After a job loss in India, do not treat the company’s “layoff” label or a single settlement figure as proof of what you are owed. Check each amount separately: contractual or package severance, any applicable statutory retrenchment compensation and notice, earned wages and leave, gratuity, tax treatment, and your EPF account options. The result depends on your legal classification, service history, employer and establishment, state rules, contract, and the actual form of separation.
What am I entitled to after a layoff in India?
There is no single severance formula that applies to every employee. First identify the legal and contractual basis for each payment; then compare the employer’s written offer with the rules that apply to your circumstances. A package may combine amounts with different rules, and the word “layoff” in an announcement does not by itself establish that statutory retrenchment provisions apply.

India’s Ministry of Labour & Employment announced that the Code on Wages, Industrial Relations Code, Code on Social Security, and Occupational Safety, Health and Working Conditions Code took effect on 21 November 2025. The Industrial Relations Code is the central framework identified by India Code for industrial relations and disputes. Older statutory material, including the Chief Labour Commissioner’s explanation of Industrial Disputes Act section 25F, can help explain the cited notice and compensation measures, but should not be treated as the only current law. The applicable code, rules, state provisions, and facts need checking for an individual case.

The cited central retrenchment text concerns a covered “workman” with at least one year of continuous service. A professional or managerial employee should not assume that this category applies—or that it does not—without checking the applicable legal definition and job duties. Contract terms, standing orders, state Shops and Establishments law, employer policy, settlement terms, and other applicable rules may also matter.

How should I break down the final settlement?
Ask the employer for an itemized written calculation, not only a total. For every line, record its stated basis, calculation inputs, payment date, tax withholding, and whether it is statutory, contractual, policy-based, or discretionary. This helps distinguish an amount that is offered as a package from one that may be payable under a separate rule.
| Payment or benefit | What to verify |
|---|---|
| Company severance or ex gratia | Whether the offer is contractual, policy-based, or discretionary; the amount and eligibility conditions; any release or acceptance terms; and whether it is additional to other dues. |
| Notice or wages in lieu | Whether notice will be worked or paid instead, the applicable contract or statutory basis, the period used, and how the amount was calculated. |
| Statutory retrenchment compensation | Whether the relevant law covers you and the establishment, the recognized service period and wage basis, and whether the calculation and timing meet the applicable requirements. |
| Earned salary, leave, bonus or incentives | Unpaid wages through the separation date, any leave-encashment basis, and whether earned or conditional variable pay is included under the contract, policy, or applicable law. |
| Gratuity | Whether you qualify under the governing provisions, which wage base and service period apply, and the amount and payment date. |
| Benefits and insurance | The precise end date of coverage, any continuation option, and what happens to employer-provided benefits after separation. |
| EPF | Whether you will transfer the account to new employment or, if eligible, make a settlement or other permitted claim; check your account records and current EPFO guidance. |
| Tax and withholding | How each component is classified, what tax has been withheld, and whether any exemption applies to that specific payment and tax year. |
Is notice pay mandatory if I’m laid off?
It depends on the employee’s coverage and the applicable law and contract. The Chief Labour Commissioner’s section 25F material describes one month’s written notice stating the reasons, or wages in lieu of notice, for a covered workman with at least one year of continuous service who is retrenched. It also describes a requirement for prescribed notice to the appropriate government or authority. Do not apply this as a universal notice-pay rule to every termination in India.
For your own case, compare the termination letter with your employment contract, applicable standing orders or policy, and the current central and state requirements. Check whether the employer expects you to work through notice or is paying in lieu, and whether the offered period and calculation match the rule that actually covers you. If the employer calls the separation a layoff, ask what legal category and basis it is using.

How is statutory retrenchment compensation calculated?
The Chief Labour Commissioner’s cited section 25F text gives a measure of 15 days’ average pay for every completed year of continuous service, or part of a year exceeding six months, for a covered workman meeting the provision’s conditions. The text also describes notice or wages in lieu and prescribed government notice. These are not enough to calculate every employee’s entitlement: coverage, the operative law, the applicable wage definition, service record, and rules must first be confirmed.
Ask the employer to show the average-pay figure, the service period it recognized, how it treated a partial year, and the provision it relied on. Compare those inputs with your records and the rule that applies to you. If your role is managerial or otherwise outside the relevant statutory category, your contract, state law, standing orders, or a separation agreement may be more important than this formula.
Is company severance the same as statutory compensation?
No. “Severance” may refer to a voluntary company package or ex gratia payment, while statutory retrenchment compensation, contractual notice pay, and other final dues are distinct questions. A company package may be offered in addition to statutory amounts, or may describe several components together. The offer’s wording alone does not establish that it satisfies every separate obligation.
Before accepting, ask for the components to be identified individually and whether each amount is inclusive of or additional to another payment. Review any release, waiver, confidentiality clause, acceptance deadline, or condition attached to the package. If a calculation or coverage issue is disputed, obtain advice from an India employment-law professional or a worker legal-aid service before signing.
Will I receive gratuity if my job is terminated?
Gratuity is a separate benefit, not another name for severance. The Ministry of Labour & Employment’s 2026 Labour Code FAQ says gratuity payable on or after 21 November 2025 is governed by the Code on Social Security, 2020. It also says a fixed-term employee is eligible after one year of service under the contract. That FAQ does not establish that every employee or separation qualifies, nor does it supply enough information to calculate every person’s amount.
Ask payroll to state the governing provision, qualifying service period, wage base, calculation, and expected payment date. Check the applicable statutory provisions and your employment records before relying on the figure, particularly where employment was fixed-term or the service history is disputed.

Should I transfer or withdraw my PF after leaving a job?
EPF is an account decision, not severance. EPFO’s “About EPFO” page lists Form 13 for transferring an old account to a new one, Form 19 for a member’s final settlement, and Form 31 for withdrawals in certain cases. These are different processes, and the form names do not by themselves confirm your eligibility.
Check EPFO’s current claim guidance and your account records before choosing a process. Confirm the applicable conditions and consider any pension-related implications; do not assume that withdrawal is the best option for every person changing or leaving employment.

Do not assume that every termination payment is tax-free. The Income Tax Department’s salary guide describes section 10(10B) relief for qualifying retrenchment compensation, including a ₹5,00,000 cap in the cases it describes, subject to formula and scheme-specific qualifications. It does not support treating every severance package, notice payment, or settlement component as exempt.

Ask for the employer’s component-wise tax classification and withholding details, then assess each amount under the rules for the relevant tax year and your circumstances. The salary guide also addresses salary, provident-fund, and gratuity tax topics; complex or mixed settlements may warrant a qualified tax adviser.
What should I do before accepting the settlement?
- Get the separation terms in writing. Keep the termination or retrenchment letter, package offer, contract, relevant policy, payslips, service records, and correspondence.
- Ask for an itemized calculation. Have the employer identify severance or ex gratia, notice or wages in lieu, any statutory compensation, earned wages, leave, gratuity, variable pay, tax withholding, and benefit end dates separately.
- Check coverage and calculation inputs. Confirm the legal classification and service period used, applicable central and state rules, wage basis, and the provision or contract clause cited for each amount.
- Review conditions and timing. Check when each amount will be paid, whether notice is worked or paid in lieu, and whether acceptance requires a release or other commitments.
- Choose an EPF process only after checking eligibility. Consult current EPFO claim guidance and your account details for transfer, final settlement, or a permitted withdrawal.
- Resolve material uncertainties before signing. Seek local employment-law advice for disputed coverage or statutory calculations, and tax advice for complex payment classifications.
Which sources govern the main checks?
The Ministry of Labour & Employment and Press Information Bureau announced the Labour Codes’ effective date; India Code identifies the Industrial Relations Code; and the Ministry’s 2026 Labour Code FAQ addresses the post-21 November 2025 gratuity framework and fixed-term employee point. The Chief Labour Commissioner’s material explains the cited section 25F measures. EPFO lists the account processes, while the Income Tax Department’s salary guide describes the qualified section 10(10B) exemption. The central sources do not resolve every state rule, employee classification, contract, or individual calculation; those details must be checked for the particular separation.
