Start with the Commodity Futures Trading Commission’s Tips & Complaints process. For suspected violations of the Commodity Exchange Act or CFTC rules, submit the online Division of Enforcement Complaint Form or call 866-FON-CFTC (866-366-2382). If you want whistleblower-program treatment, use Form TCR instead; the CFTC says you do not need to file both forms.
A separate Reparations Complaint may let an eligible customer pursue damages against a futures-industry professional who was registered with the CFTC when the alleged misconduct occurred or when the complaint was filed. Most spot-crypto exchange fraud does not automatically qualify for reparations, so choosing the correct route is the most important first step.

Choose the CFTC route that matches your goal
The CFTC has three distinct complaint paths. They are not interchangeable: one supplies information for enforcement, one invokes the whistleblower program, and one is a damages forum with eligibility rules, sworn submissions and filing fees.

The CFTC describes the public as an important source of information for its regulatory and enforcement responsibilities. A complaint can therefore be useful even when the agency cannot obtain a refund for you.

What the CFTC can and cannot do with a crypto complaint
Virtual-currency products can involve different legal categories. Futures, options, swaps and leveraged transactions fall within the CFTC’s commodities and derivatives responsibilities. A cash or “spot” transaction is different: the CFTC’s consumer advisory warns that much of the virtual-currency cash market operates through internet platforms that may be unregulated and unsupervised.
That distinction affects the remedy. A spot-market customer who loses coins to an exchange impersonator, withdrawal freeze or other suspected fraud can still provide valuable information to the CFTC, but the matter may be treated as fraud or suspicious-activity information for referral and investigation rather than as a reparations case. Reparations eligibility depends on the respondent’s CFTC registration and on the futures-industry nature of the dispute.
The CFTC’s virtual-currency advisory also states that there is no such thing as a guaranteed investment or trading strategy. A promised guaranteed return is a warning sign worth documenting, but the CFTC does not automatically reimburse every loss reported to it.
Prepare before opening a form
Identify the exact respondent
Write down the exchange’s legal name, trading name, website address, application name, customer-service addresses and the names or usernames of people who contacted you. Record your account number, user ID, wallet addresses and any ticket numbers. If a person or company used a similar name to impersonate a real exchange, preserve both the impersonator’s details and the legitimate company’s details.
Describe what the platform actually offered. Note whether the transaction involved futures, options, swaps, margin or leverage, or only the purchase and sale of spot cryptocurrency. This classification helps the CFTC determine whether the facts fit its jurisdiction and whether a reparations filing is even available.
Check registration and disciplinary information
Where the dispute involves derivatives or a professional claiming to provide futures-related services, check the CFTC’s registration and disciplinary information for the respondent. Save a dated screenshot or downloaded record showing what you found. Registration status can change, so note the date of the check as well as the status displayed.

Preserve original evidence
Do not rely on a summary written from memory. Download or export the underlying records and keep an untouched copy. Useful material includes:

- Blockchain transaction hashes, deposit and withdrawal addresses, network names and timestamps.
- Bank, card or payment-service records showing deposits, withdrawals, chargebacks or rejected transfers.
- Screenshots and screen recordings of balances, error messages, withdrawal restrictions and security warnings.
- Emails, support tickets, live-chat transcripts, text messages and social-media messages.
- The exchange’s terms of service, risk disclosures, privacy policy and advertisements in force when you traded.
- Identity-verification requests, submitted documents and messages explaining why access or withdrawals were blocked.
Keep metadata where possible. Do not edit screenshots to add labels; place your explanation in a separate note. If a page may disappear, save a PDF and record the page address and the time you captured it.
Build a dated timeline
Create a table or spreadsheet with one row for each material event. Include the date and time zone, the person or system involved, the action taken, the amount and asset, the transaction or ticket identifier, and the resulting balance. Add what you did after discovering the problem and how the exchange responded.
A useful timeline answers five questions in order: what was represented, what you did in reliance on it, what occurred, what you lost or could not access, and what the respondent did after you complained. Separate facts you personally observed from information supplied by another person. If you are unsure of a date or amount, mark it as approximate instead of presenting it as exact.
How to file the ordinary Division of Enforcement complaint
Use this route when your main goal is to give the CFTC information about suspected misconduct and you are not asking for whistleblower-program treatment.

- Select the complaint option for suspected violations and enter the respondent’s legal identity, websites, locations and contact details. Include alternate names and the account identifiers you recorded.
- Describe the conduct in chronological order. Explain which products were involved, how the transaction was presented, what rule or Commodity Exchange Act concern you believe the facts raise, and how the respondent reacted when you sought help.
- State the financial effect with care. Distinguish money deposited, money withdrawn, unrealized losses, realized losses, fees, interest, cryptocurrency quantities and any amount still held or recoverable.
- Attach the supporting documents requested by the form. Use clear filenames and a short index so an investigator can match each attachment to a date or allegation.
- Review every answer for accuracy, submit it, and save a copy of the completed form and any confirmation number.
The ordinary form is an information submission, not a lawsuit. Filing it does not create a private right to a CFTC payment or guarantee that the agency will open an investigation.

When Form TCR is the better choice
Form TCR is the CFTC’s required submission for people who want potential whistleblower-program treatment. The program is designed for information that may assist an enforcement action, rather than for a customer simply asking the agency to calculate and return a trading loss.
What changes when you choose TCR
Use the TCR form when eligibility for a whistleblower award or the program’s applicable anti-retaliation protections matters to you. The CFTC states that eligible awards can reach 30% of money collected. An award is not automatic: the information must satisfy the program’s requirements and contribute to a qualifying enforcement result.
You do not need to submit both a TCR and an ordinary Division of Enforcement Complaint Form. Filing duplicate submissions can make the record harder to follow. Choose the route that reflects your purpose and identify all related communications in that one submission.
Make the information useful to investigators
Point to the evidence that supports each important allegation. Identify people with first-hand knowledge, internal messages, transaction records and other material that an investigator could verify. Explain how the conduct may have affected other customers or involved derivatives, but do not speculate about facts you cannot support.
If you are represented by an attorney, follow the TCR instructions concerning representation and signatures. Keep copies of everything sent and of the date and method of delivery.
When a Reparations Complaint may fit
Reparations is a separate CFTC process for a customer’s damages claim against a futures-industry professional. The respondent must have been registered with the CFTC when the alleged wrongdoing occurred or when the complaint was filed. A dispute involving only an unregistered spot-crypto exchange, a self-custody wallet, or an impersonator generally does not satisfy that requirement merely because cryptocurrency was involved.

Information the reparations filing requires
Explain the transaction, the professional’s role, the legal or contractual duty you believe was breached and the loss caused by the conduct. State the amount claimed and show the calculation. For a trading loss, identify the relevant prices, quantities, dates, fees and offsets rather than submitting only a rounded total.
The form asks whether you have filed another court or arbitration action concerning the same dispute. Answer completely; do not omit a demand, arbitration, settlement or related case. The submission includes a sworn verification, so distinguish what you know personally from what you believe to be true based on information received from someone else.
Understand the three procedures and fees
The current Reparations Complaint Form lists nonrefundable fees of $50 for the voluntary procedure, $125 for the summary procedure and $250 for the formal decisional procedure. Select the procedure that matches the case and the form’s instructions. The fee is separate from the amount of damages you claim and is not a guarantee that you will prevail.
Because reparations is an adjudicatory damages forum, organize exhibits as if another party will challenge every material assertion. Keep the originals, label each exhibit and maintain a calculation that can be updated if a deposit, withdrawal or settlement changes the amount.

A victim of a spot-crypto scam should still report the conduct. The CFTC’s virtual-currency guidance directs suspected victims to 866-366-2382 or CFTC.gov/Complaint. The agency may use the information for enforcement, coordination or referral even when the complaint is not eligible for reparations.

Prompt reporting can help preserve platform logs and identify related victims, although it cannot guarantee recovery.
How to write a credible factual narrative
Lead with a short incident summary
Begin with two or three sentences stating who the respondent was, what product or service was involved, the date range and the immediate harm. Then provide the chronology and evidence references. An investigator should be able to understand the allegation before reading every attachment.
Use neutral, precise language
Describe conduct rather than assigning motives you cannot prove. “The withdrawal request remained pending for 21 days after the stated processing period” is stronger than “the exchange stole my money” when the records establish only the delay. You can state your conclusion about a possible violation, but identify the facts supporting it.
Separate known facts from belief
Mark information obtained from another customer, a social-media post or an unidentified support agent as reported information. Explain why you consider it relevant and attach the original message when available. Do not convert a rumor into a definite allegation.
Errors that can weaken a complaint
- Choosing reparations solely because you lost money: eligibility depends on the respondent’s CFTC registration and the futures-industry nature of the claim.
- Filing both ordinary and TCR forms without a reason: the CFTC says a TCR submission is sufficient when you seek whistleblower treatment.
- Sending only screenshots: include transaction identifiers, statements and a timeline that can be independently checked.
- Mixing assets and currencies: state whether each figure is in cryptocurrency, U.S. dollars or another currency, and identify the valuation date used.
- Ignoring offsetting recoveries: disclose withdrawals, refunds, chargebacks, insurance payments or settlements that reduce the claimed loss.
- Overstating certainty: knowingly false or fraudulent statements on the Complaint Form can lead to criminal penalties under 18 U.S.C. §1001.
- Forgetting the sworn nature of reparations: the Reparations Complaint requires verification and asks you to distinguish known facts from information you believe to be true.
- Losing the submission record: save the final text, attachments, confirmation and dates of any follow-up contact.
What to do after submitting
Keep monitoring the email address or phone number supplied in the filing and preserve any new communication from the respondent. If the exchange later restores access, pays part of the balance or provides a new explanation, update your records and disclose the change in any permitted follow-up.
Do not destroy original evidence after sending copies. Maintain a separate folder for the CFTC submission, exchange correspondence, law-enforcement reports and any court or arbitration documents. If another forum asks whether you have filed elsewhere, answer consistently and provide the relevant case or confirmation details.
A CFTC submission is one part of a response to a crypto-exchange dispute. It can put facts before the agency and support broader enforcement, but it is not a guaranteed recovery mechanism. The best filing is the one that uses the correct route, identifies the respondent precisely, ties each material statement to evidence and states the financial effect without exaggeration.
