How to Get a Refund or Dispute a Credit Card Charge for Furniture You Never Received

By Freedom251 Team · · 12 min read

If furniture you paid for by credit card never arrived, ask the seller in writing to cancel the order and refund you, then send a written billing-error notice to your card issuer if the seller does not fix the problem. Send that notice to the issuer’s billing-inquiries address—not the payment address—within 60 days after the first statement showing the error was sent. Call or use the issuer’s online dispute tool to open a case, but do not rely on a phone call alone to preserve the federal written-notice procedure.

This guide covers the U.S. federal credit-card process for non-delivery. It does not determine state contract rights, a retailer’s own obligations, or whether a particular issuer will extend a deadline.

Why a furniture non-delivery can be a billing error

The Fair Credit Billing Act (FCBA) treats some charges for goods that were not delivered as agreed as billing errors. The key fact is not that you changed your mind; it is that the seller charged you for an order that was never delivered according to the agreement.

The Consumer Financial Protection Bureau explains: "It can be considered a billing error to be charged for a purchase when you did not receive what you ordered or did not accept delivery of the purchased items." That federal process concerns credit cards and other revolving credit. It does not automatically apply to a debit-card transaction, a personal loan, a buy-now-pay-later account, or a cash purchase.

Do these things first

  1. Find the order record. Gather the receipt or confirmation, order number, card statement, promised delivery date, shipping or delay notices, and the seller’s cancellation and refund terms.
  2. Create a contact log. Record the date, time, person or department, phone number or channel, and substance of every call, chat, email, and message.
  3. Ask the seller to cancel and refund. State that the furniture was not delivered as agreed, identify the order and promised date, and request a refund. Put the request in writing even if you also call.
  4. Preserve proof. Save the original files, screenshots showing dates, delivery estimates, tracking pages, and the seller’s response. Do not send your only copy to either party.

The CFPB advises consumers to approach the seller first. If the seller does not resolve the issue, the consumer can contact the card company about a dispute or billing error.

The two possible credit-card paths

Path When it fits Timing or conditions What to do
FCBA billing-error notice The card was charged for furniture that was not delivered as agreed. Send a written notice within the ordinary statutory window measured from the first statement showing the error. A delivery date far in the future can make the timing difficult. Send the notice to the billing-inquiries address on the statement or account materials, with the order, delivery promise, transaction amount, and seller correspondence.
Claims-and-defenses protection A qualifying seller dispute remains unresolved and the billing-error route does not fully address it, including some disputes about the goods or transaction. FTC guidance generally describes goods costing more than $5, a purchase in the consumer’s home state or within 100 miles of the billing address, a good-faith effort with the seller first, and withholding payment. Exceptions can apply. Check the issuer’s instructions and the applicable conditions. Treat this as a separate, conditional protection—not a replacement for a timely billing-error notice.

The first path is the main one for furniture that never arrived. The second has different requirements and should not be described as if every condition applies identically to a non-delivery billing error.

How to file the billing-error dispute

1. Confirm what was promised

Use the order confirmation, invoice, delivery appointment, retailer messages, and any written change to identify the agreed delivery date or delivery window. If the seller gave several dates, list each date and explain which one passed. Include whether you rejected a proposed substitute date or whether the seller stopped responding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Make a clear written demand to the seller

Send the request through the seller’s customer-service email, web form, or dispute channel, and keep the sent message and confirmation. Use a factual statement such as: “Order 12345 was charged to my card on June 3 for $1,248. The promised delivery window of June 20–27 passed, and the furniture has not arrived. Please cancel the order and refund the full charge.” Do not rely on vague language such as “please check the status.”

Give the seller a reasonable opportunity to correct the problem, but do not let repeated promises cause you to miss the issuer’s notice window. If the seller offers a new delivery date, ask for it in writing and keep the offer with your records.

3. Open a case with the card issuer

Call the number on the back of the card or use the issuer’s online dispute channel to start the case and learn its preferred submission method. Tell the representative that the charge is for merchandise not delivered as agreed. Ask for the case number, the deadline for documents, and the exact address or upload location for a billing-error notice.

A phone call can start an investigation, but a call alone may not preserve the FCBA written-notice procedure. Send the signed or electronically submitted written notice separately.

4. Send the written notice to the correct address

Use the billing-inquiries address printed on the statement or in the account materials. Do not send the notice to the address used for payments. If the issuer provides a secure electronic billing-error submission that clearly serves the same purpose, retain the submission receipt and any confirmation number.

Include:

  • Your name and mailing address.
  • The account number or enough account information for the issuer to identify the account; avoid sending unnecessary sensitive information.
  • The transaction date and exact amount.
  • The merchant name and order number.
  • The promised delivery date or window.
  • A short explanation that the furniture was not delivered as agreed and that you requested cancellation or a refund from the seller.
  • Copies, not originals, of the order confirmation, statement line, delivery promise, delay notices, and seller correspondence.
  • The remedy you want: cancellation of the charge and removal of related finance charges attributable to the disputed amount.

Sign and date the notice. Keep a complete copy, proof of mailing or electronic submission, and the delivery confirmation. A tracked mailing method is useful because it creates evidence of when the issuer received the notice.

5. Check the 60-day rule and late-delivery complication

The usual FCBA deadline is 60 days after the first statement showing the error was sent to you. The relevant date is the statement’s sending date, not necessarily the date you opened it. Send the notice as soon as you know the order was not delivered; waiting for another promised date can put the ordinary procedure at risk.

Furniture is often ordered weeks or months before delivery. If the first statement arrived before the promised delivery date, the non-delivery may not have been apparent during the ordinary 60-day period. FTC guidance says you may be outside the FCBA protection in that situation, although some issuers may voluntarily extend the window for delayed shipments. An extension is not guaranteed. Send the notice anyway, explain the original delivery promise, attach delay messages, and ask the issuer whether it will accept the late notice.

6. Pay the undisputed part of the account

While a qualifying billing-error investigation is pending, you may withhold the disputed amount and related finance charges, but you must pay undisputed purchases, fees, and other required amounts by their due dates. Pay at least the portion of the bill that is not part of the dispute. Keep proof of each payment.

If the issuer’s instructions tell you to make a temporary payment while it investigates, follow those instructions and ask how any provisional credit or payment will be handled. Do not stop paying the entire account merely because one furniture charge is under review.

7. Monitor the issuer’s deadlines and letters

The issuer generally must acknowledge a proper notice in writing within 30 days unless it has already resolved the issue. It generally must complete the investigation within two billing cycles and no more than 90 days. Keep the acknowledgment, requests for more information, provisional-credit notices, and the final decision together.

If the issuer says the charge is correct, it must explain the decision, state how much you owe, and identify when payment is due. Read that letter immediately; a denial can permit collection activity to resume.

Do not include unsupported accusations such as fraud unless they are accurate. The issue here is non-delivery, so describe the missing goods and the agreed delivery terms precisely.

What counts as useful evidence

  • Proof of the transaction: the receipt, order confirmation, invoice, and statement line showing the merchant, date, and amount.
  • Proof of the agreement: the promised delivery date, delivery window, appointment confirmation, and written changes.
  • Proof of non-delivery: delay notices, messages saying the item is backordered, failed delivery appointments, and the absence of a delivery record.
  • Proof you contacted the seller: emails, chat transcripts, letters, call notes, and the seller’s refund or cancellation response.
  • Proof of procedure: a copy of the issuer notice, mailing receipt, electronic submission confirmation, case number, and every issuer letter.

Organize the documents chronologically and label each file. A one-page timeline can help an investigator understand the order without searching through dozens of messages.

If the issuer denies the dispute

Compare the denial with your evidence. Check whether the issuer treated the claim as a quality complaint, relied on a delivery record, or concluded that the notice was late. If a factual error appears, respond in writing with the missing document and a concise explanation tied to the order date and promised delivery date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The FTC says you may appeal in writing within the payment period specified by the issuer or within 10 days after receiving the explanation, whichever is later. Use the deadline in the issuer’s letter, send the appeal through the stated channel, and keep proof of submission. Ask for copies of documents the issuer relied on if the explanation does not include them.

You may also submit a complaint to the Consumer Financial Protection Bureau. A complaint does not guarantee a refund, but it creates a separate record of the issuer’s handling of the dispute. Continue watching payment dates while the denial or appeal is pending.

When the claims-and-defenses route may matter

FTC guidance describes a separate protection for certain disputes with a seller. It generally involves goods costing more than $5, a purchase made in the consumer’s home state or within 100 miles of the billing address, a good-faith effort to resolve the matter with the seller, and withholding payment. Exceptions exist, and the route has different legal requirements from an FCBA billing-error notice.

This route is especially relevant when the problem is framed as a seller dispute that does not fit neatly into the billing-error procedure, including some complaints about the quality of goods. It should not obscure the central non-delivery step: send a timely billing-error notice when the furniture was not delivered as agreed. Ask the issuer how it handles claims and defenses and verify every condition before relying on it.

Non-delivery is different from poor quality

A charge for furniture that arrived but is defective, damaged, or materially different can involve a quality dispute rather than a simple non-delivery billing error. The FTC distinguishes quality complaints from billing errors and describes claims-and-defenses conditions for some of those cases. Do not label a quality complaint as non-delivery merely because the seller’s proposed remedy is unsatisfactory.

Describe exactly what happened: no delivery, an incomplete delivery, a refusal to accept delivery, or goods that arrived with a defect. The issuer’s classification can affect which procedure and deadlines it applies.

Common mistakes that weaken a dispute

  • Sending the letter to the payment address. Use the billing-inquiries address instead.
  • Relying only on a phone call. A call may open a case but may not preserve the written-notice procedure.
  • Waiting for endless delivery promises. Document each promise, but protect the statutory notice deadline.
  • Sending originals. Keep the originals and provide copies or secure uploads.
  • Disputing more than the missing transaction. Identify the exact furniture charge and pay unrelated charges.
  • Stopping every payment. Pay the undisputed balance on time.
  • Assuming an extension is automatic. An issuer may extend a late-delivery window, but federal guidance does not guarantee that it must.
  • Using a quality-dispute argument for a non-delivery claim, or vice versa. Match the description and evidence to what actually happened.
  • Ignoring the final decision. A denial letter contains payment and appeal deadlines that require prompt attention.

Special timing situations

The delivery date was months after the purchase

Keep the statement that first showed the charge, the original delivery commitment, and every delay notice. Send the dispute as soon as the promised date passes and ask whether the issuer has a delayed-shipment extension policy. Explain why the problem could not reasonably be identified earlier, without claiming that the issuer is legally required to accept the late notice.

The seller promises a refund but does not issue it

Ask the seller for a written refund confirmation and the expected posting date. If the credit does not appear, notify the issuer that the seller acknowledged the cancellation but failed to post the refund, and attach the confirmation. Identify the original charge and any partial credit so the issuer can calculate the remaining amount accurately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The seller stops responding

Save bounced emails, unanswered messages, and failed delivery notices. Send the issuer the complete timeline and state the date of your last seller contact. Lack of response is evidence of your effort to resolve the matter, but it does not by itself guarantee that the issuer will approve the dispute.

Which payment methods are covered?

The FCBA procedure discussed here is for credit cards and other revolving credit covered by the federal rules. Debit cards, bank transfers, personal loans, installment contracts, and cash payments follow different laws and account agreements. Contact the payment provider promptly to ask about its own error-resolution process, but do not assume that the credit-card 60-day procedure applies.

A final checklist before you send anything

  • Have you identified the exact merchant, order number, transaction date, and amount?
  • Do you have the promised delivery date or window in writing?
  • Did you ask the seller for cancellation and a refund in writing?
  • Did you calculate the ordinary FCBA notice period from the first statement showing the error?
  • Are you using the billing-inquiries address rather than the payment address?
  • Have you enclosed copies of the order, statement, delivery evidence, and seller communications?
  • Did you keep a complete copy and proof of mailing or electronic submission?
  • Are you paying all undisputed charges on time?
  • Have you recorded the issuer’s case number and every response deadline?

For a furniture order that never arrived, a prompt written seller request followed by a documented issuer notice is the most useful sequence. The strength of the dispute depends on the delivery agreement, the timing of the notice, and the records showing what you did to resolve the problem.
