Start with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Brady State Lists to find out whether the FBI or a state agency handles a background check for the relevant firearm and transaction. Then use the state’s own agency guidance and current law to verify permits, approvals, identification, fees, waiting periods, and private-transfer rules. ATF’s list explains check routing; it is not a complete guide to state sale requirements.
What to identify before you look up the rules
The answer can depend on details of the transaction. Before consulting state materials, note:

- The state where the sale or transfer will take place.
- The buyer’s state of residence, especially if the transfer crosses state lines.
- Whether the transaction is through a federally licensed firearms dealer (FFL) or between private parties.
- Whether the firearm is a handgun or a rifle or shotgun.
These distinctions can affect who conducts a check and which transfer routes are allowed. A general state lookup cannot determine whether a particular person is legally eligible to possess a firearm.

How to find the applicable requirements
- Look up the state in ATF’s Brady State Lists. Check the entry for the relevant firearm category and transaction. The list indicates whether the FBI conducts the NICS check, the state acts as a point of contact (POC) for all transactions, or the state handles only some transactions. ATF’s page links to state clarifications and reports a last update of February 10, 2026.
- Follow the state link and confirm the procedure. Consult the responsible state agency—often the state police, department of justice, or attorney general—for instructions on applications, approvals, identification, fees, and timing. For a legal requirement, check the current statute or regulation as well; an agency FAQ may explain the process without being the governing law.
- Check for requirements beyond the background-check route. Verify whether the state requires a permit, a separate approval, a waiting period, or other conditions for the specific sale or transfer. The POC designation does not answer all of those questions.
- Cross-check the federal baseline. ATF says FFLs must conduct a NICS check for covered transfers to nonlicensees, subject to limited exceptions. ATF also directs licensees to follow applicable state law. An exception to a point-of-sale NICS check does not, by itself, establish that a transfer is exempt from state requirements.
- For a transfer across state lines, check both states’ laws and the delivery route. ATF says a firearm may be shipped to an FFL in the buyer’s state for delivery there. The federal over-the-counter exception for a nonresident applies to rifles and shotguns and remains subject to federal law and the laws of both states.
- Use current materials for the transaction date. State laws and agency procedures can change. Confirm the applicable state guidance and law close to the date of the sale or transfer.
What the Brady State Lists tell you—and what they do not
Some states conduct NICS background checks as POCs, and some divide check responsibilities by firearm type or transaction. ATF’s Federal Firearms Licensee Quick Reference and Best Practices Guide explains: “Some States, known as point of contact (POC) States, conduct NICS background checks for some or all firearms transfers.”

That routing information helps identify who handles a check. It does not establish every state rule on permits, fees, waiting periods, private transfers, or other conditions of sale. Use the linked state clarification for check procedures, then consult the relevant state agency and law for the rest.
Questions to verify for your particular transaction
- Who conducts the check? Determine whether the FBI, a state POC, or both have a role for this firearm and transaction.
- Is the sale through an FFL or between private parties? Do not assume a rule for dealer sales automatically applies to private transfers, or vice versa.
- Does the state require a permit or separate approval? Confirm the requirement with the state source, rather than inferring it from the POC listing.
- Are there fees or a waiting period? Check the current state procedure and the law that applies to the transaction.
- Does the transfer cross state lines? Verify the federal transfer route and the laws of both the state of transfer and the buyer’s state.
- How current is the information? Note the update date on the state’s official materials and check again near the transaction date.
If a check is delayed or denied
A delay or denial is not a general determination of eligibility that can be resolved by this lookup guide. The FBI explains that a NICS denial may reflect a federal or state prohibition. For a specific result, follow the instructions provided with the check outcome and consult the appropriate official channel; the reason can depend on the individual circumstances.
