The safest way to evaluate an Indian real-estate opportunity is to follow a fixed sequence: define your objective and holding period, verify title and approvals for the exact property, model every cash flow with local evidence, calculate tax and transaction costs, and compare realistic exit routes. RERA registration can improve project information, but it is not a guarantee of title, completion or returns. Listed REITs offer a different risk and liquidity profile from owning a specific property.
Start by defining what you are actually investing in
“Real estate” is not one investment. A completed apartment bought for rent, an under-construction project, a land parcel, a commercial unit and a listed real-estate investment trust (REIT) have different legal rights, cash-flow timing, costs and exits. Do not compare them using only a price per square foot or an advertised annual return.

- Home with possible appreciation: personal use is the primary benefit, so affordability, location and suitability matter more than a speculative resale estimate.
- Rental income: the property must attract tenants at a sustainable rent after vacancy, maintenance, tax, insurance, management and financing costs.
- Capital appreciation: the thesis depends on a credible demand and supply case, a holding period long enough to absorb cycles, and an exit market.
- Land: title, permitted use, access, development restrictions and resale liquidity are central; land normally does not produce rent while you hold it.
- Diversified real-estate income: listed REIT units provide market exposure without buying one parcel, but their prices move in the securities market.
Set the decision limits
Record your maximum cash contribution, acceptable loan-to-value ratio, emergency reserve, required income, minimum and maximum holding period, and the conditions that would make you sell. Include whether you can tolerate delayed possession, a vacant property, a large repair bill or a fall in market price. A good opportunity is one that still fits these limits in a downside case, not merely one that works under optimistic assumptions.
#1 Best Overall
Compare like with like
A ready-to-rent unit starts producing potential income immediately; an under-construction unit may require staged payments and generate no rent until completion. A land parcel may have no operating income at all. A REIT unit can usually be sold through the securities market, while a direct sale may require finding a buyer, negotiating, completing documentation and paying transfer costs. Put each route on a separate cash-flow timeline before choosing.
Choose the route: direct property or a listed REIT
| Decision factor | Direct ownership | Listed REIT units |
|---|---|---|
| Control | You control use, leasing and sale subject to law, approvals, association rules and contracts. | You own units and do not control individual buildings or tenants. |
| Diversification | Often concentrated in one parcel, project, city or tenant. | Exposure may be spread across multiple assets and tenants; inspect the actual portfolio and concentration. |
| Liquidity | Sale can take time and depends on a suitable buyer and completed transfer formalities. | Units trade in the securities market, but liquidity and price can vary. |
| Recurring costs | Maintenance, property tax, insurance, repairs, management, financing and vacancy costs may fall directly on you. | Fees, property-level expenses and leverage are reflected in the vehicle’s disclosures and distributions. |
| Income source | Rent from the specific property, reduced by vacancy and operating costs. | Distributions linked to the REIT’s portfolio and financial performance; do not assume a fixed yield. |
| Disclosure | You must obtain and verify parcel-level title, approvals, contracts and operating information. | SEBI-regulated filings disclose assets, occupancy, tenants, lease maturity, valuation, leverage, fees and related-party matters; read the current filings. |
| Exit risk | Price, buyer demand, documentation and transaction costs determine the exit. | Market price can fall even when underlying property values appear stable. |
For a REIT, review the current offer document and periodic disclosures under the Securities and Exchange Board of India (SEBI) REIT framework. Check asset type and location, occupancy, tenant concentration, lease expiries, valuation method, leverage, fees, distributions, related-party transactions and unit-trading liquidity. SEBI’s regulations require important disclosures, but disclosure does not remove market risk. The SEBI regulations page retrieved for this article showed an amendment dated 18 April 2026; confirm that the page and the particular REIT’s latest filings are current when you invest.
Verify legal ownership before analysing returns
Financial projections are irrelevant if the seller cannot transfer the interest, the land cannot be used as promised, or an undisclosed claim blocks your ownership. Have a property lawyer qualified in the relevant state or Union territory examine the exact transaction. The records and search procedure are not nationally uniform: they vary by jurisdiction, property type and local registration system.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsIdentify the interest being sold
- Obtain the seller’s identity and authority to sell. For a company, trust, partnership or power-of-attorney transaction, verify the authority and supporting resolutions or instruments.
- Establish whether you are buying freehold, leasehold, a unit in a co-operative or owners’ association, development rights, a share in land, or another interest. The rights, term and transfer restrictions differ.
- Match the agreement, title description, survey or plot number, boundaries, area and floor or unit number across every document.
Check the chain of title and encumbrances
Your lawyer should trace prior transfers and check the relevant land and registration records for mortgages, charges, liens, attachments, easements, acquisition notices, litigation and other claims. Ask how the search was performed and what date the records cover. A promoter’s declaration is evidence to examine, not a substitute for an independent search.
Confirm land use and physical access
Verify the permitted land use, zoning, conversion orders where applicable, road access, rights of way, development restrictions and any environmental, heritage, coastal or acquisition constraints relevant to the parcel. A cheap parcel can be a poor investment if the intended building, subdivision or commercial activity is not legally permitted.
Match the contract to the promise
Read the sale or allotment agreement, payment schedule, possession clause, delay remedies, cancellation terms, area variation rules, maintenance obligations, parking rights, common-area rights and dispute provisions. Marketing material is not a substitute for the signed contract. Record every promise that matters to your decision and identify where it appears in the binding documents.
Use RERA as a project-information check, not a guarantee
The Real Estate (Regulation and Development) Act, 2016 was enacted on 25 March 2016 and is recorded by India Code as enforced from 1 May 2016. Implementation, rules, authorities, portals and records still require a state- or Union-territory-specific check.
When evaluating a covered project
- Find the relevant state or Union territory RERA authority’s portal and search by the project’s exact name, promoter and registration number.
- Compare the portal entry with the brochure, model flat, price sheet and agreement. Resolve differences before paying a booking amount.
- Review the promoter’s disclosed title and encumbrance information, approvals, sanctioned plans, permitted changes, promised completion date, construction progress, complaints and authority orders shown on the portal.
- Check whether the unit, phase, tower and amenities you are buying are included in the registered project and sanctioned plan.
- Save dated copies of the relevant disclosures and portal pages. Online information can change, and the version you relied on should be identifiable.
Government guidance explains that project webpages should expose project details and report progress. Exact fields and procedures vary by jurisdiction. RERA registration and disclosure are useful checks for covered projects; they do not establish perfect title, guarantee completion, guarantee a return or eliminate the need for a lawyer.
Understand the separate-account rule carefully
Government guidance issued in 2016 describes 70% of amounts realised in the applicable RERA context being placed in a separate account for land and construction costs, alongside project and progress disclosures. Treat this as a project-fund safeguard, not a performance statistic. It does not promise timely completion, promoter solvency or investment profit. Confirm applicability and current local rules with the relevant authority.
Build a property-level financial model
Use dated, locality-specific evidence and a spreadsheet that shows when money leaves and enters your account. A headline price or broker’s appreciation forecast is not an investment case.
List every acquisition cost
- Agreed purchase price and any premium for parking, furnishings, floor, view or other rights.
- State or Union territory stamp duty, registration charges and transaction-specific levies.
- Taxes collected or payable in the transaction, legal review, valuation, brokerage, loan processing, mortgage creation and document costs.
- For a new or under-construction property, staged instalments, taxes and fit-out costs due before possession.
Model operating cash flow
For a rental property, estimate gross rent by month, then subtract realistic vacancy, tenant turnover, brokerage, maintenance, property tax, insurance, repairs, utilities you pay, association charges, management and loan interest. Include rent escalation only when supported by local leases or comparable evidence. Separate recurring costs from one-time costs so the net yield is not overstated.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →A simple annual net operating calculation is:
Net operating income = collected rent − vacancy and collection loss − operating expenses
If you borrow, show principal repayments separately from interest. Principal reduces debt but is still a cash requirement. Model rate resets, processing fees, prepayment terms and the possibility that the lender values the property below your purchase price.
Use achieved evidence, not asking prices
For each comparable, record the date, locality, property type, area definition, condition, floor, age, parking, transaction status and source. Distinguish a completed sale from an asking price. A rent quoted for a furnished unit cannot automatically validate an unfurnished unit, and a premium tower cannot validate an older building nearby. If the evidence is thin or stale, widen the downside range rather than treating an estimate as fact.
Model the exit
Estimate a sale price from comparable completed transactions, then deduct brokerage, legal and documentation costs, taxes and any loan balance. Allow for the time required to find a buyer and complete transfer. An attractive paper gain can disappear after years of vacancy, interest, repairs and selling costs.

| Scenario | Assumptions to stress | Decision question |
|---|---|---|
| Base case | Evidence-supported purchase price, rent, vacancy, financing, costs and sale timing. | Does the investment meet the objective under reasonable assumptions? |
| Downside case | Delayed possession, lower rent, longer vacancy, higher financing cost, larger repairs or slower resale. | Can you fund the property without breaching your cash and debt limits? |
| Severe but plausible case | Several adverse factors occur together, such as delay plus rent weakness and a lower sale price. | Would you still be able to hold, or must you sell into a weak market? |
For an under-construction purchase, put every instalment on its expected date and add a delay period with no rent. For a land purchase, model zero operating income unless a lawful, documented income source exists. Do not use a national rental-yield or appreciation figure as a substitute for local evidence; no national figure establishes the outcome for a particular property.
Best Value
Calculate taxes and transaction charges for the actual deal
Stamp duty and registration rates are not one national number. They depend on the state or Union territory, property location, document, consideration or assessed value, and sometimes the parties’ status or concessions. Check the current local schedule before signing and budget for changes that apply to the exact instrument.
Tax treatment also depends on facts such as the asset, holding period, ownership structure, residency, financing, rental income and sale. Check current Income Tax Department guidance and obtain transaction-specific advice rather than copying a rate from an old article.
Special care when the seller is non-resident
Income Tax Department Form 141 guidance accessed on 13 October 2026 describes a procedure under section 393(2) for resident individual or Hindu Undivided Family buyers purchasing immovable property from a non-resident seller, with a change effective 1 October 2026. The buyer’s obligations depend on the exact transaction and current law. Confirm the applicable form, withholding, identification details, payment timing and filings with a tax professional before transferring funds.
Keep a transaction file
- Signed agreement, invoices, payment proofs and loan documents.
- Stamp-duty and registration receipts.
- Tax deduction, withholding and filing records where applicable.
- Possession, completion, association and maintenance documents.
- Comparable evidence and the dated assumptions used in your model.
Compare income, control and liquidity before choosing a REIT
A listed REIT can avoid the single-parcel concentration and day-to-day ownership work of direct property, but it is not a deposit or a guaranteed-income product. Review the current portfolio and filings for occupancy, tenant and sector concentration, lease maturity, valuation, debt, fees, distributions, related-party transactions and trading volume. Check how much of the portfolio is in the locations and asset types you actually want.
Unit prices can fall because of interest rates, market sentiment, leverage, vacancy or concerns about future distributions, even when a building remains occupied. Conversely, a direct property may appear stable simply because it is not quoted every day; that does not make it risk-free or liquid. Compare the cash you need, the time you can hold, the control you require and the exit you can realistically execute.
Set walk-away rules and complete final checks
Write the investment thesis in one page: what you are buying, why the location and asset should meet demand, how much cash is required, what return or income you need, and how you will exit. Attach the evidence, assumptions, unresolved questions and the date each item was checked.
Quick Recap
Walk away or pause when
- The seller cannot prove authority or the title chain contains an unresolved gap.
- An encumbrance, litigation, acquisition notice or land-use problem is not cleared in writing.
- Required approvals, sanctioned plans or RERA project details do not match the sale material.
- The promised completion date is unsupported, materially delayed or dependent on an approval not yet obtained.
- Rent, vacancy or resale assumptions work only at an optimistic estimate.
- Financing costs, staged payments or maintenance exceed your cash reserve.
- The exit depends on a buyer, conversion or development permission that has not been demonstrated.
- The investment no longer meets your objective after taxes, duties, vacancy, repairs and selling costs.
Final pre-commitment sequence
- Obtain independent legal title, encumbrance, land-use and approval advice for the exact parcel or unit.
- Verify the relevant RERA registration and disclosures if the project is covered.
- Reconcile the contract, payment schedule and promised specifications with the verified records.
- Refresh local sale and rent comparables and rerun base, downside and severe scenarios.
- Confirm current stamp duty, registration, tax and any non-resident-seller procedures.
- Check that the loan, reserve and exit plan remain affordable if the adverse case occurs.
- Record the facts that would change your decision and make payment only after those checks are resolved.
