To challenge an Indian GST order that imposes a penalty but no tax demand, file FORM GST APL-01 under section 107 before the correct Appellate Authority. The ordinary limit is three months from communication of the order. For a genuinely penalty-only order, the current section 107(6) proviso requires payment of 10% of the penalty, in addition to any amount admitted from the order. A further period of up to one month may be allowed when sufficient cause prevented a timely appeal.
Identify the order, communication date, passing officer, jurisdiction and penalty provision before starting. Then prepare the order and notice record, statement of facts, numbered grounds, prayer, payment proof and supporting evidence; submit APL-01 through the GST Portal; and preserve the final acknowledgment and appeal number.

What a penalty-only GST appeal is
A first appeal under section 107 is the statutory challenge to an adjudicating authority’s order. A penalty-only order is one that demands a penalty without demanding tax. It may still be appealable even when the tax column is nil. The absence of a tax demand does not, by itself, remove the appeal requirement or reduce the statutory pre-deposit to zero.

First check whether the order and forum are correctly identified
Do not begin with the portal form. Start by reading the complete order and its demand summary. Record the following in a working sheet:
- Order number and date.
- Date and method by which the order was communicated, such as a portal notice or other documented delivery.
- Designation of the officer who passed the order.
- GSTIN, tax period and issue under dispute.
- The statutory section or rule used to impose the penalty.
- Separate amounts for tax, interest, fine, fee and penalty.
- Whether any tax, interest, fee or penalty is admitted rather than disputed.
The designation of the adjudicating officer and the applicable jurisdiction determine the Appellate Authority. Use the order, jurisdictional assignment and applicable notification or rules; do not select an authority by guessing from the taxpayer’s registered address.
What is the time limit to file a GST appeal?
Section 107(1) gives the appellant three months from communication of the order to file the appeal. The relevant starting point is communication, not simply the date printed on the order. Keep evidence showing when and how you received it, because that date affects limitation.

Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Section 107(4) allows the Appellate Authority to admit an appeal filed during a further period of up to one month if sufficient cause prevented filing within the ordinary three months. This is discretionary, not an automatic grace period. Explain the cause, dates and supporting evidence in the condonation request and do not assume that a late filing will be accepted.
Deadline checklist
- Locate the communication event in the portal, email or other delivery record.
- Calculate the three-month period from that communication date.
- Allow time for payment, document preparation, portal authentication and any technical issue.
- If the ordinary period has expired, determine whether the filing is still within the possible additional one-month period and prepare a specific sufficient-cause explanation.
- If more time has passed, obtain case-specific advice before relying on the portal’s ability to accept an application.
Do I need to pay a pre-deposit for a penalty-only GST order?
Yes, under the current official text of section 107 checked in October 2026, an appeal against an order demanding penalty without involving a tax demand cannot be filed unless 10% of the penalty has been paid. The same appeal must also include full payment of amounts arising from the order that the appellant admits.
This is distinct from the ordinary rule where tax is disputed. The general section 107(6) framework uses a percentage of disputed tax, while the current proviso addresses an order that demands penalty without tax. A GST Portal FAQ’s general explanation of a 10% deposit refers to disputed tax and does not, in the passage considered, set out this penalty-only proviso. Check the enacted text applicable on the filing date and reconcile it with the live portal calculation and the exact demand summary.

| Order type | Amount admitted | Pre-deposit for disputed portion |
|---|---|---|
| Penalty only, with no tax demand | Pay in full | 10% of the penalty demanded under the current section 107(6) proviso |

Illustrative calculation
If a penalty-only order demands ₹1,00,000 and you dispute the whole penalty, 10% is ₹10,000. That arithmetic is only an illustration; use the penalty amount actually demanded, identify any admitted amount separately, and follow the payment reference and amount generated for your order. If the order also contains a tax demand, it is not a penalty-only order for this distinction.
Prepare the appeal record before opening APL-01
FORM GST APL-01 requires more than an uploaded order. Assemble a coherent record so that each ground can be checked against the notice, your response and the officer’s findings.
Core documents
- The impugned order and demand summary.
- Proof of communication, including the relevant portal or email record.
- The show-cause notice and documents relied on by the officer.
- Your reply, written submissions and hearing correspondence or record.
- Invoices, returns, ledgers, reconciliations, contracts or other evidence that addresses the findings actually made.
- Proof of payment of admitted amounts and the applicable pre-deposit.
- Authorization or representative details where someone files on the taxpayer’s behalf.
The exact attachments vary with the order and penalty provision. The list above is practical preparation based on the form’s requirements for facts, grounds, amounts and supporting documents; it is not a universal list of mandatory attachments for every dispute.
Organize a short chronology
Write the material events in date order: notice, reply, hearing, additional submissions, order, communication and payment. A chronology helps the authority test procedural objections and prevents the statement of facts from becoming a repetition of every document in the file.

The seven-day document instruction
The GST Portal APL-01 FAQ describes a situation in which the order is not uploaded and a self-certified copy must be submitted within seven days. Read the live instruction attached to your application and comply with that deadline. A late copy can affect the filing date or processing of the appeal. Do not treat the seven-day period as a replacement for the three-month statutory limitation; they address different parts of the filing workflow.

Provisional and final acknowledgment
The portal distinguishes a provisional acknowledgment from the final acknowledgment or appeal number. Keep both if issued, together with the exact documents submitted. A screenshot alone is not a substitute for downloading the acknowledgment and the completed application.
How to write the statement of facts, grounds and prayer
The appeal succeeds or fails on the order and record, not on the fact that the tax demand is nil. Explain precisely why the penalty should be cancelled, reduced or otherwise modified under the provision used by the officer.
Statement of facts
Set out only facts needed to understand the dispute:
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →- What transaction, return, document or conduct the notice examined.
- What you submitted and when.
- What the officer found and how the penalty was computed.
- Which part of the finding or amount you accept, if any.
- How the order was communicated.
Use paragraph numbers that match the documents and identify exhibit names consistently.
Grounds of appeal
Number each ground and connect it to a finding in the order. Depending on the actual record, grounds may address:
- Whether the statutory penalty provision applies to the facts found.
- Whether the order relies on a fact that was not established by the notice, evidence or hearing record.
- Whether your reply or documents were overlooked or misread.
- Whether the authority followed the required notice and hearing procedure.
- Whether the penalty amount was computed using the correct period, base or statutory limit.
- Whether the order gives adequate reasons for imposing the penalty and rejecting your explanation.
Do not claim that a penalty is automatically invalid merely because no tax is demanded. Section 107 expressly contemplates appeals from penalty-only orders and sets a deposit rule for them.

Prayer for relief
State the result you want in specific terms. For example, ask the authority to set aside the penalty, or to grant the alternative reduction or modification that follows from a particular computation or finding. Identify the order number and the exact amount covered by the prayer. Avoid a vague request to “do justice” without identifying the decision sought.

Classify the order before paying. The classification affects the deposit calculation and the way you describe the dispute.
| Question | Penalty-only order | Tax plus penalty order |
|---|---|---|
| Is any tax demanded? | No; the demand is limited to penalty, subject to any other amount shown in the order | Yes; tax is included in the demand |
| Key deposit basis | 10% of penalty under the current penalty-only proviso | General disputed-tax calculation under section 107(6) |
| What must be paid if admitted? | Every amount arising from the order that is admitted | Every amount arising from the order that is admitted |
| Main classification evidence | Demand summary showing no tax demand | Demand summary showing tax and penalty components |
Interest, fine or fee shown in the order should not be silently treated as part of the penalty. List each category separately, decide what is admitted, and use the order’s own breakup when completing APL-01.

Counting from the order date instead of communication
The statutory period runs from communication. Preserve the delivery record and calculate from that event.
Assuming a zero tax demand means zero deposit
For a genuinely penalty-only order, the current proviso requires 10% of the penalty. Confirm the enacted provision and the portal amount before submission.
Using the wrong Appellate Authority
The correct forum follows the adjudicating officer’s level, designation and jurisdiction. Check the order and applicable assignment rather than selecting a convenient office.

Uploading only the order
The form asks for facts, grounds, prayer and amount details. Attach the notice, reply, hearing material and evidence needed to test the findings, subject to the portal’s file instructions.
Writing grounds that do not answer the order
Generic objections are difficult to decide. Quote the finding by paragraph or page, identify the contrary document, and explain the legal consequence you seek.
Missing the portal’s follow-up deadline
If the system requires a self-certified order copy within seven days because the order was not uploaded, submit it within that window and retain the submission proof.
Failing to save the final acknowledgment
A successful payment screen is not the complete appeal record. Download the acknowledgment, appeal number and submitted files and store them with the order.
What to do when the ordinary deadline has expired
First determine the exact communication date and whether the filing is still within the possible additional one-month period. If so, include a clear sufficient-cause request explaining the event, its duration, the steps taken to file and the documents supporting it. The Appellate Authority decides whether the cause is sufficient; the extension is not automatic.
If the delay is longer, or if limitation is disputed, the outcome depends on the order, governing statute, jurisdiction and procedural history. Obtain qualified Indian GST advice before relying on a late portal submission or assuming that payment alone preserves the right of appeal.
Final pre-submission checklist
- Correct order, officer, GSTIN, period and jurisdiction identified.
- Communication date evidenced and three-month deadline calculated.
- Any sufficient-cause request prepared if filing during the additional month.
- Order confirmed as penalty-only or classified as tax plus penalty.
- Admitted amounts paid in full.
- Correct pre-deposit paid: 10% of penalty for a current penalty-only order, or the applicable disputed-tax calculation where tax is disputed.
- Statement of facts, numbered grounds and precise prayer completed.
- Notice, reply, hearing record, evidence and payment proof attached as relevant.
- Personal-hearing preference selected in APL-01.
- Portal follow-up, including any seven-day self-certified-copy instruction, completed.
- Final acknowledgment, appeal number and submitted documents downloaded and retained.
Bottom line for a penalty-only GST order
Use FORM GST APL-01 under section 107, file within three months of communication unless a discretionary one-month sufficient-cause extension is available, and do not assume that a nil tax demand means no pre-deposit. Under the current statutory wording, a penalty-only order requires 10% of the penalty plus full payment of admitted amounts. The quality of the appeal then depends on matching each ground and document to the actual notice, findings, evidence and penalty provision.
