How to Get a Refund for a Gift Card or Unused Restaurant Loyalty Rewards

Sometimes—but not always. In the United States, a paid gift card, a free promotional card and restaurant loyalty points can be treated differently. Covered paid gift-card funds generally must remain valid for at least five years, but federal law does not guarantee a cash refund for every unused balance. Loyalty points may follow the restaurant program’s terms, and state law can add protections. Start by identifying what kind of value you have, then ask the issuer or restaurant for the specific remedy that fits it.

First identify what kind of value you are trying to recover

“Gift card” and “rewards” can describe different arrangements. The route to a remedy depends on whether you paid for the value, how it is held, and what happened to it. Do not assume that rules for a purchased card automatically apply to points or a free award.

What you have What to check Likely first request
A restaurant or store card purchased with money, including a reloadable stored-value balance Purchase or load records, current balance, card and funds expiration dates, and state protections Ask the issuer to confirm the balance and, if the card expired but funds remain valid, how to replace or access that balance
A general-use prepaid card, such as a network-branded prepaid card Whether it is covered by the applicable federal gift-card rules, its terms, and state law Contact the issuer about the balance, fees, expiration and any available replacement or cash-out option
A free promotional or loyalty card awarded by a restaurant How the award was issued and whether it qualifies for an exception to federal gift-card protections Ask the restaurant or program operator to identify the applicable award terms and available remedy
Points, a coupon or another account-based restaurant reward The current program terms for expiration, redemption, account closure and changes to rewards Ask the program operator to explain the specific event and consider restoring the points or providing another remedy

Federal rules cover specified types of gift cards and prepaid cards, but qualifying cards or codes awarded for loyalty, promotional or similar purposes can be excluded. A merchant retention program that gives consumers cards or coupons redeemable toward goods or services as a reward for purchases or visits can fit the loyalty-program category. The particular program structure matters, so the word “gift card” on an award does not settle the question. See the CFPB’s gift-card rules and its official interpretation of loyalty-program coverage.

Two comparisons help prevent a dead end. First, ask whether you have stored funds or an account record of points: a card issuer can check a money balance, while a restaurant program operator can review points, redemptions and account activity. Second, separate an expiration of the card used to access value from an expiration of the value itself. The same date or customer-service response may not answer both questions.

Can you get cash back from an unused gift card?

There is no single nationwide yes-or-no answer. Federal rules generally protect the validity of funds on covered paid gift cards; they do not require issuers to pay cash for every unused balance. State law may provide additional rights, including cash-out rights for some small balances, but eligibility and thresholds depend on the state and the card. Check the law where the card is governed or issued and the terms that apply to your specific card before treating a cash refund as guaranteed.

The federal baseline is about how long covered funds remain valid, not a universal refund promise. Under 12 CFR § 1005.20, funds on covered gift certificates or cards generally cannot expire earlier than five years after issuance or, for a reloadable card, the date of the last load. The precise coverage and date calculation depend on the card and transaction. The CFPB regulation and the Electronic Code of Federal Regulations text set out the rules.

That five-year protection does not mean every card must be redeemable for cash after five years, or that every card type is covered. It is a minimum period for covered funds, calculated from the relevant issuance or last-load date. Ask the issuer which date it used and whether it is saying the card itself expired, the underlying funds expired, or a fee reduced the balance. Those are separate explanations to evaluate.

State protections can change the answer. Florida’s 2024 statute, for example, generally restricts expiration and post-sale fees for many gift certificates, but contains exceptions, including certain loyalty or promotional certificates provided without a separately identifiable charge. That Florida rule is an illustration, not a rule that applies across the country. See Florida Statutes § 501.95. If you want cash rather than continued access to a balance, ask the issuer whether your state provides a cash-out option and what conditions apply.

Check whether the card expired or only the card itself

A printed expiration date may refer to the physical or electronic card, not necessarily the funds stored on it. For a covered card, funds generally cannot expire until at least five years after issuance or the last load. If the card expires while its funds remain valid, the issuer may replace the card or make the remaining balance available another way, subject to applicable state law, without charging for that service. Ask the issuer to check the underlying funds separately from the card’s expiration date. The CFPB’s official interpretation of § 1005.20 describes replacement or another way of providing a still-valid balance.

The interpretation explains that when a card expires but its funds have not expired, an issuer may, at its option and in accordance with applicable state law, provide a replacement card or otherwise provide the remaining balance—for example, by check. The practical point is to ask about access to valid funds, not only whether the original plastic can still be swiped. A transfer or replacement is not the same thing as a general right to receive cash on demand.

Request a written explanation of the dates the issuer used. In particular, find out whether it considers the card expired, the funds expired, or an inactivity fee applied. These are different issues and may have different remedies. If the issuer says the funds expired, ask for the issuance or last-load date it relied on and the applicable term or rule. If it says the card expired but the balance remains, ask how to transfer or replace that balance.

Gather records before contacting the issuer or restaurant

Useful records make it easier to identify the value, show what was promised and explain what went wrong. Collect what is available before opening a support request; do not send a full card number or other sensitive details through an unsecured channel.

  • The card or account identifier, with only the information the company needs to locate it.
  • Purchase receipts, reload records, or the date and details of the award if it was free or promotional.
  • A current balance record, transaction history, or screenshot of points and redemption activity.
  • The card packaging, email or account page showing relevant dates and terms.
  • The current program terms, especially sections on expiration, account closure, redemption and changes to rewards.
  • Any error message, failed redemption confirmation, notice of points removal or prior support correspondence.

Keep a copy of every message, the date it was sent and the company’s response. The FTC’s gift-card tips advise consumers to contact the issuing company when a card appears expired or fees have been deducted and to retain key card information and purchase records.

Make a precise written request

Use the issuer’s or restaurant’s official support channel. State what kind of value you hold, what happened, what the terms say if you can identify the relevant section, and what outcome you are requesting. A clear request makes it harder for a generic response to miss the issue.

  1. Identify the account or card securely. Provide the card or account number as requested through the company’s secure channel, plus the approximate purchase, reload or award date.
  2. Describe the disputed event. For example: the card shows an expiration date but appears to retain funds; an inactivity fee reduced the balance; points expired earlier than the terms indicated; a redemption failed; or points were deducted without the promised reward.
  3. Ask for the facts the company used. For a card, request the current balance and transaction history, the dates used to determine funds expiration, and an explanation of any fee. For points, request the exact program term applied and the account activity relevant to the loss.
  4. Name the remedy you want. Depending on the facts, request a replacement card, transfer of a still-valid balance, restoration of points, completion of the promised redemption, or a cash refund if the terms or applicable law provide one.
  5. Ask for a written answer. Save the request and reply, including any explanation that the company will not provide the requested remedy.

For restaurant rewards, describe the specific failure instead of making a general demand that all points be refunded. Ask the program operator to explain whether the points were removed under an expiration or account rule, whether a redemption failed, and whether it will restore the points or offer an equivalent remedy. A request for reinstatement is not a guarantee of entitlement; the answer depends on the program terms and what happened.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A concise request can say: “Please confirm whether this is a paid card balance or an award, the remaining balance or points, and the term and dates you relied on. If the card has expired but covered funds remain valid, please explain how I can access them. If points were removed or a redemption failed, please identify the applicable rule and whether you can restore the points or deliver the reward.” Tailor the request to what you actually hold, and send account details only through an official secure channel.

How to handle common situations

The card is expired but still shows a balance

Ask the issuer to confirm the underlying funds’ validity and the date used to calculate expiration. If the funds are still valid, request a replacement card or another way to access the remaining balance. For a covered card, replacement or another means of providing still-valid funds must be free of charge, subject to state law. Do not assume that the date printed on the plastic alone proves the funds have expired.

A fee has reduced the balance

Ask for the transaction history and the date and basis for each fee. Then compare the explanation with the card terms and applicable federal and state rules. The FTC recommends contacting the card issuer when fees have been deducted. If the issuer’s explanation does not resolve the issue, preserve the records and consider a complaint through the relevant state consumer-protection channel.

Restaurant points expired under the stated terms

Read the expiration rule that applied to your account and check whether the program sent notices or made changes that affected your balance. Ask the operator to identify the term and dates it relied on. If the terms clearly allowed the expiration and were applied as described, the program may decline to restore points; request an exception or other goodwill remedy if appropriate, but do not present cash-out as an automatic right.

Points were deleted, devalued or deducted after a failed redemption

Document the balance before and after the event, the redemption attempt, any error message and the reward the program advertised. Quote the relevant terms or representation, then ask the operator to explain the change and restore the points or deliver the reward if it was promised. A technical failure or merchant-partner issue may matter to a complaint, but it does not automatically establish that every restaurant program is subject to the same rules.

The company closed an account or will not explain its decision

Ask which account-closure or eligibility term it applied and whether the decision affects purchased funds, promotional value or account points. These categories can be treated differently. Keep the company’s written explanation and the terms in effect at the time. If the value was a paid covered card balance, distinguish the status of those funds from the loss of account access and ask how the company will make any still-valid balance available.

When CFPB rewards guidance may be relevant

The Consumer Financial Protection Bureau’s Circular 2024-07, dated December 18, 2024, addresses credit-card rewards programs and their operators and service providers—not every restaurant loyalty program. It describes circumstances in which conduct involving devaluation of rewards already earned or purchased, denial based on buried or vague conditions, or points deducted without the corresponding reward could violate consumer-protection law. It also notes that a merchant partner or technical problem does not necessarily remove a covered entity’s responsibility. See the CFPB circular on credit-card rewards.

This guidance is most directly relevant when the disputed reward belongs to a covered credit-card rewards program. It can also provide context where a consumer alleges misleading representations or failure to deliver a promised reward, but it is not a blanket rule requiring restaurants to cash out or reinstate every unused point. Keep the distinction between a restaurant’s own loyalty program and a credit-card issuer’s rewards program clear when describing a complaint.

The CFPB’s summary says covered providers “may violate the prohibition against unfair, deceptive, or abusive acts or practices” in circumstances that include certain rewards devaluations, denials based on buried or vague conditions, and points deducted without the promised reward. The circular also recognizes that conduct may involve a third party, such as a merchant partner, and may be relevant even where a provider says it followed the program terms. This is context for the covered credit-card rewards programs discussed in the circular, not a guarantee that every restaurant-points dispute has the same legal answer.

Escalate an unresolved dispute through official channels

If the issuer or restaurant does not resolve a documented dispute, the next step may be a complaint to a state attorney general or consumer-protection office. USAGov provides directories for state attorneys general and state consumer-protection offices. Include the amount or points at issue, dates, relevant terms, receipts or account evidence, your written request and the company’s response. Explain what outcome you requested and why you believe the decision conflicts with the terms or applicable law.

Choose the channel that fits the problem. A complaint about a balance on a paid card, a dispute over a promotional award and a restaurant-points redemption complaint may involve different entities and rules. A state office can direct or review consumer complaints, but filing one does not guarantee a refund or replace checking the law that applies to your card or program.

A quick decision path

  1. Was the value purchased? If yes, identify the issuer and card type. If it was awarded for loyalty or promotion, examine the award terms and do not assume paid-card protections apply.
  2. Is it stored money or account points? A card balance and points are not interchangeable; use the card issuer’s process for funds and the restaurant program’s process for account rewards.
  3. Did the access card expire, or did the underlying value expire? Request the balance and dates in writing before accepting an expiration notice as final.
  4. What does the applicable state add? Check for state-level protections or cash-out rights, since federal law does not create a universal cash-refund right.
  5. Was value lost in a way that conflicts with a promise? Preserve the terms and evidence, ask for the specific remedy, and escalate with the company’s answer if unresolved.

Frequently Asked Questions

Can I get a refund for an unused gift card?

Possibly, but there is no universal federal right to cash for every unused balance. Federal rules generally protect covered paid gift-card funds from expiring for at least five years; state law may provide additional rights, including cash-out rights in some circumstances. Ask the issuer to confirm the balance and check the law and terms that apply to your card.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I get cash back from a restaurant gift card?

Not automatically. A restaurant gift card purchased with money may be covered by federal rules governing funds expiration, but those rules do not require a cash refund for every balance. State law can add protections, so ask the issuer whether your state allows a cash-out and what conditions apply.

My gift card expired but still has a balance. Can I get a replacement?

If the card expired but the underlying funds remain valid, the issuer may replace the card or provide the balance another way, such as by check, subject to state law. For a covered card, that service cannot be charged for. Ask the issuer to check the funds separately from the card’s printed expiration date.

Can I get my unused restaurant rewards points back?

It depends on the program terms and what happened. Check rules for expiration, redemption, account closure and changes to rewards. If points disappeared unexpectedly, a redemption failed or the reward was not delivered, document it and ask the operator to identify the term applied and consider restoring the points or providing an equivalent remedy. Restaurant points are not automatically refundable for cash.

The restaurant deleted my points. How do I complain?

Save screenshots or account records showing the balance before and after, the relevant terms, any notices or error messages, and your support correspondence. Contact the program operator in writing, ask what rule and dates it relied on, and request restoration or delivery of a promised reward. If the dispute remains unresolved, USAGov lists state attorney general and consumer-protection offices. CFPB Circular 2024-07 concerns covered credit-card rewards programs, not every restaurant loyalty program.

The Bottom Line

Start by separating paid card funds from free awards and account-based restaurant points. Ask the issuer or program operator for the balance, the dates and terms it relied on, and the specific remedy available. A covered paid card’s still-valid funds may be replaceable even if the card expired, while cash refunds and restaurant-points reinstatement depend on state law, program terms and the facts.
