How to Document Cryptocurrency Holdings for Debt Enforcement or a Court Case

To document cryptocurrency holdings, preserve original exchange and wallet records, map every acquisition and transfer in a dated timeline, and connect each account or address to the person or entity in question. Add bank records for related fiat movements and dated valuation evidence. Those records can support an application or disclosure request, but a wallet address or blockchain transaction by itself does not prove legal ownership or control. Court requirements depend on the jurisdiction, the type of case, and the order being sought.

What your evidence needs to establish

A useful bundle separates three questions that are often incorrectly treated as one:

As an Amazon Associate I earn from qualifying purchases.

  1. What happened? Exchange statements, wallet activity and blockchain records can show a balance, a transaction, an asset type, a quantity and a date.
  2. Who was connected to the account or address? Account-opening records, identity checks, bank deposits, correspondence and other records may connect an exchange account or wallet to a person or entity.
  3. Who legally owned or controlled the asset? Legal ownership, beneficial interest and practical control are conclusions made under the applicable law and facts. The same record may support an argument without proving it on its own.

Keep those propositions distinct in your index and timeline. For example, a public transaction identifier can corroborate that coins moved between two addresses. It does not, standing alone, identify the person who controlled either address.

Preserve records before an exchange or wallet provider loses them

Export records as soon as a dispute, enforcement risk or disclosure obligation is foreseeable. HM Revenue & Customs warns in its Cryptoassets Manual that an exchange may keep transaction records for only a limited period or may no longer exist when the records are needed. Its tax guidance states: The onus is therefore on the individual to keep their own records for each cryptoasset transaction. That statement appears in tax recordkeeping guidance, not as a universal court rule, but it is a practical warning for anyone who may later need to prove a historic holding.

Exchange and broker records

Download the account’s complete activity rather than relying on a screenshot of the current balance. Preserve, where available:

  • Trade, deposit, withdrawal, transfer and conversion histories in the provider’s original export format.
  • Asset names, quantities, transaction dates and timestamps, including the time zone used by the provider.
  • Fiat deposits and withdrawals, fees, order confirmations and statements showing the account holder’s name or account identifier.
  • Account-profile, verification and correspondence records that identify the customer or entity.
  • Historical balance statements or account snapshots for dates relevant to the dispute.

Keep the unedited download. Make a working copy for sorting or conversion and record when, from which account and by whom each export was obtained. If a provider offers several date ranges or file types, retain each relevant original and note the selected range.

Self-hosted, hot and cold wallets

Gather records for every wallet that may have held the assets, including software wallets, hardware wallets and cold-storage arrangements. Useful material can include wallet activity exports, receiving and sending addresses, transaction history, device records, backup documentation and contemporaneous notes. A hardware wallet purchased today does not establish what it held in the past; the evidence must relate to the historical addresses and transactions at issue.

Do not place seed phrases or private keys in a court bundle or ordinary evidence folder. Preserve them securely and disclose only what the applicable legal process requires. A private key may demonstrate technical ability to sign a transaction, but whether that amounts to legal control or ownership is jurisdiction- and fact-dependent.

Bank and payment records

Obtain statements covering the relevant period for accounts used to buy or sell cryptoassets, fund an exchange, receive sale proceeds or pay related expenses. Keep the complete statement page or official PDF, not only a spreadsheet extract. Mark the transaction reference, date, amount, currency and counterparty, then link it to the corresponding exchange or wallet event. Bank records can strengthen attribution, but a payment to an exchange may have been made for another person’s benefit; explain the inference rather than presenting it as conclusive.

Blockchain references

Record the transaction identifier, network, sending and receiving addresses, asset and amount, block date and any relevant token or contract identifier. Save an archival copy of the explorer page or data export where permitted, and note the source and retrieval date. Public-chain data is useful corroboration because it can show that a transaction was included on a network. It does not by itself show who owned or controlled an address, why a transfer occurred or whether a beneficial interest changed.

Build an evidence bundle that can be audited

A court, investigator or opposing party should be able to move from a proposition in your statement to the underlying original record. A practical bundle, based on the record categories identified by HMRC, can contain the following sections:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Index and document map. Give every item a stable identifier, short description, source, date obtained and covered period.
  2. Identity and account-link material. Include exchange profile records, account numbers, verification material and records explaining which person or entity used each wallet or bank account.
  3. Dated master timeline. List acquisitions, transfers, sales, conversions, fees and relevant fiat movements in chronological order.
  4. Original exchange exports. Preserve the downloaded files in their original format and provide a readable copy only as an additional convenience.
  5. Wallet records. Group addresses by wallet or device only where the grouping is supported by records; do not infer common control merely because transactions interact.
  6. Blockchain references. Include transaction identifiers and the network data needed to locate them.
  7. Bank statements. Place the relevant pages beside a reconciliation showing the related exchange or sale event.
  8. Valuation file. State the valuation source, currency, timestamp and method used for each date at issue, with saved supporting records.
  9. Method and limitations note. Explain missing periods, duplicated records, unavailable providers, converted currencies and any assumptions.

This layout is practical editorial advice, not a court-approved form and not a guarantee that every item will be admitted or given a particular weight.

Use a transaction ledger, not a narrative alone

Create one row per event. At minimum, include the fields HMRC identifies for cryptoasset transactions:

Field What to enter
Cryptoasset type For example, the coin or token name and, where relevant, network or contract identifier.
Transaction date The provider or network timestamp, with time zone and a note if records use different conventions.
Event type Buy, sell, transfer, conversion, deposit, withdrawal, reward or another clearly described event.
Units Quantity sent, received, bought or sold, including the unit precision shown in the source record.
Sterling value The value at the transaction date when available, together with the valuation source and timestamp.
Cumulative units The running quantity held after the event, with the calculation or reconciliation supporting it.
Source references Exchange file name, wallet record, bank statement page and blockchain transaction identifier.

Where a value is unavailable, mark it as unavailable and explain why. Do not replace it with a current price or an unexplained estimate.

Reconcile the timeline

Start with opening balances for the earliest reliable date, then add acquisitions and incoming transfers and subtract disposals, outgoing transfers and fees. Check that the resulting balance agrees with exchange or wallet snapshots at the relevant dates. Investigate, rather than silently netting out, differences caused by staking or rewards, token migrations, wrapped assets, internal transfers, dust balances, rounding or a provider’s treatment of fees.

Compare evidence sources by what they actually show

Source Typical period covered Balances Individual transactions Asset and quantity Dated valuation Link to person or entity
Exchange export Provider-selected date range; historical availability varies Sometimes, if balance statements or snapshots are included Usually, for activity recorded by that provider Usually identified with units May be included; otherwise calculate and document a method Potentially strong where account, verification and payment records identify the user
Self-hosted or hardware wallet record From the wallet’s available history or the relevant blockchain Address-level balance can be reconstructed at a date Yes, when matched to network transactions Usually, subject to correct network and token identification Usually not; add a separate dated valuation record Requires separate evidence linking addresses or devices to the person or entity
Bank statement Statement period supplied by the bank No crypto balance Fiat deposits, withdrawals and payments Fiat amount, not necessarily crypto units Not a crypto valuation record Usually identifies the bank-account holder
Public blockchain data From network history for the chain Address-level balance or historical state Yes, with transaction identifiers Network asset and quantity, if correctly interpreted Not unless paired with a dated price source Does not identify the address controller by itself

These are organizing dimensions, not a legal sufficiency test. The weight of a record depends on authenticity, completeness, explanation and the legal issues in the particular proceeding.

Step-by-step workflow for preparing the file

  1. Identify the relevant dates and issues. List the date of the alleged holding, judgment, transfer, sale, insolvency event or disclosure request. Include pre- and post-event periods where they help explain the trail.
  2. Preserve originals immediately. Export exchange histories, wallet records and bank statements before changing account settings or closing an account. Store an untouched copy in secure, access-controlled storage.
  3. Inventory every account and address. Record provider names, account identifiers, wallet labels, networks and known address relationships. Mark uncertain relationships as unconfirmed.
  4. Build the ledger. Enter each event with quantity, date, event type, source reference and value information. Keep transfers between accounts separate from sales or disposals.
  5. Reconcile balances. Compare calculated holdings with provider snapshots and address balances at the dates that matter. Document every unexplained difference.
  6. Trace fiat movements. Match bank deposits and withdrawals to exchange records, allowing for processing dates, fees and currency conversion.
  7. Document attribution. For each account or address, list the records that connect it to the relevant person or entity and distinguish direct evidence from inference.
  8. Document valuation. State the asset, currency, price source, date and time used. Preserve the underlying price record and explain why that time was selected.
  9. Prepare a readable index and chronology. Give a reviewer a path from each conclusion to an original file, page, transaction identifier or calculation.
  10. Review disclosure limits. Remove seed phrases and unrelated personal data unless a lawyer advises that disclosure is required. Keep a confidential master set so redactions do not destroy context.

How to connect crypto records to a person or entity

Attribution is usually the difficult part. Organize evidence by the strength of the connection rather than asserting that an address is “owned” because it appears in a spreadsheet.

  • Account identity: provider records showing the customer’s name, entity, verified identity, email, phone or account number.
  • Funding trail: bank deposits, card payments or other fiat records that match purchases or withdrawals.
  • Operational evidence: contemporaneous instructions, correspondence, invoices, accounting entries or device records that explain who used the account or wallet.
  • Transaction control: records of a signed transaction or other technical evidence, with an explanation of what it proves and what it does not.
  • Consistency across sources: matching dates, quantities and identifiers across exchange exports, wallets, banks and public-chain data.

Present alternative explanations where they exist, such as nominee arrangements, joint ownership, custodial holdings, employee access or transfers made for another person. A court may need to determine legal or beneficial ownership separately from technical control.

England and Wales: judgment-debt information under CPR Part 71

England and Wales has a specific post-judgment procedure that should not be presented as a universal crypto-disclosure rule. Civil Procedure Rules Part 71 enables a judgment creditor to require a judgment debtor to attend court and provide information for the purpose of enabling enforcement of a judgment or order. The procedure concerns the debtor’s means; it is not a general checklist for every civil claim or every country.

What Practice Direction 71 adds

Practice Direction 71 says that an application seeking production of specific documents should identify those documents. If cryptoassets are relevant, a request should therefore describe the records sought with enough precision to distinguish, for example, exchange account statements for a defined period from every document relating to digital assets. The court’s directions, proportionality requirements and the facts of the enforcement matter still govern what must be produced.

Preparing material for a Part 71 application

  1. Confirm that there is an enforceable judgment or order and that Part 71 is the appropriate route.
  2. Define the information or documents needed to enforce it, using dates, account identifiers, providers, addresses or transaction references where known.
  3. Use the chronology and index to explain why each requested category could identify assets or transfers.
  4. Check the current Civil Procedure Rules and Practice Direction 71, and obtain advice on the application, service, attendance and consequences of non-compliance.

Do not copy this England-and-Wales procedure into a court filing elsewhere. Other jurisdictions may use different discovery, examination, disclosure or enforcement mechanisms.

What recent cases illustrate—and what they do not establish

Singapore International Commercial Court: DVA and another v DVC

In DVA and another v DVC [2026] SGHC(I) 4, the Singapore International Commercial Court discussed transfers among exchange and other wallets, claims involving asset-related disclosure and the relevance of expert evidence. The decision illustrates why a party may need a map of exchange accounts, wallet identifiers and transfers rather than a single balance screenshot. It is a case-specific example from Singapore, not a general disclosure checklist or a rule for England, Wales, the United States or another jurisdiction.

New York matrimonial proceeding: A.S. v. A.B.

A.S. v. A.B., 2026 NY Slip Op 50471(U), is a New York trial-level matrimonial decision involving allegations of nondisclosure of cryptocurrency holdings amid broader financial-disclosure disputes. It shows how cryptoassets can become part of a wider financial-disclosure fight. The allegations, procedural setting and evidentiary treatment are specific to that case and should not be treated as a universal test for proving a holding.

Criminal confiscation is a different process

UK government confiscation guidance addresses criminal asset-recovery powers involving cryptoasset-related items, electronic information and transfers from service-provider wallets. Those powers and procedures are distinct from a private creditor’s civil enforcement application. If the matter involves a criminal investigation or confiscation order, preserve records and obtain advice under the relevant criminal procedure; do not use a private debt-enforcement bundle as a substitute for that process.

Common documentation failures and fixes

  • Only a current screenshot: Add historical exports and dated balance evidence.
  • Missing source files: Preserve the original download and keep a separate readable copy.
  • Unexplained address ownership: Add identity, funding and operational records; label inferences as inferences.
  • Transfers treated as sales: Mark internal movements separately and reconcile both sides of the transfer.
  • Unsupported valuations: Record the price source, currency, timestamp and calculation for each relevant date.
  • Gaps hidden by a neat spreadsheet: List unavailable providers, missing periods, duplicates and assumptions in a limitations note.
  • Private keys disclosed casually: Protect seed phrases and keys; disclose only what the applicable process requires.
  • Foreign procedure assumed to apply locally: Identify the governing jurisdiction and check its current rules with qualified counsel.

When to obtain specialist help

Get jurisdiction-specific legal advice before making a formal application, signing a statement of truth, responding to a disclosure order or deciding that an address proves ownership. A lawyer may also recommend a blockchain-analytics or tracing specialist when the issue is a complex chain of transfers, mixers, bridges, multiple exchanges or disputed control. Verify the specialist’s territory, methods, confidentiality arrangements and ability to explain findings in the forum hearing the case.
