Do not treat “we sponsor” as part of a job offer until the employer identifies the immigration category, filing steps, start conditions, and role details in writing. Evaluate the job itself separately from the credibility of the sponsorship plan, then have qualified immigration counsel assess how the plan fits your status and filing history.
Start by naming the immigration outcome
“Sponsorship” can mean temporary work authorization, an employer-sponsored permanent-residence process, or both. Those outcomes use different government filings, timelines, eligibility rules, and employer obligations. A recruiter’s general statement is therefore incomplete until it answers: sponsorship for what category, for which role, and at what stage?
| Possible outcome | What the employer may need to do | What you should verify |
|---|---|---|
| Temporary work authorization | Identify a qualifying nonimmigrant category and complete the category-specific employer filings. For H-1B work, the Labor Condition Application and petition process are central parts of the case. | The exact category, worksite, duties, compensation, filing date, and conditions that must be met before you can start or continue working. |
| Employer-sponsored permanent residence | For applicable routes, support a permanent job offer and the required labor-certification and immigrant-petition steps. A PERM-based route generally starts with a prevailing-wage determination, followed by recruitment and notice steps where applicable, then PERM filing and later immigrant-petition and residence steps. | Whether the employer means PERM and an employment-based immigrant petition, which stage it will support, when it will start, and what approvals or tenure requirements apply. |
| A category that permits self-petitioning | The employer may not be the petitioner for every employment-based category or exception. | Whether your proposed route actually requires this employer’s sponsorship or has a different filing structure. Do not assume an employer promise is necessary—or sufficient—without a category analysis. |
USAGov’s employment-based immigrant-visa overview, updated March 17, 2026, describes five permanent-worker preference categories and notes that requirements differ. Some require an employer job offer and labor certification; particular categories or exceptions can permit self-petitioning. Your category, country of chargeability, current status, and filing history can change the practical answer.

An assurance is not the same as a filed case
An offer letter, interview statement, or recruiting message does not by itself prove that an immigration petition has been prepared or filed. Ask the employer to separate its current status from its future intention.
Use an evidence ladder
- General statement: “We sponsor visas” or “We can sponsor later.” This is a policy signal, not a commitment for your role.
- Role-specific explanation: The employer names the proposed category, worksite, duties, compensation, and the business unit responsible for the process.
- Written plan: The employer states the intended filing sequence, earliest start point, prerequisites, internal approvals, and who will provide documents and pay costs.
- Counsel discussion: Company immigration counsel explains the proposed path and its limits, and can communicate with your own counsel if you authorize that exchange.
- Government filing evidence: The employer confirms that the relevant filing has actually been submitted and provides the appropriate filing confirmation or case information. A planned filing and a submitted filing are different risk levels.
Past sponsorship is useful context, but it is not a guarantee. A company may have sponsored workers in one business unit, location, job family, or hiring cycle and decline to do so for another. Ask specifically about the role you are being offered.
Questions to send the employer before accepting
Request written answers. Written responses make it easier to compare offers and reveal whether the person making the promise knows the process.

Category and objective
- Which immigration category would the company support for this specific role?
- Is the commitment for temporary work authorization, permanent residence, or both?
- Is the proposed route employer-petitioned, or does it depend on a category in which the worker may self-petition?
- Has the company used this route for this role, business unit, and work location?
Timing and conditions
- What is the earliest filing or sponsorship start point?
- Is the start contingent on a minimum tenure, performance review, manager approval, budget approval, headcount, or a future business review?
- What must happen before the company will engage counsel or authorize a filing?
- What happens if the start date, worksite, manager, job duties, or business need changes before filing?
Employer steps and employee responsibilities
- Which government filings and employer attestations will the company undertake?
- Which documents will you need to provide, and by what deadlines?
- Which costs will the company cover, and which costs does it expect you to handle?
- Will company counsel explain the proposed path directly to you and, if needed, to your own attorney?
Do not assume a verbal statement settles the legal allocation of fees or case costs. Ask for the employer’s written policy and have counsel review it alongside the proposed category.

- What job title, duties, occupational classification, worksite, and compensation will appear in the immigration filings?
- Will the role be remote, hybrid, or assigned to a particular office, and can that arrangement change?
- How will travel, client sites, or a move to another office be handled?
- What happens to the immigration plan if the employer changes the position or compensation?
These are not merely human-resources details. The Department of Labor explains that prevailing wage depends on the occupation and intended employment area. For H-1B, H-1B1, and E-3 programs, the employer must pay the higher of the prevailing wage or the actual wage paid to similarly skilled and qualified workers.
Compare the offer on two separate tracks
First decide whether the ordinary job is attractive without counting an uncertain immigration benefit. Compare salary, benefits, role scope, manager, stability, location, schedule, and start date. Then evaluate sponsorship credibility independently.
| Track | Questions to record | Why it matters |
|---|---|---|
| Ordinary job terms | Salary and variable pay; benefits; responsibilities; manager; team stability; location and schedule; probation or termination terms; growth opportunities. | You may remain in the job if sponsorship is delayed, denied, or no longer available. |
| Immigration category | Named category; temporary authorization, permanent residence, or both; employer-petitioned or self-petitioned structure. | Different categories have different eligibility rules and employer commitments. |
| Written commitment | Specific language in the offer, an immigration policy, or a separate written plan. | “We sponsor” is less useful than a role-specific statement with conditions and dates. |
| Filing start conditions | Earliest start point; tenure, performance, budget, manager, or business-review dependencies. | A promise that can be postponed indefinitely should not be valued like a scheduled filing. |
| Demonstrated process | Relevant prior cases, named internal owner, outside counsel, document workflow, and explanation of the filing sequence. | Evidence of a repeatable process is stronger than a recruiter’s unsupported assurance. |
| Role and worksite match | Title, duties, occupational classification, compensation, office or remote location, and expected changes. | Those facts can affect wage calculations and whether the proposed filing fits the actual job. |
| Contingency plan | Plan if the case is delayed, denied, the role changes, the worksite moves, or employment ends. | It exposes the financial and status risk you would carry. |
You can make a personal worksheet by marking each dimension as clear, conditional, or unanswered. That is a decision aid, not an evidence-based score. Do not let a high salary compensate automatically for an immigration plan that has no category, date, or responsible owner.

Understand the permanent-residence process the employer is describing
PERM-based sponsorship
The Department of Labor says an employer generally needs a prevailing-wage determination before filing PERM. The process involves identifying a permanent, full-time job, obtaining the wage determination, completing recruitment and notice steps where applicable, and submitting the application. The employer should tell you which of these steps has occurred and which it is prepared to undertake.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAsk whether the company is promising to begin the process, to complete a particular filing, or to continue through later stages. Those are materially different commitments. A statement such as “we will sponsor your green card” may still leave unanswered whether the company means a future PERM start, an already filed labor-certification case, an immigrant petition after an approved labor certification, or support for adjustment of status or an immigrant-visa application.
Employer petition and visa availability
After the applicable labor-certification stage, an employer-sponsored route may require an employment-based immigrant petition and then a residence process. The State Department describes five employment-based immigrant-visa preference categories and approximately 140,000 employment-based immigrant visas available annually under U.S. law. Numerical limits and visa-bulletin movement mean that employer approval does not itself create an immediately available immigrant visa.
The State Department also explains that individual case duration varies and cannot be predicted accurately. An employer can control its own filing decisions and document production, but it cannot control every government queue, numerical limit, or visa-availability change. Ask what the company will do while waiting and what happens if the category is backlogged.
Why wage and location details can change the assessment
The proposed job must be described accurately. A title alone is not enough. The occupational classification, actual duties, required experience, worksite, and compensation should match the work you will perform.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
- Occupation: The Department of Labor bases prevailing wage on the occupation, so a change in duties can affect the analysis.
- Area of employment: The intended employment area matters. A move to another metropolitan area or a new client site can require a fresh review.
- Actual versus prevailing wage: For H-1B, H-1B1, and E-3 programs, the required wage is the higher of the prevailing wage or the actual wage paid to similarly skilled and qualified workers.
- Remote arrangements: Clarify the official worksite and how the employer will handle a move, recurring travel, or a new assigned location.
Ask the company to confirm which title, duties, location, and compensation it will use in the immigration process. If those details are still being negotiated, treat the sponsorship assessment as provisional.
What changing jobs can mean in common scenarios
Job-change rules are conditional. The answer depends on your category, the filings already made, the stage of the case, and the new job’s duties and location. Do not apply an H-1B rule to another status or treat a green-card portability rule as universal.
H-1B transfer or portability while a petition is pending
The Department of Labor’s H-1B portability fact sheet, revised in November 2016, says eligible H-1B workers may begin employment with a new employer after that employer files a nonfrivolous petition and submits an unexpired, approved Labor Condition Application covering the work, subject to the fact sheet’s other conditions.
That fact sheet is an older summary, not a complete statement of current law for every case. Before changing jobs, check current U.S. Citizenship and Immigration Services guidance and have counsel review your status history, the new petition, the filing timing, the LCA, and any gaps or changes in employment. A recruiter’s statement that “you can start as soon as we file” is not a substitute for that case-specific review.

Changing employers during an employment-based adjustment case
USCIS explains that certain employment-based adjustment applicants with an approved employment-based petition may change employers when the adjustment application has been pending for at least 180 days and the new job is in the same or a similar occupational classification, subject to the provision’s limitations.
This is not a general rule that a green card “transfers with you.” The approved petition, adjustment filing, 180-day period, new job, and other requirements all matter. If your case has not reached that stage, or the new role is materially different, obtain an individual assessment before resigning.
Changing jobs during an employer’s PERM plan
A PERM-based plan is built around a particular employer, permanent full-time position, duties, wage, and area of employment. A move to a different employer or a substantial change in the role can disrupt the plan and may require a new process. The practical consequence depends on what has already been filed and whether another immigration category is available.
Ask the current and prospective employers to identify the exact filing stage rather than describing the case as simply “started.” Have counsel review the documents before assuming that work already performed for one employer can be reused by another.
Best Value
Warning signs that sponsorship is too uncertain to value fully
- The employer will not name a category or says only that it “handles visas.”
- The promise appears only in a conversation and is absent from the offer or written policy.
- No one can state the earliest filing point or the conditions that could delay it.
- The company has no clear owner for immigration decisions or refuses to let counsel explain the plan.
- The proposed job title, duties, worksite, or compensation are still changing.
- The employer claims that approval or timing is guaranteed despite government quotas, visa availability, or case-specific eligibility.
- The employer treats a prior sponsorship for another worker as proof that your case will be filed.
- The plan depends on an unspecified future review, budget, or manager decision with no deadline.
- The company asks you to rely on a verbal fee arrangement instead of providing its policy.
Indicators of a more credible plan
- The employer names the proposed category and explains why it fits the role.
- The written offer or sponsorship policy states whether support is for temporary authorization, permanent residence, or both.
- A responsible human-resources or legal contact can describe the filing sequence and prerequisites.
- The company has a repeatable process for comparable roles and locations, while acknowledging that prior cases are not guarantees.
- The role, worksite, duties, and compensation are defined and consistent across the offer and immigration discussion.
- The employer explains what it controls, what depends on government processing or visa availability, and what happens if the plan changes.
- The company will coordinate with your counsel rather than insisting that you accept an unexplained promise.
A practical decision worksheet
- Write the immigration objective: temporary authorization, permanent residence, or both.
- Record the proposed category: use the employer’s exact wording and note anything it has not identified.
- Map the filing stage: intention, internal approval, preparation, submitted filing, or an already approved step.
- List dependencies: tenure, performance, budget, manager approval, headcount, role stability, and document deadlines.
- Freeze the job facts: title, duties, compensation, office or remote location, travel, and expected changes.
- Assess disruption risk: delay, denial, termination, transfer to another office, new manager, or change in duties.
- Value the job without sponsorship: decide whether the ordinary compensation and role still work for you.
- Get case-specific advice: provide your current status, expiration dates, prior petitions, adjustment filings, proposed duties, and worksite to qualified immigration counsel.

Subject: Clarifying immigration sponsorship for the role
Hello,
Thank you for the offer. Before I make a decision, please confirm in writing:
1. The immigration category the company would support for this role.
2. Whether the support is for temporary work authorization, permanent residence, or both.
3. The earliest filing or sponsorship start point and every condition that could delay it.
4. The employer filings and steps the company would undertake.
5. The documents and costs expected from me, together with the company’s written policy on fees.
6. The title, duties, compensation, worksite, and remote or travel expectations that would be used in the immigration process.
7. What happens if the role, manager, worksite, or business need changes.
8. The appropriate immigration-counsel contact for a detailed discussion.
Best,
Candidate
When to obtain individual legal advice
General offer evaluation cannot determine whether you qualify for a particular category or whether changing jobs is safe. Seek qualified immigration counsel before relying on a sponsorship promise when you have an approaching status expiration, a pending or approved petition, an adjustment application, a prior status violation, a planned job change, a move between worksites, or a role whose duties are still evolving.
Bring the offer letter, written sponsorship statements, current immigration documents, expiration dates, prior approval and receipt notices, adjustment-filing information, job descriptions, compensation details, and proposed worksite. Tell counsel what has actually been filed—not merely what the employer intends to file.
Bottom line
Count sponsorship as a meaningful part of an offer only when the employer has identified the category, documented the filing plan, stated its conditions, and matched the plan to a defined job and worksite. Treat timing, visa availability, and portability as conditional. Accept the job because the underlying role works for you, with the immigration benefit valued according to the evidence available today rather than a promise that may never become a filing.
