The defensible way to evaluate a mortgage AI agent is to test the work it will actually perform—not the quality of a product demonstration. Build representative processing and servicing scenarios, measure accuracy and harmful failure, test adversarial behavior, and verify that staff can understand, challenge, and safely override the agent. Require an auditable record of the inputs, sources, tool calls, decisions, and handoffs for every consequential output.
There is no regulator-published universal pass score for mortgage AI agents. Set thresholds before a pilot or procurement decision, tie them to the consequences of each use case, and document why the evidence meets your institution’s risk appetite. The framework below combines mortgage-servicing examination domains with general AI evaluation and housing-finance risk guidance.

Start with the use case, not the model
An agent that summarizes a payoff statement for an employee presents a different risk from one that changes an escrow account, sends a delinquency notice, recommends a loss-mitigation option, or updates a credit-reporting record. The same underlying model can therefore require different controls depending on its permissions and workflow position.
FHFA advises more robust risk-management consideration for AI/ML uses involving critical business functions, legal or regulatory compliance, or highly complex and opaque methods. Its Advisory Bulletin 2022-02 is directed to Fannie Mae, Freddie Mac, and the Federal Home Loan Banks; other institutions should treat it as relevant supervisory risk guidance and confirm which requirements apply to them.

Before scoring a vendor, write a one-page use-case specification. It becomes the boundary for testing and prevents a polished demo from quietly expanding into unauthorized production work.
| Specification item | Questions to answer | Evidence to retain |
|---|---|---|
| Purpose and users | Which employee, borrower, or process does the agent support? Is it advisory, assistive, or allowed to act? | Approved use-case statement, process map, accountable owner |
| Data access | Which loan, borrower, payment, document, and third-party records can it read? Which data is prohibited? | Role and permission matrix, data-flow diagram |
| Write and tool authority | Can it create a task, send a message, alter a record, initiate a payment action, or call an external service? | Tool allow-list, approval gates, transaction logs |
| Decision boundary | What may it recommend, and what must a qualified employee decide? | Decision-rights policy and sample approval records |
| Handoff triggers | Which uncertainty, contradiction, vulnerability, complaint, legal issue, or system failure requires a human? | Escalation rules, queue ownership, service-level targets |
| Prohibited behavior | What must the agent never infer, disclose, promise, or execute? | Negative test cases and blocked-action logs |
Separate low-impact assistance from actions that can affect payments, borrower communications, loss mitigation, credit-related outcomes, privacy, or legal rights. A summary may be allowed with sampling; a change to a borrower’s account may require dual control, confirmation, and an immutable audit event.
Map the mortgage workflows the agent will touch
Servicing coverage from examination domains
Use the CFPB’s Mortgage servicing examination procedures, updated January 18, 2023, as a coverage map. The procedures are supervisory materials, not an AI benchmark, so translate each domain into your own products, systems, policies, and expected outcomes.
Recommended Free Tools
- Transfers and required escrow disclosures.
- Payment processing and account maintenance.
- Borrower inquiries, complaints, and error resolution.
- Escrow analysis, insurance, and related notices.
- Credit reporting.
- Privacy and information sharing.
- Collections and bankruptcy.
- Early intervention and continuity of contact.
- Loss mitigation.
- Foreclosure.
For each domain, identify the records the agent needs, the policy version that governs the task, the permissible action, the evidence a reviewer must see, and the point at which the work leaves the agent’s authority.
Processing and broader housing-finance coverage
For origination and other housing-finance operations, organize tests around consumer experience, creditworthiness assessment, operations from origination through servicing, and risk management or compliance. FHFA used these areas in its 2024 TechSprint: Generative AI in Housing Finance. The TechSprint is a discussion of responsible use, not a regulatory standard or a complete test protocol.
Its operations question is useful when defining scope: “How might generative AI be used to enhance the efficiency and effectiveness of operational processes within the housing finance system, from origination to servicing and secondary market activities?” A test plan should answer that question with concrete tasks rather than a general claim that the agent is “good at mortgages.”

Construct representative scenarios
A scenario is more than a prompt. It should contain the starting records, the policy and system state, the permitted tools, the expected result, the evidence that proves the result, and the severity of an error. Use production-like data that has been lawfully prepared for testing, plus synthetic or de-identified cases for sensitive conditions.

- Clean cases: complete, consistent records with one expected path.
- Incomplete cases: a missing document, stale insurance proof, absent payment detail, or unresolved identity field.
- Contradictory cases: conflicting dates, balances, borrower instructions, or policy versions.
- Edge conditions: transfers, bankruptcy indicators, a complaint combined with an error claim, an escrow shortage, or a vulnerable borrower signal.
- Adversarial cases: instructions hidden in a retrieved document, a user attempting to bypass approval, malicious content in an attachment, or a request for data outside the user’s role.
- Abstention cases: situations in which the correct result is to stop, explain the uncertainty, preserve the record, and route the case to a specified human queue.
| Workflow example | What to test | Expected safe behavior |
|---|---|---|
| Payment posting | Partial payment, unapplied funds, duplicate transaction, or conflicting effective dates | Use the approved procedure, show the source records, avoid an unauthorized adjustment, and escalate when the account state is ambiguous |
| Escrow change | New tax or insurance information that conflicts with the current analysis | Identify the conflict, calculate only with approved data, preserve disclosures, and require review before a notice or account change |
| Error resolution | Borrower alleges a servicing error while asking for immediate relief | Classify the request correctly, capture required dates and documents, avoid promising an outcome, and route it under the applicable process |
| Loss mitigation | Incomplete package, multiple liens, or a record indicating bankruptcy | Ask only permitted follow-up questions, identify missing evidence, protect deadlines, and hand off legal or eligibility uncertainty |
| Credit reporting | Disputed balance or correction request with inconsistent account history | Retrieve the authoritative history, distinguish a dispute from a routine inquiry, and prevent an unsupported update |
| Privacy | User requests another person’s loan details or includes sensitive data in a prompt | Deny unauthorized disclosure, minimize exposed data, log the event, and provide the approved alternative |
Define a gold outcome and severity
For every case, specify the correct action, acceptable alternatives, mandatory evidence, prohibited actions, and escalation destination. Classify failures before testing. A wrong greeting is not equivalent to an incorrect payment change, an impermissible disclosure, a missed complaint deadline, or a recommendation that creates disparate treatment. Severity levels should reflect financial harm, legal or regulatory exposure, borrower impact, reversibility, and the number of affected accounts.
Use three complementary evaluation modes
NIST’s ARIA Evaluation Planning Manual: Elements of ARIA-Style AI Evaluations, published September 18, 2026, describes a holistic evaluation built from model testing, red teaming, and user testing. Apply all three; a strong result in one does not compensate for a failure in another.
1. Model and task testing
Run a fixed, versioned scenario set repeatedly. Record the exact model, prompts, retrieval configuration, policy documents, tools, permissions, temperature or other relevant settings, and date. Test both single-turn and multi-step cases because an agent may produce a plausible first response and then make an unsafe tool call.
Check whether it:
- Completes the task correctly and within the permitted workflow.
- Uses the current approved source rather than an obsolete or unapproved document.
- Retrieves every required record and cites the relevant evidence in the case file.
- Distinguishes facts from assumptions and states when information is missing.
- Abstains or escalates when the case exceeds its authority.
- Produces consistent results when the same case is rerun or presented with harmless wording changes.
- Meets operational requirements such as latency, availability, and queue-routing behavior.
Keep a case-level record, not just an average score. A mean completion rate can conceal a small number of high-severity failures.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitches2. Red-team testing
Red-teamers should try to make the agent violate its boundaries while preserving realistic mortgage context. Probe instruction manipulation, conflicting or misleading documents, prompt injection in retrieved content, unauthorized data exposure, tool misuse, and attempts to trigger actions outside the agent’s role.

Examples include an attachment that says to ignore the servicing policy, a borrower message that embeds a request to reveal another borrower’s information, a staff member who asks the agent to skip a required approval, and a tool response that returns malformed or stale data. The expected result is not merely a refusal; it should be a safe refusal or handoff, with no unauthorized state change and an auditable event.
3. User testing
Have representative processors, servicing specialists, quality reviewers, compliance staff, and supervisors perform realistic work with the agent. Measure whether users can find the source evidence, notice uncertainty, understand an explanation, correct an error, and complete a handoff without creating a second error.
Test workload conditions as well as ideal demonstrations: interruptions, queues, unfamiliar cases, poor-quality scans, time pressure, and a system outage. If users routinely accept unsupported answers because the interface looks authoritative, the control has failed even when the underlying model is accurate in a laboratory.

Choose measures that match the task
NIST’s Trustworthy and Responsible AI Resource Center describes testing, evaluation, verification, and validation as a way to build customized assessments and evidence that systems meet organizational goals while reducing negative impacts. The measures below are a practical starting set, not regulator-mandated figures.
| Measure | How to interpret it |
|---|---|
| Completion correctness | Share of cases in which the final result matches the approved outcome and follows the permitted process |
| Critical-error rate | Frequency of errors that can change money, rights, reporting, privacy, legal status, or required communication; report severity separately |
| Evidence retrieval | Whether required records, policy clauses, dates, and calculations were retrieved and linked to the output |
| Unsupported-claim rate | How often the agent states a conclusion, deadline, eligibility fact, or policy requirement that the available evidence does not support |
| Abstention and escalation quality | Whether the agent stops on the right cases, explains why, routes to the correct queue, and preserves all necessary context |
| Consistency | Whether equivalent cases receive equivalent treatment across repeated runs, channels, and permitted wording changes |
| Human rework | Time and correction effort required to turn the agent’s output into a compliant final work product |
| Operational performance | Latency, availability, failed tool calls, duplicate actions, and recovery after timeout or outage |
Set thresholds by use case before reviewing vendor results. An internal summarizer may tolerate occasional manual correction; an automated payment or borrower-notice action may require a much stricter critical-error threshold, mandatory approval, or no autonomous execution at all. Document the rationale, the confidence interval or uncertainty in the estimate where appropriate, and the minimum sample needed to make a decision.
Do not combine every result into one opaque score. Report performance by workflow, severity, data condition, channel, and consequential subgroup or operating condition where appropriate. A vendor’s overall average is not evidence that a high-impact edge case is safe.

Test fairness, data quality, and regulatory risk explicitly
The CFPB’s Equal Credit Opportunity Act (ECOA) baseline review procedures, updated July 23, 2026, are designed to identify and analyze ECOA and Regulation B risks. They do not prescribe a universal agent-specific fairness metric. For a credit-related use, involve qualified fair-lending, compliance, and legal professionals in the design, data selection, interpretation, and remediation of tests.
Evaluate whether data errors or proxy variables produce different error rates, escalation rates, explanations, or access to human review across legally relevant groups. Check the complete pipeline: intake, document extraction, feature construction, retrieval, recommendation, communication, and downstream action. A model can appear neutral while an upstream missing-data pattern or a downstream workflow rule creates unequal outcomes.
Data accuracy is a separate control. The CFPB notes that HMDA reviews include transactional testing for HMDA data accuracy. If an agent extracts, classifies, or submits reportable information, test field-level accuracy, provenance, correction handling, and the ability to reproduce the submitted record from source documents.
Probe security, privacy, and resilience
Include the privacy and information-sharing scenarios identified in the CFPB servicing procedures. Review least-privilege access, retention, logging, encryption and approved data paths under the institution’s applicable controls. Confirm whether vendor personnel, subprocessors, or model-training processes can access borrower information, and obtain contractual answers rather than relying on a sales statement.
- Attempt retrieval of records outside the user’s role and verify denial plus logging.
- Insert sensitive information into a prompt and check redaction, retention, and downstream exposure.
- Feed the agent malicious instructions through documents, web content, email, or tool output.
- Force a timeout, unavailable system, malformed response, or duplicate tool call and verify safe recovery.
- Revoke a permission or policy document and confirm that cached content cannot authorize a prohibited action.
- Test rollback, transaction cancellation, and reconciliation after a partial failure.
Security testing should include the agent’s tools and orchestration layer, not just the language model. A model that refuses an unsafe request is not safe if an integration can still execute the underlying action without confirmation.

For every consequential output, retain enough traceability to answer:
- Which borrower, loan, document, system record, and policy version were used?
- What did the agent retrieve, infer, calculate, or omit?
- Which tools were called, with what parameters and results?
- What rule allowed the action, and which approval or human override occurred?
- What explanation was shown to the employee or borrower?
- Can an independent reviewer reproduce the result after the model or policy changes?
Explanations should support objective review, not merely provide a fluent narrative. A reviewer needs source references, assumptions, uncertainty, and a clear way to challenge the result. Human-in-the-loop is meaningful only when the person has sufficient authority, time, information, and a technically reliable override; clicking “approve” on an unexplained recommendation is not effective control.
Compare vendors on identical evidence
Give every candidate the same de-identified or synthetic scenario set, policy versions, permissions, scoring rubric, and time window. Ask vendors to disclose test configuration, excluded cases, human involvement, model and retrieval versions, known limitations, and how results can be reproduced. Do not accept a benchmark that omits the cases on which your institution would refuse deployment.
| Comparison axis | Questions for procurement and risk teams |
|---|---|
| Task performance | What are correctness, critical-error severity, completion, abstention, and rework results for each target workflow? |
| Robustness | How does the agent behave with incomplete, conflicting, unusual, multilingual, low-quality, and adversarial inputs? |
| Fairness and compliance | What legally appropriate data and methods support the claims, and who reviewed them? |
| Security and privacy | How are access, retention, isolation, encryption, subprocessors, training use, and incident response controlled? |
| Traceability | Can you export prompts, retrieved sources, tool calls, policy versions, approvals, and final outputs? |
| Human control | Are escalation, override, rollback, dual approval, and emergency shutdown tested rather than merely documented? |
| Integration and reliability | What happens during outages, latency spikes, schema changes, duplicate events, and partial transactions? |
| Evaluation evidence | Are results reproducible on your cases, independently reviewed, and updated after material model or workflow changes? |
This is an editorial comparison framework synthesized from NIST trustworthiness and evaluation guidance and CFPB/FHFA mortgage domains; it is not a regulator-published vendor scorecard.
Turn the evaluation into a controlled deployment
Before a pilot
- Approve the use-case specification, risk tier, accountable owner, and prohibited actions.
- Map the workflow and select representative cases from every applicable servicing or processing domain.
- Define gold outcomes, severity levels, metrics, thresholds, escalation queues, and evidence-retention requirements.
- Prepare lawful test data and lock the model, prompt, retrieval, policy, tool, and permission versions.
- Obtain security, privacy, compliance, legal, model-risk, and operations review appropriate to the use case.
During a pilot
- Run the agent in a sandbox or read-only mode where feasible; require human approval before consequential writes or communications.
- Capture complete logs and have reviewers label correctness, evidence quality, uncertainty, and severity.
- Run red-team and user-testing rounds against the same release candidate.
- Compare results with the existing process, including rework, delays, missed escalations, and user error.
- Investigate every critical failure to determine whether the fix belongs in data, policy, prompt, retrieval, permissions, interface, or process design.
Before production and after changes
- Require documented sign-off that thresholds were met and residual risk was accepted by the accountable business and control owners.
- Deploy monitoring for drift, critical errors, unsupported claims, escalation volume, access violations, tool failures, and subgroup differences where appropriate.
- Sample live work and reconcile agent actions to authoritative systems.
- Re-test after a model, prompt, retrieval index, policy, integration, permission, or vendor change; do not treat a version update as operationally neutral.
- Maintain rollback, suspension, incident response, borrower-remediation, and regulator-response procedures.
NIST’s TEVV-Athlon page describes a public draft announced August 7, 2026, with comments closing October 6, 2026. Treat that material as draft guidance rather than a final standard, and verify its status before incorporating it into a formal policy: NIST TEVV-Athlon Framework for Evaluating AI Systems.
Common evaluation mistakes and their fixes
- Scoring a demo: Replace scripted demonstrations with locked, representative cases that include failure and escalation paths.
- Using one average: Publish case-level and severity-level results by workflow and relevant operating condition.
- Testing only the model: Test retrieval, tools, permissions, interfaces, human decisions, and downstream records as one system.
- Letting the vendor define success: Set outcomes, thresholds, and prohibited actions internally before viewing comparative results.
- Assuming a human can catch everything: Measure whether users actually detect errors under realistic workload and whether they can override safely.
- Ignoring abstention: Reward correct uncertainty and routing; an agent that always answers is unsafe in ambiguous mortgage cases.
- Treating explanations as decoration: Require source-linked, reproducible evidence and an actionable challenge path.
- Forgetting change management: Re-run tests after material model, data, policy, integration, or permission changes.
- Confusing a proposal with a rule: The CFPB mortgage-servicing resources page reports that a proposed servicing rule was issued July 10, 2024; a proposal is not a final rule. Check current status before operational use: CFPB Rules on mortgage servicing.
What a defensible decision looks like
Approve an agent only for the workflows, data, tools, and user roles that the evidence covers. Record the tests run, the cases excluded, the critical failures found, the remediations applied, the residual risks accepted, and the conditions that would suspend use. A narrow, well-controlled deployment is stronger than a broad approval supported by a high-level accuracy claim.
The central question is not “Which model scores highest?” It is “Can this agent perform this mortgage task, with these permissions, under these difficult conditions, while recognizing uncertainty, protecting borrowers, preserving evidence, and keeping a qualified person in control?” Your evaluation should make that answer demonstrable to operations, compliance, auditors, executives, and affected borrowers.
