes and audit rights.
- Approvals: establish who approves scripts, artwork, builds, marketing, localization and updates, and how long each review may take.
- Modifications: state whether you may alter clothing, color, dialogue, story, animation, name or setting, and whether derivative artwork belongs to you or requires assignment.
- Credit and marks: specify required notices, placement, trademark formatting and whether the rights holder’s name can appear in marketing.
- Exclusivity and conflicts: determine whether either party is restricted from licensing or using similar material elsewhere.
- User content and partners: cover contractors, distributors, influencers, customers and user-created adaptations.
- Termination and takedown: define what happens after breach, expiration, policy change or safety concern, including removal deadlines and sell-off rights.
Do not infer a right from a silence, a purchase of the original game, an informal “fan-friendly” comment or a platform’s acceptance of your upload. The grant must come from an authorized rights holder and must cover the use you intend.
Step 7: Obtain written authorization before production or launch
Keep the signed agreement, schedules, approvals and correspondence in a rights file. Record the exact asset versions and the people authorized to approve changes. Give your artists, developers, agencies and marketing team a short rights summary so they do not expand the use accidentally.

Build a clearance checkpoint into production. Before a trailer, store page, update, localization or advertisement is released, compare it with the licensed asset list and approval requirements. If the project changes platform, territory, business model, character design or campaign length, pause and request an amendment rather than relying on the original approval.
Recheck the publisher or platform policy before launch. Roblox states that publishing content using someone else’s intellectual-property rights without permission violates its Terms of Use and may lead to removal of the content and the account. A policy or catalog offering can change, so preserve the terms that applied when you obtained the license.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How common project types should be evaluated
Putting the character in your own game
This usually requires a license for the character’s name, likeness, story elements and any supplied art or audio, plus permission for marketing and distribution. If players can create or share content involving the character, address that activity expressly. A license limited to a game platform does not automatically cover a downloadable build, console release, merchandise or advertising outside that platform.
Using the character in an advertisement
Ask for advertising and endorsement rights separately. State the product being advertised, media channels, countries, campaign dates and whether the character appears to recommend your product. A gameplay-video policy rarely answers those questions.
Streaming or uploading gameplay
Read the applicable streaming policy and identify third-party music, characters and other content in the recording. SEGA’s guidelines require permission from all appropriate rights holders for third-party intellectual property in gameplay videos. Bandai Namco similarly limits its policy to IP it holds or controls. YouTube monetization still depends on commercial-use rights granted by the publisher’s license.

Merchandise and physical products
Use the publisher’s merchandise or brand-licensing inquiry route, where one exists. Describe product categories, manufacturing quantity, sales countries, retailers, packaging, quality control and launch dates. A right to depict a character digitally is not a manufacturing authorization.
Best Value
Fan projects and free releases
“Free” does not eliminate copyright, trademark, publicity or contract questions, especially when the project carries advertising, donations, sponsorship, paid upgrades or a business promotion. A fan policy may permit a narrow activity while reserving commercial uses. Treat the policy as a limited permission and stay within its wording.
Common mistakes and how to recover
- Contacting the wrong company: ask the publisher to identify owners of music, voice, artwork or collaboration elements rather than assuming it can grant everything.
- Sending an abstract request: replace “Can I use this character?” with a complete use brief listing assets, media, territory, term and monetization.
- Relying on a policy screenshot: save the current policy, but verify that your project fits its defined activity and commercial limits.
- Launching while waiting for a reply: stop publication and promotion until written authorization is signed. Silence is not consent.
- Expanding after approval: seek an amendment before adding a platform, country, character version, advertisement, translation or user-generated feature.
- Using third-party music or footage: remove or separately clear those elements if the principal character license does not cover them.
- Assuming fair use is a shortcut: obtain jurisdiction-specific legal advice before relying on an exception, particularly for a commercial product or advertisement.
If you have already published without permission, stop new distribution, preserve records of what was used, remove unlicensed promotional material where practical and contact the rights holder through its official channel. Do not alter or destroy evidence, and obtain advice from a lawyer familiar with the relevant countries and rights.
Fees, timing and approval expectations
The available policies and licensing pages do not establish a typical fee, approval rate or response time. Pricing and review requirements vary with the property, project, territory, audience, exclusivity, production scale and commercial model. No responsible guide can promise that a rights holder will approve a request.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsPlan for multiple review rounds and for separate agreements when ownership is divided. Budget for legal review, translations, artwork revisions, reporting and possible royalties, but do not treat any unquoted figure as a market standard. Ask the rights team what information is needed before discussing a launch date publicly.
Legal limits and when to seek counsel
Copyright, trademark, publicity and contract rules differ by country and by the particular use. Fair use and similar doctrines are fact-specific; EA’s policy acknowledges that some uses may be lawful under applicable exceptions but does not determine an individual case. A lawyer can help when the project involves several countries, a substantial investment, exclusivity, user-generated content, a disputed ownership chain, a public figure’s likeness or a potentially confusing endorsement.
Professional advice does not replace the rights holder’s authorization. It helps you identify the rights that must be cleared, interpret the proposed agreement and manage obligations after signing.
A practical final checklist
- Write the project, audience, business model, platforms, territories and dates.
- List every character asset, recording, image, logo, text, footage and music element.
- Trace each item to its owner, licensor or contributor.
- Read the current official policy and determine whether it actually covers your use.
- Use the official licensing, legal or special-use route and submit a specific pitch.
- Confirm scope, edits, approvals, credit, fees, revenue share, term, territory and termination in writing.
- Obtain signatures before production release, sale, upload or promotion.
- Maintain a rights file and re-clear any material change.
Conclusion
Permission is obtained by matching a precisely described commercial use with the correct rights holders and a written license. Inventory the character and every accompanying asset, use the owner’s official route, treat platform and gameplay policies as limited permissions, negotiate the boundaries and keep the signed agreement controlling production and promotion. If ownership is divided or the stakes are significant, obtain jurisdiction-specific legal advice before committing to a launch.
