How to File a GST Refund Claim for Inverted Duty Structure (Current Rule 89(5) Guide)

If GST paid on your inputs is higher than the GST charged on your outward supplies, the resulting accumulation of input tax credit may qualify for a refund under the inverted-duty provisions. The claim is filed electronically in FORM GST RFD-01 on the GST common portal. The amount is not automatically equal to your electronic credit-ledger balance: it is the maximum produced by the current formula in CGST Rule 89(5), after the required tax-payable adjustment.

Before filing, confirm that your supplies, input-tax-credit records, relevant period, any notified exclusions and the Section 54 relevant-date rule support a claim. A difference between input and output tax rates by itself does not guarantee eligibility.

What “inverted duty structure” means

An inverted duty structure exists when the GST rate on goods or services used as inputs is higher than the GST rate on the taxpayer’s outward supplies. Credit then accumulates because the tax paid on purchases cannot be fully absorbed by the tax charged on sales. The refund mechanism is intended to address eligible accumulation attributable to that rate structure, subject to the statutory formula and exclusions.

The claim is distinct from a refund for zero-rated exports or supplies to a special economic zone. Do not substitute the zero-rated refund formula when preparing an inverted-duty claim. The applicable calculation is the one in Rule 89(5), using the fields and definitions prescribed for this category.

Check eligibility before opening RFD-01

Use the following checks as a decision gate. They do not replace a review of the current CGST Act, rules, notifications and your records.

Confirm the outward supplies in question

  • Identify the outward supplies for which the input tax credit accumulated and determine the GST rate actually applicable to those supplies during the claim period.
  • Check whether any class of those supplies is excluded or restricted by a current notification or other applicable provision.
  • Separate supplies that belong to another refund category, such as zero-rated supplies, rather than mixing their turnover or credit into the inverted-duty computation.

Reconcile the input tax credit

  • Reconcile the credit availed in your returns and books for the relevant period.
  • For the Rule 89(5) definition of Net ITC, identify the input tax credit availed on inputs during that period. In this formula, Net ITC is not a general label for every kind of credit and should not be described as including input-service credit.
  • Separately identify credit availed on inputs and on input services, because the subtractive adjustment in the formula uses a ratio whose denominator refers to both.
  • Remove amounts that are ineligible, reversed, restricted or otherwise not available under the applicable law before relying on them in the calculation.

Establish the relevant period and relevant date

The period used for turnover, Net ITC and tax-payable figures must be consistent with the claim. Section 54 and the current rules determine the relevant date and the filing window. The exact deadline depends on the facts and the provision applicable to the claim, so confirm it from the current law before submission rather than relying on a generic calendar reminder.

Check that a rate difference is not your only evidence

Eligibility can depend on the nature of the supplies, notified exclusions, the composition of credit and compliance with procedural requirements. Treat the rate inversion as the starting condition, not as proof that a refund will be sanctioned.

The current Rule 89(5) formula

For an inverted-duty refund, the maximum amount is calculated as:

Maximum Refund Amount = {(Turnover of inverted-rated supply of goods and services × Net ITC ÷ Adjusted Total Turnover)} − {tax payable on such inverted-rated supply of goods and services × (Net ITC ÷ ITC availed on inputs and input services)}

This is a ceiling generated by the rule. It is not an instruction to refund the entire balance in the electronic credit ledger, and it does not guarantee that the amount entered will be sanctioned.

What each component means

Component How to treat it for this claim
Turnover of inverted-rated supply of goods and services The turnover of the outward supplies covered by the inverted-duty claim for the relevant period. Use the rule’s applicable turnover definitions and keep the figure tied to the same period as the other inputs.
Net ITC Input tax credit availed on inputs during the relevant period for the Rule 89(5) calculation. Do not automatically include input-service credit in this number.
Adjusted Total Turnover The adjusted total-turnover figure required by the rule. It is the denominator for the first part of the calculation and must be determined using the statutory definition for the relevant period.
Tax payable on inverted-rated supply The tax payable on the inverted-rated outward supplies included in the claim, for the same relevant period.
ITC availed on inputs and input services The denominator in the second ratio. Unlike the Net ITC definition above, this ratio refers to credit availed on both inputs and input services.

Why the input and input-service distinction matters

The formula has two different credit concepts. Net ITC in the first fraction is limited to ITC on inputs. The second fraction adjusts the result using Net ITC divided by total ITC availed on inputs and input services. Treating both terms as interchangeable can materially overstate or understate the result.

Illustrative calculation

The following numbers are an illustration only; they are not a statutory threshold or an expected refund.

  • Turnover of inverted-rated supplies: ₹12,00,000
  • Net ITC on inputs during the period: ₹3,00,000
  • Adjusted total turnover: ₹20,00,000
  • Tax payable on the inverted-rated supplies: ₹1,20,000
  • ITC on inputs and input services: ₹3,60,000

First fraction: ₹12,00,000 × ₹3,00,000 ÷ ₹20,00,000 = ₹1,80,000.

Adjustment: ₹1,20,000 × (₹3,00,000 ÷ ₹3,60,000) = ₹1,00,000.

Illustrative maximum: ₹1,80,000 − ₹1,00,000 = ₹80,000.

In an actual application, each figure must be supported by the relevant returns, ledgers and statutory definitions. A credit balance higher than ₹80,000 in this illustration would not, by itself, increase the Rule 89(5) maximum.

Do not use an old inverted-duty formula

Older explanations often show a simplified subtraction of the full tax payable on inverted-rated supplies. That is not the current amended text. Notification 14/2022 changed Rule 89(5), and GSTN’s functionality compilation records a corresponding change to the Statement 1 label so that it reflects the “Net ITC/ITC availed on inputs and input services” ratio.

Use the current rule and the current portal form, not an old spreadsheet, infographic or video. If a legacy workbook subtracts the entire tax payable without the ratio, rebuild it before entering figures in RFD-01.

Prepare the claim file

The law and portal can change their validations and prompts. Prepare a traceable working file so that every number entered in RFD-01 can be explained.

Minimum internal reconciliation

  • List each outward supply included in the inverted-rated turnover and the period in which it was reported.
  • Reconcile the turnover total to the relevant GST returns and accounting records.
  • Reconcile input credit on inputs to purchase records, eligible-credit calculations and the returns in which it was availed.
  • Prepare a separate total for input-service credit for the denominator used in the adjustment ratio.
  • Document the tax payable on the inverted-rated supplies and the adjusted total-turnover computation.
  • Record reversals, blocked credits, corrections and amendments that affect any formula input.

Check the period for overlap

Do not count the same turnover or credit in multiple refund periods. If invoices, amendments or credit notes span periods, document the allocation you used and ensure that the corresponding return data supports it.

Keep evidence ready without assuming a fixed attachment list

The reviewed official material does not establish one universal attachment checklist for every taxpayer or every current portal version. Follow the documents and declarations the portal requests for your claim, and retain the underlying invoices, ledgers, return reconciliations, calculation sheet and eligibility analysis in your records. If the portal asks for a declaration or supporting statement, use the current format displayed there rather than an old downloaded template.

File the refund electronically in FORM GST RFD-01

Rule 89 provides the electronic application route through the common portal. The exact screen sequence and validation prompts can change, so treat the portal’s current labels as authoritative.

  1. Sign in to the GST common portal. Use the taxpayer account associated with the registration for which the refund is claimed.
  2. Open the refund application service. Start a new application in FORM GST RFD-01 and select the inverted-duty refund category presented by the current portal.
  3. Set the relevant period. Enter the period covered by your reconciled calculation. Do not combine periods merely to use a larger credit balance.
  4. Enter the statutory figures. Provide turnover of inverted-rated supplies, Net ITC on inputs, adjusted total turnover, tax payable on the inverted-rated supplies and the credit figures required for the input-and-input-service ratio.
  5. Review the generated calculation. Compare the portal’s result with your independent Rule 89(5) worksheet. Investigate any difference before submission; do not overwrite a statutory field with a figure chosen only to match the ledger balance.
  6. Attach or provide the information requested by the current form. Use the portal’s current instructions and declarations. Keep a copy of every file and statement submitted.
  7. Submit the application using the authentication method available for the registration. Save the acknowledgement details generated after successful filing.

The portal may reject an entry because of a period mismatch, an arithmetic inconsistency, a turnover or credit field that does not reconcile with return data, or a validation that has changed since an older guide was published. Correct the underlying record or calculation rather than forcing a value through.

What happens after submission

Scrutiny and acknowledgement

Rule 90 addresses the officer’s scrutiny of the application. When the application is complete, the rule provides for an acknowledgement in FORM GST RFD-02. An acknowledgement means the application has entered the statutory processing flow; it is not the same as a final sanction order.

Track the application and download the ARN receipt

GST Portal guidance states that filed or saved refund applications can be viewed at Services > Refunds > My Saved/Filed Applications. Use the hyperlink for the application to view its details and download the ARN receipt. Keep the ARN with the calculation workbook and all supporting records.

Respond to later communication

If the officer seeks clarification, additional documents or a correction, respond through the channel and within the period specified in the communication. Compare the request with the figures and documents originally filed, and preserve both the response and proof of submission. Do not assume that an acknowledgement resolves an eligibility dispute.

Common mistakes and how to correct them

Claiming the whole electronic credit balance

Symptom: The amount claimed equals the ledger balance even though the Rule 89(5) result is lower.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Recalculate the statutory maximum using the inverted-rated turnover, Net ITC on inputs, adjusted total turnover and the separate tax-payable ratio. The ledger balance is not the formula’s output.

Including input-service credit in Net ITC

Symptom: The first fraction uses all input and input-service credit.

Correction: Rebuild Net ITC using ITC availed on inputs during the relevant period. Retain input-service credit for the denominator of the second ratio where the rule requires it.

Subtracting all tax payable without the ratio

Symptom: A spreadsheet uses “first fraction minus tax payable” with no Net ITC-to-total-credit ratio.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Replace the legacy calculation with the amended Rule 89(5) expression. Check that the form’s Statement 1 labels correspond to the current ratio wording.

Mixing refund categories

Symptom: Export or other zero-rated turnover, or credit linked to another category, is included in the inverted-duty figures.

Correction: Separate the categories and prepare the calculation required for each applicable route. Do not use the zero-rated formula as a substitute for Rule 89(5).

Using inconsistent periods

Symptom: Turnover comes from one period while credit or tax payable comes from another.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Reconcile every component to the same relevant period and document any permitted amendment or credit-note treatment.

Relying on an outdated portal guide

Symptom: A screenshot, downloaded form or tutorial shows different Statement 1 labels or validation rules.

Correction: Follow the current common-portal form and current statutory text. Notification 14/2022 changed the formula and the related form wording.

When professional review is sensible

Consider a GST practitioner or tax professional when the claim involves multiple tax rates, several business verticals, substantial input-service credit, amended invoices, prior reversals, notified exclusions or a disputed relevant date. Give the adviser the reconciled turnover, credit split, tax-payable calculation, return extracts and the portal ARN so that the review is based on the same figures you filed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a straightforward claim, professional assistance is not a substitute for your own reconciliation. The registered taxpayer remains responsible for ensuring that the application reflects the correct period, eligible credit and statutory formula.

Practical pre-submission checklist

  • Outward supplies covered by the claim are identified and their GST treatment has been checked.
  • Potential exclusions under current notifications have been reviewed.
  • The relevant period and Section 54 relevant date have been confirmed.
  • Turnover of inverted-rated supplies is reconciled to returns and books.
  • Net ITC includes only ITC on inputs for this Rule 89(5) calculation.
  • ITC on inputs and input services has been separately determined for the adjustment ratio.
  • Adjusted total turnover and tax payable on inverted-rated supplies are supported by a worksheet.
  • The amended formula, including the ratio in the subtractive adjustment, has been used.
  • The portal’s current prompts and requested documents have been followed.
  • The submitted RFD-01, ARN receipt, calculation and supporting records have been saved.
