Severance is not automatic under federal wage law, unemployment is administered by states, and health insurance choices such as COBRA, a spouse’s plan, Marketplace coverage, or Medicaid/CHIP can expire on different schedules. Your last work state, employer size, plan documents, household income, and the wording of your layoff agreement determine which options are available.
Build a benefits file before you make decisions
Create one folder—paper, digital, or both—for every document and date connected with the layoff. Keep the layoff notice, separation agreement, employment or union contract, final pay statement, benefits statements, retirement information, COBRA election notice, and unemployment claim confirmation together. This is practical organization rather than a separate federal recordkeeping rule, but it prevents missed deadlines and gives an agency or plan administrator the facts needed to answer your questions.

- Write down your last day worked and the date your employment officially ends.
- Record when wages, accrued leave, bonuses, commissions, and any severance are scheduled to be paid.
- Note the date health coverage ends, not merely the date your job ends.
- Save every response deadline, election window, certification date, and agency message.
- Keep the employer’s legal name, address, payroll contact, plan administrator, and federal employer identification information if shown on your documents.
Use the state where the work was performed as your starting point for unemployment questions. If you worked across state lines or remotely, do not infer the filing state from your home address alone; ask the relevant state agency for instructions.
Is your employer required to pay severance?
Usually not under the Fair Labor Standards Act (FLSA). The U.S. Department of Labor states: “There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay.” Severance is generally controlled by an agreement between the employer and worker or representative, rather than by the FLSA’s minimum-wage and overtime rules.

That federal baseline does not end the analysis. A payment may be required or promised under a written separation agreement, employment contract, collective-bargaining agreement, severance plan, equity or bonus plan, or applicable state law. Read the documents that apply to your job and ask which one controls if their terms conflict.
What to check in the separation paperwork
- Employment end date: Confirm whether the document uses your last day worked, a later payroll date, or another date for benefits and eligibility.
- Payment amount and schedule: Identify the gross amount, installments or lump sum, payroll dates, withholding, and any conditions attached to payment.
- Health-insurance subsidy: Look for an employer contribution toward COBRA or another continuation option, including when the subsidy begins and ends.
- Release and response terms: Check whether you must sign a release, when you may revoke it, and the deadline for returning it. Do not sign a document you do not understand; obtain qualified legal advice if the release affects claims, age-discrimination rights, equity, or other significant benefits.
- Accrued compensation: Look for vacation or paid-leave treatment, commissions, bonuses, expense reimbursement, and equity vesting or exercise rules.
- Property and confidentiality duties: Note return-of-equipment instructions and any continuing confidentiality, non-disclosure, or other post-employment terms.
Ask the employer for missing plan documents rather than relying on a verbal promise. The Department of Labor’s severance guidance says obligations can arise from contracts, plans, collective-bargaining agreements, state law, or a particular federal program even though the FLSA itself does not require severance.
WARN notice is separate from severance
A plant-closing or mass-layoff notice under the federal Worker Adjustment and Retraining Notification (WARN) Act does not prove that severance is owed. The Department of Labor’s WARN guidance treats severance, including vacation pay, as a separate matter generally governed by contract, state law, and sometimes the Employee Retirement Income Security Act (ERISA). Whether WARN or a state notice law applies depends on the employer, number of affected workers, timing, and location. Ask the labor agency for your state and review the employer’s notice; do not treat a WARN notice as a severance check.

There is no federal unemployment program. Each state operates its own unemployment-insurance system, sets its own eligibility rules, determines the weekly amount and duration, and decides how severance or other separation payments affect a claim. A layoff commonly leads to an application because the worker may be unemployed through no fault of their own, but the state agency—not the employer or a general federal rule—makes the individual eligibility decision.

File with the correct state agency
- Identify the work state: Start with the state where you performed the work. If you worked in more than one state, lived in another state, or worked remotely, contact the agencies involved and follow their interstate-claim instructions.
- Use the official agency portal or telephone number: Avoid unofficial filing sites that charge a fee or request unnecessary credentials.
- Gather claim information: Have your Social Security number or other identity information, address, employer names and addresses, dates of employment, reason for separation, wages, and bank details if direct deposit is available.
- Describe the layoff accurately: State that the separation was a lack of work or layoff when that is what occurred. Answer questions about severance, wages in lieu of notice, vacation pay, pension payments, or other compensation exactly as asked.
- Save the confirmation: Record the confirmation number, filing date, login credentials, weekly-certification schedule, and every message from the agency.
- Continue required certifications: Many states require weekly or biweekly certification and work-search activity. Missing a certification can delay or stop payment even after an initial approval.
- Report changes promptly: Tell the agency when you return to work, receive reportable income, begin training, or have another change the state asks you to report.
Many states use a look-back period and require a minimum amount of earnings or work. The weekly benefit, maximum duration, work-search rules, waiting period, appeal process, and treatment of severance differ by state and can change. Ask the agency how your specific severance schedule affects eligibility rather than assuming that a lump sum or installments are treated the same way everywhere.
If the agency denies or delays the claim
- Read the determination for the precise reason, deadline, and appeal method.
- Keep proof of the layoff, wages, availability for work, certifications, and any severance payments.
- File an appeal on time even if you are still gathering documents; follow the agency’s process for submitting additional evidence.
- Continue required weekly certifications while an appeal is pending unless the agency instructs otherwise.
- Ask the agency—not your former employer—to explain how a separation payment was counted.
Can you keep health insurance after a layoff?
Compare coverage immediately because election and special-enrollment periods run independently of your severance negotiations. Ask the plan administrator for the date active coverage ends, the monthly cost, covered dependents, effective date of continuation, and the exact deadline printed on your notice.
COBRA continuation coverage
Federal COBRA generally applies to private-sector employer health plans sponsored by employers with 20 or more employees and to most state and local government plans. Federal government and certain church plans are outside that general rule. State “mini-COBRA” laws may extend continuation rights to some smaller employers, so check with your state insurance department or plan administrator.

For a qualifying loss of coverage caused by job loss, COBRA may let you, your spouse, and dependent children continue the same group plan. The general federal election period is 60 days, measured from the later of the date the election notice is provided or the date coverage ends. The usual initial continuation period is 18 months, although longer periods can apply in some circumstances. Your notice and individual circumstances control the actual dates.
COBRA usually requires you to pay the employee and employer portions of the premium plus up to a 2 percent administrative fee—a general maximum of 102 percent of the plan cost for most continuation coverage. Request the actual monthly amount, including dependent coverage, before electing. An employer may subsidize COBRA as part of severance, but the Department of Labor says that subsidy is not required. Confirm whether the subsidy covers the full premium, the administrative fee, or only certain months.

Special enrollment in another employer plan
A spouse’s or family member’s employer plan may allow special enrollment after loss of other coverage. Department of Labor guidance generally gives you 30 days to request special enrollment after losing eligibility for the former plan. Ask that plan’s administrator for the request method, documents, premium, network, prescription coverage, and effective date. Do not wait for a COBRA subsidy to end before checking this deadline; the end of a subsidy does not necessarily create a new special-enrollment period.
Marketplace, Medicaid, and CHIP coverage
Marketplace coverage can be compared with COBRA using your location and household information. Check the actual premium, deductible, out-of-pocket limit, provider network, prescription formulary, and eligibility for financial help. Current income, household size, and state rules affect the result, so a severance payment or change in income can alter eligibility.
Also check Medicaid or the Children’s Health Insurance Program (CHIP) when household income falls within the applicable limits. These programs and Marketplace enrollment procedures vary by state. Use HealthCare.gov or your state Marketplace and the relevant state agency to confirm current windows and effective dates.
Health-coverage comparison
| Option | What to compare | Who confirms the details |
|---|---|---|
| COBRA | Full premium, up-to-2-percent fee, dependents, current doctors and prescriptions, 60-day election deadline, start and end dates, and any employer subsidy | COBRA election notice and plan administrator |
| Another employer plan | Premium, provider network, prescriptions, effective date, and 30-day special-enrollment deadline | Spouse’s or family member’s plan administrator |
| Marketplace | Local premiums, deductible, out-of-pocket limit, network, prescriptions, household eligibility, and financial assistance | HealthCare.gov or your state Marketplace |
| Medicaid or CHIP | Household income limits, covered family members, benefits, and enrollment timing | Relevant state agency |
Choose based on total cost and continuity of care, not the premium alone. A cheaper plan may have a narrower network, higher deductible, or different prescription coverage. Ask whether a pending treatment, specialist, or medication is covered before the old plan ends.

Protect retirement accounts and other earned benefits
Ask the retirement-plan administrator for the Summary Plan Description and an individual benefit statement. Review the account balance, vested percentage, distribution choices, tax consequences described by the plan, and every deadline that follows separation. Ask how the termination date affects vesting, employer contributions, loan repayment, and access to the account. Plan rules—not a general layoff rule—determine what you can keep or withdraw.
Review separate documents for stock options or restricted equity, annual or sales bonuses, commissions, paid leave, education benefits, life insurance, disability coverage, and health reimbursement or flexible-spending accounts. Each plan may use a different vesting, claim, or forfeiture date. Get the answer in writing from the administrator responsible for that benefit.
For ERISA-covered retirement or health plans, the Department of Labor’s Employee Benefits Security Administration can explain worker-assistance channels. The state unemployment agency handles unemployment eligibility and filing. The health-plan or COBRA administrator handles election notices, costs, and coverage terms. Contact the authority that controls the specific question.
Use this decision sequence
- Today: Save the separation documents, identify your last employment and coverage dates, and list every response deadline.
- As soon as possible: File the unemployment claim with the state agency that covers the work, then calendar every certification and work-search requirement.
- Before health coverage ends: Request the COBRA premium and election notice, check the 30-day special-enrollment window in another employer plan, and price Marketplace and public coverage for your household.
- Before signing a release: Check severance conditions, payment timing, benefit subsidies, accrued compensation, equity, and continuing obligations. Obtain qualified advice when the document waives claims or involves substantial rights.
- After filing and electing coverage: Store confirmations, notices, payment records, and administrator contacts in the same benefits file.

Is my employer required to pay severance?
The FLSA does not require severance pay. A contract, separation agreement, union agreement, severance plan, state law, or another applicable rule may create an obligation, so inspect those sources before concluding that no payment is due.
How long do I have to elect COBRA?
The general federal period is 60 days from the later of the date the election notice is provided or the date coverage ends. Your notice, plan type, and circumstances control the actual deadline.
