How to Document Original and AI-Edited Property Photos for Compliance

For a CRMLS listing, keep the untouched original of each qualifying digitally altered photo, display it immediately before or after the edited image, and label the edited image in its photo-description field. Keep the photographer’s publication permission and a simple edit log with the files. These are CRMLS-specific instructions—not a universal U.S. rule—and other MLSs, states, and advertising channels may have different requirements.

What does CRMLS require for an AI-edited listing photo?

CRMLS Rule 11.5.2, which CRMLS says applies from January 1, 2026, requires a subscriber who submits a qualifying digitally altered image to also submit the original, unaltered version. The original must appear in the listing immediately before or after the edited image, and the edited image must be labeled in the photo-description text field in the add/edit module.

CRMLS accepts “Photo Modified,” “Virtually Staged,” “Digitally Altered,” “AI Altered,” or another accurate, substantially similar label. The rule is about the image and its presentation; a disclosure does not make an otherwise prohibited edit acceptable.

Do I have to keep the original photo if I use AI virtual staging?

For a qualifying image submitted to CRMLS, yes. Preserve the untouched original as a separate file and submit it with the altered version. Do not overwrite the source file with the edited export. In the listing, place the original immediately before or after the edited photo so viewers can see the relationship between them.

CRMLS defines a digitally altered image under Rule 11.5.2 as an image changed through photo-editing software or AI to add, remove, or change image elements related to furniture or appliances. Its guidance addresses virtually staged or cleared rooms. This is CRMLS’s local rule definition, not a universal legal definition of digitally altered imagery.

Where should the original photo appear next to an edited listing photo?

In a CRMLS listing, the original must appear directly before or directly after its edited counterpart. A separate folder containing the original is useful for your records but does not replace this listing-placement requirement. After upload, check the live listing to confirm the sequence and the label display as intended.

Do I need an AI watermark, or is a label in the photo description enough?

CRMLS says a photographer-added watermark is not needed to satisfy Rule 11.5.2. The edited photo needs an accurate label in its photo-description text field, and the original must be displayed adjacent to it. A watermark or label baked into the image should not be treated as a substitute for the required description-field label.

Does fixing lighting or color count as digitally altered?

CRMLS says common slight photographic adjustments are outside this rule when they do not change the property’s representation. Its examples include lighting, sharpening, white balance, color correction, straightening, cropping, and exposure adjustments. The practical distinction is whether an adjustment merely improves the photograph or changes what a viewer is shown about the property or its surroundings.

Edit type CRMLS treatment described in its guidance Practical handling
Exposure, white balance, or color correction that does not change the property’s representation Common slight adjustment outside Rule 11.5.2 Keep an accurate export; do not use a correction to disguise a material property condition.
AI furniture staging or clearing furniture or appliances May be a qualifying digitally altered image Keep and submit the untouched original, place it directly before or after the edited image, and label the edited image.
Changing flooring, walls, windows, fixtures, landscaping, or another real-property feature Not permitted under the stated rule, except for the specified improvement exception Do not depict the change unless the exception applies and the stated conditions are met.
Removing or changing a visible utility pole, streetlight, neighboring property, or window view CRMLS identifies these as visible outside elements; altering them may misrepresent the property or surroundings Leave the element as photographed.

Can AI change the landscaping or remove a utility pole from a listing photo?

CRMLS says subscribers may not add, remove, or modify real-property features or visible surrounding elements under Rule 11.5.2. Its examples include flooring, walls, windows, structural elements, cabinetry, paint color, hardscape, landscaping, façades, fixtures, floor plans, streetlights, utility poles, window views, and neighboring properties. CRMLS also says AI-generated landscaping images are not permitted in the MLS where they may misrepresent the actual property.

The stated exception is for property improvements that will match the image at closing as part of the listed price. Do not assume that planned work qualifies merely because it is mentioned in marketing copy: verify that the listing’s terms satisfy the CRMLS exception before using an image showing the improvement. If they do not, use a photo that accurately depicts the property and its visible surroundings.

How should I keep a compliance record for each image?

Keep a small, consistent file packet for each listing. CRMLS’s original-image and labeling requirements, together with NAR guidance on publication authority, support this practical recordkeeping workflow. Neither source establishes a universal retention period or requires a particular storage system.

  1. Save the source. Keep the original capture in an untouched folder or archive. Preserve the edited export separately with a clear filename or image ID; never save over the original.
  2. Record the edit. For each derivative, note its filename or image ID, edit date, person or tool responsible, what changed, the review decision, the disclosure label, and where the image was published.
  3. Check the content. Compare the export with the original. Identify whether the change is only a common photographic adjustment, or whether it adds, removes, or changes a scene element. Check especially for altered real-property features and visible surroundings.
  4. Confirm publication rights. Retain the photographer’s license, contract, or other evidence that the listing broker has authority to publish the photo. Confirm that the permission also covers any edited derivative you intend to use.
  5. Upload and verify. For a qualifying CRMLS image, add the accurate description-field label and place the original immediately before or after the edited image. Review the live listing after upload.
  6. Keep a backup. Store the packet in an organized location with access limited to the team members who need it. A separate backup, such as an external drive, is optional; no particular device is required.

Who has the right to publish a listing photo?

NAR’s MLS photograph policy says the listing broker should own or have authority to publish photos submitted to the MLS. Copyright ownership can depend on who took the photos, so do not assume that paying for a shoot automatically grants every right needed for MLS submission, edits, or reuse on other channels. Keep the photographer’s terms or license with the image files and confirm that they cover the planned use.

NAR’s listing-content resource also addresses contractual and intellectual-property rights, including chain of ownership. A useful record connects the photographer’s permission to the original capture and to the edited files that the broker actually publishes.

Does one photo-disclosure rule apply everywhere in the United States?

No nationwide disclosure rule is established here. CRMLS associates its guidance with California AB 723, but the statute’s text and scope have not been independently verified here; the operational instructions above are based on CRMLS Rule 11.5.2 and CRMLS’s own guidance. Do not apply those instructions automatically to a different MLS, state, or non-MLS channel.

Separately, NAR’s 2026 Code of Ethics says a REALTOR®’s duty to present a true picture in public representations includes website content and images. Standard of Practice 12-10 prohibits misleading consumers, including through misleading images. That professional ethics standard is relevant context, not a replacement for a local MLS rule or applicable law.

  • Check the MLS rules for the property’s listing, including its image definition, label wording, and original-photo placement requirements.
  • Check applicable state advertising requirements and any channel-specific disclosure rules before publishing the image outside the MLS.
  • Keep the image accurate for the property’s condition and the sale terms, even where a particular MLS disclosure procedure does not apply.
