How to Evaluate Florida’s Tax Benefits Before Moving Your Business or Residence

Florida’s lack of a state personal income tax can be valuable, but it is not a complete estimate of what you will save by moving. A defensible comparison must set your current state against a specific Florida county, then model individual income, business tax, sales and use tax, property tax, tangible personal property, federal obligations and one-time transition costs.

Use the framework below to identify the taxes that actually change for your household or company. Until you have your origin and destination addresses, income and entity details, property values, business footprint and local rates, treat any claimed “Florida savings” as unverified.

What Florida’s tax advantage actually is

The clearest statewide benefit is that Florida does not impose a personal income tax. The Florida Department of Revenue (DOR) states that an individual does not file a Florida personal income-tax return. That removes one state-level tax from many residents’ calculations, but it does not eliminate federal income tax or other state, county and municipal taxes and fees.

For a business, the result is more complicated. A corporation doing business, earning income or existing in Florida can owe Florida corporate income/franchise tax. A company can also collect or pay sales and use tax, file local tangible-personal-property returns and incur property, documentary, licensing, payroll or other compliance costs. A homeowner’s result depends on assessed value, homestead eligibility and the millage rates of the county and taxing authorities.

The right question is therefore not “Is Florida lower tax?” It is “For this person or entity, moving from this jurisdiction to this Florida address, which liabilities disappear, which remain, and which new liabilities arise?”

Start with an apples-to-apples comparison

Write down the facts for both locations before looking at rates. A state-only comparison can be misleading because Florida’s county surtaxes and property-tax millage vary by address, while your current state may have city income taxes, local business taxes or credits that disappear when you leave.

Input What to collect Why it changes the answer
Origin jurisdiction State, county and city; residency dates; current filing status Your former state may continue taxing part-year income, business income or gains, and may impose local taxes.
Florida destination County, city, street address and intended move date County sales surtax, property-appraiser rules, millage and local registrations are address-specific.
Household income Wages, pass-through income, portfolio income, gains, deductions and credits The value of removing an individual income tax depends on the kinds and amount of income, and federal tax remains.
Residence Purchase price, expected assessment, ownership, occupancy and prior Florida homestead Homestead exemptions and Save Our Homes portability affect assessed value, not a guaranteed dollar reduction.
Business entity Corporation, partnership, LLC tax election or other federal classification; owners and payroll Florida corporate tax applies to corporations, while pass-through and owner-level effects follow different rules.
Business footprint Employees, property, sales by destination, inventory, contractors and offices in each state Apportionment, sales-tax collection, nexus, local filings and the tax paid to another state all depend on activity.
Assets and transactions Equipment, vehicles, inventory, leases, real-estate sales and planned distributions Tangible personal property, use tax, transfer costs and gains can offset an apparent annual saving.

Use the same tax year for both sides. Label one-time costs separately from recurring annual liabilities, and keep a written assumption for every estimate.

Individual income tax and residency

“Do I have to file a personal income tax return in Florida?”

Generally, no. The DOR’s personal-income-tax FAQ says Florida does not impose a personal income tax, so an individual does not file a Florida personal income-tax return merely because the individual lives there. Florida’s new-resident information also says the state has no personal income tax, inheritance tax, gift tax or tax on intangible personal property.

Those statements describe Florida taxes; they do not excuse a federal return or settle another state’s claim. The state you leave may require a part-year return, tax income sourced there after the move or apply residency rules based on facts rather than your stated move date. Confirm the departure state’s rules for wages, business income, rental property, trusts and investment transactions.

“Does Florida have a capital gains tax?”

Florida has no separate state personal capital-gains tax because it has no individual income tax. Federal capital-gains tax can still apply. In addition, the former state may tax a gain connected with property, business activity or a period when you were resident there. A corporation’s gain can be included in Florida corporate taxable income when the corporation is subject to the corporate income/franchise tax.

Do not multiply an old state’s marginal rate by every dollar of investment gain and call that your Florida savings. Holding period, basis, loss offsets, entity ownership, sale date and sourcing rules can change the result. Model the transaction in the year it occurs and preserve records showing residency and asset ownership.

Proving the move without assuming a magic day

For planning, establish a documented timeline: when the Florida home became your permanent residence, when the former home was sold or rented, where you worked, where dependents attended school, and where licenses, voter registration, vehicles and important accounts were maintained. No single document guarantees residency treatment. Keep closing statements, leases, utility records, travel logs and tax returns so an adviser can evaluate conflicting facts under both states’ laws.

Business income tax: entity, activity and apportionment

When Florida corporate income/franchise tax applies

Florida imposes corporate income/franchise tax on corporations for the privilege of conducting business, deriving income or existing in Florida. This includes entities taxed as corporations for federal purposes. A move of the owner does not automatically move a corporation’s tax base; an entity can continue to have activity, property, employees or sales in the origin state.

The DOR’s rate information lists a 5.5% Florida corporate income/franchise tax rate for taxable years beginning on or after January 1, 2022. The computation is not simply 5.5% of gross receipts. Florida adjustments, an exemption and the state’s apportionment calculation affect taxable income.

How multistate apportionment changes the calculation

For multistate activity, Florida generally apportions adjusted federal income using property, payroll and sales factors. Moving headquarters can change those factors without moving customers or production. For example, a Florida office with customers and staff in several states may still report a Florida-apportioned share rather than all company income; the exact result depends on the entity and current Florida rules.

Business fact Question to answer Possible consequence
Property Which state owns or rents equipment, offices and inventory, and for how long? Changes the property factor and may create local property filings.
Payroll Where do employees perform services, and where are contractors treated as payroll for the applicable formula? Changes the payroll factor and can create withholding or registration duties elsewhere.
Sales Where are customers and receipts sourced under the applicable rules? Changes the sales factor and sales-tax collection analysis.
Entity election Is the business taxed as a C corporation, S corporation, partnership or disregarded entity? Determines whether Florida corporate tax applies at the entity level and how owners report income.

Check the tax year’s federal conformity

Florida starts with federal concepts but does not promise identical treatment for every deduction or adjustment. The DOR’s 2026 Tax Information Publications index lists a July 7, 2026 publication concerning Florida’s adoption of the 2026 Internal Revenue Code. Use the Florida return instructions for the specific tax year and reconcile federal and Florida adjustments; do not assume a federal change flows through unchanged.

Sales and use tax for households and businesses

The 6% state rate is only the starting point

Florida’s general state sales-tax rate is 6%. County discretionary sales surtax can increase the rate, and the applicable county depends on the transaction and delivery rules. Whether a sale, service, rental or admission is taxable depends on its category and any exemption. Obtain the current rate for the destination address rather than using 6% as a universal checkout rate.

Use tax can be due when taxable goods are brought into or used in Florida without Florida sales tax having been paid. A business relocating equipment, buying from an out-of-state vendor or converting inventory to business use should test each transaction instead of assuming the purchase was tax-free.

Registration, collection and remote sales

A business conducting taxable activities may need to register with the DOR, collect tax and file returns. The DOR states that a remote seller generally has a Florida collection obligation when taxable remote sales into Florida exceed $100,000 in the prior calendar year. Marketplace providers have collection and remittance obligations for facilitated taxable sales, but the underlying business still needs to determine registration, documentation and non-marketplace obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Map sales by customer destination and channel for the prior calendar year. Separate direct web sales, marketplace sales, exempt transactions and taxable services. Keep exemption certificates and reconcile marketplace reports to general-ledger revenue.

Home property tax, homestead and portability

What the homestead exemption does

An owner who makes a Florida property a permanent residence may qualify for a homestead exemption that decreases taxable value by as much as $50,000. This is an exemption from assessed value, not a $50,000 cash payment or a guaranteed $50,000 reduction in the tax bill. The property appraiser determines eligibility and assessed value, while county and other taxing authorities set millage.

The DOR’s 2026 adjustment notice lists a maximum inflation-adjusted additional homestead exemption of $26,411. It applies to qualifying assessed value above $50,000 and to non-school taxes. The figure is a maximum exemption amount for the 2026 tax year, not the amount saved; the actual bill effect depends on the taxable value and each authority’s millage.

Save Our Homes and portability

A qualifying homeowner may port all or part of the Save Our Homes assessment difference to a new Florida homestead. Portability is not automatic tax forgiveness: eligibility, application deadlines, the old and new assessments and the property appraiser’s calculation determine the amount. Ask the destination county’s property appraiser how to apply and how a prior Florida homestead affects the new assessment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare millage, not just exemptions

Two homes with the same market value can have different bills because county, municipal, school-board and other taxing-authority millage differs. Request the current proposed or adopted millage and an estimate of assessed value from the relevant property appraiser. Include insurance, association charges and maintenance in a relocation budget, but keep those non-tax costs separate from the property-tax comparison.

Tangible personal property for a business

Corporate income tax and local tangible-personal-property tax are separate analyses. A business owning qualifying tangible personal property—such as equipment—on January 1 generally must file a return with the county property appraiser by April 1. Each return is eligible for an exemption of up to $25,000 of assessed value.

The DOR’s definition excludes some items, including inventory, household goods and certain vehicles. Prepare a January 1 asset list by county, retain acquisition and depreciation records and verify exclusions with the local property appraiser. A business that moves during the year can still have a filing obligation based on what it owned on January 1.

Federal and one-time transition costs

Florida’s state income-tax difference does not change federal income tax, self-employment tax, payroll tax, estimated-tax payments or federal information returns. A move can also trigger costs that never appear in a state-rate comparison:

  • Part-year returns and final estimated payments for the former state.
  • Entity qualification, withdrawal, dissolution or foreign-registration filings in states where the company continues operating.
  • New Florida business-tax registrations, local business-tax receipts and sales-tax systems.
  • Property-appraiser filings, equipment re-titling, permits and revised payroll accounts.
  • Real-estate closing costs, lease termination, moving, storage and duplicate housing expenses.
  • Professional fees for residency, multistate apportionment, sales-tax and property-tax advice.

Classify each item as recurring, one-time or contingent. A large one-time cost may be rational if annual savings persist, but it should not be hidden inside a recurring tax-rate percentage.

A step-by-step evaluation method

  1. Fix the comparison date. Choose the tax year and intended move date. Note whether the move occurs before or after a property purchase, business sale, bonus, distribution or other major transaction.
  2. Define the people and entities. List household members, ownership percentages, entity classifications, trusts and properties. Separate personal income from company income.
  3. Document the origin state. Identify resident, part-year, nonresident and local filings; taxes on sourced income; credits; and any continuing property or business connections.
  4. Select the Florida address. Record county, municipality and property-appraiser jurisdiction. Obtain current sales-surtax and property-tax information for that address.
  5. Build the individual model. Remove Florida personal income tax from the scenarios, but retain federal tax and any former-state tax on sourced or part-year income. Model wages, pass-through income, gains, rental income and deductions separately.
  6. Build the business model. Apply the 5.5% Florida corporate rate only where the corporation is subject to Florida tax, then calculate Florida adjustments, exemption and apportionment. Preserve property, payroll and sales data by state.
  7. Map transactions and registrations. Test sales and use tax by product, service, customer destination and channel. Check the $100,000 prior-calendar-year remote-sales threshold and marketplace responsibilities, then list every required registration and return.
  8. Calculate property effects. Estimate assessed value, homestead eligibility, Save Our Homes portability and local millage. Separately list business tangible personal property, the April 1 filing and the up-to-$25,000 exemption.
  9. Add federal and transition items. Include federal tax, former-state filings, entity registrations, moving and closing costs, professional fees and compliance software or staff time.
  10. Run sensitivity cases. Change income, sales location, home value, millage, move date and business footprint. A conclusion that changes under a reasonable alternative is a planning range, not a guaranteed saving.
  11. Save the evidence. Keep rate pages, appraiser estimates, invoices, asset schedules, residency records and assumptions with the model so it can be updated when rates or facts change.

How different fact patterns change the result

High personal income, little Florida business activity

The absence of Florida personal income tax may be the largest recurring difference, especially when the former state taxes ordinary income at meaningful rates. The benefit is reduced by part-year taxation, continued source income and federal tax, and it says nothing about the cost of buying and maintaining the Florida home.

Owner moves, corporation remains multistate

The owner’s residence and the corporation’s tax footprint are distinct. Florida corporate tax can apply to the company, while property, payroll and sales in the former state can preserve that state’s filing obligations. Recompute apportionment instead of moving all profit to Florida on paper.

Retailer expands into Florida

The 6% state rate, county surtax, product exemptions, use-tax purchases and remote-sales threshold matter more than the owner’s residence. Build a destination-based transaction map and reconcile direct and marketplace sales before forecasting collection obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Homeowner with a prior Florida homestead

Portability may lower the new property’s assessed value, but the benefit depends on the prior Save Our Homes difference, the new assessment and application requirements. Obtain a county-specific calculation rather than applying the $50,000 or $26,411 figures directly to the tax bill.

Common mistakes and how to correct them

  • “No income tax means no tax.” Correct the statement to “no Florida personal income tax,” then add sales, property, business and federal taxes.
  • Using the 6% rate for every purchase. Check county surtax, taxable category, exemption and use-tax treatment for the actual transaction.
  • Applying the 5.5% corporate rate to revenue. Start with the corporation’s adjusted federal income, Florida modifications, exemption and apportionment.
  • Calling an exemption a tax saving. Convert exempt assessed value into a bill effect using the applicable millage; the $26,411 2026 amount is not cash saved.
  • Ignoring the January 1 property date. Review tangible personal property ownership on January 1 and the April 1 filing deadline, even after a midyear move.
  • Assuming a new address ends the old state’s claim. Review part-year, sourced-income and continuing-business rules and retain evidence of the move.
  • Assuming federal and Florida returns match. Read the instructions for the tax year, including the 2026 federal-code conformity publication and later updates.
  • Comparing states without comparing counties. Replace statewide averages with the Florida county, municipality, taxing authorities and property appraiser that apply to the destination.

When to obtain a professional calculation

Use a Florida CPA or tax attorney before moving when the household has a large gain, trust, deferred compensation, rental portfolio or business interest; when the company has employees or customers in several states; when a corporation, S corporation or partnership will change its registration; or when a prior homestead portability claim is material. Ask for a written model that identifies tax year, jurisdictions, assumptions, apportionment method, property assessment, one-time costs and unresolved legal questions.

For a straightforward employee household, the same worksheet can still provide a useful first estimate. The result becomes reliable only after the origin state, Florida county, income sources, property facts, entity structure and business activity have been verified.
