How to Find U.S. Tech Jobs That Sponsor H-1B Visas

The most reliable way to find potential H-1B-sponsoring tech employers is to combine historical U.S. Department of Labor (DOL) Labor Condition Application (LCA) disclosures with current job listings and direct confirmation from the recruiter. Use DOL records to identify employers that have recently filed for technology roles in locations you can work, then verify that a specific, open requisition supports your type of sponsorship.

An LCA is evidence of a filing, not a job advertisement, a promise to sponsor you, or an H-1B approval. The workflow below shows how to use the public data without treating old filings as current hiring commitments.

What the public H-1B data can—and cannot—tell you

The DOL’s Office of Foreign Labor Certification (OFLC) publishes selected information from employer applications and system-generated metadata. Its Performance Data page provides quarterly and fiscal-year LCA disclosure files and the record layouts needed to interpret them.

The currently listed FY2026 Q3 release covers determinations issued from October 1, 2025, through June 30, 2026. The page organizes data by fiscal year, identifies records by OFLC case number and latest determination date, and notes that a small percentage of determinations can change after an appeal or redetermination.

An LCA is the employer’s filing with DOL for a proposed H-1B worker. A certified LCA allows the employer to move to the petition stage; it does not prove that:

  • the employer has an equivalent vacancy today;
  • the named role was filled or the petition was approved;
  • the employer will sponsor a particular applicant;
  • the same worksite, level, salary or remote arrangement is available now; or
  • the case was not later withdrawn, denied or changed.

Some pending matters are not visible until a final determination. Employer-entered fields can contain typographical errors, omissions or other anomalies, and personally identifying information is excluded. Open-text fields may not extract cleanly. Treat the files as historical leads that require a current employer check.

Step 1: Define the job you actually want

Before searching a large dataset, write down the profile you will use to filter it. A filing by a major technology company is useful only if its occupation, level and worksite are plausible matches for you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Specify the role family

Use concrete targets such as backend software engineer, data scientist, site-reliability engineer, security analyst or product designer. Keep a short list of equivalent titles because employers may describe similar work differently. Do not assume that every “technology” title is a specialty occupation.

Set a realistic level

Separate entry-level, mid-level, senior and staff searches. A company that has filed for staff engineers may not sponsor a graduate role, and a filing for an experienced manager may say little about junior openings.

Choose acceptable worksites

List cities, states and any acceptable hybrid or remote arrangement. LCA records are tied to a worksite and wage area. A company with filings in one state is not automatically a sponsor for a position based elsewhere.

Record your immigration situation

Note whether you need a cap-subject first H-1B, are eligible for a cap-exempt route, or need a transfer from an existing H-1B employer. Also record your current work authorization, degree field and expected start date. These details determine what to ask about a live requisition.

Step 2: Use OFLC disclosure files to build a prospect list

  1. Open the official data page. Start at the DOL Performance Data page and select the latest LCA quarterly or fiscal-year file. Save the associated record layout; field names and formats changed beginning in FY2020.
  2. Choose the time window. Begin with the newest quarter or fiscal year, then compare earlier years when you need to see whether filings recur. Record the fiscal year and latest determination date for every result.
  3. Filter by employer. Search the employer’s legal name and common variants. Subsidiaries, acquired companies and alternate legal entities can appear separately, so check the employer-name field rather than relying on a brand name alone.
  4. Filter by occupation or title. Use the occupation code, job title and any available description fields to isolate technology work. Review the record layout before interpreting codes or text.
  5. Filter by worksite. Match the city, state and area to the locations you can use. A filing can list multiple worksites or a location that differs from the employer’s headquarters.
  6. Check determination status. Distinguish certified, denied, withdrawn and other statuses. Keep the case number and latest determination date so you do not count one record twice.
  7. Export a working sheet. Copy only the fields needed for comparison and add columns for the current careers URL, requisition number, sponsorship language and your follow-up date.

The DOL’s H-1B Advisor Public Access page explains that specified employer LCA records are available for public inspection. Use it as a companion reference when you need to understand the public-access context.

Fields worth capturing

Field How to use it What it does not prove
Employer name Find the legal entity and its careers site. That every affiliated company or division sponsors.
OFLC case number Deduplicate records and save a traceable reference. That the case became a petition or approval.
Latest determination date and fiscal year Measure recency and compare trends. That an opening is still available.
Occupation code and title Assess similarity to your target role and level. That your education satisfies the position.
Worksite city and state Check geographic fit and wage-area context. That the employer permits remote work from your location.
Determination status Separate certified filings from other outcomes. That a certified filing was used for a specific applicant.
Wage information Compare the filing’s role, area and level with a live posting. Your eventual offer or total compensation.

Step 3: Rank employers without creating a misleading “top sponsors” list

Use a simple evidence score to decide which employers deserve investigation first. This is a prioritization method, not a probability estimate.

Axis Strong signal Questions to ask
Recency Relevant determinations in the newest available quarter or fiscal year. Is the filing recent enough to reflect current hiring practices?
Role relevance Several records resemble your occupation and seniority. Do the titles and occupation codes match the work you can perform?
Location relevance Worksites fall within your acceptable locations. Would the same location apply to the current requisition?
Status and trend Repeated, clearly identified determinations across fiscal years. Are you counting case numbers rather than assuming filings equal hires?
Live vacancy An open requisition matches the role and level. Is the posting active, or merely an evergreen talent-pool page?
Sponsorship confirmation The posting or recruiter confirms sponsorship for your situation. Does it support a new petition, a transfer, or neither?
Compensation context Role, location, level and pay range align with the filing. Does the live role describe a different wage area or seniority?

The first four axes are historical evidence. A live vacancy and sponsorship confirmation are current employer-level evidence and should control your application decision. Avoid static rankings that label an employer a “top sponsor” without defining the fiscal years, occupations and counting method.

Step 4: Turn a historical lead into a live job lead

Search the employer’s own careers site

Search the legal employer name plus your role, city and level. Use the employer’s job ID or requisition number in your notes. A third-party job board can help you discover a listing, but open the employer’s page to confirm that the requisition is still active and that the wording has not been copied from an old post.

Read the eligibility language carefully

Look for statements such as “will sponsor employment visas,” “sponsorship may be available,” “must have unrestricted work authorization,” or “no sponsorship now or in the future.” Treat each phrase literally. “May be available” is not confirmation; a blanket “no sponsorship” statement normally rules out a new petition for that requisition.

Check the application questions

Applications often ask whether you will need sponsorship now or later, whether you are authorized to work in the United States, and whether you require a transfer. Answer accurately. An LCA lead does not justify selecting “no” to a sponsorship question.

Ask the recruiter a specific question

When the posting is ambiguous, provide the requisition number and your exact circumstance:

“For requisition [code], does the team support H-1B sponsorship for a candidate who [needs a cap-subject petition / currently holds H-1B status and needs a transfer]? If so, at what stage is sponsorship considered?”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Replace the bracketed wording with your situation; keep the question tied to one job. Ask whether sponsorship is available for this role, not whether the company has ever filed an LCA.

Step 5: Check specialty-occupation and worker fit

DOL describes an H-1B specialty occupation as work requiring specialized knowledge and at least a bachelor’s degree, or equivalent, in the specific specialty. USCIS separately reviews whether the offered job qualifies and whether the proposed worker meets the statutory requirements. The title “software engineer,” “analyst” or “designer” does not establish eligibility by itself.

  • Compare the job’s duties with your degree field or an accepted equivalent.
  • Check whether the employer’s stated education requirement is specific enough for the role.
  • Keep transcripts, diplomas, credential evaluations and experience records available if a petition requires them.
  • Ask qualified immigration counsel about unusual degree combinations, experience equivalency, status gaps or a material change in job duties.

The statutory cap is 65,000 new H-1B numbers each year, plus 20,000 under the U.S. advanced-degree exemption, according to the DOL’s Labor Condition Application (LCA) Specialty Occupations with the H-1B, H-1B1 and E-3 Programs page. Those are program caps, not a prediction of your chance of finding a sponsor. Some employers and institutions can be cap-exempt, so ask counsel or the employer which route applies rather than inferring it from a data record.

Step 6: Interpret wages, location and level correctly

For an LCA, the required wage is the higher of the employer’s actual wage for similarly qualified employees or the prevailing wage for that occupation and area. The filing’s wage therefore has to be read alongside the occupation, worksite and level.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a live listing includes a salary range, compare:

  • the same metropolitan area or state;
  • the same seniority and duties;
  • base salary versus bonuses, equity and benefits; and
  • the proposed primary worksite, including any required office days.

Do not present an LCA wage as a personal offer. A historical case may involve a different level, a different worksite or an employee who is no longer in that job.

How the LCA and H-1B petition fit together

  1. Employer prepares and files the LCA with DOL. The filing identifies the occupation, worksite, wage and other labor-condition information.
  2. DOL makes a determination. A certified LCA is the labor-condition step reflected in the disclosure data.
  3. Employer may submit the H-1B petition to USCIS. The petition contains evidence about the job and the candidate, which USCIS evaluates separately.
  4. USCIS reviews specialty occupation and worker qualifications. A certified LCA does not substitute for this adjudication.

The DOL’s H-1B Advisor describes this LCA-to-petition sequence. Because disclosure files stop at the public labor-certification record, they cannot tell you whether a particular worker’s petition was filed or approved.

Troubleshooting common search problems

“My target employer has no recent record”

Check alternate legal names, earlier fiscal years, nearby worksites and equivalent occupation titles. An absent record can mean the employer has not filed recently, uses a different entity, has pending matters not yet disclosed, or simply does not sponsor that role. Move the employer to a lower-priority list and rely on a direct recruiter answer.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The file shows many cases, but no matching job”

That is normal: disclosure data is not a vacancy feed. Search the current careers site and confirm the requisition’s status. Do not apply to an unrelated role merely because the employer appears frequently in the data.

“Records appear duplicated”

Use the OFLC case number, latest determination date and fiscal year to distinguish repeated records from the same case. Do not convert a row count into a headcount or a number of hires.

“The record contains an odd title, wage or address”

DOL warns that data-entry or application errors can create anomalies. Compare neighboring fields and the record layout, then verify the current role with the employer. Do not “correct” the public record by guessing.

“The posting says sponsorship is unavailable, but the employer has certified LCAs”

Follow the posting for that requisition. Employers can sponsor some teams, locations or job levels while excluding others, and policies can change. Ask whether a transfer or new petition is allowed for the specific opening.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Build a tracking sheet you can act on

A small, dated worksheet prevents historical evidence from being mistaken for current confirmation.

Column Example entry
Employer legal name Name exactly as shown in the disclosure file
Case number and determination date One row per case, with fiscal year
Target occupation and level Backend engineer, mid-level
Worksite City/state and remote constraint
Careers URL and requisition Direct employer page and job ID
Posting sponsorship text Exact wording, or “not stated”
Recruiter response Date, name and whether new filing or transfer is supported
Next action Apply, clarify, wait for response or archive

Set a reminder to recheck an ambiguous posting before its closing date. Save a copy of the text you relied on because job descriptions and sponsorship policies can change.

What not to infer from an LCA search

  • Do not infer an applicant-level approval probability from an employer’s filing count; official sources do not publish such a probability.
  • Do not call an LCA a visa approval or a job opening.
  • Do not assume a filing’s offered wage is the salary you will receive.
  • Do not assume a technology title automatically meets specialty-occupation rules.
  • Do not treat an old certified case as a current promise to sponsor you.

For case-specific immigration questions, use a qualified U.S. immigration attorney. The public files can help you choose whom to contact, but they cannot determine your legal eligibility.

Frequently Asked Questions

Can a small company sponsor an H-1B if it has no public LCA history?

Possibly. A new or infrequent filer may not appear in the latest files, and a pending matter may not yet be disclosed. Ask the company whether it has an immigration process and whether it will budget for a petition for the particular requisition; do not treat the absence of a record as proof either way.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Should I apply if a job post says sponsorship is available only for current employees?

Only if you already meet that condition or the recruiter confirms an exception. That wording generally distinguishes an internal transfer from a new H-1B petition, so request a written clarification before investing in the process.

Where can I get advice about my degree or immigration history?

A qualified immigration attorney can assess degree equivalency, prior status, cap eligibility and changes in employment. Employer recruiters can explain company policy, but they are not a substitute for individualized legal advice.
