How to Find Copyright-Safe Devotional Music for a 24/7 YouTube Stream in India

For the lowest-ambiguity starting point, use music you created yourself or music from YouTube’s Audio Library, and check the applicable terms for continuous livestreaming. For another person’s bhajan, kirtan or other devotional recording, get written permission from the relevant rights holders that expressly covers India, 24/7 YouTube livestreaming, monetization and any replay or later hosting. A devotional subject, a credit line or a “free” label does not by itself clear a track.

What “copyright-safe” means for a 24/7 stream

YouTube’s guidance defines safe music as music in the public domain or music used with permission from the copyright owner. That is a rights question; Content ID is a separate system for identifying and claiming material. A track can be claimed even if you describe it as free, and a Content ID result cannot establish whether you have permission obtained elsewhere.

For a continuous channel, permission should match the use you actually plan: transmission on YouTube, in India, on a continuing or looped livestream, with or without monetization, and with the intended treatment of replays, clips or later hosting. A license for ordinary videos or short-form use may not include those rights.

This is practical guidance, not a legal determination for a particular track or channel. Indian copyright questions can depend on the facts and on which rights are controlled by each party.

#1 Best Overall

Choose a music source with clear terms

Source What to verify for a 24/7 stream
Your own original music Confirm that you control the recording and the underlying composition and lyrics, including contributions by performers, writers or arrangers.
YouTube Audio Library Check the terms attached to the specific track and any attribution requirements. YouTube recommends its Audio Library as a source, but you still need to follow the track’s applicable terms.
Creator Music, where available Read the specific track terms and confirm that they allow continuous livestreaming, the intended territory, monetization and any replay or later hosting.
Third-party library, label or other recording owner Find the license for the exact recording and request written clarification if it does not explicitly cover India, live transmission, continuous looping, monetization, archive/VOD use or Content ID claims.
Music marked “free,” a credit line, or a purchased CD/download None of these facts alone establishes permission to livestream. Identify the rights holders and obtain terms for the actual online use.

Do not assume a traditional melody, devotional text or old composition makes a modern recording free to stream. A recording can have rights distinct from the underlying music and lyrics; a new arrangement or performance may also have its own relevant rights.

Clear both the recording and the underlying work

Identify each rights layer

A song may involve rights in the sound recording and separate rights in the musical composition and literary work, including lyrics. Make a track-level inventory of the exact recording, version or arrangement, composers, lyricists and recording owner or label where known. Permission from one party may not cover the other rights.

Ask the right organization or owner

IPRS explains that its licensing concerns musical and literary works in its controlled repertoire; it does not necessarily clear every right in a song. Its guidance distinguishes those works from the sound recording, which may require permission from the label or recording owner. Ask IPRS whether the specific composition or lyrics are in its repertoire, and contact the relevant label or recording owner about the recording. Get the scope from each relevant rights holder in writing.

Do not treat a venue or public-performance license as digital-streaming permission. PPL India says its cited on-ground license does not authorize digital usage, including online streaming; its FAQ says it does not issue virtual-use licenses and directs users to labels. A license for a particular repertoire and physical use should not be assumed to cover a YouTube stream.

Use this clearance workflow before going live

  1. Inventory the planned stream. List every track and exact version, its recording and underlying composition/lyrics, and whether the channel will be continuous, monetized, sponsored, donation-supported, archived, clipped or repackaged.
  2. Choose the source route. Start with original music or YouTube Audio Library tracks. For a third-party catalog or label, locate the actual license for each track; ask for written clarification where any relevant use is missing or ambiguous.
  3. Confirm both rights layers. Identify the recording owner and the owners or administrators of the composition and lyrics. Verify that permissions cover the same track, channel, territory and use.
  4. Get terms you can keep. Preserve the permission, license version, invoice and correspondence. The written terms should identify the tracks, platforms and channels, territory, dates, live and looped use, monetization, edits, replay or later hosting, attribution requirements, and what to do if Content ID claims the material.
  5. Test the intended use where permitted. A private or unlisted test stream using the intended tracks can help you check Studio for copyright notices. A clean test does not prove that rights are cleared or prevent a later claim.
  6. Keep an audit folder and update it. Store track metadata, receipts, permissions and claim-release instructions together. Recheck clearance when replacing a track or changing from live-only use to an archive, clip or repackaged video.

Do not rely on the religious-ceremony exception without advice

Section 52(1)(za) of India’s Copyright Act includes an exception for communication of works or recordings “in the course of any bona fide religious ceremony.” The Copyright Office’s official exceptions listing states that language, but the official material located does not decide whether a continuous online channel qualifies. It is not safe to infer that a permanent stream qualifies simply because its music is devotional, particularly if the stream includes independent entertainment or monetization elements. Ask a qualified Indian copyright professional to assess the actual channel and stream before relying on this exception.

If a licensed track receives a Content ID claim

  • Check the claim against the exact track and the written permission you hold; a claim does not establish whether your separately obtained license is valid.
  • Follow YouTube’s claim-dispute process if you have permission that covers the claimed use. Keep the license and any correspondence or release instructions available to support the dispute.
  • Ask the licensor whether the track is registered in Content ID and how the claim can be released for the relevant channel or video. Do not assume a license automatically prevents an automated claim.
  • Review your records and the license scope before continuing to rely on the track, especially if the permission does not clearly cover the stream, territory, monetization or replay.
