How to Find the Rights Holder for a Video Game Before Licensing It

Start with the game’s credits, packaging or store listing, official website and copyright notices, then verify the names in copyright and trademark records. Treat those sources as leads—not proof that one company controls every asset. Before licensing anything, confirm in writing that the party you contact can grant the exact rights, for the territory, term, media and use you need.

What you are actually trying to identify

“Who owns this game?” is usually too broad a question for a licensing deal. A commercial game can contain several rights layers, and the answer can differ by asset, territory and intended use.

As an Amazon Associate I earn from qualifying purchases.

Asset or use Right that may apply What to verify
Source code and game build Copyright, usually connected to the developer, publisher or another contracting party Which legal entity owns or controls the specific edition and whether the proposed use includes code, a build or only a display of the game
Visuals, environments, artwork and interface elements Copyright; some logos or source-identifying graphics may also have trademark protection Whether the artwork was made for the game, acquired from a third party or reused under a restricted license
Characters, story and dialogue Copyright and, in some cases, separate personality, publicity or trademark rights Which elements are included in the grant and whether any character likeness or name requires another approval
Music and sound effects Copyright in the composition, recording and sometimes performer or neighboring rights Whether the soundtrack is original, commissioned, stock or licensed, and whether the existing license covers your media and territory
Game title, logo and branding Trademark and sometimes copyright Trademark owner, relevant classes and territories, plus any recorded assignment or coexistence limits
Gameplay footage, screenshots and streams A combination of copyright, trademark and sometimes rights in music, performers or depicted people Exactly which frames, audio tracks, logos and promotional context the permission covers

The World Intellectual Property Organization’s 2026 overview describes developers and publishers as rights holders for many game elements while noting that games can include pre-existing, separately licensed material. Consequently, a publisher name in a store listing may identify the right business to approach for one purpose but not automatically authorize every song, character, logo or clip.

Define the proposed licence before searching

Ownership research is only useful when the requested permission is precise. Make a short rights brief before opening a database.

  1. Identify the game. Record the exact title, platform, release or remastered edition, region and release date if known. Different editions can contain different music, artwork, publishers or contractual rights.
  2. Describe the material. Say whether you need the whole game, a playable build, a character, story text, artwork, a logo, soundtrack, screenshots, gameplay footage or another specific element. List every asset if the project combines them.
  3. Describe the use and media. State whether the material will appear in advertising, a film, television, a book, an event, a product, a website, a social post, an educational project or another medium. Explain whether you will edit, translate, synchronize, merchandise or otherwise adapt it.
  4. Set commercial boundaries. Note whether the use is commercial, promotional, internal, non-profit or mixed; whether you need exclusivity; and whether sublicensing to a production partner, distributor or platform is required.
  5. Set territory and term. Specify countries or regions, launch dates, the length of the licence, renewal options and any continuing use of copies already distributed.

These details determine which rights holder must consent. A request for a ten-second promotional clip in one country is not the same transaction as a worldwide, perpetual licence for a character and soundtrack.

Collect attribution clues from the game and its official channels

Check the in-game credits

Open the credits in the exact edition you plan to use. Capture the developer, publisher, copyright notice, music credits, middleware or asset acknowledgements, licensors and year statements. Save screenshots or a written record with the date you accessed them. Credits may reveal a composer, record label, localization company or other contributor whose permission is needed for your proposed use.

Review packaging and store listings

Physical packaging, manuals and digital store pages often name the publisher, developer, copyright claimant or distributor. Record the legal company name rather than relying on a studio nickname, imprint or brand. Preserve the listing for the relevant platform and region because a different storefront or edition can identify a different contracting party.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the official website and announcements

Look for legal notices, terms, press releases, licensing contacts, acquisition announcements and statements about ownership. A studio may have changed names, been acquired or assigned publishing rights after launch. Note the date and the entity that made each statement; a current contact is more useful than an old marketing page.

Separate a lead from proof

The Library of Congress recommends examining notices, publishers and authors as initial leads. Those clues help you form search names, but they do not establish a complete chain of title. A credit can describe a contributor, a publisher or a distributor without stating who can license every asset today.

Search U.S. copyright records

For a U.S. transaction, the U.S. Copyright Office database is a central verification step. Search by the game title, likely claimant, developer, publisher and individual creators. Search spelling variants and legal names discovered in the credits.

What to examine in a result

  • Registration title and work type, including whether the entry describes a computer program, audiovisual work, artwork, music or another component.
  • Claimant name and author information, which can differ from the public-facing studio or publisher name.
  • Registration date and publication details, to check whether the record matches the edition or asset you are licensing.
  • Documents recorded against the work, such as assignments, exclusive licences or other transfers.
  • Whether the record covers the entire game or only a component. A registration for a soundtrack or artwork does not by itself settle ownership of code, characters or branding.

Copyright Office records and recorded documents from 1978 onward are available online. The Office states that registrations, renewals and transfers from before 1978 require a manual search. If the game or relevant transfer predates that period, plan for additional correspondence or professional searching rather than treating an empty online result as evidence that no rights exist.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the Office’s search guidance

Copyright Office Circular 22 and Circular 23 provide the Office’s recommended guidance for researching records and transfers. Use them to refine searches and understand what a record does and does not show. A database result is evidence to investigate, not a government-issued certificate that the listed party controls every requested right today. Transfers may have occurred after the last recorded document, or a contract may grant control without assigning ownership in the way a searcher expects.

Build a chain-of-title file

For each relevant record, save the registration number, claimant, authors, dates and recorded-document references. Add the credit or notice that led you there and mark any mismatch in legal names. Create a timeline from developer to publisher, acquisition or assignment, and note gaps that the prospective licensor must explain. Do not infer that a later corporate name automatically proves a transfer; request documentation or a written representation from the party granting the licence.

Search trademarks separately

If your project displays the game title, logo, character mark or another source-identifying brand, perform a trademark search in every jurisdiction relevant to the release. In the United States, the U.S. Patent and Trademark Office explains that trademark and copyright protect different things and provides the Assignment Center for recorded ownership changes.

What a trademark search can answer

  • Which entity filed or currently owns a registration for the title or logo.
  • The goods and services classes and the geographic scope of the registration.
  • Whether an assignment or other recorded change identifies a new owner.
  • Whether similar marks or status issues could affect the proposed branding.

A trademark result does not prove ownership of the game’s code, visuals, music, story or other copyrightable content. Conversely, a copyright record for artwork does not grant permission to use a registered game title as a brand. If the deal uses both expressive content and branding, clear both rights categories and make sure the written grant addresses each one.

Investigate split and third-party rights

Ask directly whether each requested element was created for the game or incorporated under another licence. This question is essential for music, voice performances, photographs, fonts, stock art, middleware demonstrations, real-world brands and character likenesses.

Questions for the prospective licensor

  • Did the company commission or acquire the asset, and does its agreement provide the right to sublicense it for your proposed use?
  • Are any tracks, recordings, characters, names, logos or performances controlled by another company or individual?
  • Does the existing permission cover your territory, media, duration, edits, synchronization, advertising and commercial exploitation?
  • Are there approvals, attribution requirements, usage restrictions or talent consents that must accompany the licence?
  • Will the licensor obtain separate clearances, or must you contact the third-party owner yourself?

Do not assume that a publisher can grant a soundtrack merely because it distributed the game. Music rights can involve separate composition and recording owners, and a game’s existing licence may be limited to gameplay in specified markets. The same analysis applies to a character or logo supplied by an outside rights holder.

Compare possible counterparties and evidence

When several companies appear in credits, records and announcements, compare them against the asset and use rather than choosing the most prominent name.

Comparison point Questions to ask Evidence to request
Asset controlled Does this party control the code, art, music, character, title, logo or footage you need? Registration or assignment references, contracts, credit trail and a written representation of control
Type of right Is the permission based on copyright, trademark, a third-party licence, publicity or personality rights, or several categories? Applicable registrations and the agreement that authorizes sublicensing
Territory Where may you distribute, display, sell or promote the material? Territorial grant and any country exclusions
Use and media Which platforms, formats, edits, advertising contexts and downstream distributors are covered? Detailed licence language and asset-specific approvals
Term and exclusivity How long does the permission last, and is anyone else allowed to use the same rights? Start date, end date, renewal, exclusivity and sell-off provisions
Authority and chain Can the signatory bind the owner and grant sublicensing rights? Corporate identity, signatory authority, transfer history and any required third-party consents

If one candidate controls the trademark but another controls the soundtrack, you may need two agreements. If a publisher has worldwide rights for one platform but not another, limit the grant accordingly.

Contact the likely rights holder through an official channel

Use the legal, licensing or business-development contact published by the likely rights holder, not an unverified social-media account or an address copied from an old fan page. Identify your project and attach the rights brief. Ask the recipient to confirm that the named legal entity controls—or is authorized to sublicense—the exact asset, territory, term and use.

Information to include in the first request

  • Game title, edition, platform and territory.
  • Specific asset list, with filenames, character names, tracks or scene descriptions where possible.
  • Proposed media, commercial purpose, distribution channels and whether the material will be edited or synchronized.
  • Requested term, territory, exclusivity and sublicensing rights.
  • Launch or production schedule and any required approval deadlines.
  • Your legal entity and the production partners that would need permission.

Ask who else must approve the request. A licensing department may route music to a label, a character to a separate owner or a performer likeness to an individual representative. Keep the reply, attachments and every version of the proposed asset list with your rights file.

Put the permission in writing

Verbal approval, a credit, a press statement or a general fan policy is not a substitute for a licence tailored to your use. The Library of Congress recommends written permission that identifies the material, duration, intended use and context. Make those points explicit, along with the other terms that determine whether the grant is usable.

Core provisions for a rights grant

  1. Parties and authority: use full legal names, addresses and the signatory’s authority to bind the owner or sublicense the asset.
  2. Defined material: attach a schedule listing the game edition, code or build, images, characters, logos, recordings, compositions, footage and any approved edits.
  3. Rights and media: state whether the grant covers reproduction, display, distribution, public performance, synchronization, adaptation, translation, merchandising, advertising or other specified acts.
  4. Territory and term: name countries or regions, start and end dates, renewal mechanics and treatment of copies released before expiry.
  5. Exclusivity and sublicensing: say whether the licence is exclusive, sole or non-exclusive and identify distributors, platforms or production partners that may receive a sublicense.
  6. Approvals and attribution: define review deadlines, permitted edits, credits, notices and brand guidelines.
  7. Third-party clearances: allocate responsibility for music, performers, character likenesses, trademarks or other components not owned outright by the licensor.
  8. Representations and remedies: record what the licensor represents about its authority and what happens if a third party challenges the use.

Have counsel review the final document when the project is commercial, worldwide, exclusive, long-term or materially valuable. Rights clearance is a legal due-diligence task, not merely a search for an email address.

What to do when records conflict or no owner responds

Conflicting names or transfers

Pause the deal if a registration names one claimant, a trademark record names another and the publisher gives a third explanation. Ask for the missing assignment, merger document, exclusive licence or sublicensing authority. Keep a written list of unresolved points; do not “average” conflicting records into an assumption.

No online record

An absent copyright entry does not establish that the game is free to use. Copyright protection can exist without registration, and pre-1978 U.S. records require manual searching. Continue with official notices, contracts and a specialist search where the value or risk justifies it.

Unreachable or unknown owner

The Library of Congress states: “There is no special legal protection for using works just because they are orphan works, so you cannot use a work without permission simply because the rights holder cannot be easily located.” That guidance was last updated February 7, 2020. Document your search, but do not treat a failed search as consent. Delay, redesign the project, use material with a clear licence or obtain professional rights-clearance advice.

Account for jurisdiction and changing rights

The Copyright Office and USPTO steps above describe U.S. records. Ownership searches, registration systems, trademark rules, moral rights and licensing formalities vary by country. Search the trademark and copyright systems in every territory where the material will be exploited, and check whether a local representative or collecting society is involved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

International distribution also creates practical questions: a licence valid in one country may exclude another; a music agreement may cover only particular platforms; and a corporate acquisition may change the contracting entity without changing the public-facing brand. State the governing law and dispute forum in the agreement, and obtain local advice when the project spans jurisdictions.

A rights-clearance checklist

  • Exact game title, edition, platform and territory recorded.
  • Every requested asset and intended use listed.
  • Commercial status, term, exclusivity and sublicensing needs defined.
  • Credits, packaging, store listing, website and notices saved with dates.
  • Legal company names distinguished from studio or brand names.
  • U.S. copyright searches completed for title, claimant, creators and transfers where relevant.
  • Pre-1978 U.S. records escalated to a manual search when applicable.
  • Trademark searches and assignment records checked for titles and logos.
  • Third-party music, character, publicity, performer and other component rights identified.
  • Prospective licensor’s authority for each asset, territory and use confirmed.
  • Written permission signed with material, duration, use, context, territory, media and approval terms.
  • Conflicts, gaps and unanswered ownership questions resolved before publication, distribution or launch.

The reliable route is therefore sequential: define the use, collect attribution clues, verify copyright and trademark records, separate third-party components, confirm authority with the right legal entity and sign a scope-specific grant. Skipping any of those steps can leave a licence that covers the game’s name but not its music, or the footage but not the people and recordings visible in it.
