Verify retention, training use, sharing, storage location, access controls, security, contracts and deletion; test the tool on representative work; assign a qualified human reviewer; and record conditions for use and re-evaluation. The practitioner—not the software—remains responsible for competent, confidential and accurate work.
What client trust requires from an AI evaluation
“Trust” is not a single security feature. It is the combination of confidentiality, competent service, explainable decisions, reliable outputs and accountability when something goes wrong. An AI assistant that is technically secure may still be unsuitable if its contract permits broad training use, if it produces unverifiable work, or if no one is empowered to reject its output.

Professional obligations vary by country, regulator, contract and data category. A legal practice, accounting firm, consultancy, clinic or agency should therefore evaluate a specific workflow rather than approve “AI” in the abstract. A tool might be acceptable for brainstorming with public information and prohibited for drafting advice from confidential client files.
Recommended Free Tools
The Singapore Ministry of Law’s Guide for Using Generative AI in the Legal Sector, published March 6, 2026, captures the procurement standard: “Selecting the right tool requires proper and thorough due diligence to ensure that the tool is secure, reliable, and suitable for legal work.” The same logic applies to other professional services, subject to their own rules.

1. Define the use case and its boundaries
Write a one-page use-case statement before speaking with a vendor. It should identify the work, users, information, outputs and decisions affected. Vague goals such as “use AI to improve productivity” cannot produce a meaningful risk or quality assessment.
Describe the work precisely
- Task: for example, summarize a supplied interview transcript, classify incoming support requests, create a first-pass contract clause comparison, or draft an internal project outline.
- Users: name the roles allowed to use the system, their training level and whether contractors or clients can access it.
- Inputs: list personal data, privileged material, trade secrets, regulated records, source documents, images and metadata that may be uploaded or entered.
- Outputs: state whether results are internal notes, client-facing communications, filings, calculations, recommendations or decisions.
- Consequences: identify what could happen if an answer is wrong, incomplete, biased, late or disclosed.
- Human check: specify what a competent reviewer must verify before anyone relies on the result.
Set boundaries in operational language. “Do not upload client-identifying information” is weaker than “Only de-identified text from matters tagged ‘training-approved’ may be submitted; privileged documents and health records are excluded.” Define whether the tool may quote, transform, rank, recommend or make a decision. A drafting assistant and an automated eligibility decision need different controls.
Set acceptance criteria before testing
Choose measurable thresholds that match the task. Examples include factual accuracy against a checked answer key, citation correctness, required-field recall, consistency across repeated runs, maximum acceptable hallucination rate, formatting compliance and time saved after human review. Record which errors are tolerable and which are automatic disqualifiers. For a client-facing deliverable, one fabricated authority or invented figure may be unacceptable even if the average answer looks polished.
2. Map prompts, files and outputs through the service
Request written answers for the exact product, region, account type and configuration under consideration. Marketing pages often describe a family of services; the terms and controls can differ between consumer, team, enterprise, hosted and self-managed deployments.
Questions to ask the vendor
- Are prompts, uploaded files, conversation history, generated outputs and diagnostic logs retained? State the retention period for each and whether administrators can change it.
- Are inputs or outputs used to train, fine-tune or improve models? Can that use be disabled by default and contractually prohibited?
- Can one customer’s information influence responses shown to another customer?
- Where are data stored and processed? Identify countries, cloud providers, backup locations and any cross-border transfer mechanism.
- Which vendor staff, subprocessors and support personnel can access content? What role-based, least-privilege and authentication controls apply?
- How are encryption, key management, vulnerability handling, security testing and breach notification managed?
- What deletion options exist for individual items, accounts, backups and derived data? How is deletion verified after termination?
- What happens to data during an outage, legal demand, account suspension or vendor acquisition?
The Singapore guide specifically highlights training use, prompt and input retention, storage location and jurisdiction, and access controls. Florida Bar Opinion 24-1 directs lawyers to investigate retention, sharing and self-learning policies. D.C. Bar guidance asks whether information is saved or affects future answers. Treat an unanswered question as an unresolved risk, not as an implied “no.”
Classify information before it reaches a model
Create an input policy with categories such as public, internal, confidential, personal, privileged, regulated and restricted by contract. For each category, state whether it is allowed, allowed only in a separately approved environment, or prohibited. Include practical controls: redaction, pseudonymization, removal of account numbers, disabling history, approved connectors and a rule against pasting whole case files into an unapproved chat window.

De-identification is not automatically safe. Rare facts, dates, combinations of attributes and attached metadata can re-identify a person. Keep the original-to-redacted mapping outside the AI service, and test whether the remaining text still exposes a client.
3. Confirm the exact tier, deployment and contract
Do not approve a vendor on the strength of a product name. Record the edition, model, region, hosting arrangement, enabled features, administrator settings and effective terms. A consumer agreement may allow data practices or dispute terms that are unsuitable for professional work; enterprise terms can provide different commitments. The Law Society of Ireland’s vendor assessment resource warns that consumer agreements may not provide protections required in professional practice.
Contract terms that deserve specialist review
| Area | What to verify | Evidence to retain |
|---|---|---|
| Confidentiality | Content is treated as confidential and used only to provide the contracted service. | Signed agreement, data-processing addendum and confidentiality schedule. |
| Training and improvement | Customer content is excluded from training or improvement unless an expressly approved exception applies. | Specific clause and administrator setting, not a general marketing statement. |
| Data location | Storage, processing, backups and support access fit client, regulator and transfer requirements. | Region list, subprocessor register and transfer mechanism. |
| Security | Controls, audit reports, incident response and notification deadlines are defined. | Current assurance report, security schedule and incident procedure. |
| Availability and support | Service levels, maintenance notices, support response and remedies match the workflow’s importance. | SLA, support plan and escalation contacts. |
| Change management | Material model, feature, policy or subprocessor changes trigger notice and a reassessment right. | Notice clause and version-monitoring process. |
| Subcontracting | Subprocessors are disclosed, bound to equivalent duties and subject to objection or termination rights where appropriate. | Current subprocessor list and contract language. |
| Exit | You can export needed records, delete content and terminate without losing client work or audit evidence. | Export format, deletion certificate process and termination terms. |
Have privacy, information-security, procurement and professional-ethics specialists review terms proportionate to the risk. A contract cannot cure a workflow that sends prohibited data to the wrong environment, and a strong technical control cannot override a client agreement that forbids a particular processor.
4. Test performance and failure modes on representative work
Demonstrations are not validation. Build a test set from real task patterns, but protect it through de-identification, synthetic records or an approved secure environment. Include ordinary examples, ambiguous requests, incomplete records, adversarial prompts, unusual formatting, multilingual material and cases where the correct response is “I do not have enough information.”
Measure what matters to the practitioner
- Accuracy: compare claims, calculations, classifications and extracted fields with a verified reference.
- Completeness: check whether required issues, exceptions, citations or fields are omitted.
- Traceability: determine whether a reviewer can locate the source passage for each material assertion.
- Consistency: repeat equivalent prompts and record materially different answers.
- Robustness: vary wording, document order and formatting to expose brittle behavior.
- Safety: test prompt injection, unauthorized disclosure, unsafe advice and attempts to bypass role restrictions.
- Human effort: measure review and correction time, not just the speed of first-draft generation.
For legal research or drafting, independently verify every authority, quotation and citation. D.C. Bar guidance recounts fabricated legal citations and warns that general-purpose systems are not substitutes for traditional fact- and cite-checking. In other fields, apply the equivalent discipline: reconcile financial figures to source records, validate clinical or technical claims against authoritative references, and have the responsible professional approve the final work.
Use a scored test record
For each test item, save the input version, model and settings, output, reviewer corrections, severity of each error and pass/fail decision. Separate harmless style edits from errors that could mislead a client or breach a rule. Report results by task and risk category; an overall average can hide a catastrophic failure mode. Re-test after a material model, prompt, connector or policy change.

5. Preserve professional judgment and client communication
AI assistance does not transfer responsibility. Florida Bar Opinion 24-1 states: “Lawyers remain responsible for their work product and professional judgment.” The same principle applies to other licensed or fiduciary professionals: the accountable practitioner must understand the work, supervise the system and be able to explain the final result.
Decide when disclosure is required or prudent. Client agreements, regulator rules, court requirements and the sensitivity of the task may require notice, consent or a prohibition on external processing. Do not claim that a human “reviewed” an output unless the reviewer had enough time, expertise and source access to perform a meaningful check.
Define reviewer authority
- Name the role that can approve, reject, correct or escalate an output.
- Require source verification for material facts, calculations, citations and recommendations.
- Prevent the system from sending client communications or making consequential decisions without an approved human action.
- Keep an audit trail of the prompt or source set, output, edits, approver and delivery date when the task warrants it.
- Provide a route for reporting suspected disclosure, bias, fabrication, security incidents or policy violations.
6. Assess operational and governance fit
A technically capable model can fail as a professional service if it cannot fit existing systems or be maintained responsibly. Assess compatibility with identity management, document repositories, billing or case systems, records retention, accessibility requirements and export formats. Check capacity limits, latency, rate limits, regional availability and the effect of outages on deadlines.

- Who owns the approval, budget, configuration, user training and periodic review?
- What documentation explains permitted uses, prohibited inputs, prompts, review steps and escalation contacts?
- How are new users trained and how is access removed when someone changes role?
- Which logs are retained, who can inspect them and how are they protected from becoming a second sensitive dataset?
- How will incidents, complaints, model drift and material vendor changes be investigated?
- What evidence is supplied to auditors, clients, regulators or insurers when requested?
U.S. government CMS guidance recommends documenting use and evaluation activities, validating third-party outputs, and maintaining monitoring and accountability. UK procurement guidance includes transparency, accountability, independent audits and knowledge transfer. Use these as governance prompts, then adapt them to the profession and jurisdiction.
7. Compare alternatives with one decision matrix
When evaluating multiple services, score the same criteria for the exact configuration rather than comparing brand reputations. A useful matrix makes a “not stated” answer visible instead of allowing an assumption.
| Criterion | Evidence to compare | Decision question |
|---|---|---|
| Task fit | Supported inputs, integrations, controls and tested results for the defined workflow. | Does it meet the acceptance threshold without unacceptable workarounds? |
| Data handling | Retention, training use, sharing, deletion, storage and processing jurisdictions. | Can the permitted data category be used lawfully and contractually? |
| Access and security | Identity controls, roles, encryption, logs, incident response and administrator settings. | Can access be limited, detected and revoked? |
| Output risk | Error rates, edge-case behavior, traceability and reviewer workload. | Are serious errors detectable before delivery? |
| Operational fit | Compatibility, scale, availability, support, maintenance and accessibility. | Will the workflow remain usable under normal and failure conditions? |
| Contract and exit | Confidentiality, service levels, change notice, subprocessors, export and deletion. | Can the organization enforce duties and leave safely? |
| Governance | Training, ownership, records, monitoring, auditability and incident routes. | Is there a named accountable owner throughout the lifecycle? |
Record “not stated” where the vendor has not supplied evidence. Do not convert an absence of information into a favorable score.

8. Make a conditional decision and document it
A decision record should be specific enough that another reviewer can reproduce it. Include:
- The approved task, users, deployment, model or version and geographic scope.
- Allowed, restricted and prohibited information categories.
- Contract terms and technical settings relied upon.
- Test set, acceptance criteria, results, serious failures and reviewer corrections.
- Required human approvals, source checks, disclosures and record-keeping.
- Unresolved risks, compensating controls and the person who accepted them.
- Triggers for suspension, such as a breach, material terms change, model change, repeated errors or a new data category.
- The next review date and owner.
The NIST AI Risk Management Framework is a voluntary framework for incorporating trustworthiness considerations into AI design, development, use and evaluation. It can structure this record, but it does not replace a professional regulator’s rules, a client contract or a legal determination.
Common failure modes and practical fixes
“The vendor says data is private.”
Ask what “private” means for retention, training, support access, subprocessors, backups and jurisdiction. Require product-specific contractual language and verify the corresponding settings.
“The enterprise label guarantees safety.”
Enterprise packaging is not a universal certification. Assess the actual tier, region, enabled connectors and administrator configuration, then test the controls.
“The model scored well in a generic benchmark.”
Generic scores rarely predict performance on a firm’s documents, terminology or professional standard. Use representative tasks and an independently checked answer key.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
“A quick human glance is enough.”
Assign a reviewer with relevant expertise, source access and authority to reject the result. Measure correction time and require verification of high-impact claims.
Best Value
“We can fix governance later.”
Without an owner, input policy, logging and an incident route, use expands informally and becomes difficult to audit. Approve a narrow workflow first and set the controls before rollout.
“One approval covers every department.”
Different tasks and data categories create different risks. Scope approvals by workflow, user group, deployment and jurisdiction, and re-evaluate when any of those changes.
What professional-services respondents identified as barriers
Thomson Reuters Institute’s 2024 professional-services report recorded these concerns among its respondents. They are survey findings from that report, not universal rates or current 2026 estimates.
Free tools Windows power users keep installed

| Concern | Share of respondents |
|---|---|
| Potential for inaccurate responses | 70% — Thomson Reuters Institute, 2024 |
| Concerns about data security | 68% — Thomson Reuters Institute, 2024 |
| Privacy and confidentiality of information entered into tools | 62% — Thomson Reuters Institute, 2024 |
| Complying with relevant laws and regulations | 60% — Thomson Reuters Institute, 2024 |
| Ensuring ethical and responsible use | 57% — Thomson Reuters Institute, 2024 |
These concerns map directly to the evaluation sequence: test accuracy, verify data handling, obtain appropriate contract terms and assign ongoing accountability.
Account for jurisdiction, profession and changing terms
The available guidance spans a 2026 Singapore legal-sector guide, Florida and D.C. legal ethics opinions, Ireland-focused professional materials, U.S. government guidance, UK procurement guidance, a voluntary NIST framework and a 2024 survey. None establishes one rule for every country or profession.
Before approval, identify the governing regulator, client-imposed restrictions, cross-border requirements, privilege or secrecy duties, records rules and insurance conditions. Recheck the vendor’s current contract and documentation because retention settings, model behavior, subprocessors and geographic availability can change. Keep dated copies of the terms and test evidence that supported the decision.
When to say no
Decline or pause the deployment when the vendor will not explain material data practices, the contract permits an unacceptable use of client information, the service cannot meet location or deletion requirements, serious test failures are not reliably detectable, or no qualified person can supervise the output. A slower manual process is preferable to an opaque system that creates an unmanageable confidentiality or competence risk.
