Start by identifying what you want the IRS to do: refund tax you overpaid, reconsider a tax decision, pay damages for unlawful collection conduct, or compensate you for injury or property damage. Each is a different legal route with its own forms, deadlines, and possible court. There is no single form for every “claim against the IRS.”
Which kind of IRS claim might you have?
Match the problem to the relief you want before choosing a form or calculating a deadline. A delayed refund, an audit disagreement, and a levy you believe was unlawful do not automatically use the same process.

| What you want | Likely route | Starting point |
|---|---|---|
| Return tax you believe you overpaid | Federal income-tax refund claim | Your original or amended income-tax return and the relevant filing and payment dates; see IRS refund-claim guidance. |
| Remove or return certain penalties, interest, fees, or other specified taxes | Abatement or refund claim for an amount covered by Form 843 | Check the current Form 843 instructions for the tax and type of relief; the form does not cover income-tax refunds. |
| Challenge proposed additional tax before paying it | Response to a statutory notice of deficiency, including a possible Tax Court petition | The notice and its stated deadline; IRS appeal-rights guidance. |
| Seek damages for certain unlawful collection actions | Potential claim under Internal Revenue Code section 7433, or another collection-related provision | Determine the legal basis and administrative-claim requirement; IRS Publication 5390 and Form 15237 are identified for certain claims. |
| Seek compensation for personal injury or property damage | Potential Federal Tort Claims Act (FTCA) claim | The separate FTCA administrative-claim process described by the IRS. |
This is a route-finding guide, not a determination that a particular set of facts qualifies. The notice, tax year, payment record, alleged conduct, and applicable law can change the answer.

Check the refund-claim deadline
For a federal income-tax credit or refund, the general deadline is the later of three years after the return was filed or two years after the tax was paid. The IRS states this general rule on its refund-claim guidance, current as accessed October 4, 2026. Special rules and exceptions can apply, including in certain disaster, combat-zone, assessment-extension, bad-debt, and worthless-security situations.

Use the actual dates for the tax year rather than estimating from the calendar. A return filed before its due date is generally treated as filed on the due date. Withholding and estimated tax payments are generally treated as paid on the return’s due date. The time limit for filing is not necessarily the amount limit: the amount that can be refunded may be capped according to when payments were made.
Use the income-tax return route
An original federal income-tax return or an amended Form 1040-X can serve as an income-tax refund claim. Form 843 is not the form for an income-tax refund and cannot be used to amend an income-tax return. The IRS Form 843 instructions, revised December 2024, describe its use for specified other taxes, penalties, additions to tax, interest, and fees. Confirm the live instructions for the particular tax and relief requested.
Keep the dates and records together
For a possible refund, assemble the relevant return, proof of filing, records showing when tax was paid or withheld, IRS correspondence, and the tax year involved. The Taxpayer Advocate Service calls the end of the time to file a credit-or-refund claim for a tax year the refund statute expiration date (RSED). If the IRS denies a claim, the disallowance letter explains the denial and appeal rights.

What if the IRS denied my refund claim?
Separate an administrative appeal from a lawsuit deadline
The ordinary deadline to bring a refund suit is two years from the date the IRS mails its notice of disallowance. The IRS says that asking for an administrative appeal does not extend that period. Its Publication 556, “Examination of Returns, Appeal Rights, and Claims for Refund,” states: “You generally must file suit for a credit or refund no later than 2 years after the IRS informs you that your claim has been rejected.” Publication 556 dates to September 2013, so check the actual notice and current IRS appeal guidance as well.
The IRS describes refund suits in U.S. District Court or the U.S. Court of Federal Claims. Its guidance generally identifies circumstances in which a taxpayer may sue, including when the tax has been fully paid and the IRS denied the claim, when the IRS has taken no action for six months, or when the IRS mailed a denial less than two years ago. The rules governing a particular suit can depend on the claim and case facts.
Check whether a written extension was completed
Form 907 is a written agreement to extend the time to file suit over a refund claim. It is effective only if both you and the IRS sign it before the existing deadline. Do not assume that a pending appeal, phone call, or request for more time preserves the suit period.

Is your issue a proposed tax bill rather than a refund?
A statutory notice of deficiency is different from a denial of a refund claim. It concerns proposed additional tax and provides a way to petition the U.S. Tax Court within the deadline stated in the notice, generally before paying the proposed amount. A Tax Court petition is not the standard route for recovering tax you have already paid.

Collection-related damages claims
Internal Revenue Code section 7433 allows a damages action against the United States in federal district court when an IRS officer or employee, in connection with tax collection, recklessly, intentionally, or negligently disregards the Internal Revenue Code or related regulations. That is a specific legal standard, not a general remedy for every upsetting interaction, audit disagreement, or late refund.

Some claims involving sections 7433, 7432, and 7426(h) require an administrative claim before suit. For certain such claims, IRS guidance points to Publication 5390 and Form 15237. The IRS Internal Revenue Manual describes exhaustion of administrative remedies before a damages judgment and a two-year suit limitation measured from accrual. Which rule applies depends on the claim and facts, so do not calculate a deadline from the date you first became dissatisfied without confirming the applicable basis and accrual rules.
Injury or property damage
A claim for personal injury or property damage allegedly caused by the IRS may instead fall under the Federal Tort Claims Act. The IRS describes that as a distinct administrative claim and lawsuit process. Its manual distinguishes this FTCA route from section 7433 claims, which use IRS Collection Advisory procedures.

- Identify the result you want. Write down whether you seek an income-tax refund, another kind of abatement or refund, review of a proposed tax decision, collection-related damages, or compensation for injury or property damage.
- Read the notice and record its dates. Keep the notice, envelope or other mailing evidence, tax year, return filing date, payment dates, and any stated response or court deadline.
- Use the route-specific IRS instructions. Check the current refund-claim guidance, the Form 843 instructions where relevant, the notice’s appeal instructions, or the materials for the particular damages process. Do not substitute Form 843 for an income-tax refund claim.
- Preserve evidence supporting the claim. Save proof of filing and payment, IRS correspondence, collection records, and documentation of any loss or injury. The relevant evidence depends on the relief sought.
- Get qualified help when the clock or legal theory is uncertain. A tax controversy attorney or tax professional experienced with IRS claims may be useful if you have a denial notice, collection action, possible damages claim, or approaching deadline. A court deadline can run while an administrative appeal is pending.
IRS procedural materials cited here include refund-claim and Form 843 guidance current as accessed October 4, 2026, IRS appeal-rights guidance published August 4, 2026, and Internal Revenue Manual material on damages and FTCA claims. The Form 843 instructions are revised December 2024, and Publication 556 is from September 2013. For action on a real claim, verify current IRS forms and guidance and follow the notice that applies to your case.
