To file a complaint about a surgeon, contact the state medical board that licenses the surgeon or oversees the state where the care occurred, and follow that board’s current instructions. The Federation of State Medical Boards (FSMB) provides a directory of state medical boards; the applicable board—not a general national form—sets the filing process.

What a state medical board complaint can address

State medical boards regulate physicians’ licenses and investigate allegations of incompetence or unprofessional conduct under state law. FSMB’s consumer guidance lists substandard care and failures in post-operative care among common complaint concerns. Other examples include prescribing problems, a missed diagnosis later discovered, harmful delays in communicating test results, and failure to respond to a hospital call in a traumatic situation. These examples do not establish that a particular surgeon violated a rule. FSMB consumer guidance

The board first considers whether it has authority under the state’s Medical Practice Act. If it lacks jurisdiction, it may refer the matter to another agency or tell you it cannot investigate. The precise scope of authority depends on state law.

How to file a complaint against a physician

  1. Find the appropriate state board. Start with the FSMB state medical board directory. Check that the board covers the surgeon’s license type: some states have separate boards for allopathic and osteopathic physicians. If the surgeon treated you in a different state from the one where they are licensed, contact the board to confirm where to file.
  2. Read the board’s current complaint instructions. Confirm which form to use, how to submit it, what information and supporting documents are requested, and what the board says about confidentiality. Processes vary by state. FSMB notes that the board information in its guide was provided during 2020, so verify current requirements directly with the relevant board.
  3. Write a factual chronology. Note dates and locations; identify the surgeon, facility, and other people involved; describe what happened and what was said; and explain what followed and why it concerns you. Separate what you personally observed from what someone else told you.
  4. Collect relevant documents. Gather records already available to you, such as discharge paperwork, test results, bills, correspondence, and notes of follow-up communications. Submit sensitive records only as the board instructs. There is no single evidence checklist or submission rule established for every state.
  5. Submit through the board’s stated channel and keep a copy. Save your completed complaint and attachments, along with any confirmation or case number. Ask the board how to send additional information and how to inquire about status.
  6. Respond to follow-up requests. The board may ask for clarification or additional material. Follow the instructions it provides and keep copies of any further submissions.

What happens after you submit

Filing a complaint does not automatically lead to discipline or establish that the surgeon did anything wrong. In FSMB’s description of the common process, a board assesses jurisdiction, prioritizes and investigates cases, and may then proceed to settlement or a hearing-like adjudication. The sequence and terminology differ by state.

What a board complaint does not do

A medical board complaint is a professional-regulation process focused on physician licensing and public protection. The FSMB materials describe investigation and possible license discipline, not a process for awarding compensation to an individual patient. If you are considering compensation or a malpractice claim, treat that as a separate question that depends on the facts and jurisdiction.
