Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteThe safest way to evaluate an AI tool for healthcare marketing or patient engagement is to assess the exact workflow—not the product’s label. Define what the system does, who uses it, what data it receives, what it produces, and which decisions it can influence. Then trace the data, analyze HIPAA and FTC implications, test performance with the intended population, verify human oversight, and require evidence from the vendor before deployment.
This is U.S.-focused procurement guidance. It does not determine whether a particular product, contract, or deployment complies with federal or state law. Have qualified privacy, security, and legal staff review the final workflow and agreement.

Start with the exact use case
“AI for healthcare marketing” can describe very different systems. A tool that drafts an email from staff-written content presents a different risk profile from a chatbot that answers patient questions, selects audiences using health information, or recommends a clinical action. Treating all of these as one category leads to incomplete reviews.

| Example use | Typical output | Questions that change the review |
|---|---|---|
| Content drafting | Draft web copy, email text, or social posts for staff approval | Does any patient information enter the prompt? Can the system publish automatically? Is generated copy checked for unsupported health claims? |
| Audience selection | A list of patients or prospects for a campaign | Which attributes determine inclusion? Are they identifiable or protected health information (PHI)? What purpose and permission support the communication? |
| Personalized messaging | A message adjusted to an individual’s history, preferences, or care status | What information is used, who sees it, whether authorization is required, and how opt-outs and preferences are enforced? |
| Patient engagement chatbot | Answers about services, policies, appointments, or next steps | Can it identify a patient? Does it handle PHI? What happens when a question is urgent, ambiguous, or clinical? |
| Scheduling or navigation | Appointment options, reminders, or routing to staff | Can the system change or cancel care? Is information disclosed to the right person? What is the escalation path when no suitable slot exists? |
| Clinical recommendation | A suggestion that could influence diagnosis, treatment, or triage | Is the product’s function potentially within FDA digital-health or device-related guidance? What clinical governance and validation are required? |
Record the intended users, patient population, communication channels, geographic scope, and operating hours. Identify every decision the system may influence, even if a person is supposed to approve the final output. Set prohibited uses explicitly—for example, no autonomous clinical advice, no use of sensitive attributes for an unapproved campaign, or no publication without human review.
Map every data flow before discussing compliance
Ask for a diagram showing data entering the tool, processing inside the vendor environment, transfers to subprocessors, storage locations, outputs, logs, and deletion points. A generic “HIPAA compliant” statement does not tell you what actually happens to a patient record.
Inventory inputs and identifiability
- List each input category: names, contact details, appointment information, diagnoses, treatment history, insurance details, demographic attributes, preferences, conversation transcripts, device data, and free-text notes.
- Mark whether each field is PHI, directly identifying, pseudonymous, aggregated, or still linkable to an individual.
- Document whether prompts, uploaded files, chat transcripts, analytics events, and support tickets can be tied back to a person.
- Separate information needed for the stated task from optional fields. Apply the minimum-necessary principle where applicable.
Trace access, retention, and reuse
- Who can view raw inputs, generated outputs, audit logs, and support records?
- Which vendor employees, contractors, subprocessors, and model providers can access them?
- How long are inputs, outputs, backups, and logs retained, and can your organization set shorter periods?
- Can the vendor use your data to train, fine-tune, evaluate, or improve a general model? Is that use disabled by contract and by configuration?
- What deletion method applies when an account closes or a record-retention period ends, including copies held by subprocessors?
Confirm contractual roles
Determine your organization’s HIPAA role and the vendor’s role for each workflow. Where the arrangement involves a covered entity or business associate handling PHI, review whether a business-associate agreement and appropriate contractual limits are required. Do not assume that a platform’s terms automatically establish the correct legal relationship. Have counsel reconcile the data-flow diagram, service agreement, privacy terms, security addendum, and any business-associate agreement.
Analyze whether a communication is HIPAA marketing
HHS describes HIPAA marketing as a communication about a product or service that encourages recipients to purchase or use it. In general, use or disclosure of PHI for marketing requires the individual’s authorization, subject to specified exceptions. The analysis depends on the communication’s purpose and the information used or disclosed; it is not resolved by calling a feature “patient engagement.”
Separate marketing from related communications
HHS distinguishes marketing from certain communications about a covered entity’s own health-related services, treatment, and care coordination. Appointment reminders, care instructions, and navigation may fall into different categories depending on their content, purpose, sender, and funding. Do not assume that every reminder is exempt, or that every patient-facing message requires authorization. Document the facts for the proposed workflow and obtain a legal determination where the line is unclear.
Review the message and the audience-selection logic together
A message can look like ordinary education while the selection process uses PHI to identify people for a service promotion. Review both the words delivered and the data used to choose recipients. For each campaign or automated journey, document:
- The purpose and sponsor of the communication.
- The health information or inferred attributes used to select or personalize recipients.
- The channel, sender identity, frequency, and any payment or third-party involvement.
- Whether an authorization is required, how it is obtained, and how it is recorded.
- How revocations, opt-outs, communication preferences, and wrong-number or wrong-address events stop future messages.
- What the system does when a person asks why they received a message or requests correction.
Do not rely on a certification slogan
There is no substitute for reviewing the actual workflow, contract, settings, and controls. Ask the vendor to explain how its product supports authorization records, purpose limits, audience rules, and auditability. Treat “HIPAA compliant” as a claim to verify, not as evidence that your proposed use is permitted.

Apply FTC standards to consumer-facing health data practices
HIPAA is not the only privacy screen. HHS guidance on consumer health information explains that the FTC Act can reach deceptive or unfair health-data practices, including practices by businesses that are not HIPAA-covered entities. A vendor or healthcare organization can create risk through a misleading notice, an undisclosed secondary use, weak safeguards, or a consent flow that does not match what the system actually does.
Inspect the patient experience
- Read the notice shown before a person starts a chat, submits a form, or receives personalization.
- State what information is collected, why it is needed, how long it is retained, who receives it, and whether it is used for model improvement.
- Make consent language specific enough that a person can understand the consequence of proceeding.
- Provide a practical opt-out or preference-management path where applicable, and ensure it reaches every connected system.
- Do not imply that a system is anonymous if records, identifiers, IP addresses, or conversation histories can be linked back to a person.
Test safeguards and review them periodically
Check access controls, authentication, encryption, logging, incident response, vendor oversight, and change-management practices. HHS emphasizes robust safeguards and periodic review of health-data practices. A privacy notice that was accurate at launch can become misleading after a new model, analytics service, subprocessor, or retention setting is introduced.
Use the NIST AI RMF as a lifecycle structure
The National Institute of Standards and Technology (NIST) AI Risk Management Framework is voluntary. Released January 26, 2023, it is intended to help organizations incorporate trustworthiness considerations into AI design, development, use, and evaluation. Its companion Playbook suggests actions under four functions: Govern, Map, Measure, and Manage. It is a risk-management structure, not a product certification or legal safe harbor.
| Function | What to establish | Evidence to request or create |
|---|---|---|
| Govern | Ownership, policies, accountability, escalation, and decision rights | Named risk owner; approved intended-use statement; prohibited-use list; review and incident procedures; staff training records |
| Map | Context, affected people, data, impacts, and operating conditions | Data-flow diagram; population and channel description; stakeholder analysis; foreseeable misuse and failure modes |
| Measure | Performance, safety, privacy, security, and fairness signals | Evaluation design; representative test data; error analysis; subgroup results where relevant; privacy and security test results; monitoring metrics |
| Manage | Mitigations, deployment decisions, monitoring, and response to change | Risk register; controls and owners; human-review rules; rollback process; incident playbook; update and drift reviews |
Use the four functions across the system’s entire lifecycle. A passing pre-launch test does not eliminate the need to monitor changes, complaints, unexpected outputs, and population shifts after deployment.

Procurement should produce verifiable answers rather than a collection of marketing claims. Ask for the following and record whether each item is complete, conditional, or unavailable.
Data-use and contract evidence
- Current data-flow and architecture diagrams, including subprocessors and model providers.
- Contract language covering purpose limitation, PHI handling, retention, deletion, confidentiality, and training or model-improvement use.
- Business-associate documentation where applicable, with responsibilities aligned to the actual service.
- Configuration options for access, retention, export, deletion, and communication preferences.
- Notice of material changes to terms, subprocessors, models, or data practices.
Performance and safety evidence
- A description of the evaluation method, test population, data provenance, and operating conditions.
- Known limitations, failure modes, false positives, false negatives, hallucination controls, and examples of unacceptable output.
- Results relevant to your intended language, channel, patient population, and workflow rather than a generic benchmark.
- Subgroup analysis where differences in performance could affect access, communication, or safety.
- Post-deployment monitoring, complaint handling, drift detection, and thresholds that trigger review or rollback.
Human oversight and operations
- Which outputs require review before reaching a patient and which, if any, can be sent automatically?
- How can staff override, correct, pause, or delete an output?
- How are urgent, sensitive, ambiguous, or out-of-scope questions escalated?
- What audit records show the input, output, reviewer, approval, edits, and delivery status?
- How are security incidents, harmful messages, model changes, and service outages communicated?
These are procurement questions derived from privacy and risk-management principles; they are not a claim that one regulator requires every named document in every transaction.
Test the system before patients see it
Run a controlled evaluation using realistic, approved examples. Do not upload live PHI to a trial environment unless the data use, safeguards, and agreement permit it.

- Add boundary cases. Test requests for diagnosis or treatment, urgent symptoms, self-harm or abuse disclosures, identity mismatches, requests from unauthorized people, and attempts to obtain another patient’s information.
- Check factual and policy accuracy. Compare answers with approved service descriptions, hours, eligibility rules, and escalation scripts. Record unsupported claims and omissions.
- Verify privacy behavior. Confirm that the system does not reveal information from another conversation, expose hidden prompts or internal notes, or continue messaging after an opt-out.
- Measure human-review workload. Record how often staff must edit, reject, or escalate outputs and whether the review queue is practical at expected volume.
- Document results and approval criteria. Keep test cases, outputs, reviewers, decisions, and remediation owners. Do not deploy while critical failure modes remain unresolved.
Design patient communications with human accountability
Every patient-facing workflow needs a named owner who can stop it. Define which staff role reviews content, who handles complaints, who answers privacy questions, and who can disable a campaign or chatbot during an incident.
Use clear boundaries in the interface. A chatbot that provides service information should not imply that it has reviewed a medical record or made a clinical judgment. If a conversation could involve urgent symptoms or clinical decisions, provide an obvious route to qualified staff or emergency guidance appropriate to the organization’s policy. Log the escalation and verify that it reaches a monitored destination.
For marketing messages, maintain a suppression list or equivalent preference control that is synchronized across campaign, customer-service, and messaging systems. Test the control with new numbers, shared contact details, bounced addresses, and revoked authorizations.
Review security and resilience as operational requirements
Marketing and engagement systems often connect to customer-relationship platforms, electronic health-record interfaces, analytics tools, email services, and call-center software. Each connection expands the possible exposure and failure surface.
- Use role-based access and strong authentication, with separate privileges for campaign creation, data export, template editing, and approval.
- Keep audit logs that support investigation without retaining more sensitive content than necessary.
- Define backup, recovery, outage, and manual-workaround procedures for reminders, scheduling, and patient support.
- Test what happens when an integration sends stale, duplicated, or misidentified data.
- Require a documented incident-notification process and clear responsibilities for containment, investigation, patient communication, and regulatory reporting.
- Review model and software updates before they reach production, including changes to prompts, retrieval sources, safety filters, subprocessors, and retention behavior.
Decide whether FDA materials are relevant
FDA relevance depends on the product’s function and intended use, not simply on the presence of AI. Ordinary copywriting, campaign scheduling, or service-information software is not automatically evaluated under guidance intended for clinical or regulatory functions.
The FDA’s January 2025 document, “Considerations for the Use of Artificial Intelligence To Support Regulatory Decision-Making for Drug and Biological Products,” presents a risk-based credibility assessment for a model used in a particular context of use. It is a draft, contains non-binding recommendations, and is expressly not for implementation. It should not be treated as a universal standard for healthcare marketing tools.
For products that make or support clinical, diagnostic, treatment, triage, or device-related decisions, review the FDA’s current digital-health guidance index and conduct a reasoned scope analysis. Document why the material does or does not apply to the specific function. Do not infer FDA status from a vendor’s use of the word “AI.”

Compare vendors on one documented scorecard
If multiple products remain under consideration, score them against the same use case and evidence requirements. A lower score in a critical category should not be hidden by a high marketing or usability score.
| Axis | What to compare | Decision evidence |
|---|---|---|
| Data use and control | Input categories, PHI handling, retention, deletion, training reuse, subprocessors, and purpose limits | Contract terms, configuration screens, data-flow diagram, deletion procedure |
| Privacy and communication controls | Authorization support, consent records, audience selection, opt-outs, preference synchronization, and patient disclosures | Workflow demonstration, sample records, notice text, test results |
| Use-case evidence | Evaluation methods, representative data, limitations, error analysis, subgroup performance, and monitoring | Technical report, test set description, incident history, monitoring plan |
| Human accountability | Review gates, escalation, override, audit records, and ownership for failures | Role matrix, approval workflow, sample audit trail, escalation exercise |
| Security and resilience | Access management, safeguards, incident response, recovery, integration controls, and change management | Security documentation, test reports, recovery plan, notification terms |
| Governance and transparency | Intended use, prohibited use, risk owners, model changes, limitations, and update notices | Product documentation, change log, governance policy, customer notification process |
| Regulatory scope | HIPAA marketing analysis, FTC consumer-health practices, and possible FDA relevance | Written legal and compliance assessment tied to the proposed deployment |
Use a simple status for each requirement—meets, meets with conditions, does not meet, or evidence unavailable—and assign an owner and remediation date for every conditional item. Do not award a pass when the vendor refuses to describe a material data use or cannot explain who can access patient information.

“The vendor says it is HIPAA compliant.”
Why it fails: The phrase does not establish that your message is outside HIPAA’s marketing definition, that your configuration protects PHI, or that the contract assigns the right responsibilities.
Fix: Analyze the communication’s purpose, data, recipients, authorization or exception, contract, settings, and audit trail together.
“We removed names, so the data is anonymous.”
Why it fails: Conversation text, dates, rare conditions, account identifiers, logs, and linked systems can still make a person identifiable.

“FDA guidance covers any healthcare AI.”
Why it fails: FDA materials are scope-specific, and the January 2025 drug and biological-product document is draft and non-binding.

A practical approval sequence
- Write the intended-use statement. Name users, recipients, inputs, outputs, decisions, channels, population, and prohibited uses.
- Map the data. Identify PHI, identifiers, subprocessors, access, retention, training reuse, deletion, and integrations.
- Classify communications. Analyze marketing purpose, authorization needs, exceptions, preferences, and disclosures for each workflow.
- Review consumer representations. Check notices, consent, opt-out behavior, security claims, and secondary-use explanations under FTC principles.
- Assign governance. Use Govern, Map, Measure, and Manage to name owners, risks, tests, mitigations, and monitoring.
- Collect vendor evidence. Obtain contract language, diagrams, evaluation results, security information, incident procedures, and change controls.
- Run boundary testing. Include privacy, identity, urgent, clinical, multilingual, accessibility, and integration-failure cases.
- Approve with conditions or reject. Record unresolved risks, compensating controls, responsible owners, and the trigger for re-review.
- Monitor after launch. Track errors, complaints, opt-outs, incidents, drift, model changes, and changes in the population or workflow.
The strongest decision is sometimes to narrow the use case: for example, allow drafting with mandatory staff approval while prohibiting automated audience selection from PHI, or limit a chatbot to approved service information with immediate escalation for clinical questions. A precise boundary, supported by evidence and ongoing oversight, is more defensible than a broad promise that an AI product is simply “safe” or “compliant.”
