The reliable way to investigate a possibly personalized online price is to run a controlled comparison. Check the identical product, seller, options, delivery location, account status, promotion eligibility, and purchase conditions in separate browser profiles or on different devices. Record both the advertised price and the complete amount shown immediately before payment, then repeat the comparison later. A difference is a clue—not proof that a store used your personal data—because demand, inventory, location, sellers, promotions, taxes, shipping, and fees can produce different totals.
What “personalized price” means
Personalized pricing is different from an ordinary sale or a price that changes for everyone in response to demand. In its August 2026 proposed policy statement, the Federal Trade Commission (FTC) describes it as using personal data to set a price according to what a company believes an individual consumer is willing to pay. The proposal distinguishes that practice from supply-and-demand changes affecting people in the same market.

The proposal is not a final rule or a categorical ban. The FTC opened it for public comment with a September 18, 2026 deadline. It should not be treated as enacted law or as a final finding about any particular retailer. FTC Chairman Andrew Ferguson said in the release accompanying the proposal: “The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce.” That statement describes the agency’s position in a proposed policy context, not a legal conclusion about your purchase.
Why a price difference does not settle the question
Two shoppers can see different numbers even when no personal willingness-to-pay estimate is involved. Before attributing a discrepancy to profiling, eliminate ordinary explanations that change the transaction itself.

The FTC says businesses may use dynamic pricing based on demand or inventory when the information presented to shoppers is not misleading. That kind of market pricing is not automatically personalized pricing. A one-time observation cannot distinguish the causes.
Run a controlled price comparison
Use the following procedure when the difference matters. It is a practical consumer method, not an official FTC test or a legal proof threshold.
1. Lock down the exact listing
- Open the product page and note its URL.
- Match the model or SKU, size, color, quantity, condition, and every selected option.
- Confirm the seller and fulfillment method, especially on a marketplace where several merchants may offer similar items.
- Note whether the page shows a subscription, recurring order, bundle, or one-time purchase.
Save a dated screenshot or note at this stage. A product title alone is not enough if variants or sellers differ.

2. Compare at approximately the same time
Open the same listing in two separate browser profiles, a second device, or another controlled session. Record the time to the minute if possible. Prices and inventory can change while you are switching between windows, so a comparison made hours apart is weaker evidence than one made concurrently.
3. Match location and currency
Enter the same delivery ZIP code or address area in both sessions. Match the currency, country or region setting, shipping method, and any store-specific delivery choice. If the site calculates tax only after an address is supplied, use the same address conditions in each session. A local offer is not evidence of personal profiling when the location itself differs.

4. Record account and promotion status
Write down whether each session is signed in, enrolled in a rewards or membership program, using a stored payment method, or eligible for a coupon. Do not silently compare a member price with a guest price. If one session has a welcome discount, abandoned-cart offer, or other limited promotion, record its eligibility requirements and expiration.
5. Capture the listing price and the checkout total
Record the headline price before adding the item to the cart. Then proceed only as far as the page that shows the complete amount immediately before payment. Keep separate entries for the item price, discounts, shipping, taxes, mandatory fees, optional add-ons, and the final total. The FTC’s fee guidance says required charges should be disclosed in the total before payment; a listing-only comparison can miss a later charge.

Repeat the comparison in separate browser profiles or on another device. A private browsing window can reduce the effect of some saved cookies or local history, but it does not make you invisible. During the session, the site can still observe activity and may recognize the device or account through other signals.
7. Repeat later when the result is important
Run the same check again at a later time while preserving the same conditions. If both sessions move together, a market or inventory change is more plausible. If one session repeatedly receives a different offer while all transaction conditions match, you have a stronger lead for asking the retailer how prices are determined, but still not conclusive proof of unlawful conduct or a particular profiling mechanism.
Keep an evidence record you can audit
A useful record lets you identify what actually changed and gives a retailer or regulator something specific to review. For each observation, preserve:

- Exact product URL, seller, model, condition, quantity, and selected options.
- Delivery location or ZIP code and currency.
- Browser profile or device used, and whether the session was signed in.
- Rewards, membership, coupon, or promotion status.
- Listing price before the cart.
- Shipping method and cost.
- Taxes, mandatory fees, optional add-ons, and discounts.
- Final amount displayed immediately before payment.
- Screenshots showing the page and the timestamp or contemporaneous notes describing it.

Keep the original files rather than editing screenshots. The record documents what you saw; it does not, by itself, establish that a retailer violated a law.

What data might influence an offer?
The FTC’s initial staff findings released in 2025 describe possible inputs that intermediaries could use in pricing systems. They include precise location, browsing history, demographic information, mouse movements, and items left in a shopping cart. The findings examined materials from six intermediary respondents that worked with at least 250 clients. That client count is not a count of retailers confirmed to personalize prices and is not a prevalence estimate.
Lina M. Khan, then FTC Chair, said the initial findings showed that retailers frequently use personal information for targeted prices, “from a person’s location and demographics, down to their mouse movements on a webpage.” The statement describes a plausible capability documented in the materials reviewed; it does not show that a particular store used each signal or that a particular price difference came from one of them.
Does incognito mode change online prices?
It can change some local conditions, but it cannot answer whether a price is personalized. A private session generally removes local browsing history and may limit some stored cookies after the window closes. It does not prevent the site from seeing activity while the window is open. Cookies, pixels, device fingerprinting, app advertising identifiers, account data, and cross-device tracking can all provide signals, according to FTC consumer guidance.
Use a private window only as one controlled comparison condition. Do not treat the result as a clean, anonymous baseline, and do not assume that a lower price in private mode proves the site rewards anonymity. The change could instead reflect a missing membership cookie, a different promotion, a changed inventory state, or a normal price update.

Privacy controls: useful limits, not a price detector
Browser settings and permissions
Review the browser’s privacy controls, site cookie notice, location permissions, and the retailer’s account settings. Restricting location access or deleting site data may reduce some signals, but it also changes the conditions you are testing. Record every change so that Session A and Session B remain interpretable.
Extensions and ad blockers
Some browser extensions or ad blockers can limit particular trackers. FTC guidance cautions that they may not block all tracking, especially when a site uses first-party account data or other identification methods. An extension can therefore be an optional privacy measure, not a certification that a store cannot personalize an offer.
Cookies, private sessions, and VPNs
Clearing cookies, using a private window, or changing network routing can alter some tracking signals and regional detection. None guarantees a lower price, reveals the pricing algorithm, or proves that a retailer did not use personal data. If you use one of these methods, treat it as a separate experimental condition and keep the original comparison as a control.
How to interpret common results
Only the headline price differs
First check whether the pages show the same seller, stock status, currency, variant, and time. If the final totals converge, the apparent discrepancy may have been a display or fee issue rather than a different price for the individual shopper.
The logged-in session is cheaper
Look for a clearly stated membership, rewards, or account promotion. A benefit tied to published eligibility is different from a hidden estimate of what one person will pay. Capture the promotion terms before comparing again.
The price changes after you add the item to the cart
Compare the shipping address, tax jurisdiction, delivery option, quantity, and mandatory charges. Record the amount immediately before payment. A cart-stage change can reflect transaction costs or stock updates, and the listing page alone cannot establish personalization.
One device repeatedly sees a higher offer
Check for account sign-in, saved location, rewards status, browser extensions, app identifiers, and cross-device account activity. Repeat on a second profile while keeping all non-device conditions fixed. Persistent divergence is worth documenting and asking the retailer to explain, but it remains a lead rather than proof of a specific data-driven price.
The discrepancy disappears on a later check
A disappearing difference is consistent with demand, inventory, a temporary promotion, or an ordinary price refresh. Preserve the earlier record; do not rewrite it as evidence of a stable individualized price.

Questions to ask the retailer
Contact customer support with a concise, factual record rather than an accusation. Ask:
- Was the item, seller, variant, and stock status identical in both sessions?
- What explains the difference between the listing price and the final pre-payment total?
- Were either account, rewards, coupon, location, or delivery conditions eligible for a restricted promotion?
- Does the company use personal information or behavior to set an individual price, rather than merely to show an offer or advertisement?
- Which charges are mandatory, and where were they disclosed before payment?
Save the response with your screenshots and timestamps. Avoid claiming that a difference proves unlawful conduct; the materials available here do not establish a universal consumer test or a standard proof threshold.
When to consider a complaint
If the retailer cannot explain a recurring discrepancy or appears to omit mandatory charges until late in checkout, you can retain your records and consider contacting the relevant consumer-protection authority. Describe exactly what you observed, the conditions you matched, and the explanation you received. Separate verifiable facts—such as two screenshots with different totals—from your hypothesis about personalization. The FTC’s proposed 2026 policy statement remains a proposal, so it should not be cited as a final ban or as a determination that your individual purchase violated federal law.
The practical conclusion
You cannot identify personalized pricing from a single different number. You can make the question testable by holding the product, seller, options, time, location, account, promotion status, browser conditions, and checkout path as constant as possible. Record the listed price and every component of the final pre-payment total, repeat the observation, and investigate ordinary market and transaction explanations first. The result is a careful record of a possible discrepancy—not a guarantee that you have uncovered an individualized pricing algorithm.
