Evaluate the exact service, tier, workload and support model against the eight sovereignty objectives in the European Commission’s Cloud Sovereignty Framework, version 1.2.1 (October 2025), then set a minimum assurance level for each objective and retain current evidence for every conclusion.
What digital sovereignty means in a cloud contract
Digital sovereignty is the ability to keep making lawful, informed and independent decisions about digital services and data, even when a provider, parent company, subcontractor, upstream technology supplier or foreign authority is involved. In cloud procurement, that means examining who controls the service and whether your organisation can continue operating, protect information, audit access and move elsewhere if circumstances change.

Physical residency is one input, not a verdict. A workload can be stored in an EU region while its provider is controlled elsewhere, administrators are outside the EU, support depends on a non-EU subcontractor, encryption keys are accessible to another party, or a foreign law can reach the contracting group. Conversely, an EU-established provider still needs to prove its operational, technical and supply-chain arrangements for the particular service you intend to buy.
The European Commission’s Cloud Sovereignty Framework, version 1.2.1 dated October 2025, organises the assessment into eight objectives. It is a procurement framework: the buyer assesses tender answers, supporting material and public service documentation. Its assurance levels and scores are meaningful only for the stated service scope and evidence; they are not a universal certification.

Start with the exact decision and workload
Write down what you are actually deciding before asking a provider for a sovereignty statement. A company-wide claim is too broad to evaluate. Define the service and the consequences of losing it.
- Service boundary: record the product, edition, tier, regions, availability zones, optional features, support plan and management interfaces.
- Workload: describe the application, data classes, users, integrations, recovery objectives and any sector or public-sector obligations.
- Information flows: separate customer content from metadata, backups, logs, telemetry, monitoring data, support tickets, management-plane records and AI prompts or outputs.
- Business impact: state what happens if the provider cannot authenticate users, restore systems, deliver updates, answer support requests or export data.
- Decision authority: name the accountable security, legal, procurement, architecture and business owners who will accept residual risk.
Require the provider to answer for that scope. If a document covers an entire portfolio but your service uses a different region, support path or AI feature, mark the mismatch and request service-specific confirmation.
The eight sovereignty objectives to evaluate
Use the following objectives as separate workstreams. A serious weakness in one cannot be hidden by strong performance in another.
Recommended Free Tools
| Objective | Questions the buyer must answer | Useful evidence |
|---|---|---|
| Strategic sovereignty | Who owns and governs the provider? Is ownership stable? Can EU-based decision-makers sustain the service if support is withdrawn, ownership changes or an upstream partner is disrupted? | Ownership and control disclosures, governance arrangements, continuity plans, financial and operational resilience information, and contractual commitments on service support. |
| Legal and jurisdictional sovereignty | Which entity contracts with you, where is it established, which law governs the agreement, and can foreign laws with cross-border reach affect the provider, systems or data? | Contracting-entity and parent-structure information, governing-law clauses, legal-request procedures, transparency reporting, challenge and notification commitments, and technical measures limiting compelled access. |
| Data and AI sovereignty | Where are data, backups and derived data processed? Who controls cryptographic keys and privileged access? Can access be audited and deletion verified? How are AI inputs, outputs, models and pipelines governed? | Architecture and data-flow diagrams, key-management design, access logs, support-access controls, retention and deletion procedures, backup treatment, AI-use terms and model or pipeline documentation. |
| Operational sovereignty | Who can administer, patch, restore and support the service, from where and under what authority? Can local staff maintain operations without non-EU vendor involvement? | Operator locations and roles, staffing and skills plans, support escalation paths, incident and recovery procedures, service-continuity tests, documentation and migration assistance. |
| Supply-chain sovereignty | Which countries and companies control hardware, firmware, software, updates, subprocessors and critical upstream services? What fails if one becomes unavailable? | Service-specific dependency maps, supplier and subprocessor registers, provenance information, update and signing processes, substitution plans, audit rights and concentration-risk analysis. |
| Technology sovereignty | Are interfaces documented and based on open standards? Can you inspect architecture and data flows, integrate alternatives and leave without prohibitive conversion work? | API and format specifications, standards conformance, architecture diagrams, export tools, portability tests, source or design visibility where available, and lock-in or exit-cost estimates. |
| Security and compliance sovereignty | Where are security operations and incident response controlled? Which certifications and compliance arrangements apply to this service and region? Can the provider remain secure during disruption? | Applicable audit reports and certificates, security-operations locations, response playbooks, privileged-access records, resilience testing, vulnerability-management evidence and contractually defined notification duties. |
| Environmental sustainability | Can the service remain resilient as energy availability, infrastructure dependencies and raw-material constraints change? | Energy and infrastructure dependency information, resilience planning, resource-efficiency data, continuity assumptions and long-term capacity strategy. |
Build an evidence request instead of accepting a label
Send a structured request that makes every answer auditable. For each objective, specify the requirement, minimum acceptable assurance, service boundary, proof required, evidence date and accountable reviewer. Ask for both contractual language and technical or organisational material; a marketing page cannot substitute for an enforceable term or an architecture record.
Request current service documentation
- Architecture and data-flow diagrams covering primary storage, processing, backup, failover, recovery, monitoring and support.
- Locations and legal entities for data processing, operations, security monitoring, support and subcontracting.
- Subprocessor, supplier and upstream-service inventories, including the function each dependency performs.
- Key-management and encryption descriptions showing who can create, rotate, use, escrow, recover or override keys.
- Retention, deletion and backup-expiry procedures, including treatment of replicas, caches, logs and derived data.
- Audit reports, certifications and compliance statements that identify the exact service, edition, region and assessment period.
- Continuity, disaster-recovery and exit plans with recovery objectives, export formats, assistance obligations and charges.
Capture provenance and assumptions
Record the document title, version, publication date, provider contact, covered service and any assumptions. Distinguish a binding contract from a policy, a design intention, a customer-configurable option and a provider-controlled default. If an answer depends on a feature being enabled, include that configuration in the procurement and operating procedures.

Check legal control separately from physical location
Ask first which entity is your counterparty and where decisive service and operational decisions are made. Map the parent and control structure, governing law, locations of administrators and support teams, and the entities able to direct or suspend the service.
Then examine foreign-law exposure. A provider should explain whether laws outside your jurisdiction can reach the provider, its affiliates, personnel, equipment or subcontractors; what legal, contractual or technical channel could be used to compel access; and how the provider challenges, narrows, records and reports requests. Ask when you would be notified, subject to lawful limits, and whether the service can technically prevent an unauthorised party from obtaining readable data.

Your organisation’s location, sector, data categories, threat model and contract wording determine the applicable analysis. Selecting an EU region does not by itself remove foreign-law exposure.
Trace data, keys, access and deletion end to end
Map every copy and processing path
Draw the journey of each data class from ingestion to deletion. Include replicas, snapshots, backup vaults, disaster-recovery sites, caches, logs, telemetry, support tooling and security monitoring. Identify whether failover can move data to another country or a third-country service. Require strict regional confinement if your policy demands it, and verify that the provider has no automatic fallback outside the approved boundary.
Prove effective cryptographic control
Document who generates and stores keys, who can use them, who can recover them and who can override customer settings. Check whether privileged provider personnel can decrypt content, under which approval process and with what logging. Confirm that access records are available to your reviewers and retained for the period your policy requires. Customer-controlled keys are useful only when the customer can actually deny use, detect attempts and recover safely.

Make deletion verifiable
Define what “deleted” means for primary data, replicas, backups, logs, caches and derived datasets. Ask how deletion is initiated, how long residual copies persist, how legal holds are handled and what evidence you receive when removal is complete. For high-sensitivity workloads, require a verifiable and irreversible-removal procedure rather than a general statement that data is removed according to policy.

Include AI features explicitly
For managed AI, record model hosting locations, prompt and output handling, retention, human or provider access, training or reuse conditions, logging, fine-tuning data, retrieval pipelines and downstream subprocessors. Establish whether your organisation controls the data pipeline and can remove prompts, outputs, embeddings and derived artefacts. Treat an AI feature as a separate service boundary if its processing or terms differ from the underlying cloud region.
Test operational resilience and the ability to exit
Identify who can keep the service running
List the people and entities able to administer, patch, restore, monitor and support the environment. Record their locations, employment or subcontracting relationship, authority and access path. Ask whether EU-based operators have the skills, documentation and tooling to sustain operations if a non-EU vendor is unavailable, legally restricted or unwilling to provide support.
Model disruptive scenarios
Run tabletop exercises for provider insolvency, ownership change, compelled suspension, loss of an upstream software supplier, regional outage, revoked support access and a decision to terminate the contract. For each scenario, record the first operational impact, the independent action your team can take, the dependency that blocks it and the time to restore an acceptable service.
Perform a real portability test
Export a representative copy of the workload, including databases, object data, identities, configuration, encryption metadata and application dependencies. Recreate it in an alternative environment and measure data fidelity, downtime, performance, reconfiguration effort, specialist skills, egress charges and recovery time. An export button is not portability if the format is proprietary, undocumented or unusable without the provider’s control plane.

Inspect the supply chain and technology stack
Request a dependency map that goes beyond your contracting provider. It should identify critical hardware, manufacturing and firmware, software components and update channels, data-centre operators, network carriers, subprocessors, identity services, observability systems and AI providers. For each dependency, ask who controls it, which jurisdiction applies, what happens if it is withdrawn, and whether you have audit, notification, substitution or continuity rights.
Review the technical escape route at the same time. Check whether APIs, identity protocols, storage formats, orchestration interfaces and security logs use documented standards. Ask for architecture and data-flow visibility sufficient to audit the service and design a replacement. Record features that cannot be replicated elsewhere, mandatory proprietary agents, minimum commitments and conversion work. A locally operated region can still be dependent on externally controlled firmware, software updates or specialist support.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Set assurance levels by objective and workload
Version 1.2.1 of the Commission framework defines five levels called SEAL-0 through SEAL-4. Use them as a common vocabulary in a tender, not as a substitute for examining evidence.
| Level | Framework meaning | How to use it |
|---|---|---|
| SEAL-0 | No sovereignty | Indicates that the objective has no demonstrated sovereignty assurance. |
| SEAL-1 | Jurisdictional sovereignty | Addresses control of the applicable legal and jurisdictional environment. |
| SEAL-2 | Data sovereignty | Adds control over data location, access and related data protections. |
| SEAL-3 | Digital resilience | Adds resilience and the ability to sustain digital operations under disruption. |
| SEAL-4 | Full digital sovereignty | Represents the framework’s highest level across the relevant sovereignty concerns. |
Set a minimum SEAL level separately for each objective that matters to the workload. A regulated archive may demand stronger data and jurisdictional assurance than a low-impact development environment; a critical public service may also require high operational, technology and supply-chain assurance. Document why any lower level is acceptable and which compensating controls apply.

Minimum levels are pass/fail procurement requirements for the objectives you specify; the score helps rank features among candidates. Do not average a critical failure away because a provider performs well on less consequential dimensions. The framework’s procurement guidance says that consistently missing required minima can disqualify a bid.
Best Value
Use a repeatable scoring and review record
Create one assessment record per service and workload. The following fields keep decisions comparable:
- Requirement: state the policy, legal obligation or business consequence.
- Objective: assign it to one of the eight framework objectives.
- Minimum assurance: record the required SEAL level or an organisation-defined control threshold.
- Evidence: attach the contract clause, diagram, audit report, test result or provider response.
- Scope: identify region, tier, support plan, feature, subprocessors and data classes covered.
- Evidence quality: mark whether it is binding, independently assessed, provider attested, customer-configurable or merely descriptive.
- Dependency: name the upstream party or technical condition that could invalidate the answer.
- Residual risk: describe the gap, consequence, owner, mitigation and acceptance date.
- Review date: set the next reassessment and the events that trigger an earlier review.
Compare candidates on the same axes: jurisdiction and enforceability; data, key and access control; independent operations and continuity; supplier concentration and substitution; openness and exit; and service-specific security and compliance. Weight them according to the workload’s sensitivity and disruption impact, while retaining hard-stop requirements for non-negotiable risks.
Reassess when the service changes
Sovereignty evidence expires when the service changes. Reopen the assessment after an ownership or control change, a new subprocessor, a new operating location, a revised legal term, an architectural redesign, a new AI capability, a support-model change or a material incident. Also review changes to your own workload, data classification, jurisdiction or recovery objectives.
Keep the framework version and every evidence date in the record. The Commission has said it would publish an updated version based on procurement lessons, so verify the operative framework before using version 1.2.1 as a tender baseline.
What the Commission’s 2026 procurement example shows
On 17 April 2026, the European Commission announced four contracts for Union entities to procure sovereign cloud services for up to EUR 180 million over six years. The tender used the eight objectives and SEAL levels, with SEAL-2 as its eligibility threshold. The Commission reported that three selected provider groups reached SEAL-3 and a group led by Proximus reached SEAL-2.
The four groups reported were a Post Telecom-led partnership with OVHcloud and CleverCloud; STACKIT; Scaleway; and a Proximus-led partnership using services from S3NS, Clarence and Mistral. The Commission described the procurement as seeking diversification and resilience. Those results belong to that procurement’s scope, terms and assessment date. They are not a general ranking, a market-wide statistic or proof that any named service meets another organisation’s requirements. Verify current contracts and service documentation before treating any lineup as an available option.
Common mistakes that invalidate a sovereignty assessment
- Equating an EU region with sovereignty: location does not reveal ownership, governing law, administrator access or upstream dependencies.
- Assessing the provider instead of the service: another tier, region, support plan or AI feature may use different operators and subprocessors.
- Accepting policy language without enforceability: a public statement may not bind the contracting entity or survive a service change.
- Ignoring metadata and backups: logs, telemetry, snapshots and recovery copies can contain sensitive information and follow different paths.
- Assuming customer-managed keys solve every issue: key control does not answer operational continuity, legal exposure, supply-chain or portability questions.
- Skipping an exit test: theoretical export capability can conceal proprietary formats, hidden dependencies and unmanageable conversion time.
- Scoring away a critical failure: a strong certification or low price cannot compensate for a disqualifying jurisdictional or continuity gap.
- Letting evidence go stale: ownership, subcontractors, architectures and legal terms change; an old answer is not current assurance.
A decision rule for procurement approval
Approve a service only when the documented evidence meets every mandatory objective for the defined workload, unresolved dependencies have named owners and mitigations, legal conclusions have been reviewed for the relevant jurisdiction, and an exit or continuity test meets the organisation’s recovery objectives. If a provider cannot identify who controls a decision, where a data flow goes, which law can reach it, or how operations continue after a dependency fails, classify that point as an unresolved sovereignty risk rather than assuming the most favourable answer.
