An AI model being downloadable does not automatically make it open source, commercially usable, or legally unrestricted. Evaluate the exact release—not just its repository label—by checking four separate layers: the files you received, the controlling license and policies, the training-data disclosure, and the laws that apply to your deployment.
Record the provider, version or commit, release date, every component you use, the permissions and conditions in each applicable document, what training information is disclosed, and every unresolved ambiguity. This evidence-based record is the difference between a defensible decision and an assumption based on the phrase “open weights.”

Open-weight is not the same as open-source AI
“Open-weight” generally means that model parameters, often called weights, can be downloaded or accessed. Those parameters let you run inference and may let you fine-tune the model, subject to the applicable terms. Weight access says nothing by itself about whether the source code, training method, datasets, or documentation are available.

A release can publish parameters while withholding meaningful information about the data used to train them or the code needed to study and modify the system. Conversely, a provider may publish a detailed training-data summary without releasing the underlying corpus, because privacy, copyright, confidentiality, or security constraints can prevent redistribution.

Use precise language in your internal records. “Weights available” describes an access condition. “Open source” should be reserved for a release whose terms and disclosures satisfy the definition you are applying. “Unrestricted” is usually too broad unless you have checked the license, acceptable-use rules, platform terms, and applicable law for the exact use.
Start by identifying the exact artifact
Rights attach to a particular release and its components. Before reading a license, create an inventory of what you will actually download, run, modify, or redistribute.
Record the release identity
- Provider or organization responsible for publication.
- Model name, variant, parameter size, and release date.
- Repository address and the specific version, tag, commit, or file hash.
- Whether you are using base weights, a fine-tune, an instruction-tuned version, a quantized copy, or a merged checkpoint.
- The intended deployment: local inference, a hosted API, an internal application, a public service, or redistribution to customers.
A model name may cover several generations with different terms. Save a copy of the license and model card as they existed when you made the decision. If a repository changes its files or policy, you need to show which text governed your use at the relevant time.

Weights are only one part of a working system. List the inference or training code, tokenizer, configuration files, adapters, quantization scripts, evaluation data, example prompts, and any datasets supplied with the release. A single repository can contain files under different licenses. A permissive license on code does not automatically grant rights to the weights, and a weight license does not necessarily cover a tokenizer or a dataset.
For a fine-tuned or quantized model, identify the upstream base model and the transformation that produced your copy. Your rights may depend on both the upstream terms and the terms attached to the derivative artifact. If you plan to publish the result, document which files are copied, which are generated, and which are merely referenced at runtime.
Read the operative license and every additional policy
Repository metadata is a signpost, not the contract. Platforms such as Hugging Face let repository creators attach license metadata to code or data and offer multiple licensing options, but the metadata can be incomplete, generic, or inconsistent with a separate model-specific document. Open the full license file linked from the exact release and look for provider terms on the model page.
Questions the license must answer
- Who grants the rights? Confirm the named entity and whether it has authority to grant rights in the artifact.
- What is covered? Determine whether the text covers weights, source code, documentation, data, outputs, or only a subset.
- What may you do? Look for express permission to use, reproduce, modify, fine-tune, deploy, host for others, and distribute.
- What conditions apply? Check attribution, notice, copyright, license-file, access, reporting, or pass-through requirements.
- What is excluded? Identify prohibited sectors, users, geographies, model sizes, or deployment patterns.
- What happens on violation? Note termination, suspension, cure periods, and reinstatement language.
- Are there disclaimers or liability limits? These affect risk allocation even when they do not remove a permission.
Do not assume that a familiar software license governs every model component. A provider can combine a software license with model-specific terms, an acceptable-use policy, or a separate agreement. Read those documents together and record which one controls if they conflict.

Check commercial and redistribution details
Write down the actual activities your project will perform, rather than asking whether the model is “commercial.” Internal experimentation, selling access to a hosted service, embedding the model in a product, fine-tuning it, and redistributing weights are different acts. A license may permit one and restrict another.

Check whether redistribution requires passing along notices, preserving the license, registering an application, displaying an attribution, or accepting additional terms. A hosted service may avoid distributing weights but can still be subject to use restrictions or output-related obligations. If customers can upload prompts or obtain model access through your service, assess whether that makes you a distributor, host, or another defined party under the terms.
Read the acceptable-use policy separately
An acceptable-use policy can prohibit activities that the license’s general grant appears to allow. Look for rules concerning fraud, surveillance, weapons, exploitation, personal data, political influence, regulated advice, or high-impact decisions. Check definitions, exceptions, enforcement rights, and whether the policy applies to outputs, fine-tuned versions, or downstream users.
Keep the license and use policy as separate entries in your evidence record. A policy is not necessarily a copyright license, and a copyright license is not permission to violate a use restriction.
Evaluate training-data transparency independently
Weight availability does not reveal what went into training. Assess disclosure in its own section of your review, using the model card and any linked technical or regulatory documentation.
What a meaningful disclosure should contain
- Sources and provenance: named datasets, collections, sites, archives, or categories, with information about where the data came from and how it was obtained.
- Scope and characteristics: languages, modalities, time ranges, domains, geographic coverage, and approximate composition where available.
- Selection: inclusion and exclusion criteria, sampling, weighting, and the rationale for choosing sources.
- Processing: filtering, deduplication, labeling, annotation, synthetic-data generation, and safety processing.
- Third-party and non-public material: what was used, what permissions were obtained, and what cannot be disclosed.
- Training stage: whether the description covers pretraining, supervised fine-tuning, preference optimization, evaluation, or all stages.
The Open Source AI Definition expects extensive data information, including provenance and characteristics, how data was obtained and selected, and labeling and processing details. It also recognizes that information about data that cannot be shared may still be necessary. A high-level statement such as “public web data and licensed datasets” is useful context but leaves major diligence questions unanswered.
Interpret missing information carefully
Mark a source as “not disclosed” when the provider does not identify it, and “unclear” when the wording is too vague to determine what happened. Do not convert an information gap into a finding of infringement. Lack of disclosure makes risk harder to assess; it does not, by itself, prove that training was unlawful. The reverse is also true: a detailed summary does not prove that every training use was licensed or that every jurisdiction will treat it the same way.
Ask whether a disclosure covers the base model or only a later fine-tune. A fine-tuning data statement cannot substitute for information about the pretraining corpus. If the provider publishes a data summary but withholds the corpus, record exactly what is available and what cannot be independently inspected.

Turn the documents into a use-specific decision rather than a general label. List each activity and test it against the model license, additional policy, platform terms, and applicable law.

If a material term is ambiguous, obtain advice from counsel familiar with the relevant jurisdictions before launch. This is especially important when you will redistribute weights, process personal data, make decisions about people, or operate in a regulated sector.
Account for jurisdiction and the European Union AI Act
Legal obligations depend on where the provider and deployer operate, who can access the system, and what the system does. A license cannot waive mandatory law, and a model’s “open-source” label does not settle regulatory status.
What Article 53 requires
Article 53 of Regulation (EU) 2024/1689 sets obligations for providers of general-purpose AI models. It includes a policy to comply with EU copyright law and a publicly available, sufficiently detailed summary of training content.

The Act provides an exception from specified provider documentation duties for certain qualifying open-source general-purpose AI models when access, usage, modification, and distribution are allowed and the weights, architecture information, and usage information are publicly available. These are conditions to evaluate, not a blanket exemption for every model whose weights can be downloaded.
Limits of the open-source exception
European Commission guidance explains that the exception does not remove the copyright-policy and training-content-summary obligations. Models classified as presenting systemic risk do not receive the same exemption. Applicability also depends on provider status, model classification, release conditions, and the current interpretation of the Act.
“General-purpose AI models released under free and open-source licences should be considered to ensure high levels of transparency and openness if their parameters, including the weights, the information on the model architecture, and the information on model usage are made publicly available.”
This recital describes specified transparency conditions. It does not declare that every weights-available model is open source, lawful for every purpose, or exempt from downstream duties. Check the current AI Act text and Commission guidance for the release and role you are assessing.
Build an evidence record that survives version changes
For every conclusion, preserve the document and date that support it. A practical record can use the following fields:

- Release identity: provider, model, version or commit, release date, repository, and files used.
- Component map: weights, code, tokenizer, adapters, quantization files, datasets, and external dependencies.
- Controlling documents: license, model-specific terms, acceptable-use policy, platform terms, model card, and training-data documentation.
- Permission matrix: use, modification, fine-tuning, commercial deployment, hosting, and redistribution marked as documented, not disclosed, or unclear.
- Training-data findings: named sources, provenance, selection, processing, unavailable information, and the training stage covered.
- Jurisdiction notes: provider and deployer locations, user locations, applicable AI, copyright, privacy, consumer-protection, and sector rules.
- Open issues: every unresolved restriction, missing source, conflicting document, or term requiring legal interpretation.
- Review trigger: a date or event that forces rechecking, such as a new model version, changed policy, new deployment, or regulatory update.
Use stable, versioned copies or links where possible. When a provider edits a model card or policy without changing the model files, record the new text separately and determine whether it changes your obligations.

When choosing among releases, use the same questions for each candidate. A model with a permissive-looking license may still be a poor fit if its provenance is opaque or its terms conflict with your deployment.

Do not award a model an “open” score merely because one axis is strong. Report the evidence for each axis and keep “not disclosed” distinct from “not applicable.”

Relying on a repository badge
Mistake: treating a metadata label as the complete license.
Correction: open the exact license file, model-specific terms, and acceptable-use policy; save their versions and dates.
Assuming weights include all rights
Mistake: believing that downloading weights grants rights to the training data, tokenizer, code, or outputs.
Correction: inventory each component and identify its own terms.

Calling a broad summary “transparent” without qualification

Confusing a license with permission for every use

Mistake: applying the base model’s terms to a fine-tune, adapter, or quantized copy without checking its publisher.
Correction: trace the chain of upstream and downstream artifacts and preserve every applicable document.
Failing to revisit the decision
Mistake: treating a one-time review as permanent.
Correction: recheck when the version, policy, deployment, provider status, or law changes.
A decision rule for unresolved uncertainty
Classify each important question as documented, not disclosed, or unclear. Proceed only when the documented permissions and controls match the intended use. Escalate when a missing or ambiguous fact could change the decision, especially for redistribution, personal data, regulated decisions, or public-facing services.
The most defensible conclusion is often qualified: “Weights are available under these stated terms; code and data information are disclosed to this extent; the following restrictions apply; and these issues remain unresolved.” That statement is more accurate than calling a release fully open or unrestricted when the evidence does not support those labels.
