How to Evaluate Staking Providers for a Trust: Custody, Fees, Slashing, and Reporting

Evaluate a staking provider by documenting who controls the keys and withdrawal credentials, who can stake or exit, how every fee and reward is allocated, who bears slashing losses, how quickly assets can become liquid, and what records the trustee receives. Review those terms alongside the trust instrument and custody agreement; a provider’s “institutional” or “non-custodial” label is not a substitute for examining actual controls and contract language.

Compare providers against the same decision criteria

Use a common set of questions for each provider, custodian, sponsor, or other party involved. The answers should be specific enough to compare contract terms and operational controls—not just marketing descriptions.

Area Evidence to request Decision test
Custody and authority Party-and-control diagram; key and withdrawal-credential details; transaction and exit permissions Can the trustee identify who can move, stake, or recover the assets?
Fees and reward allocation Complete fee schedule; sample reward statement; rules for changes and expenses Can total compensation be reconciled to rewards actually received?
Slashing and service failure Validator controls; incident process; indemnity or insurance terms and obligor details Are preventable operational failures addressed, and is any promised recovery enforceable and adequately scoped?
Liquidity and exit Network-specific activation, exit, and withdrawal process; responsible party; reserve policy Can the trust meet foreseeable expenses and distributions without assuming immediate access?
Records and reporting Reporting schedule; asset, reward, deduction, penalty, and distribution records; reconciliation responsibilities Can the trustee, administrator, and tax preparer trace activity consistently?

Who controls the assets, keys, and exit?

Separate safeguarding from validation. A custodian may safeguard assets while a staking operator runs validators, but a single company may perform both roles. Identify each party’s duties, any sponsor or interface involved, and every subcontractor. Obtain a diagram showing where assets and rewards are held or delivered and which party can authorize each transaction.

Map the keys and permissions

  • Who holds the signing keys, and who can use them?
  • Who controls withdrawal credentials, and can the trustee or custodian change or recover them without the operator?
  • Who can initiate staking, partial withdrawals, or a full exit?
  • Where do withdrawn assets and rewards go, and who can alter that destination?

On Ethereum, provider arrangements differ in which keys they hold. If withdrawal credentials point to an owner-controlled address, the owner may be able to exit independently; if the provider controls those credentials, recovery may depend on its processes rather than an independent protocol-level route. That explanation is specific to Ethereum and should not be applied unchanged to other proof-of-stake networks. See Ethereum.org’s guide to staking as a service.

For any network, translate the diagram into contract terms: permissions, approvals, recovery steps, and what happens if a provider becomes unavailable. Do not infer control from a product name or a claim that staking is “non-custodial.”

How are fees and rewards allocated?

Request a complete schedule rather than a headline commission. It should identify the provider’s share of rewards, custodian and sponsor charges, fixed fees, transaction costs, expenses, and any spread or other compensation. Ethereum staking services, for example, may charge a flat monthly fee or a percentage of rewards, according to Ethereum.org.

Make the economics comparable

  • Establish whether each charge is calculated on gross rewards or net rewards, when it is applied, and how it appears on statements.
  • Ask who pays operating expenses and whether fees or allocation terms can change unilaterally.
  • Reconcile a sample statement from gross rewards through each deduction to the amount credited to the trust.
  • Compare providers using the same assumptions and period; do not treat an unverified “typical fee” or projected yield as a market benchmark.

For trusts that meet the conditions of the IRS safe harbor discussed below, reward allocation between provider and custodian must be arm’s length and independent of their expenses; the provider bears its own expenses, and related terms must also be arm’s length. Those are conditions of that particular safe harbor, not a universal rule for all staking contracts.

Who bears slashing and service-failure losses?

Slashing can reduce staked assets when validator behavior violates consensus requirements; Ethereum.org also explains that a slashed Ethereum validator is forcibly exited. Ask which protocol events can trigger penalties, how the operator prevents signing conflicts and missed duties, what monitoring and escalation it uses, and how the agreement allocates losses. A reported clean record does not establish that future losses are impossible.

Read recovery promises as contract terms

If a provider offers indemnity or insurance, establish exactly what causes are covered and excluded, the cap and deductible, notice deadlines, claims process, and whether recovery covers principal, rewards, or both. Identify the party obligated to pay and assess its ability to meet that obligation. An insurance label or reimbursement promise transfers risk only to the extent its terms and obligor support recovery.

The SEC Division of Corporation Finance’s May 29, 2025 staff statement includes slashing coverage or reimbursement among ancillary staking services. The statement is the staff’s view, not a Commission rule, regulation, or binding guidance; read its status on the SEC statement page.

How much liquidity can the trust rely on?

Staked assets may not be available when the trust needs to pay expenses, make distributions, or meet other obligations. For the relevant network, document activation and exit queues, any unbonding period, who can request withdrawal, the destination address, expected timing, and the contingency if the provider is unavailable. Set a reserve based on the trust’s own cash needs and governing requirements rather than assuming every staked asset is immediately accessible.

Ethereum exit and withdrawal depend on protocol processes: a full exit unlocks the remaining balance, and transfer follows a subsequent sweep. Queues and conditions can vary, so do not rely on a universal exit-time estimate. See Ethereum.org’s description of Ethereum staking withdrawals.

What records should the trustee receive?

Specify a regular reporting package that reconciles assets staked, rewards actually received, provider and custodian deductions, penalties, exits, distributions, and valuation data. Name who prepares the records, who reviews and reconciles them, and when they reach the trustee, administrator, and tax preparer. Preserve source records so the trust can trace reported amounts back to activity and apply its reward and distribution policy consistently.

IRS broker-reporting rules do not settle every trust’s tax question. The IRS says Form 1099-DA reporting applies to certain broker-reported digital-asset dispositions from transactions on or after January 1, 2025. Its guidance identifies staking transactions among temporary reporting exceptions pending further guidance, but says the exception does not apply to staking rewards or other participant compensation. That describes broker-reporting scope; it does not determine a particular trust’s income inclusion, character, timing, or information-return obligations. See the IRS guidance on digital-asset broker reporting and have a qualified tax adviser assess the trust’s facts.

Does the IRS trust safe harbor apply?

Revenue Procedure 2025-31, published in Internal Revenue Bulletin 2025-48 on November 24, 2025, is conditional—not blanket approval for staking by every trust. Among its conditions, an in-scope trust must be exchange traded; hold cash and one qualifying proof-of-stake asset; use a custodian-controlled address with exclusive custodian access to the associated private keys; conduct due diligence on unrelated providers; maintain liquidity procedures; protect assets against slashing due to provider activities; and handle and distribute rewards as specified. The trust must also retain federal tax ownership. Review the procedure itself and the trust’s actual agreements and operations with qualified advisers before relying on it.

The IRS states: “Provided all the requirements in section 6.02 of this revenue procedure are satisfied, a trust’s authorization, pursuant to its trust agreement, to stake its digital assets and the resulting staking of the trust’s digital assets do not prevent the trust from qualifying for Federal income tax purposes as a trust classified as an investment trust under § 301.7701-4(c) and as a grantor trust.” Read Revenue Procedure 2025-31 in Internal Revenue Bulletin 2025-48; do not treat the quoted conditional statement as a conclusion about a trust that has not been assessed against all requirements.

Turn diligence into a documented decision

  1. Collect the governing documents. Review the trust instrument, custody agreement, staking agreement, liquidity policy, and relevant fee and reporting schedules together.
  2. Identify every party and control. Record the custodian, sponsor, operator, key holder, withdrawal authority, subcontractors, and responsibility for each action.
  3. Reconcile economics and risk transfer. Tie fee terms to reward statements and examine validator controls, incident procedures, documented slashing history where reliable, and the exact scope and creditworthiness of any indemnity or insurance.
  4. Trace an exit and reporting cycle. Map how assets would leave staking and reach the trust, compare timing with expenses and distributions, and confirm the cadence and reconciliation of reward, penalty, and distribution records.
  5. Obtain trust-specific review. Ask qualified advisers to assess the trust instrument, state-law duties, federal tax classification, applicable securities or exchange requirements, and the selected network’s mechanics.
